The June 2, 1980 regular meeting of Council was called to order by
Mayor Headlee with roll call as follows: Chambers, present; Geese,
present; Headlee, present; Lewis, present; Mand, present; Maurer, pres-
ent; and Shawan, present. The minutes of the May 19, 1980 meeting were
read and approved as corrected by motion of Mr. Shawan, seconded by
Mr. Chambers. The listing of bills (attached) was approved by motion
of Mr. Geese, seconded by Mr. Mand.
ORDINANCE NO. 19-80
Mr. Harrison Smith, represented the applicants for the rezoning
request of approximately 286 acres located south of Brand Road, to be
known as "Earlington Village". As requested by the Planning and Zon-
ing Commission, a clear definition of the term "cluster housing" and
the inclusion of the green spaces explanation were submitted as part
of the application package. Bikeway routes, water service and water
retention plans were pointed out and explained by Mr. David Hussey,
also representing the applicant.
Mr. Smith made the following proposals for the applicants' con-
tribution to the sewer system for both Earlington and Brandon (Ordi-
nance 1120-80):
1) Provide a force main system with emergency back-up to the
pumping station if it should not function; or

2) Whatever the amount of money #1 would require, they would
make a contribution towards the construction of the gravity
sewer, with a commitment to release ownership to the Village
within two years; or
3) Pay 60% of the actual cost of construction for the offsite
gravity sewer coming to their property and be reimbursed
from capacity charges from offsite users who would benefit
from the new sewer, based on their 60% contribution; or
4) If there is a legal means in which the Village could collect
fees at the time of tap in, from any downstream user, the
pro rata, per acre charge, to be remitted to the developers
up to the amount of the actual cost for them to build the
gravity sewer. This could be collected by capacity charges
as they tap in or by pro rata charge for useage.
Mayor Headlee suggested that a committee be appointed to meet
with Mr. Smith and Mr. Hussey to determine feasibility of proposals
3 and 4. The committee will include Mayor Headlee; Village Manager,
Sherman Sheldon; Law Director, Steve Smith; Village Engineer, Charles
Wolfe; and any Council member who could arrange to attend the meeting.

Mr. Harrison Smith then requested Ordinance #19-80 be tabled to
the June 16, 1980 meeting. Mr. Lewis moved to table the ordinance
and Mr. Shawan seconded the motion. All members voted to approve the
motion with Mr. Geese abstaining from the vote.
ORDINANCE NO. 20-80
Ordinance #20-80, dealing with the rezoning of approximately 240
acres to be known as Brandon Village was presented for discussion.
Mr. Harrison Smith, representing the applicants, requested the
ordinance be tabled for discussion to the June 16, 1980 meeting. Mr.
Smith pointed out that the four (4) proposals presented in discussion
of Ordinance #19-80, also applied to the Brandon Village ordinance.
Mr. Lewis then moved to table the discussion to the June 16, 1980 meet-
ing. The motion was seconded by Mr. Chambers and unanimously approved.

ORDINANCE NO. 37-80

Ordinance #37-80, dealing with establishing fire lanes and the enforce-
ment of same was read for the third time. The ordinance was passed by
unanimous vote.
ORDINANCE NO. 40-80
Ordinance #40-80, dealing with regulating the sale of firearms, was
read for the second time. Police Chief Mayer recommended approval of the
ordinance to allow for more control over the buying and selling of stolen
firearms. Mr. Chambers questioned Section 1 of the ordinance, stating
gun collectors should be excluded from these requirements of the ordinance.
An amended ordinance will be presented at the June 16, 1980 meeting.
ORDINANCE NO. 41-80
Ordinance #41-80, providing for a contract for a fiscal impact model
was read for the second time.
ORDINANCE NO. 42-80

Ordinance #42-80, dealing with renewal of note on the municipal build-
ing was introduced by Mr. Geese and read for the first time. Mr. Mand
moved to approve the ordinance, do away with the three time reading, and
pass an an emergency. The motion was seconded by Ms..Maurer and the motion
and the ordinance were both passed unanimously.

