AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
EXECUTE NECESSARY CONVEYANCE DOCUMENTS TO ACQUIRE
A 0.198 ACRE, MORE OR LESS, PERMANENT EASEMENT FROM
VINCENT P. AND CYNTHIA B. LOM BARDO, FROM THE
PROPERTY LOCATED AT 7100 AVERY ROAD FOR THE PUBLIC
PURPOSE OF CONSTRUCTING A SANITARY SEWER.
WHEREAS, the City of Dublin (the "City'? is preparing to construct a sanitary sewer
line across Avery Road (the "Project'; and
VVHEREAS, the Project requires that the City obtain a permanent easement from
Franklin County Parcel No. 273 - 000418 -00 owned by Vincent P. and Cynthia B.
Lombardo (the "Grantors "), said easement more fully described in the attached
Exhibit A and depicted in the attached Exhibit B; and
WHEREAS, the pity and the Grantors participated in good faith discussions and the
Grantors have agreed to donate the easement to the City at no cost; and
WHEREAS, the City desires to execute necessary conveyance documents to
complete the transaction between the City and the Grantors.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
Delaware, Franklin, and Union Counties, State of Ohio, , of the elected
members concurring that:
Section 1. The City Manager is hereby authorized to execute all necessary
conveyance documents to acquire a 0.198 acre, more or less, permanent easement
from Vincent P. and Cynthia B. Lombardo, said easement located within Franklin
County Parcel No. 273- 000418 -00, and more fully described and depicted in the
attached Exhibits A and B.
Section 2. Council further hereby authorizes and directs the City Manager, the
Director of Law, the Director of Finance, the Clerk of Council, or other appropriate
officers of the City to take any other actions as may be appropriate to implement this
Ordinance.
Section 3, This ordinance shall take effect in accordance with 4.04(b) of the
Dublin Revised charter.

The City of Dublin ("City") is preparing to construct a sanitary sewer line across Avery Road (th
"Project") east to serve 7100 Avery Road and, in the future, properties to the south. The Projec
requires that the City obtain certain permanent sanitary sewer easements. I
Tincent P. and Cynthia B. Lombardo (the "Grantors") own property from which the City desires a
permanent sanitary sewer easement. This property is located at 7100 Avery Road, and is
idened as Franklin County Parcel No. 273-000418-00.
After engaging in amicable discussions, the Grantors have agreed to donate the easement to the
City at no cost.
The City will be acquiring from the Grantors only one easement, which is necessary for purposes of
the Project, as depicted in the legal descriptions and depictions attached to this memorandum.
The acquisition is a 0.198-acre permanent sanitary sewer easement.
Ordinance 01-17 would authorize the City Manager to execute all necessary conveyanc

Proposed Sanitary Sewer
Easement
7100 Avery Road
Situated in the State of Ohio, County of Franklin, being a part of Virglnla military Survey
Number 32010, being a 0.198 acre sanitary sewer easement out a of 2.30 acre tract as
conveyed to Vincent P. Lombardo and Cynthia B. Lombardo in Instrument Number
201507280103271 and being mare particularly described as follows;
Commencing, for reference, at a point in the centerline of Avery Road (60 feet in width)
at the northwesterly corner of said 2.30 acre tract and being the southwesterly corner of
a 0.893 acre tract as conveyed to Jeff R. Siefker in Instrument Number
201010010128978;
Thence, North 71' 44' 13" East, along the line common to said 2.30 acre and said 0.893
acre tract, a distance of 34.07 feet to a point in the easterly right -of -way line of said
Avery Road, said point being THE TRUE PLACE OF BEGINNING of said proposed
sanitary sewer easement;
Thence, from said PLACE OF BEGINNING, North 71° 44' 13" East, continuing along
the line common to said 2.30 acre tract and said 0.893 acre tract, a distance of 28.39
feet to a point;
Thence, South 10° 02' 18" West, across said 2.30 acre tract, a distance of 179.61 feet
to a point in the southerly line of said 2.30 acre tract, being the northerly line of a 1.35
acre tract as conveyed to Joseph D. Manchik in Instrument Number 200010260217213;
Thence, North 79° 57' 42" Want, along the line common to said 2.30 acre tract and said
1.35 acre tract, a distance of 25.00 feet to a point in the easterly righW -way line of said
Avery Road;
Thence, North 10° 02' 18" East, across said 2.30 acre tract and along said easterly
right -of -way line, a distance of 166.15 feet to the TRUE PLACE OF BEGINNING.
Containing 0.198 acres of land, more or less.
Subject to all easements, restrictions and rights -of -way, of record.
Bearings are based on the easterly right - of-way line of Avery Road (North 10 °02'18"
East) utilizing the O.D.O.T. VRS RTK Network..
This description is based on a field survey performed by Pomeroy & Associates, Ltd. in
April of 2016.
All references are to records of the Franklin County Recorders Office, Franklin County,
Ohio.
