The regularly scheduled meeting of the Dublin Village Council was called to order by Mayor Michael L. Close at 7:30 P.M. on Monday, May 5, 1986. -.. Mr. Thornton led the Pledge of Allegiance. Members of Council present were: Mr. Amorose, Mayor Close, Mr. Jankowski, Ms. Maurer, Mr. Rozanski, Mr. Sutphen, and Mr. Thornton. Mr. Smith, Law Director, and Mr. Sheldon, Village Manager, were present as were the following members of the Village Staff: Mr. Bowman, Mr. Harding, Mr. Johnson, Ms. Jordan, Ms. Prushing, and Mr. Warner. Mr. Amorose moved to approve the minutes of the April 14, 1986 meeting of Council. Mr. Jankowski seconded the motion. The vote was unanimous in favor of the motion. Mr. Sutphen made a motion to approve paying the bills. Mr. Amorose seconded the motion. Mr. Thornton thank the Finance Director for reinstalling an asterisk on the list of bills of the amounts of money that are a direct re- payment to the Village. In other words those amounts marked with an asterisk cost the Village no money; it has been collected from another source. ",.... The vote was 7-0 in favor of paying the bills. ..... Ordinance No. 30-86 - Authorize Purchase of Land for Parks and Recrea- tion. Public Hearing. There were no registered proponents or opponents. Mayor Close said that he had been asked by the Parks and Recreation Director that this ordinance be passed as an emergency measure. Mr. Amorose moved to do away with the three time reading rule and treat as an emergency Mr. Sutphen seconded the motion. The vote was unanimous in favor of the motion. The vote on the ordinance was 7-0 in favor. Ordinance No. 22-86 - Accept Annexation of 101.3 Acres North of High School. Third Reading. Mr. Bowman told Mr. Jankowski that the area is zoned Limited Residential and would come into the Village with a Rural designation. Mr. Bowman said that there are four or five owners with two majority owners. r- r ~ Mayor Close commented that after acceptance by Council the ordinance does have to layover for a period of 30 days for the purposes of public referendum if there be any citizens in opposition to the annexation. The vote was unanimous in favor of the ordinance. Resolution No. 07-86 Second Reading. Mr. Smith said that he had met with the School Board counsel and they discussed the items that would go into the suggested agreement. He said that he had received a first draft of the suggested items only this afternoon and that it was not acceptable in its present form. As a result he asked Council to hold the resolution for two weeks to give an opportunity for further work on same. Locating a School Site in Earlington Subdivision. He also said that in addition there were discussions going on with Muirfield regarding school sites which have not yet been finalized. Ms. Maurer said she had a concern, specifically as it relates to the amount of space that would be needed for parks in the'future. She indicated that the last time there had been a real study done was in 1978, and at that time the study proposed that the Village should have nine neighborhood parks and several large centralized park space for recreational activities Ms. Maurer suggested that the Parks and Recreation Standing Committee study the matter further before Council approves giving away 20 plus acres of land. Mr. Rozanski suggested perhaps tabling the resolution until the Council has additional time to study the proposed draft. Mayor Close commented that it could be tabled at the third reading which would be at the second meeting in May of the Council. ~ Mr. Geese, as a private citizen, spoke before the Council regarding the ordinance. Mr. Geese recalled that for a period of six years, when each of the many subdivisions came in for plat approval before Council and the Planning and Zoning Commission that he was a strong advocate of setting aside land for park sites and school sites. He indicated that he thought that the tapes of those meetings should be found and made available. He also said that Earlington did agree to have a school site, and possibly two school sites. A lease situation was not discussed; they intended to have a school site. He also commentEd that the open space ordinance was in effect when Earlington "came in". Mr. Geese said that he recalled that there was land set aside for school sites ....... ".... Mayor Close commented that on some of the plats that the designation of park/school appeared; particularly on the site described in this ordinance appears that way. He said that it was his understanding that there had been a number of changes as a result of some of the other green space that was to be put in and maintained by the developer of the area that resulted, perhaps, being slightly less than it might have otherwise been. He indicated that what this resolution is addressing is that fact that some of the land was originally platted as both school and park property. Ms. Maurer asked if there had been a definite decision as to how it was to be divided and was there any "vision" as to how that was