ORDINANCE NO. 43-80
Ordinance #43-80, dealing with the employment of a Village Planning
Consultant was introduced by Mr. Geese and read for the first time. Mr.
Mand requested the Planner, Mr. Helman, to prepare a report to Council
for the next meeting regarding the following:
1. Role of the Planner to Village.
2. Authority by which the Planning Consultants realize decisions.
3. Provide greater understanding of conflicting roles as consult-
ants to the Planning and Zoning Commission, authorizing plans
quad study and ordinances and then speaking against same.
Mr. Helman agreed to provide a written answer to the questions raised
by Mr. Mand, to be submitted for review at the June 16, 1980 meeting.
RESOLUTION NO. 14-80

Resolution #14-80, setting the time and place for the 1981 budget
hearing was introduced by Mr. Shawan and read for the first time. Ms.
Maurer moved to hold the public hearing for the 1981 budget at the Munici-
pal Building, 7:30 P.M., June 16, 1980 and to pass the resolution as an
emergency. Mr. Shawan seconded the motion. The motion and resolution
were unanimously passed.

ORDINANCE NO. 44-80
Ordinance #44-80, dealing with the proposed rezoning of property north
of the Delaware County line and east of State Route #745, was introduced
and read for the first time. Mayor Headlee set the time for the Public
Hearing on the rezoning for 7:30 p.m., July 7, 1980.

Two representatives of Koppers Co., Mr. Doug Myers and Mr. Mark Schwartz,
appeared before council to present information regarding cedar shake shingles
and fire retardent cedar shake shingles.

PERRY TOWNSHIP
In a discussion regarding the new street levy and the existing police
levy in Perry Township, Mr. Shawan moved, with Mr. Geese seconding, to re-
quest that Village officials proceed to file a complaint against Perry Town-
ship and challenge the double taxation of the road and police levies for
Dublin residents within Perry Township. The motion was unanimously passed.
The meeting was adjourned by Mayor Headlee at 10:05 P.M.

A Special Meeting of Council was held at 7:00 p.m. on June 2,
1980. The meeting was called to order by Mayor Headlee with roll
call as follows: Chambers, present; Geese, present; Headlee, present;
Lewis, present; Mand, present; Maurer, present; and Shawan, present.

The meeting was called to discuss basic zoning laws. Mr. Michael
Gunner, Assistant Law Director, presented information on three major
issues of zoning.

1. The effect of a "master plan" if the Village decides to
adopt a new one or related to the 1967 Plan.
2. What is the effect of the Sawmill/161 Quad Study, if
adopted by Dublin?
3. Are there confli8ts regarding Planned Unit Development
time requirements of the zoning code?

Regarding Issue #1, Mr. Gunner pointed out that the Planning
Commission has authority to recommend through the "master plan" the
location for streets, roads, bridges, parks, open spaces, etc., pub-
lic utilities and the relocation or removal of same. The Commission
may make changes at any time to the master plan. The original Master
Plan for the Village was adopted in 1967.
Issue #2, the 161/Sawmill Quad Study, according to Mr. Gunner,
is not a zoning code, but an overlay type of zoning district for that
particular area. Any commercial or non-residential use of this land
would have to comply with the guidelines of said Plan. At this point,
question was raised by Mr. Moffitt, a member of the Planning and Zoning
Commission, as to whether or not this was approved by the Commission.
Mayor Headlee will have the minutes researched for this information
and report to Council at the next meeting.

Regarding the time requirements of P.U.D. and whether there
are conflicts with the zoning code and amended Charter, Mr. Gunner
was unsure. The Clerk was then asked to research both to determine
time requirements of P.U.D. as stated in the Charter and the Zoning
Code and to provide this information to Council for the next meeting.
