Mayor Amorose Groomes called the Monday, October 26, 2020 Regular Meeting of
Dublin City Council to order at 6:00 p.m.
ROLL CALL
Present were Mayor Amorose Groomes, Vice Mayor De Rosa, Ms. Alutto, Ms. Fox, Mr.
Keeler and Mr. Peterson. Mr. Reiner was absent.
Staff members present were Mr. McDaniel, Mr. Rogers, Ms. Readler, Mr. Boggs, Ms.
O'Callaghan, Mr. Stiffler, Chief Paez, Mr. Earman, Ms. Rauch, Ms. Gilger, Ms. Burness,
Mr. Hammersmith and Mr. Plouck.
ADJOURN TO EXECUTIVE SESSION
Mayor Amorose Groomes moved to adjourn to executive session to consider the
purchase of property for public purposes and to consider the employment of a public
employee.
Ms. Alutto seconded the motion.

Mayor Amorose Groomes reconvened the meeting at 7:00 p.m. She reiterated that,
due to the COVID-19 pandemic and the State's emergency declaration, the meeting is
being conducted via an online platform and live -streamed at the City's website and via
the City's YouTube. This is now allowed as a result of the passage of Am. Sub. H.B.
197, which includes temporary changes to the Ohio Open Meetings Law. She reiterated
her previous statement regarding the submission of any comments by the public prior
to the meeting by e-mail to the Clerk or during the meeting via the form on the
website. She emphasized that Council desires to accommodate public participation and
comment to the greatest extent possible throughout this Pandemic.

SPECIAL PRESENTATIONS/ PROCLAMATIONS
• Jeff Noble, Lt. Col., Ret. — Veterans Day
Lt. Col., Ret. Jeff Noble noted he is Commander of American Legion Post 800 and
member of the Veterans Committee. He updated Council on the activities for Veterans
Day, given the in-person Veterans Day event is not possible due to COVID-19
restrictions on gathering. Instead, a video has been prepared and will be on the City's
website and shared with Dublin Schools. He described the various activities the
Veterans are engaged in throughout the year.
Mayor Amorose Groomes echoed the disappointment about the impact the pandemic
will have on these annual activities for the community. She thanked the Veterans for
all the sacrifices they have made and the wisdom imparted to younger generations
each year.
• Dublin Coffman Girls Swim Team - 2020 Ohio Girls Division I State Swimming
Championship
Mayor Amorose Groomes read a proclamation in recognition of the Division I state
championship achieved by the Dublin Coffman Girls Swim Team earlier this year. The
recognition was delayed due to COVID, and it is still not possible to have the team in
person. Coach Steven Von Schriltz and team members Ellie Andrews, Ava Warren,
Kristyn Sabol, Emma Bowman, Hannah Bailey and Gretchen Schneider were recognized
and congratulated on this achievement. The Coach and team members provided brief
comments.
Mayor Amorose Groomes stated this is a tremendous group of accomplished swimmers
and thanked the coach and team members who could be virtually present at the
meeting.

SECOND READING/PUBLIC HEARING - ORDINANCES
Ordinance 28-20
Adopting and Enacting a Supplement (S-48) to the Code of
Ordinances for the City of Dublin, Ohio,
Ms. Readier stated that this Ordinance adopts the Code supplement prepared
by American Legal Publishing, the City's codifier. The supplement is typically
prepared twice per year to update our Code on the City's website. Staff
recommends approval of the Ordinance.
The Clerk and Ms. Burness reported no public comment has been received for
this item.

INTRODUCTION /FIRST READING — ORDINANCES
Ordinance 30-20
Amending Various Sections of Ordinance 15-17 (Compensation Plan
for Non -Union Personnel).
Ms. Alutto introduced the Ordinance.
Ms. Miglietti noted that this is companion legislation to the proposed operating

budget and incorporates the changes to the organizational structure made in
the budget into the compensation plan. In addition, there is an upgrade to the
Director of Economic Development pay grade. There is also a proposed change

to the provisions e

ons regarding sick leave annual cash out, requiring that an
employee maintain an 80 -hour balance after their sick leave cash out. There is
also a change to the structure of the pay grade table, reflective of work done in
consultation with the City's compensation consultant, Wescott Hunter. This is
reviewed on a biennial basis. Staff recommends approval at the second
reading/public hearing on November 9.

for this matter.
Ms. Alutto stated she is supportive of the change to the sick leave cash out
policy as it is important to maintain a healthy sick leave balance to access when
it is needed.

