The July 7, 1980 regular meeting of Council was called to order
by Mayor Headlee with the following members present: Chambers, Geese,
Headlee, lewis, Mand, Maurer, Shawano

The minutes of the regular meeting held on June 16, 1980, were read
and unanimously approved upon motion of Mr. Chambers, seconded by Mr.
Geese. The listing of bills (attached) was approved for payment by
motion of Mrs. Maurer and a second by Mr. Shawano
COMMUNICATIONS
The following communications were read:
1. From the Concord Township Trustees opposing the connection
of Edgewood Drive which is part of the rezoning concept plan
described in Ordinance #44-80.
2. Addressed to Mr. Callahan, Chairman of Planning and Zoning
Commission, from Perry Township Trustees. The letter states
the Perry Township Trustees' opposition of the rezoning re-
quest stated in Ordinance No. 38-80.
3. A news release from Mayor Headlee which described the in-
creased limits of flood insurance coverage available to
residents in the National Flood Insurance Program.

PUBLIC HEARINGS
ORDINANCE NO. 38-80
--
A public hearing on Ordinance #38-80, the proposed rezoning at
Bright and Sawmill Roads, was held with representatives of the
developer/applicant, as well as many area residents speaking
for and against the proposed rezoning. A summary of the main
comments made by proponents and opponents of the issue is
attached to these minutes.
ORDINANCE NO. 44-80
A public hearing was also held to discuss Ordinance No. 44-80,
which is a proposed rezoning in Delaware County of 17.317 acres.
Representatives of the developer and many area residents who
will be affected by this rezoning appeared before Council to
discuss the plan. A summary of the main comments made by pro-
ponents and opponents of the issue is attached to these minutes.
PROPOSED 1981 BUDGET
The proposed 1981 budget was unanimously approved.

ORDINANCE NO. 43-80

Ordinance #43-80, dealing with a contract for the Village Planning
Consultant, Godwin-Bohm NBBJ, was read for the third time. Following
a discussion, Mr. Chambers moved to table the ordinance and to request
the Village Manager to proceed with procuring proposals of other
planning firms to have a basis for comparison. The proposals will
then be submitted to the Planning and Zoning Commission for their
review and report back to Council. A month-to-month contract will be
maintained with Godwin-Bohm until a decision on the ordinance is
reached. The motion was seconded by Mr. Shawan and passed with the
vote as follows: 5-Yeas: Lewis, Mand, Maurer, Shawan, Chambers.
2-Nays: Headlee, Geese.

ORDINANCE NO. 47-80
Ordinance #47-80, dealing with amending the criminal code Part Five
and Subsection 501.02 was introduced by Mr. Shawan and read for
the first time. Following a discussion, Mr. Geese moved to do away
with the three time reading rule and pass as an emergency. Mr.
Lewis seconded the motion. The motion and ordinance were unani-
mously approved.
ORDINANCE NO. 48-80
Ordinance #48-80, dealing with amending the bond schedule for
Mayor's court was introduced by Mr. Shawan and read for the first
time.
PARKS AND RECREATION COMMISSION
Mr. Mand made a motion to refer all rezoning requests which in-
volve the dedication of land as open spaces to the Parks and d PI . &

Mr. Geese moved to request a swimming pool study be done by the
Parks and Recreation Commission and submitted for review by
Council. The motion was seconded by Mrs. Headlee and unanimously
passed. The study is to include suggested financing, type and
size of facility and location.
MISCELLANEOUS
Mayor Headlee announced that "Jack Nicklaus Day" has been scheduled
for August 4, 1980 and that she will notify Council as to their role
in this event.
Mr. Mand asked if the Estates and Benefits Committee had been
formed yet. Mayor Headlee responded with the explanation that
they had been unable to meet because the Village Historical
Society had neglected to designate a representative to serve on
the Committee. It was agreed then that the Committee would
arrange to appoint a member of the community to serve on the
committee.
Mr. Chambers commended the Parks and Recreation Commission for a
superb job done in their planning the July 4th parade and picnic.
He suggested that before next year's planning begins, a separate
corporation be formed to establish rules and allocate funds for
the event.

