Ordinance No. 33 -17 RECORD OF ORDINANCES Form No. 30043 Passed .20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTS TO ACQUIRE 0.009 -ACRE, MORE OR LESS, OF FEE SIMPLE RIGHT -OF -WAY; AND A 0.005 - ACRE, MORE OR LESS, TEMPORARY EASEMENT FROM THE INDIAN RUN UNITED METHODIST CHURCH OF DUBLIN, LOCATED AT THE INTERSECTION OF AVERY ROAD AND BRAND ROAD, FOR THE PUBLIC PURPOSE OF CONSTRUCTING ROAD�11�/IAY IMPROVEMENTS. WHEREAS, the City of Dublin (the "City'? is preparing to construct a roundabout at the intersection of Avery Road and Brand Road (the "Project'; and WHEREAS, the Project requires that the City obtain a fee simple right -of -way interest as well as a temporary easement from Franklin County Parcel No. 273 - 010855 -00 owned by the Indian Run United Methodist Church of Dublin (the "Grantor "), said property interests more fully described in the attached Exhibits A and depicted in the attached Exhibits B; and WHEREAS, the City and the Grantor participated in good faith discussions and have come to mutually agreeable terms for the acquisition of the necessary property interests for the sum of $17,225.00, which is the appraised value of the property interests; and WHEREAS, the City desires to execute necessary conveyance documents to complete the transaction between the City and the Grantor. NOW, THEREFORE, B IT ORDAINED by the Council of the City of Dublin, Delaware, Franklin, and Union Counties, State of Ohio, of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documents to acquire 0.009 -acre, more or less, of fee simple right -of -way, and a 0.005 -acre, more or less, temporary easement from the Indian Run United Methodist Church of Dublin, for the appraised value of $17,225.00, said property interests located within Franklin County Parcel No. 273 - 010855 -00, and more fully described and depicted in the attached Exhibits A and B. Section 2. Council further hereby authorizes and directs the City Manager, the Director of law, the Director of Finance, the Clerk of Council, or other appropriate officers of the City to take any other actions as may be appropriate to implement this Ordinance. The City is obtaining right-of-way and easements from various landowners to construct the Project. This Project requires that the City acquire fee simple right-of-way and a temporary easement from the Indian Run United Methodist Church of Dublin (the "Grantor') from the property located on Brand Road,, identified as Franklin County Parcel Number 273-010855-00. The City and the Grantor participated in good faith discussions and have come to mutually agreeable terms for the acquisition of the necessary property interests for the sum of $17,225.00, which is the appraised value of the property interests. The appropriation consists of 0.009-acre, more or less, of fee simple right-of-way, and a 0.005- acre, more or less, temporary easement. The appraised fair market value of the property interests was determined to be $17,225.00, Ordinance 33-17 would authorize the City Manager to execute all necessary conveyance documents to formally acquire the necessary property interests described above. Staff recommends that Council approve Ordinance 33-17 at the second reading/public hearing on June 26,2017.
