OF DUBLIN, COUNTY OF FRANKLIN, AND STATE OF OHIO.
WHEREAS, the City of Dublin is preparing to install a waterline as part of its
improvement of Emerald Parkway; and
WHEREAS, installment of the waterline will require the City of Dublin to obtain a
utilities easement as well as a temporary construction easement in and to the premises
described in the attached Exhibit "A" and Exhibit "B", located in the City of Dublin,
County of Franklin, State of Ohio.
NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin,
State of Ohio, ~ of the elected members concurring that:
Section 1. Council considers it necessary and declares its intention to appropriate,
for the purpose of improving Emerald Parkway and installing a waterline easement; a
utilities easement and a temporary construction easement in the premises located in
the City of Dublin, County of Franklin, State of Ohio as more fully described in the
legal descriptions attached hereto as Exhibit "A" and Exhibit "B".
Section 2. The City Manager is hereby authorized to cause written notice of the
passage of this Resolution to be served upon the owners and persons in possession or
having an interest of record in the above-described property. This notice shall be
served according to law.
Section 3. This Resolution shall take effect and be in force from and after the
earliest date permitted by law.

PROJECT BACKGROUND:
The City of Dublin is preparing to install a thirty (30) foot, eight (8) inch wide waterline in its
effort to improve Emerald Parkway. The installation of the waterline requires the acquisition
of utilities easements and a temporary construction easement from two property owners.
ACQUISITION INTRODUCTION:
This memorandum discusses the acquisition of property owned by Charles E. and Karen S.
Richardson. The acquisition consists of a .143 acres, more or less, utilities easement and a .009
acres, more or less, temporary construction easement located north of Emerald Parkway and
east of Coffinan Road, City of Dublin, County of Franklin, State of Ohio.
ACTION TAKEN IN THIS CASE:
The Law Department engaged M/E Companies (Mr. James Howard} to negotiate the
acquisition with the landowners. This negotiation will continue to take place after passage of
ww.SZD.com this resolution. This resolution indicates the City's intent to appropriate the above land. This
resolution merely begins the eminent domain process and further legislation is necessary to
c°'°"'a'S begin acquisition of the land.

c'""""2° If an agreement is reached, then the Law Department will prepare an ordinance authorizing the
City Manager to enter into a real estate purchase contract with the landowner. If an agreement
cannot be reached, the Law Department will proceed with preparing an ordinance for
presentation at an upcoming City Council meeting regarding litigation.
RECOMMENDATION:
The Law Department recommends approval of Resolution No. 80-08.

Beginning, for reference, at an iron pin found at the southwest corner of said Lot 25, same being
the southeast corner of Lot 26 as shown and delineated upon the said recorded plat of "THE
WOODS OF INDIAN RUN" and being the TRUE POINT OF BEGINNING;
Thence N 24°38'14"W a distance of 67.94 feet along the property line between said Lot 25 and
Lot 26 to an angle point;
Thence N 20°21'46"E a distance of 23.49 feet along a new line into the Grantor's property to an
angle point;
Thence N 34°55'57"W a distance of 92.95 feet along a new line across the Grantor's property to
the west line of said Lot 25, same being the east line of Lot 26;
Thence N 24°38'14"W a distance of 13.99 feet along the line between said Lot 25 and Lot 26 to
an iron pin found at the northwest corner of Lot 25, same being the northeast corner of Lot 26
and lies on a circular curve in the southeasterly right-of--way line of Forest Run Drive;
