HomeMy WebLinkAboutResolution 083-17RECORD OF RESOLUTIONS Dayton Legal Blank, Inc., Form No. 30045 Resolution No. 83-17 Passed , 20 A RESOLUTION DEMONSTRATING THE CITY OF DUBLIN'S COOPERATION WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR THE REPLACEMENT OF GUARDRAIL END TREATMENTS ALONG US -33 SO"TH OF POST ROAD (ODOT PID NUMBER 104166) WHEREAS, the following is a Resolution enacted by the City of Dublin, Franklin, Union and Delaware Counties, Ohio, (hereinafter referred to as the local Public Agency (''LPA', in the matter of the stated described project; and WHEREAS, the Ohio Department of Transportation has identified the need for the replacement of guardrail end treatments along US -33 south of Post Road, within the Dublin corporation limits; and WHEREAS, the total construction cost of the project is estimated to be $867,000, with the construction projected to start in the spring of 2018 and completion projected for the fa I I of 2018. NOW, T REFORE, BE 77 RESOLVED by the Council of the City of Dublin, State of Ohio, of the elected members concurring, that: Section 1. Consent Statement. Being in the public interest, the LPA gives consent to the Director of Transportation to complete the above described project. Section 2. Cooperation Statement. The LPA shall cooperate with the Director of Transportation in the above described project as follows: (A) The City hereby agrees to cooperate with the Director of Transportation of the State of Ohio in the planning, design and construction of the identified highway improvement project and grants consent to the Ohio Department of Transportation for its development and construction of the project in accordance with plans, specifications and estimates as approved by the Director; (B) ODOT agrees to assume and bear the costs of preliminary engineering, right- of-way, and construction by administering Federal and State funds for this project. (C) The City agrees is assume and bear one hundred percent (100%) of the total cost of those features requested by the City that are not necessary for the improvement as determined by the State and Federal Highway Administration. Section 3. Utilities and Right -of -Way Statement. The LPA agrees that all right- of-way required for the described project will be acquired and/or made available in accordance with current State and Federal regulations. Right-of-way costs include eligible utility costs. ODOT agrees to be responsible for all utility accommodation, relocation and reimbursement and agrees that all such accommodations, relocations, and reimbursements shall comply with the current provisions of 23 CFR 645 and the ODOT Utilities Manual. Section 4. Maintenance. Upon completion of the project, and unless otherwise agreed, the LPA shall: (1) provide adequate maintenance for the project in accordance with all applicable state and federal law, including, but not limited to, Title 23, U.S.C., Section 116; (2) provide ample financial resources, as necessary, for the maintenance of the project; (3) maintain the right-of-way, keeping it free of Obstructions, and (4) hold said right-of-way inviolate for public highway purposes. Section S. Authority to Sign. The City Manager is hereby empowered to enter into contracts on behalf of the City of Dublin with the Director of Transportation necessary to complete the above described project. McDaniel, City Mana � Date: November 16, 2017 Initiated By: Megan O'Callaghan, P.E., Director of Public Works Summary Memo Re: Resolution No. 83-17 —Demonstrating the City of Dublin's Cooperation with the Ohio Department of Transportation for the Replacement of Guardrail End Treatments Along US -33 South of Post Road (ODOT PID Number 104166) The Ohio Department of Transportation (ODOT) has initiated a project to replace guardrail end treatments at numerous locations throughout the central Ohio region. Guardrail end treatments are safety devices used to prevent vehicles from hitting fixed objects along the roadside and to minimize the severity of a road departure crash. A location map for all guardrail work locations in Franklin County is attached for Council's reference.