going to be used . Mr. Geese said that there have been "bubbles" changed through the development process. He said that he recalled that there was to be a 7 acre park site in Hemingway West; the "bubble" was changed and it was moved further in, into Earlington. Mr. Geese suggested that members of Council review the Northwest Quad Study. ;}, .... Mr. Bowman said that on the original plan there was a 29 acre site. It was wrapped around a pond; had a detention area; was wooded. Approximately 8 or 9 acres of that was blocked off for a school. The 29 acres also included 7 from Hemingway West. The additional acreagE in the original plan was 29 acres with 3 acres up the stream (flood plain). Also listed is a 6 acre church site. Mayor Close requested that the Clerk provide for members of Council the records of minutes, etc. of Council and Planning and Zoning Commission - those which discussed the Earlington Village site. Mr. Geese suggested that in the future when things were agreed to or committed to by developers that those agreements be put in writing. Ordinance No. 33-86 - Amend Ordinances 79-78 and 48-84 - Indian Run Meadow Development Plan. First Reading. Mayor Close said that after discussing this matter with the Law Director that it was his understanding that the appropriate action would be to accept a motion to refer the ordinance to the Planning and Zoning Commission since it does amend the plats. Mr. Amorose introduced the ordinance. .... . ~ \.r Mr. Bowman said that what was being proposed is a plan change, taking what was a 5.2 acre school site. He said that the schools would like to purchase an 8 acre site in the northeast corner, moving the park site in the northeast corner, and proposing on approximately 7 acres an office/institutional use on the boulevard. There would be an abutting school/park site. Mr. Smith said that he had talked with Mr. Wall of the schools, who said that the contracts for purchase of the property had been delivered to the School Board. They are waiting for Mr. Rich to approve the draft. According to Mr. Wall the "deal is made" as long as all the attorneys put their "stamp of approval on it" and that they hope to execute contracts within the next four or five days. Responding to a question from Mr. Rozanski regarding the location of retention areas. There was concern expressed regarding the fact that the retention area was within the park site. Ms. Jordan said that perhaps something could be worked out so that said areas could work out. ".- Mr. Geese said that he had read that there had been discussion with regard to capital improvements and the cost of extending Muirfield Road through Indian Run Meadow. Mr. Geese wanted to know what the cost of extending the road would be to the Village or whether the developer was to pay for the cost of the extension. Mr. Bowman said that the original commitment was that the developers would build three-fourths of that road and the Village would build one fourth. He said that that was clearly spelled out in the minutes, but that he would have to check to see if it was so written in the text. The developer said that he would be responsible for a collector street, which would be 36' wide. The Village said that they wanted a boulevard. Therefore the developer boulevarded a portion of the roadway and the Village will pick up the northern portion and do the same ..... Mr. Rozanski asked that the Planning and Zoning Commission and staff work closely with the Parks and Recreation Department on the retention areas within the park site. Mr. Amorose moved to refer the ordinance to the Commission. Ms. Maurer seconded the motion. The vote was unanimous in favor of the motion. Ordinance No. 34-86 - Rezone 15.479 Acres West Side of Manley Road, South of Glick Road. First Reading. Mr. Amorose introduced the ordinance. Mr. Bowman gave a brief description of the location of the property, noting that a portion of it was in Delaware County and a portion in Franklin County, with the Riviera Country Club immediately to the south. It is a long, narrow piece of property. He noted that the proposal is for P.U.D. and that what they are proposing 41 single family lots. The closest line for sewers is in Muirfield, and Muirfield would expect to be compensated for the tap in. Mr. Bowman also said that there is a problem in that the land starts to falloff so that the lots on the end of the cul-de-sac would have to be force main or some type of ejector system to get them into the pipe where the gravity takes over. \..