The Dublin Village Council met in Executive Session at about 7:10 P.M.
to discuss potential litigation.

The regularly scheduled meeting of Council was called to order by Mayor
Close at 7:50 P.M. on Monday, June 16, 1986.
Mr. Thornton led the Pledge of Allegiance.
Members of Council present were: Mr. Amorose, Mayor Close, Ms. Maurer,
Mr. Rozanski, Mr. Sutphen, and Mr. Thornton.
Mr. Jankowski was absent.
Mr. Stephen Smith, Law Director, and Mr. Sheldon, Village Manager, were
also present as were Mr. Bowman, Mr. Harding, Ms. Jordan, Ms. Prushing,
and Mr. Warner of the Village Staff.
Mr. Amorose moved to approve the minutes of the June 2, 1986 Council
Meeting.
Mr. Thornton seconded the motion.
The vote was unanimous in favor of approving the minutes.
Mr. Sutphen moved to pay the bills.
Mr. Thornton seconded the motion.
The vote was 6-0 in favor of paying the bills.
There was no correspondence.

Ordinance No. 43-86 - Adoption of the Proposed 1987 Tax Budget. Public
Hearing.
There were no registered proponents or opponents.
Mayor Close reviewed the Council Rules of Order.
Mayor Close said that the ordinance would be held over for a third
reading at the Council Meeting of July 7, 1986.

Ordinance No. 14(A)-86 - Rezone 3.8 Acres Between Martin Road and Dublin-
Granville Road. Third Reading.
Mr. Bowman reported briefly on the background of the ordinance -
1. Originally the ordinance involved over 12 acres of land; it has
since been split up into two sections; the lots facing Dublin-
Granville Road being Part A and the lots facing Martin Road
being Part B.
2. The Planning and Zoning recommended approval of the P.U.D. subject
to three conditions -
A. The stone wall in front be increased to 36".
B. There was some wording in the text that the Commission wanted
deleted.
C. More specifications for the proposed building on the lot.
3. All of those changes have been made and the package before Council
Members as reviewed and approved by the Planning Commission.
The vote was unanimous in approval of the ordinance.
Ordinance No. 32-86
Third Reading.
Mr. Amorose moved to approve the amended ordinance as was given to
Council members in their packets.
Mr. Rozanski seconded the motion.
The vote was 6-0 for approval of the amended ordinance.
Specifications for a Variance for a Brick Sidewalk.
Mr. Sutphen moved to amend Section 2., Number 3. to read as follows:
"4" of limestone compacted base covered by 3~" of concrete (residential
grade".
Mr. Amorose seconded the motion.
The vote was unanimous in favor.

Ordinance No. 45-86 - Accept Lowest/Best Bid on 1986 Street Improvements.
First Reading.
Mr. Rozanski introduced the ordinance.
Mr. Thornton moved to accept the recommendation of the Villa~e Manager,
accept the bid of the Strawser Paving Company, do away with the three
time reading rule and treat as an emergency.
Mr. Amorose seconded the motion.
Mr. Warner described the Ralumac system as being "cheap asphalt". He
said that it is basically an asphalt similar to S-l mixed with limestone,
larger than what tar and chip is, and a little bit heavier than slurry
seal.
Mr. Warner said that it would be used on Avery Road, which eventually will
not be a heavily traveled road; acting as a cosmetic cover to all the
patchwork.
Mr. Warner noted that Strawser Paving Company's most recent work for the
Village of Dublin was the paving work done at Avery Road Park.
Mayor Close asked Mr. Warner how the bids on tack coat could go from a
penny a unit to a dollar a unit.
Mr. Warner said that they are covering that cost in other items; that
is the way that bidders often bid.
The vote on doing away with the three time reading rule and treating
as an emergency was 6-0 in favor.
The vote on the ordinance was unanimous in favor.
Ordinance No. 46-86 - Rezone .8 Acre on Darby Street, 200' North of
Bridge Street. First Reading.
Ms. Maurer introduced the ordinance, and moved to refer same to the
Planning and Zoning Commission.
Mr. Thornton seconded the motion.
The vote was unanimous in favor of the motion,
Ordinance No. 47-86 - Ordinance Requirine the Use of Seat Belts. First
Reading.
Mr. Thornton introduced the ordinance.
Ms. Maurer commented that there appeared to be an incomplete sentence at
the end of Section F.
Mr. Smith said that he would check same.
The second reading will be at the July 7, 1986 Council meeting.
Ordinance No. 48-86 - Amendin Codified Ordinances for New Zonin District.
First Reading.
Mr. Amorose introduced the ordinance.