Ordinance 31-20
Amending Chapter 51 and 52 Establishing User Fees and Capacity
Charges for the Sanitary Sewer and Water Systems,
Ms. Alutto introduced the Ordinance.
Mr. Stiffler stated that the Ordinance increases water and sewer fees for 2021,
as was discussed briefly at the operating and capital budgets. This three
percent increase for 2021 was recommended by the water and sewer rate
study recently completed. The sewer fees have not changed since 2018, and
water fees have been decreased from 2011 onward. Therefore, this is the first
inflationary increase reflected in these rates in several years. The 3 percent rate
increase will result in an increase in surcharge revenue of $20,,911 for the
Water Fund and an increase in surcharge revenue of $68,489 for the Sewer
Fund.
He described the Fund balance target, which is 25 percent of the historical
value for each system's capital assets. The water system asset value is $65.8
million, with a fund balance target of $16.4 million and a current fund balance
of $12.7 million or 77 percent of target. The sanitary sewer system asset value
is $65.5 million, with a fund balance target of $16.4 million and a current fund
balance of $6.6 million or 40 percent of target.
The Water Fund has a more healthy balance than the Sewer Fund, and these
fee increases should help to stabilize or increase the fund balances in the
future.
The Clerk and Ms. Burness reported there were no public comments regarding
this matter.
Mayor Amorose Groomes noted that these assets require a lot of maintenance,
as evidenced by the sewer relining projects the City does on a regular basis.
There will be a second reading/public hearing at the November 9 Council
meeting.
Ordinance 32-20
Declaring the Improvement to Certain Parcels of Real Property
in the City's Bridge Street District to be a Public Purpose and
Exempt from Taxation; Providing for the Collection and Deposit
of Service Payments and Specifying the Purposes for Which
Those Service Payments May be Expended; Specifying the
Public Infrastructure Improvements Directly Benefitting the
Parcels; and Authorizing Compensation Payments to the Dublin
City School District and the Tolles Career and Technical Center.
Ms. Alutto introduced the Ordinance.
Mr. Stiffler stated that Townplace Suites Marriott is constructing a new five -
story, 64,000 -square -foot hotel with 105 guest rooms on the south side of
Upper Metro Place. Ordinance 32-20 creates a tax increment financing district
in the Bridge Street District on the parcels as identified on the map shown.
The private improvement value is estimated at $5.5 million, and total service
payments revenue is estimated at $5.8 million or $193,578 annually. The
service payments will provide funding for debt service related to the 270/33
Interchange and public infrastructure improvements serving the Bridge Street
District.
This hotel is within the defined area of the Bridge Street District Cooperative
Agreement between the Dublin City School District and the City. The
cooperative agreement — Ordinance 20-14 — permits the City to authorize

various tax incentives, including TIFs, with the Bridge Street District that
provide for the following (for each incentive authorized): Years 1-15 — Dublin
City Schools agrees to forgo loo percent of the applicable real estate taxes in
respect to the improvements to any particular parcel within the applicable tax
incentive district® gear � 16-30 — Dublin City Schools will receive 10 percent of
whet it would have received if the applicable tax incentive district had not been
in place. In consideration for this incentive structure, from 2014 to 2045, the
City makes a payment of $1.5 million to the [)ublin city Schools. In 2046, the
City will make a payment of $2.0 i -pillion to theta. Over this 33 -year period,
these payments are expected to total $ 50 m i l l i o ri o
Staff recommends adoption of this Ordinance at the second reading/public
hearing of � November 9.
The Clerk and Ms. Burness reported that no comments have been received
regarding this matter.
Mayou Amorose Groomes asked if all of the hotel -motel tax revenues generated
by this hotel will be deposited into the hotel -motel tax fund or if this is one
where -the revenues are shared under the separate agreement.
Mr. Stiffler responded that 3.00 percent of the hotel -motel tax generated will go
into the Fund. This hotel is not part of the other agreement.

