A RESOLUTION OF INTENT TO APPROPRIATE PROPERTY AND
EASEMENTS FROM 33 DUBLIN INDUSTRIAL PARK, LLC, FROM
THE PROPERTY LOCATED AT 6280 RINGS ROAD, FOR THE
PUBLIC PURPOSE OF CONSTRUCTING A NEW ROADWAY TO BE
NAMED UNIVERSITY BOULEVARD, WHICH SHALL BE OPEN TO
THE PUBLIC WITHOUT CHARGE.
WHIEREAS, the City of Dublin (the "City') is preparing to construct Phase 2 of the new
University Boulevard (the "Project'; and
WHEREAS, the Project requires that the City obtain the following property interests
from the parcel identified as Franklin County Parcel Number 274-000130, owned by 33
Dublin Industrial Park, LLC, as described in the attached Exhibits A and depicted in the
attached Exhibits B:
4 -WD: a 0.056 -acre PRO fee simple right-of-way, with reservation of existing
access.
• 4 -WD: a 0.178 -acre fee simple right-of-way, with reservation of existing access.
• 4-U: a 0.028 -acre permanent utility easement.
• 4-T1: a 0.120 -acre temporary easement.
• 4-T2: a 0.024 -acre temporary easement.
NOW,r THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, Delaware,
Franklin, and Union Counties, State of Ohio, of the elected members concurring
that:
S=ion 1. Council considers it necessary and declares its intention to appropriate,
for the public purpose of constructing a new roadway which shall be open to the public
without charge, the following property rights and easements from 33 Dublin Industrial
Park, LLC, each of which are described in the attached Exhibits A and depicted in the
attached Exhibits B:
• 4 -WD: a 0.056 -acre PRO fee simple right-of-way, with reservation of existing
access.
• 4 -WD: a 0.178 -acre fee simple right-of-way, with reservation of existing access.
• 4-U: a 0.028 -acre permanent utility easement.
• 4-T1: a 0.120 -acre temporary easement.
• 4-T2: a 0.024 -acre temporary easement.
Section 2, The City Manager is hereby authorized to cause written notice of the
passage of this Resolution to be served upon the owner(s) and person(s) in possession
or having an interest of record in the property described in the attached Exhibits A and
depicted in the attached Exhibits B, and this notice shall be served according to law.
Section 3. This Resolution shall take effect upon adoption in accordance with
4.04(a) of the Dublin Revised Charter.

Improvement Projects Resolutions of Intent to Appropriate - Nos. 51-20 - 61-20
BACKGROUND
The City of Dublin ("City") and The Ohio State University (collectively, the "Project Partners') are
working together to construct public improvements in the area of Avery Road, Shier Rings Road and
Eiterman Road. The Project Partners entered into an Economic Development Agreement on May 24,
2019 for the public improvements. The City engaged West Erie Realty Solutions, Ltd. ("West Erie')
as the acquisition consultant for the University Boulevard - Phase 2 and the Avery Road and Shier
Rings Road Intersection Improvement projects. In that role, West Erie has been the main point of
contact with the property owners, and will be working with the property owners to reach amicable
resolution.
The Project requires the acquisition of property interest from the following property owners:
• Anthony Gioffre and John Gioffre
• 33 Dublin Industrial Park, LLC
• Joseph F. Monska, Trustee
• William L. Baker & Nancy A. Baker
• Sertek, LLC
• SH 725 LLC
• W. Baker Holdings, LLC and William L. Baker
• Avery Lakes Partners, LLC
• Dolan Investments II
• Samuel M. Baker
• Medex, Inc.
One of the acquisitions, Joseph F. Monska, Trustee, is being sought as a total take since the
acquisitions will impact virtually the entire parcel.
The City is hopeful that an amicable resolution can be reached with the property owners; however,
this Resolution begins the eminent domain process in the event that negotiations are unsuccessful.

Military District Survey Number 3542, being part of that 6.885 acre tract conveyed to 33 Dublin
Industrial Park, LLC by deed of record in Instrument Number 201806220083126, (all references
are to the records of the Recorder's Office, Franklin County, Ohio) being more particularly
described as follows:
Beginning, for reference, at Franklin County Geodetic Survey monument 5420 found at the
centerline intersection of Shier -Rings Road (C.R. 42) with Old Avery Road, as depicted on FRA-
C.R.3, dated September 23, 1997, and of record in the Franklin County Engineer Office;
Thence South 85° 36' 58" West, with the centerline of said Shier -Rings Road, a distance
of 1034.64 feet to a point at the common corner of that 0.133 acre tract conveyed to City of
Dublin, Ohio by deed of record in Instrument Number 199712040159755 and that 0.115 acre
tract conveyed to City of Dublin, Ohio by deed of record in Instrument Number
199712050160796;
Thence North 03° 13'35" West, across said Shier -Rings Road, with the line common to
said 0.113 and 0.115 acre tracts, a distance of 35.01 feet to an iron pin set in the northerly right-
of-way line thereof, at the common corner of said 6.885, 0.115, and 0.113 acre tracts and that
0.887 acre tract conveyed to Joseph F. Monska, Trustee, by deeds of record in Instrument

Thence South 85° 27'29" West, with the northerly right-of-way line of said Shier -Rings

Thence South 04° 32' 31" East, partially with the northerly right-of-way line of said

tracts, (passing the centerline of Shier -Rings Road at 1.54 feet) a total distance of 52.84 feet to an
iron pin set on the arc a curve;
Thence across said 6.885 acre tract, with the arc of a curve to the left, having a central
angle of 25° 31' 53", a radius of 480.00 feet, an arc length of 213.89 feet, a chord bearing of
North 74° 26' 21" East and chord distance of 212.13 feet to an iron pin set at a point of