Mr. Shawan suggested that the Village purchase flags to display
on holidays and to decorate the parade route.

Mrs. Maurer suggested adopting an ordinance that would allow Coun-
cil to choose the land dedicated to the Village as open space on
P.U.D. zonings.

ORDINANCE NO. 38-80
Speaking for the ordinance were Jack Chester, Richard Solove, and
leslie Thompson. The following is a summary of the comments made on
behalf of the developer/applicant:
1. All property in this area is already zoned commercial.

2. There would be many tax benefits to the Village: i.e.
sales taxes, real estate taxes, county taxes on each store,
state income tax, etc.

3. No additonal outlay for community services would be needed:
i.e. fire, police, schools.
4. Development aesthetically harmonious to this area.
5. Development needed to service community needs.
6. If this rezoning is denied, Big Bear will build north of
270 on the east side of Sawmill Road.
7. Preliminary plan allows for high mound landscaping across
the rear of this construction. Extensive landscaping all
around the project. This will act as buffer to bordering
properties.
8. No water/storm drainage problems: engineers have worked
out plan to control by retention basins. There will be
no more drainage flow than there is now.

9. Style of construction: compatible to new homes in the
area. Brick construction with shake shingle roof.

The following is a summary of the main comments made by the opponents
of the issue:
1. Residents in this area want to keep it residential.
2. We moved here for the rural area.
3. We do not need another shopping center.
4. Bright Road would have increased traffi~

traffic from Riverside Drive and Sawmill. This would be
dangerous for children, bicycles, etc. in the area.
Commercial Corridor, south of 270 not fully developed yet.
6. Council should do a Quad Study before any rezoning is done.
7. Petition by residents to be submitted to Council and to
Planning and Zoning
8. Development will change character of Village. People will
move out to get away from all this development.
9. Developers using scare tactics when they say that because
of the car dealership, etc. and all the other land is zoned
commercial.
10. Dublin should not be dictated by Columbus. (Columbus zoning
on opposite side of Sawmill)
11. A single family development not the only alternative for this
area.
12. Suggest look to residents to see how to serve them best.
ORDINANCE NO. 44-80
Speaking for the ordinance were Ray Johnson and Gerry Bird (re-
presenting applicant). Also speaking as proponents were: Dr. Robert
Seiple and Joseph DeVennish. The following reflects main comments
made for the rezoning:
1. $150,000 housing market for this rezoning area.
2. This will bring better services (fire, police) into the area.
3. Condominiums from original plan have been eliminated.
4. Have already met with Concord Township Trustees
5. Road needs to be connected (in accordance with Concord
Township Fire Department)
6. 31 single family lots at 2.34 units/acre.
7. Open space provided.

owners. larger lots next to older lots.

9. Dr. Seiple withdrew name from rezoning petition. He favors
the rezoning efforts.
10. Joseph DeVennish - representing estate of Katherine and
Dorothy Flowers and he favors the rezoning.

A summary of comments made by the opponents of the issue follows:
I. Problem with water run-off, storm sewers.
2. Alternative plan submitted to members of Council
3. Petition submitted and to be submitted to Planning and
Zoning Commission.

4. Will hire legal counsel to protect rights.
5. The road will drop 50 feet. Council will be held responsible
if anything happens to property because of the water damage
resulting from this development.
6. Density is the problem. Recommend keep R-l zoning. This
zoning is more close to R-4.
7. Concord Township (represented by Karen Koch): Oppose potential
traffic of this development. Sewer drainage serious problem.
8. Too much traffic on both S.R.745 and Edgewood Drive. (ODHS study
of SR 745 distributed to Council)
9. No coverage by Dublin Fire Department.
10. No storm sewers on Edgewood or curbs.
11. Green space area is flooded.
12. No benefits to residents of area.
13. Attempt should be made to see what the area residents want. Not
the developers.

14. This should be worked out with Delaware County.
15. Construction traffic would be a real problem.
16. Council should be willing to work with us on these
problems.
A petition from area residents was presented to Council expressing
their opposition to the proposed rezoning. The petition listed their
concerns and was signed by approx. 50 residents.