Mr. Hammersmith stated that at the September 28 meeting, Council approved
it Resolutions of Intent to Appropriate related to this road project. These
ordinances are the nem step in the appropriation process. One of the
acquisitions has been settled, but the remaining 10 have not. Negotiations
continue with the property owners. Staff recommends approval of these 10
ordinances on November 9.
In follow-up to his comments in September, he noted that there is one
additional easement acquisition needed from Dublin City Schools, and Ms.
O'Callaghan is leading the discussions with the Schools on that acquisition. Staff
is confident that will be worked out, but he wanted to clarify this one
acquisition is not completed.
The Clerk and Ms. Burness reported no comments have been submitted
regarding this item.
There will be a second reading/public hearing of Ordinances 33-20 through 42-
20 at the November 9 Council meeting.

Mr. Hammersmith stated the City has reached agreement with the property
owner. The appraised value was $310,000 for the entire parcel, and agreement
has been reached for the price of $350,000 for acquisition of the entire
property in fee simple. This ordinance allows for the City Manager to execute
conveyance documents. Staff recommends approval at the second
reading/public hearing on November 9.
The Clerk and Ms. Burness reported no comments have been submitted
regarding this item.
Mayor Amorose Groomes noted Council is appreciative of staff's efforts to
complete the acquisitions needed for this important project.

Ordinance 44-20
Amending Section 153.076 of the City of Dublin Codified Ordinances
Regarding Property Maintenance and Nuisance Code. (Case 20-
097ADMC)
Ms. Alutto introduced the Ordinance.
Ms. Rauch stated this Ordinance is a modification to the Zoning Code related to
property maintenance and nuisance abatement. The purpose of the Code
modification is to provide specific requirements for code enforcement
processes, aesthetic requirements for vacant properties, increased
requirements for maintenance and ensuring vacant properties are more

compatible to the surrounding community. This process and discussion began
at the Public Services Committee in February 2020. Staff did significant
benchmarking to understand what other communities are doing and looking at
the Dublin Code and International Property Maintenance Code in order to
prepare modifications. These modifications were reviewed by a joint work
session of ARB and PZC. Each body then reviewed it independently and made a
recommendation, which is included in the draft before Council tonight.
The main purposes of this were to look at code enforcement processes, making
sure that there are sufficient processes with which to address and highlight
vacant properties and what steps needed to be taken; to include a set of
requirements for vacant properties to ensure they are compatible with existing
properties —same standards and using the same materials, having a look of a
building that is occupied. Also, that includes increased requirements for
maintenance to make sure the structure is maintained at a standard desired
that is compatible with the surrounding community.
The first step was to define vacant properties and, ultimately, look at the
factors in which a property would be defined as vacant and making certain that
was clear.
I. Open to casual entry or trespass;
2. Is damaged to an extent which prohibits safe human occupancy;
3. Demonstrates a lack of property maintenance and upkeep;
4. Is under notice for being in violation of City ordinances;
5. Has been secured or boarded up for at least 30 days;
6. Has utilities disconnected or not in use;
7. Is under a condemnation notice or legal order to vacate; or
8. Is structurally unsound.
There are steps in the proposed draft outlining what happens should the
definition of vacant be identified for a property.
Within the proposed amendment, consideration was given to a variety of
community and nationwide standards to determine the best approach. Defining
the terms "secured" and "vacant" is part of this. Nem, specifically outlining and
making it clear that should a property be vacant, they have 48 hours in which
to secure the property and that they use wood materials. One could board up
the windows, but this ordinance provides that after 30 days, the owner must
replace that with materials that would be found on an occupied property. This
would mean glass windows, doors, trim, etc. to make it compatible with the
Existing neighborhood.
The draft code includes detailed standards for what properties need to maintain
over time —secured windows and doors —and make it look as if it is inhabited.
Planning and Zoning Commission reviewed this at their recent meeting and
recommended approval to Council. Staff is recommending approval at the
second reading/public hearing on November 9. She offered to respond to
questions, and Mr. Boggs is also available to do so.
The Clerk and Ms. Burness reported no comments have been received
regarding this matter.
Mr. Keeler commented regarding the definitions of a vacantroe .

