A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
INTO A GUARANTEED MAXIMUM PRICE (GMP) CONTRACT WITH
TURNER CONSTRUCTION COMPANY INC. FOR CONSTRUCTION
OF THE DOWNTOWN DUBLIN PARKING GARAGE, ROADWAY
IMPROVEMENTS, AND LANDSCAPING ENHANCEMENT
WHEREAS,, on February 27, 2017 the Dublin City Council authorized the City Manager to
enter into a Development Agreement with the Columbus Metropolitan Library (CML) which
established the cooperative framework within which the City of Dublin (the City) and CML
would redevelop the current Dublin branch library site to include a new 42,500 square feet
Dublin branch library (by CML), a new parking garage (by the City), and a series of abutting
roadway improvements (by the City), which agreement was executed on May 2, 2017; and
WHEREAS,, on December 5, 2016, the Dublin City Council authorized the City Manager to enter
into a Real Estate and Transfer of Property Agreement with the Dublin City School District to
facilitate the planned redevelopment of the Dublin branch library site, which agreement was
executed on February 27, 2017; and
WHEREAS,, Council approved the City's Five -Year Capital Improvements Program for 2018-
2022 on September 11, 2017 which identified funding for the City's portions of this
redevelopment project to include the parking garage, the planned roadway improvements to
North Franklin Street, North Street and Rock Cress Parkway, and landscaping enhancements
for the area located between Rock Cress Parkway and the Grounds of Remembrance Veterans
Memorial; and
WHEREAS,. in 2017 Dublin City Council reviewed and approved the development plans for
the Parking Garage, the Roadway Improvements, and the Landscaping Enhancements, and
WHEREAS., in order to ensure the fully coordinated, integrated and most efficient
construction of all of the elements of the redevelopment project, the Development Agreement
provides for the use of a single Construction Manager to be responsible for the construction of
both the City's parking garage, roadway improvements, and landscaping enhancements as
well as CML's new Library and site improvements; and
WHEREAS,. Chapter 37 of the Dublin Codified Ordinances authorizes multiple forms of
delivery methods for public infrastructure projects including Construction Manager At
Risk(CM) as contemplated within the executed Development Agreement; and
WHEREAS, clue to the very congested nature of the redevelopment site and the need for
careful and continued coordination of all construction activities located thereon it was
determined that the Construction Manager At Risk delivery method best met both the City's
needs and desired outcomes for this project as well as those of CML; and
WHEREAS, through an open, transparent and completive process, CML had previously
selected Turner Construction as its CM for all of its branch library construction projects (of which
the Dublin Branch is one) and Dublin has been able to successfully negotiate the terms of a
Construction Manager agreement with Turner Construction; and
WHEREAS, the construction plans for these City projects have been completed and approved,
and Turner Construction has successfully bid these projects through 14 separate bid packages
from 49 bidders in an open and competitive bidding process; and
WHEREAS, these bids have been carefully reviewed by Turner Construction, the City's
representative and City staff who have collectively concluded that the bidding process
achieved very good levels of interest and participation from many qualified construction firms
and that the pricing from the successful bidders is fully consistent with the project previous
estimates and with the costs identified within the City"s.2018-2022 Five -Year Capital
Improvement Program as approved by City Council on September 11, 2017; and
WHEREAS, based upon these bids, Turner Construction Company, Inc. and the City have
agreed upon the Guaranteed Maximum Price for the construction of the parking garage,
roadway improvements, and landscaping enhancements; and
WHEREAS,, City Council has determined that the Guaranteed Maximum Price of
$17,697,550 is within the budget established for this project.

N W THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio,
I of the elected members concurring that:
Section 1. The Guaranteed Maximum Price negotiated between the City Manager and Turner
Construction ('-'ompany, Inc. in the amount of $ 17,697,550 is hereby accepted for the
Downtown Dublin Parking Garage, Roadway Improvements, and Landscaping Enhancement
project.
Section 2. The City Manager is hereby authorized to enter into a Guaranteed Maximum Price
(GMP) Contract with Turner Construction Company, Inc. for said project.
Section 3. This Council further hereby authorizes and directs the City Manager, the
Director of Law, the Director of Finance, the Clerk of Council, or other appropriate
officers of the City to prepare and sign all agreements and instruments and to take any
other actions as may be appropriate to implement this Resolution and complete the Project.
Section 4. This Resolution is effective upon passage, in accordance with Section 4.04(a) of the
Revised Charter.

Resolution 04-18, if approved by Council, will authorize the City Manager to enter into a Guaranteei
Maximum Price (GMP) Contract with Turner Construction Company for the construction of that
Downtown Dublin Parking Garage, the abutting roadway improvements, and the landscaping
enhancement just south of the Grounds of Remembrance.

For multifaceted projects such as this, both public and private entities are increasingly selecting the
Construction Manager At Risk, with a guaranteed maximum price (GMP) as the ,►
construction delivery model. Chapter 37 of the Dublin Codified Ordinances authorizes multiple forms
of delivery methods for public infrastructure projects., including Construction Manager At Risk, as
was contemplated within the executed Development Agreement.

The Administration recommends that Council approve Resolution 04-18, authorizing the City
Manager to enter into a Guaranteed Maximum Price (GMP) Contract with Turner Construction
Company for the construction of the Downtown Dublin Parking Garage, abutting roadway
improvements, and landscaping enhancements for $17,697,550,
