The August 18, 1980 regular meeting of Council was called to order
by Mayor Headlee with the following members present: Chambers,
Geese, Headlee, Lewis, Mand, and Maurer. Absent from the meeting
was Mr. Shawano
The minutes of the regular meeting held August 4, 1980 were read
and approved upon motion of Mrs. Maurer, seconded by Mr. Geese.
The listing of bills (att'd) was reviewed and approved with the
exception of the payment to C. E. Williams & Co. The motion to
approve the bills was made by Mr. Chambers, seconded by Mrs.
Maurer.
CORRESPONDENCE
The following correspondence was read by the Clerk:
I) letter of resignation from Mr. Caudy as a member of
the Planning and Zoning Commission and C.I.C.
2) letter of resignation from Mr. Dennis Sander as a
member of the Architectural Review Board.
COUNCIL DISCUSSION
[
Mr. Geese called a matter to the attention of the Village Manager
where there were overgrown weeds and abandoned cars on a property
located south of Route 161 on Sawmill Road.
Mr. Chambers brought up the following items:
1) Clarification of what Council matters were to be recorded
since the Village Manager had announced the completion of
a recording system to tie-in the floor microphone along
with all Council mikes.
2) He will be submitting for review by Council, a Capital
Improvements Plan for the Village within a few days.
3) Expressed disappointment of no mention of the storm
damage to the Waterford Village apartment units on
Monday, August 11, 1980.
Regarding the same subject, Mr. Chambers asked for a full
investigation by Village Officials of the storm damage of
two apartment buildings on Frantz Road. He would like the
facts proven that the cause of the damage was neither poor
construction plan or substandard construction.

Mr. Sheldon, responding to Mr. Chambers' request, stated
that the Village responsibility was limited to the inspec-
tion and approval of only one, two and three family dwell-
ings. The buildings in question were 8 family units. He
also stated that an area resident, Mr. James Stillwell,
had requested an investigation by the State building
officials. Mr. Sheldon followed up the request with a
request that the Village be advised of their findings
if Mr. Stillwell's beliefs were founded.

Mayor Headlee shared information she had received from the
Franklin County Soil and Water Conservation Department
regarding seminars which she plans to attend in order to
help Council find ways to solve some of the serious water
drainage problems resulting from development in the Village.
Regarding the subject of drainage problems, Mayor Headlee
mentioned the Marion Street problem and a serious problem
of litter being carried away by water from various con-
struction sites. She felt that the litter problem should
be dealt with and will be working with the law Director
and Village Manager to establish litter laws and enforcing
same.
Mayor Headlee also requested an ordinance to forbid bow
hunting within the Village limits.
She reminded Council of a Special Meeting scheduled for
August 25, 1980 to discuss Capital Improvements. Vice
Mayor Maurer will be chairing this meeting.
PUBLIC HEARING - ORDINANCE NO. 51-80

The Public Hearing, to discuss the proposed rezoning of approxi-
mately 14 acres at the northeast corner of Post and Coffman Roads,
was then held. Speaking for the rezoning were Mr. Patrick Gra-
bill and Mr. C. A. Weber.
Mr. Grabill explained the plans for the rezoning and development
of the land, answering questions of Council members, Planning and
Zoning Commission members and the Village Planner. The proposed
plan calls for 112 condominium units. The applicant requested
deletion of the storm water retention requirement, subject to the
approval of the Village Engineer and also to be allowed to con-
tribute park fees to the Parks Fund rather than donate land as
required in P.U.D. zoning.
There were no comments made by the public objecting to the pro-
posed rezoning.
The discussion ended with several members of Planning and Zoning
expressing their concerns for density, lay-out of the buildings,
flood plain and a ~uest by Mr. Callahan for submittal of the
Preliminary Plan verbiage requirements before the subject is dis-
cussed with the Planning and Zoning Commissionl

Mr. Chambers requested a committee be appointed to study the
feasibility of installing an overhead electronic display for
Council chambers to be used at Public Hearings, etc. Mayor
Headlee offered to discuss the matter with the Village Manager
to see what can be done.
RESOLUTION NO. 19-80
Resolution #19-80, dealing with the objection to renewal of the
Kingswood Inn liquor license, was read for the second time. Mr.
Milt Howard, owner of the Kingswood and his attorney, Mr. Richard
Levinsky, appeared before Council to discuss the problems related
to the Kingswood. A meeting between Mr. Howard, Mr. lavinsky,