Mr. Keeler asked about increased standards for properties that remain vacant
for significant period of time. Is that period of time that is significant defined in
the Code?
Ms. Ruch responded that the vacant property definition indicates it must meet
one of the conditions and for a period of at least 30 consecutive days. It would
then be considered vacant, and the actions to remedy as outlined in the Code
would be taken.
Mr. Keeler asked at what point is the property subject to the increased
standards — 60 or 90 days.
Ms. Rauch responded the Code indicates 30 days, but the Code Enforcement
process would allow for remedy of the conditions. The definition begins at the
30 -day mark.
Ms. Fox emphasized how much work and effort the Planning staff, ARB, PZC
and the Public Services Committee put into this effort. The Code has been
tightened up to the point that she is hopeful that vacant properties will cease
being a problem in Dublin. It will not be able to be differentiated from an
occupied property nem door. The language is clear in expectations and intent,
as well as enforcement measures. She is proud of all the work that has gone
into this Code amendment.
Mayor Amorose Groomes stated she did review all of the documents. She finds
that no further changes are needed and thanked the boards and commissions
for all of their work on this. To her, writing Code is the most difficult thing to
do, as by default it is a document of unintended consequences. She asked what
the effective date of this ordinance will be, should it be approved tonight.
Mr. Boggs responded that the effective date would be 30 days after passage --
December 9.
Mayor Amorose Groomes stated she is hopeful that staff is prepared to send
out letters to vacant property owners on the effective date.
Vice Mayor De Rosa asked what type of communication plan has been prepared
regarding this change and asked for staff's input.
Ms. Rauch responded that staff is aware of some vacant property owners in the
City and will work with Communications &Public Information staff on a
community -wide communication. Interested property owners were notified of
this process, and staff will make clear the effective date for implementation.
Mr. Boggs added that staff is scheduled to have a discussion tomorrow about
steps that will be taken if this is approved.
Ms. Fox asked about the administrative order for code enforcement and asked
staff to summarize that for the public.
Mr. Boggs responded it dates to 2016 and sets forth the sequence of notices
and the terminations of the violations that code enforcement staff follows.
Generally, they achieve voluntary compliance on property maintenance
'violations. The administrative order sets out the timing of notices that are sent,
how they are to be sent, what a person must do in response, etc. — the entire
process including administrative appeals. Beyond the administrative order,
there can be a citation into Mayor's Court or a civil action filed in Environmental
Court.
Mr. Keeler stated that as the Mayor has commented, we will know any
unintended consequences and if this is effective, once the provisions are in
place. He noted some of the requirements of the property owner, i.e. within 48
hours of notification the owner must secure the structure with boarded

materials for up to 30 days and following 30 days requiring a structure to be
secured with similar materials of buildings that are not vacant, such as glass
and doors to secure exits. However, the type of door used could vary greatly in
terms of hollow -cored or solid. How much specificity could be included in the
Ordinance to provide that similar materials of buildings or entry doors that are
adjacent to the property must be used.
Mr. Boggs responded that is a good point. There was discussion about how
people may try to circumvent those security requirements. Referencing
materials typically used in other homes was intended to address the issue. The
point of the difference in exterior or interior doors is a good one and that
language can be tightened with similar examples for the second reading on
November 9.
Mr. Keeler stated that one loophole was closed by the term "glass" — as it is not
uncommon for a landlord to use Plexiglas to cover a window. That is a good
inclusion.
Ms. Fax stated the Commission had significant discussion about all of the ways
property owners could get around the requirements. It is important that the
language indicates the requirement for painting, caulking, sealing, operating
gutter systems, etc. as in a normal well-maintained home. It is also possible to
rely on the 2018 International Property Maintenance Code as well. The
ordinance may need additional tweaking in the future, but is a good start over
what exists.
Ms. Rauch noted that the legislation will be monitored going forward as are all Code
amendments to ensure it is achieving the goals.
Mr. Bogs added that the provisions in this Ordinance do not imply that the properties
are not also subject to general properly maintenance code requirements. This
legislation places them in the Nuisance section and associates them with vacancy and
the remedies required.
Ms. Fox asked about another provision of the Nuisance Code, and not allowing
commercial vehicles like trucks on vacant properties that are not residential. There was
an experience earlier this year with semi -trucks parking on a vacant lot that was not
residential, but also was not commercial. She is confused about the Code regarding
parking of trucks on vacant properties that are not attached to a business.
Ms. Rauch stated she will research this further.

