A RESOLUTION DEMONSTRATING THE CITY OF
DUBLIN °S COOPERATION 11VITH THE OHIO DEPARTMENT
OF TRANSPORTATION FOR THE RESURFACING OF US -33
FROM POST ROAD TO JUST WEST OF AVERY ROAD IN
DUBLIN, AS WELL AS THE RAMPS AT POST ROAD AND A
SECTION OF SR -161 (ODOT PID NUMBER 94145)
WHEREAS, the following is a Resolution enacted by the City of Dublin, Franklin, Union
and Delaware Counties, Ohio, (hereinafter referred to as the Local Public Agency
("LPA', in the matter of the stated described project; and
WHEREAS, the Ohio Department of Transportation has identified the need for the
resurfacing of US -33 between Post Road and Avery- Muirfield Drive, as well as the
ramps at Post Road and a section of SR -161; and
WHEREAS, the total construction cost of the project is estimated to be $1.3 million,
with the construction projected to start in the summer of 2017 and completion
projected for the fa I l of 2017.
NOW, T EREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of
Ohio, of the elected members concurring, that:
Section 1. Consent Statement. Being in the public interest, the LPA gives consent
to the Director of Transportation to complete the above described project.
Section 2. Cooperation Statement. The LPA shall cooperate with the Director of
Transportation in the above described project as follows:
(A) The City hereby agrees to cooperate with the Director of Transportation of the
State of Ohio in the planning, design and construction of the identified
highway improvement project and grants consent to the Ohio Department of
Transportation for its development and construction of the project in
accordance with plans, specifications and estimates as approved by the
Director;
(13) ODOT agrees to assume and bear the costs of preliminary engineering, right-
of -way, and construction by administering Federal and State funds for this
project.
(C) The City agrees to assume and bear one hundred percent (100 %) of the total
cost of those features requested by the City that are not necessary for the
improvement as determined by the State and Federal Highway Administration.
Section 3, Uto 0 ities and Right-of-Way Statement. The LPA agrees that a l l right-
of-way required for the described project will be acquired and /or made available in
accordance with current State and Federal regulations. Right -of -way costs include
eligible utility costs. ODOT agrees to be responsible for all utility accommodation,
relocation and reimbursement and agrees that all such accommodations, relocations,
and reimbursements shall comply with the current provisions of 23 CFR 645 and the
ODOT Utilities Manual.
Section 4. [ivl�aintenance. Upon completion of the project, and unless otherwise
agreed, the LISA shall: (1) provide adequate maintenance for the project in accordance
with all applicable state and federal law, including, but not limited to, Title 23, U.S.C.,
Section 116; (2) provide ample financial resources, as necessary, for the maintenance
of the project; (3) maintain the right -of -way, keeping it free of obstructions, and (4)
hold said right -of -way inviolate for public highway purposes.

Section S. Authority to Sign. The City Manager is hereby empowered to enter
into contracts on behalf of the City of Dublin with the Director of Transportation
necessary to complete the above described project.
Section 6. This Resolution shall take effect upon adoption in accordance with
Section 4(a) of the Revi d Charter.

The Ohio Department of Transportation (ODOT) has initiated 'improvements to the US-33 corridor
from the Post Road interchange to just west of Avery-Muirfleld Drive in Dublin. The interchange
ramps at Post Road and a section of SR-161 will also be improved. The work includes pavement
resurfacing and pavement markings. [Attached is a map exhibit of the project limits.]
This project is completely funded by ODOT. Dublin did not request any additional improvements
or enhancements that are not necessary for this improvement; therefore, no local contribution is
involved. ODOT's estimated construction cost is $1.3 million.
Staff recommends Council adoption of Resolution 07-17, demonstrating the City of Dublin's
Cooperation with the Ohio Department of Transportation for the Resurfacing of US-33 from Post
Road to just west of Avery Road in Dublin, as well as the Ramps at Post Road and a Section of SR-
161 (ODOT PID Number 94145).