Ms. Maurer proceeded to give an explanation regarding the ordinance as
chairman of the Land Use Committee. She said that originally there was
a P.I.D. (Planned Industrial District) ordinance which was referred to
the Planning and Zoning Commission. She also said that prior to that
being referred, there was a joint meeting of Council and the Planning and
Zoning Commission. After that meeting the Planning and Zoning Committee
met to review the ordinance. At their meeting they recommended that
instead of planning a Planned Industrial District to the Post Road area
(which was the intention of the use of the ordinance) that it be changed
to create a Planned Office, Laboratory and Research District.

Subsequently a joint meeting of the Land Use Committee and the Planning
and Zoning subcommittee met to review that proposal and created a new
ordinance.
Ms. Maurer said that it was the first reading of a new ordinance, and
noted that it had already been reviewed by the Planning and Zoning
Commission. Therefore, there will be a public hearing on the ordinance
at the next Council meeting (July 7, 1986) on the ordinance.
Mayor Close asked Mr. Smith if there was a requirement for notification
of said meeting to be sent to landowners.
Mr. Smith said that he did not think so, but that he would check further
into the matter.
Ms. Maurer noted that this ordinance was not, at this time, being applied
to a specific area.
Ordinance No. 49-86 - Vacating an Easement in Shannon Park, Phase 2,
Section 2. First Reading.
Mr. Amorose introduced the ordinance.
Mr. Warner said that there was an error made on the original
original plat showed the easement between lots 132 and 133.

Final Plat Approval - Earlington Village, Section II.
The vote was unanimous for approval of the final plat, Earlington Village,
Section 2.

Ms. Maurer moved to approve the final plat, Indian Run Meadow, Section 4.
Mayor Close seconded the motion.
Mr. Amorose referred to the minutes of the Planning and Zoning Commission
meetings regarding their discussions of this particular plat, specifically
the mounding and landscaping of Muirfield Boulevard. The original agree-
ment with them was to do the mounding and landscaping, the lots have been
sold, and subsequently whoever graded the lots removed the mounds and
the mounds are no longer there.
He asked who was responsible to see that the mounds are constructed in
such a manner that they proposed and on which the plan was granted approval.
Mr. Smith said that the new owner could be approached, teeling him what
had been agreed to. The new owner could then go back to the original owner.
Mr. Ben Hale, Jr. said that it was his understanding that there was to
be mounding within the right-of-way of Muirfield Boulevard which is not
there. Some monnding was put in the right-of-way. Staff reviewed same, anc
said that if those mounds were continued throughout, the boulevard would
meet the requirements. That work should be completed this week. The
mounding and landscaping along the east side of Muirfield Boulevard was also
reviewed with staff. That work is also to be completed this week.
Mr. Rozanski said that he thought that it would be helpful if all
agreements were in writing, and perhaps these problems would not occur;
more detail should be included.
Mr. Warner said that there had been two meetings. The first meeting was
to discuss the mounding on Muirfield Boulevard. A second meeting was
held to discuss the mounding on the east side of the boulevard. He
said that he and Bob Darragh checked all of the mounding on the east side
of the boulevard, and all those mounds met or exceeded Dublin code
requirements for 3' above the curb line except for one or two. Those
were corrected the following day.

