HomeMy WebLinkAboutResolution 070-18RECORD OF RESOLUTIONS Dayton Legal Blank, Inc., Form No. 30045 Resolution No. 70-18 Passed , 20 A RESOLUTION AUTHORIZINIG THE CIN MANAGER TO COOPERATE AND ENTER INTa► AN AGREEMENT WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR THE RESURFACING OF SR -161 FROM JUST EAST OF RIVERSIDE DRIVE TO THE SAWMILL ROAD INTERSECTION IN DUBLIN (ODOT PID NUMBER 106081) WHEREAS, the following is a Resolution enacted by the City of Dublin, Franklin, Union and Delaware Counties, Ohio, (hereinafter referred to as "Dublin', in the matter of the stated described project; and WHEREAS, the Ohio Department of Transportation (hereinafter referred to as "State' has identified the need for the resurfacing of SR -161 between just east of Riverside Drive and the Sawmill Road intersection in Dublin; and WHEREAS, for the portion of the resurfacing project that is within Dublin, Dublin will contribute 20% of the construction costs of the pavement surface treatment and 100% of the cost of non -surface related items such as curbs, gutters, and partial and full -depth pavement repairs; and WHEREAS, the Dublin Community Ilan promotes working cooperatively with surrounding jurisdictions to promote regional transportation planning and programming; and WHEREAS, the construction is tentatively planned to start in the summer of 2019 with completion anticipated in the spring of 2020. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, Mate of Ohio, of the elected members concurring, that: Section 1. Consent Statement. Being in the public interest, Dublin gives consent to the Director of Transportation to complete the above described project. Section 2. Cooperation Statement. Dublin shall cooperate with the Director of Transportation in the above described project as follows: (A) Dublin hereby agrees to cooperate with the Director of Transportation of the State of Ohio in the planning, design and construction of the identified highway improvement project and grants consent to the State for its development and construction of the project in accordance with plans, specifications and estimates as approved by the Director; (B) The State agrees to assume and bear one hundred percent (100%) of the necessary costs of the State's highway improvement project; Dublin's share of the cost for the pavement surface treatment is estimated to be $102,000. (C) The City agrees to assume and bear one hundred percent (100%) of the fatal cost of those features requested by Dublin that ars not necessary for the improvement as determined by the State and Federal Highway Administration. Section 3, J[ Udities and Right -of -Way Statement. Dublin agrees that all right-of- way required for the described project will be acquired and/or made available in accordance with current State and Federal regulations. Right-of-way costs include eligible utility costs. Dublin agrees that all utility accommodation, relocation and reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT Utilities Manual. Section 4. Maontenance. Upon completion of the project, and unless otherwise agreed, Dublin shall: (1) provide adequate maintenance for the project in accordance with all applicable State and Federal law, including, but not limited to, Title 23, U.S.C., RECORD OF RESOLUTIONS Dayton Legal Blank, Inc., Form No. 30045 Resolution No. 70-18 PaAP, p9e 2 of 2 ,20 Section 116; (2) provide ample financial resources, as necessary, for the maintenance of the project; (3) maintain the right-of-way, keeping it free of obstructions, and (4) hold said right-of-way inviolate for public highway purposes. Section 5. Authority to Sign. The City Manager is hereby empowered to enter into contracts on behalf of the City of Dublin with the Director of Transportation necessary to complete the above described project. McDaniel, City Mana ra4re-- Date,x November 27, 2018 Re: Resolution 70-18 — Demonstrating the City of Dublin's Cooperation with the Ohio Department of Transportation for the Resurfacing of SR -161 from just East of Riverside Drive to the Sawmill Road Intersection in Dublin (ODOT PID Number 106081) The Ohio Department of Transportation (ODOT) has initiated the design of improvements to th SR -161 corridor from just east of the Riverside Drive intersection in Dublin to the SR -315 interchange in Worthington. The work includes pavement milling, resurfacing, and pavement markings. Attached is a map exhibit of the project limits in Dublin. Staff recommends Council adoption of Resolution 70-18, authorizing the City Manager to Cooperate and Enter Into an Agreement with the Ohio Department of Transportation for the Resurfacing of SR -161 from just east of Riverside Drive to the Sawmill Road intersection in Dublin (ODOT PID Number 106081). This project falls under our urban paving policy. The ODOT Urban Paving Initiative requires that the local municipality contribute 20% of the total cost of the surface treatment for the portion of the project within its corporation limits. Additionally, the local is required to contribute 100% of the cost of non -surface related items such as curbs, gutters, utility relocation expenses, and partial -and full -depth pavement repairs. Based upon initial cost estimates, the preliminary projection for the City's contribution for this project is estimated to be $102,000 at this point. This does not include any 100% City items such as pavement repair, special striping, curb ramps, etc. Note that this is a preliminary figure and will change. Once final plans are developed and quantity splits are determined, the City of Dublin will be invoiced for its share of the project costs approximately six weeks before the project's scheduled sale. The sale is tentatively scheduled for June 2019. Enclosed is preliminary participatory legislation that is to be executed by the City. After your review and approval, please forward the legislation to Council for their necessary action. When executed, please return an electronic copy of the executed legislation to my email address, rebecca.wagner@dot.ohio.eov . In order to assure that project development proceeds in a timely manner, the enclosed legislation will need to be fully executed and returned to this office prior to February 28, 2019. SECTION I - Project Description WHEREAS, the STATE has identified the need for the described project: This project proposes to resurface a portion of SR161, from US33 to Sawmill Rd., within the City of Dublin. NOW THEREFORE, be it ordained by the City of Dublin, Ohio. SECTION II - Consent Statement Being in the public interest, the LPA gives consent to the Director of Transportation to complete the above described project. SECTION III - Cooperation Statement The LPA shall cooperate with the Director of Transportation in the above described project as follows: The City hereby agrees to cooperate with the Director of Transportation of the State of Ohio in the planning, design and construction of the identified highway improvement project and grants consent to the Ohio Department of Transportation for its development and construction of the project in accordance with plans, specifications and estimates as approved by the Director; The Ohio Department of Transportation shall assume and bear one hundred percent of the necessary costs of the State's highway improvement project; the City's share of the cost for the pavement surface treatment is estimated to be $102,000. Following appropriate legislative action, it shall take effect and be in force immediately upon its passage and approval, otherwise it shall take effect and be in force from and after the earliest period allowed by law.