Chief Mayer, Mayor Headlee and the law Director was held to help
Mr. Howard resolve some of the problems and encourage him to
prosecute trouble makers. The Village has been assured his full
cooperation in this matter. Council was also informed of his plans
to sell the business and until that time, to employ off-duty police
to help curb trouble makers. Following further discussion of the
resolution and possible actions Council could take in the future if
the problems persist, Mr. Chambers moved to table the resolution for
an indefinite period of time to allow the owner to make progress in
clearing up the problems related to the Kingswood Inn bar. Mrs.
Maurer seconded the motion which was unanimously passed.
ORDINANCE NO. 52-80
Ordinance #52-80, dealing with the proposed waterline payback agree-
ment with Shamrock II Development, was read for the second time.
ORDINANCE No. 53-80
Ordinance #53-80, dealing with accepting a petition for three acres,
was read for the second time.
RESOLUTION NO. 20-80
[
Resolution #20-80, dealing with the approval and acceptance of a
sewer easement in Metro Center, was introduced by Mr. Mand and read
for the first time. Following discussion of the resolution, Mrs.
Maurer made a motion to do away with the three time reading rule
and pass as an emergency. The motion was seconded by Mr. lewis.
The motion and resolution were unanimously passed.
ORDINANCE NO. 55-80
Ordinance #55-80, dealing with the amended sewer service agreement
with Columbus, was introduced by Mr. lewis and read for the first
time.
RESOLUTION No. 23-80
Resolution #23-80, dealing with a proposed water and sewer line
agreement on Post Road, was introduced by Mr. Geese and read for
the first time. Mr. Richard Ison appeared before Council, repre-
senting the Wellington Investment Co. and John Kessler, who are
proposing the agreement. Mr. Ison explained the future develop-
ment of 400 acres in the area and the need for such an agreement.

Mr. Sheldon, Village Manager, asked Council to seriously consider
the proposed agreement. Although the Village has entered into other
utility payback agreements, Mr. Sheldon pointed out that this is the
first resolution where the Village is asked to: 1) pay back all
costs related to the construction of the sewer and water lines;
2) pay any interest incurred by the developer and 3) pay any interest
on unpaid balances due. Mr. Smith, law Director, is to research the
legality of said resolution and report back to Council.
RESOLUTION NO. 21-80
Resolution #21-80, dealing with a change of zoning on Village maps
of property owned by Dr. Waldo Walker, was introduced by Mr. Chambers
and read for the first time.

RESOLUTION NO. 22-80
Resolution #22-80, dealing with adopting the Bikeway Study, was
introduced by Mr. Mand and read for the first time.
ORDINANCE NO. 56-80
The proposed landscaping ordinance (1156-80), was referred to the
Planning and Zoning Commission for study and recommendation to
Council. The motion to refer the ordinance was made by Mr. Geese,
seconded by Mr. Mand and unanimously passed.
DUBLIN WOMEN'S CLUB
The Dublin Women's Club requested approval to hold a Street Art
Sale in September of 1981. Following discussion, Mayor Headlee
moved to approve the request. The motion was seconded by Mr. Geese
and unanimously passed.
SEPTEMBER MEETING DATES
[
The first Monday of September being a holiday, Council discussed
alternative meeting dates. It was agreed to establish the follow-
ing dates for September, 1980:
September 8 and 22
September 9
September 15 and 29

FLAGS
The following action was taken on Mr. Shawan's proposal to purchase
flags for the parade route and to be displayed on holidays. Mr.
Mand moved to approve the purchase of the required flags. The motion
was seconded by Mr. lewis and unanimously passed.
DUBLIN PLAZA lANDSCAPING
Mr. Geese requested a discussion of action to be taken to enforce
the developers of the Dublin Plaza to carry through with landscaping
plans submitted and approved in their request for rezoning. The
law Director, Steven Smith, was asked for a legal opinion of the
Village's ability to enforce said promise and will prepare an answer
for discussion at the September 8 meeting. Mr. Smith will also
notify the developer and advise him to attend said meeting.
NORTHWEST QUAD STUDY
[
Council discussed the approval of the Northwest Quad Study and
recommendations made by Planning and Zoning Commission for the
amendment and expansion of said study. . Mr. Mand suggested that
Council go ahead and approve the Quad Study which would include
minor amendments suggested by the Planning and Zoning Commission.
It was then agreed to discuss adoption of the study at the next
meeting of Council.