A meeting between the developers will be held regarding the mounding on
the west side of the boulevard shortly.
Mr. Amorose said that topographical maps will be needed in the future.
The intent of the Planning and Zoning Commission was that there would
be mounding along both sides of the boulevard and the mounding was to
conceal, to screen out the homes along there.
Mr. Warner said that if there were a continuous screen that drainage
problems would be created.
Mr. Sutphen said that he felt that the problem was that the homes
have been sold, people are moving in, and then the mounding and trees
are being put in place. He suggested that the mounding should have been
completed before the homes were sold.
Mr. Hale said that the median is being mounded now.
Mr. Warner said that Muirfield Drive has not been accepted, that it is
still a private street.
Mr. Sutphen mentioned the many concerns of residents in Indian Run Meadow
regarding the unsightliness of the road - mud, debris, etc.
Mr. Rozanski moved that no action be taken on approval until all work has
been completed in Indian Run Meadow.
Mr. Sutphen seconded the motion.
Mr. Hale said that Mr. Schottenstein is responsible for the median; Mr.
Bill Mitchell did the development on the east side. He said that it was
his understanding that both "of those are being done this week".
Mr. Rozanski moved to table until the first meeting in July.
Mr. Sutphen seconded the motion.
The vote was unanimous in favor of the motion to table until the first
meeting in July.

Comments from Citizens
Mr. Gary Myers, a resident of Donegal Cliffs spoke to Council of a concern.
He spoke regarding a recent meeting with the School Board, at which meeting
school sites were discussed in Donegal Cliffs. The vote of the School
Board, by a vote of 3-2, was not to sign the contract.
Mr. Myers said that their purpose in coming to the Council meeting was to
learn, from Council, the responsibility of the developer or a subsequent
developer who purchases property from the original developer to guarantee
to the homeowners that the land that has not yet been developed will
be comparable in terms of what was promised to them when they purchased
their property. He said that their concern was that since the School
Board was not going to buy the property that another developer could come
in, that that developer develop the remaining lots that will guarantee
the same density and the same quality of homes that are presently there.
Mayor Close stated that the P.U.D. applies regardless of who the ultimate
developer is. The subsequent developer has to meet whatever those housing
standards are. The homeowners, he said, also have the right to enforce
by civil law suit the compliance with the restrictions that were trans-
ferred by deed.
He said that the Village cannot guarantee that the builder will be required
to build houses that will cost $75/foot as opposed to $50/foot. The
quality of the home being built, as long as it meets the basic Village
housing code and complies with the P.U.D., cannot be legilated by the
Village. '

Mayor Close also explained to the residents of Donegal Cliffs the required
rezoning procedure of the Village of Dublin.
Mr. Smith said that the general trend has been to not "downgrade". He
also said that the property cannot be rezoned unless all the adjoining
property owners are notified.
It was suggested that Mr. Myers and other interested residents meet with
Mr. Bowman to familiarize themselves with the requirements of the P.U.D.
Ms. Maurer said that it was unfortunate that that particular situation
had developed, and mentioned that as with anything else, there were pros
and cons on both sides of the issue. She reminded those present that a
great deal of traffic could be generated with 25 acres of single family
housing, whereas with a school there would only be about 18 buses twice
a day.
Council Roundtable Discussion
1. Mr. Rozanski thanked Mr. Sheldon and Mr. Johnson for their prompt
action in replacing the flagpole in the cemetery.
2. Ms. Maurer reminded Council members about the Saturday (June 21, 1986)
goal setting followup meeting.

Mr. Thornton suggested that the local press inform the citizenry
about the nine-one-one emergency system which will be in effect
beginning April 1, 1987.
Mr. Thornton said that the planning of such a system took a great
deal of work.
He noted that the basic cost of programming the unit and setting it
up will be borne by the State. The individual entities that have
the equipment, he said, will have to pay $1,364.00 per month for
five years, whereupon they will own all of the equipment (a lease
purchase agreement). He noted that the Washington Township Fire
Department and the Perry Township Police Department will be
subscribing to the system. There will be a slight increase in an
individual's telephone bill (17i to 27i per month).

4. Mr. Sutphen thanked one of the local newspapers for the article on
the old cemetery.
Mr. Sutphen said that he would like for some monies to be appropriated
for marking(s) or marker(s) in the two old cemeteries (the one off
of Kinross Court in Muirfield and the one behind the Dublin Middle
School).

Mayor Close recalled conversations regarding making a major decision on
improving O'Shaughnessy Dam. He said that the discussions concern both
some annexation of some Columbus-owned land; e.g., Glick Road to the
Village, some possible easements along the right of way, etc. in order
for Dublin to make an expansion of the bridge.
Mayor Close said that he would like a presentation from the engineering
firm working on that project at one of the meetings of the Council in
July.
