Form No. 1097 ~ Held June29~ 1983 19 r-: The regular meeting of Council was called to order by ~1ayor Lewis at 7:30 P.M. with the following members present: Amorose,Chambers, Headlee, Lewis, Thornton, and Sutphen. Mrs. Maurer arrived 10 minutes later. Also present were Mr. Sheldon Village Manager, Mr. Bowman Planner, Ms. Prushing Finance Director, Mr. Smith Law Directo~ and Mr. Warner, the newly hired Village Engi neer . '-- Mr. Amorose moved, June 6th meeting. moved, seconded by Vote on the motion seconded by Mrs. Headlee to approve the minutes of the Vote on the motion was unanimous for approval. Mr. Amorose Mrs. Headlee to approve the bill listing for June 20th. was unanimous for approval. The proposed Tax Budget for Fiscal 1984 and the proposed use of Federal Revenue Sharing Funds was read for the second time. This was also a public hearing, so Ms. Prushing explained the purpose and clarified the format of the budget to the public. r ..... Ordinance No. 29-83 Said ordinance dealing with rezoning of 10 acres north of Bridge St. at Shawan Way was read for the second time. This was also a public hearing on the ordinance. Mr. Conrad, owner of the property was present, but there were no opponents to the case. Mr. Bowman explained to Council that due to the predominant office uses surrounding the subject site, the applicant at the last P & Z Commission meeting already agreed to amend his request from CC to SO, Suburban Office District. P & Z Commission recommends approval of this amended request. One of the concerns of P & Z was the possibility of making Shawan Way part of the intersection at the time of signalization. Research shows, that with very little alterations to Shawan Way it could be part of the 161lCorbin's Mill intersection. Mr. Conrad will submit a conditional use application, when he decides on the specific use of the site, and the final plat will have to be accepted by Council. Ordinance No. 33-83 Said ordinance to regulate vehicular traffic in Dublin Cemetery was read the second time. Mr. Amorose pointed out, that the way this ordinance reads, sounds like we are limiting the usage of cemetery roadways to funeral homes and monument companies. Mr. Chambers said there was no attempt to exclude any legitimate traffic, so the words "or other authorized user" should be inserted in the appropriate place in the ordinance. The amendment has been made. Resolution No. 12-83 Said resolution dealing with participation in and citizen representation in Dublin Arts Council was introduced by Mr. Amorose and read for the first time. r- ~ Resolution No. 13-83 Said resolution accepting deeds of easement for a waterline improvement was introduced by Mrs. Maurer and read for the first time. Mr. Sheldon pointed out, that the line is complete, and in use, the resolution should pass as emergency legislation. Mrs. Maurer moved, seconded by Mr. Amorose to dispence with the three time reading rule. All members voted approval of the motion, except Mrs. Headlee, who abstained. Fonn No. 1097 ~ Held June_20_, .19BJ_ 19 r w ~ Other Charles Driscoll from Multicon Communities appeared to apply for approval of the final plat of Llewellyn Farms Part I. Llewellyn Farms is bordered by Tuttle, Rings, Frantz, and Dublin Roads. Offices and residential units will be built there simultaneously. The construction of Frantz Road will take some of the traffic from Dublin Road. The first project is a major 16' sewer and waterline which will connect with the Columbus water main that is also 16'. There is an area that will be reserved for parkland and will be available to the public as soon as there is a public right-of-way to it. Mrs. Maurer thought there was a marshy area there, but Mr. Drscoll is not aware of a natural pond, it is all cornfield. Mrs. Headlee asked if the developer will build the offices along with the residential units. Mr. Driscoll said they are not office builders, they will just develop the road and utilities and sell the land for offices as soon as there are buyers. At completion of development all utilities will be on Frantz Road. Mr. Amorose moved, seconded by Mr. Chambers to approve the final plat of Llewellyn Farms Part I. [ Mr. Herb Bash asked to speak to Council about the Game Ordinance. He would like to have a game room in the Club House of his golf cours~ but the 3 game limit restricts his rights to oprate his business, because he can not compete with businesses in Columbus. He does not understand why the 3 game limit was made in the first place. He feels if the games were detrimental to the health and welfare of the children, they Svuld be banned and if they are not, there should be no limit. He never had any problems since he first started their operation in 1974. He questions Council's right to tell people what they can go in business for. Mr. Smith pointed out that as the ordinance was passed by Council, there is no provlslon for Council to grant anybody a variance. Mr. Lewis said Mr. Bash can ask for the amendment of the ordinance, either by an informal opinion of Council, or have any particular Councilmember who is willing to support and introduce his request for amendment. Mr. Chambers asked the Law Director, whether a change can be made by a motion or a resolution. Mr. Smith explained that since we are going to do away with the major intent of the ordinance- namely the regulation of the number of games- we will have to introduce a resolution to modify this ordinance. Mr. Chambers than asked Mr. Smith to prepare the necessary resolution for the next meeting. Mr. Thornton wmon the opinion that this ordinance is totally unconstitutional and he would like to see the entire ordinance repealed. Mr. Lewis than advised Mr. Bash to meet with Mr. Chambers or Mr. Thornt~ - who will sponsor his request - to make sure his personal circumstances are relieved to his satisfaction. Mr. Thornton reported that his committee on the Municipal Building was not ready to make a report, because of vacations. They are hoping to meet this week. [ Council Roundtable Mr. Chambers pointed out that the Committee who is involved in the survey of public opinion for changes in the Charter is very pressed for time. In order to get the views of the general public, they will need at least an extra two weeks. Mr. Lewis was quite in agreement and said they can report whenever they have something to report. Mrs. Maurer told Council they are planning on putting an advertisement in the paper to get public reponse. Mr. Lewis pointed out that before Council takes action on any recommendation the committee will have to hold a public meeting on that recommendation. Mr. Chambers, who has been appointed coordinator of the cleanup activities, said that since that excercise is now over, he wants to turn this duty back to the Administrative Department. With the help of Mr. Strutner they were able to get a commitment from a 10 member cleanup crew from Franklin County. '- Mrs. Headlee made a suggestion in response to Mr. Strutner's memo on the Police Awards. She believes that one of the service organizations should be asked to have a banquet for them. Mr. Sutphen expressed his wish to repeat the very successful and enjoyable event of the recent concert by the Columbus Symphony Orchestra. Mr. Lewis said, when the auditorium is completed in Dublin High School, the orchestra may consider a series held there by subscriptions. Mayor Lewis reminded everybody, particularly the press of the forthcoming elections in November, one in Ward and three at large.