STAFF COMMENTS
Mr. McDaniel:
1. Reminded everyone that Trick or Treat will be held in Dublin on Thursday,
October 29 from 6-8 p.m. He encouraged residents to view the website and
read the safety precautions and information from Public Health. Also reminded
everyone traveling on the roadways that evening to be vigilant about the
pedestrians on the streets.
2. Reported regarding the Veterans Committee on behalf of Mr. Reiner:
a. The Veterans Committee met on October 22. Lt. Col. (Ret.) Noble
reported earlier tonight on the activities planned for Veterans Day.
b. The Committee heard a presentation from Mr. McCollough regarding
augmented reality as a way to assist with education efforts the
Committee is exploring.
c. Don Piunno provided a presentation regarding the Wreaths Across
America program, in which wreaths are laid at veterans gravesites
throughout the country to honor their service. The Dublin program was
adopted by the Grand Leprechauns and they raise sponsorship dollars to
purchase the wreaths. They are requesting some assistance from the
City in terms of staff for the ceremony, which will be virtual. People will

still be able to come and lay wreaths within the gathering guidelines of
public health. They also requested use of a City pick-up truck and
dumpster when wreaths are removed from the cemetery after the
holidays. They recommend Council endorse the program and agree to
supply the requested assistance.
It was the consensus of Council to endorse the Wreaths Across America in Dublin and
to provide the services and support requested.

MORPC: Mayor Amorose Groomes reported that MORK has been
hosting many
meetings with COMMA and cities and villages around the state. The recent one was
very informative about the potential conflicts related to the outcome of
the election.
She appreciates the work they have been doing to keep communication open between
municipalities in the midst of this pandemic.
US 33 Corridor: Vice Mayor De Rosa reported that the have y not met as a group, but

brought back a set of recommendations and the Committee met last week to discuss

Washington Township: Ms. Fox stated that Washington Township Fire '

chest compression systems. These are used foratients in cardiac c arrest and this will
be an enhancement to their ability to treat and take care of residents.

Ms. Alutto echoed Mr. McDaniel's message about the need for caution on Thursday
evening during the hours of trick or treat, especially given the inclement weather that
is expected.
Ms. Fox commented that restaurants in the Historic District are prepping for the winter
with temporary tenting, etc. to sustain business during the winter. As Council and staff
review the potential of a DORA in the spring, perhaps the policy for patio and outdoor
dining should be revisited. COVID has prompted alfresco dining that is very enjoyable.
Council has been hesitant in the past about outdoor patios spaces, with policies that
are restrictive. In looking at a potential DORA and citywide outdoor dining, it might be
good to review if our incentives are good enough, if our policies are liberal enough to
become more of a public realm, alfresco type of city. In closing Longshore Street for
outdoor dining, it became a piazza and the possibilities may be endless. She requests
that the City study the outdoor dining policy in conjunction with a potential DORA. This
would help all of our restaurants going forward and make Dublin a more interesting
place.
Mr. Keeler stated that he understands the gist of this, noting she must have watched
the WRLD CTY assignments. Some of those evoked that realm she references. He is
supportive of exploring this. As far as the regulatory aspects, the City has been flexible
throughout the pandemic to accommodate people. The issue seems to be more related
to alcohol regulations of the state. Heading in the direction of more outdoor dining is a
good idea and he supports it.
Mayor Amorose Groomes stated that the major place to address that would be in the
Zoning Code. There was a cost to construct the streets in Bridge Park per square foot
and to construct such streets and not use them as public streets should also be a
consideration in the future.
Ms. Fox stated that perhaps the thinking is not so much about being restrictive, but
how we allow buildings to incorporate patios and obtain variances in relation to the
sidewalk when we want interesting outdoor dining spaces. What we can do as a City to
create the most interesting public realm that is energetic and allows outside activity is
the question -- incorporating some of the ideas from WRLD CTY into our everyday
planning in the City.
Vice Mayor De Rosa
1. Stated this is a good segue for the Dublin 2035 session scheduled for Monday,
November 2. Council members had some assignments in advance to review
what the best thinkers and cities around the world are projecting through the
WRLD CTY sessions. We will continue to learn through the winter as this
process continues.
2. Congratulations to the Economic Development team on the Dublin Reality
Check. The October 15 session was excellent and she appreciates their work on
this. In the midst of this change, the technology was well done to support this
virtual event.
3. Congratulated all of the residents for their Halloween decorations this year!
They are incredible and reflective of everyone spending more time at home.
Thanks for all who have done these, bringing smiles to our faces.
4. Encouraged everyone to get out and vote and to vote early. It will be a busy
election, but it is such an honor to vote.
Mayor Amorose Groomes:
1. Commented that Council Member Alutto's home has no shortage of Halloween
decorations, and encouraged everyone to view it!
2. Noted she had the opportunity to attend the TEDx event in Dublin last