- Mayor Close said also that the Planning and Zoning Commission should be aware that the school is in contract with the land to the north and might want to look at the school's wishes as well. It was also noted that the water tower is to be constructed in the northeast corner, just behind Deer Run School. Mr. Amorose moved to refer Ordinance No. 34-86 to the Planning and Zoning Commission. Ms. Maurer seconded the motion. The vote was 7-0 in favor of the motion. --- ~ f Ordinance No. 35-86 - Proposed Cemetery Fee Structure for Grave Sites, etc. First Reading. Mr. Amorose introduced the ordinance. It was announced that the ordinance would be held over for a Public Hearing and Second Reading at the Council Meeting of May 21, 1986. Ordinance No. 36-86 - Amending Section 1109.s{c), (d) and (f) of Codified Ordinances (Park Fee). First Reading. Mr. Rozanski introduced the ordinance. Mayor Close announced that this ordinance, since it involves fees, would be held over for a Second Peading and Public Hearing at the meeting of May 21, 1986. Resolution No. 09-86 - Opposing House Rule 3838 Regarding Tax Reform Act First Reading. Mr. Sutphen introduced the Resolution. ,... it ,1 if. Mr. Sutphen moved to do away with the three time reading rule and treat as an emergency. Ms. Maurer seconded the motion. The vote was unanimous in favor of the motion. \.. The vote on the resolution was 7-0 in favor. It was noted that the Clerk of Council is directed to forward copies of the resolution to the members of the Senate Finance Committee and of the House Ways and Means Committee, and to the Senators from the State and Representative(s) from the district. Resolution No. 10-86 - Special Resolution Honoring Senior Citizens. First Reading. The Clerk read the Resolution in its entirety - a copy is attached. I ---....' Mayor Close moved to amend the Resolution to read as follows: "Therefore, we the Council of the Village of Dublin, Ohio, do proclaim the month of Mayas Senior Citizens Month". Mr. Thornton seconded the motion. Mr. Thornton expressed his appreciation on behalf of all senior citizens. Mayor Close expressed his personal thanks and appreciation. The vote on the amendment was unanimous in favor. The vote on the Resolution was 7-0 in favor. Mayor Close presented the Resolution to Mr. Thornton on behalf of the Village Council. Mr. Sheldon introduced Mr. David Harding, the new Administrative Assistant. ..... f , \.... Mayor Close noted that the Village Engineer had requested approval by motion to proceed with advertising for bids for 1986 street improvements Mr. Rozanski moved to approve the Village Engineer proceeding to accept bids on the 1986 road improvement projects. Mr. Sutphen seconded the motion. Mr. Warner explained that the Ralumac System is a new system being employed by the State Highway Department; about half the cost of asphalt; is better than slurry seal. Mr. Geese mentioned a bikeway study and the capital improvement program. He said that he felt that there should be a bikeway along Coffman Road, by the fence, along Shannon, Hemingway through the subdivisions. Ms. Jordan said ments program. The vote on the motion to proceed with the 1986 street improvements was unanimous in favor. Citizen Comments ~ Mrs. Catherin Headlee said that at the last meeting in December (1985) she requested that the newspapers print the telephone numbers of the members of Council and well as the telephone numbers of the Planning and Zoning Commission members. She indicated that as of the present date this had not been done, and that she would prefer not to get telephone calls regarding matters of the Village since she was no longer a member of Councilor of the Planning and Zoning Commission. She also said that she received complaints that Council members at times do not respond to calls from citizens. Ms. Maurer said that all telephone numbers were available on a roster at Village Hall and that such inquiries should be referred to the Municipal Building. -.... Form No. 1097 ~ Held May 5, 1986 19 Page Six r Because of the activities related to the Memorial Tournament on the regularly scheduled Council meeting night of May 19, 1986, there was discussion regarding changing the meeting date to another night. Ms. Maurer moved to have the Dublin Village Council meeting on Wednesday, May 21, 1986, at 7:30 P.M. At 7:00 P.M. there will be separate and special meeting with the Planning and Zoning Commission to discuss the proposed Planned Industria Development District ordinance and rezoning the Post Road area to Planned Industrial District. The vote was unanimous in favor of the motion. .......... Council Roundtable Discusssion Mr. Rozanski - Mr. Rozanski mentioned the fact that last year the Village Council made an unprecedented move by allowing a developer to start building homes prior to the roads being paved. He noted that the previous weekend the developer had been preparing the roads for paving, and Mr. Rozanski said that the road bed seemed to be "in good shape". He did say that the one bad aspect was that the curbs got damaged terribly (20 to 25% being cracked or damaged). He said that he thought that in the future Council should consider repairing the curbs before paving. Mr. Warner said that this was the first street done in Dublin entirely with fabric. The fabric does not allow the clay to come up and mix with the stone, so the stone stays firm and hard. Ms. Maurer "-- ,.. \t ~ "--' Ms. Maurer mentioned the minutes of the Land Use and Planning Committee meeting of April 30, 1986, and the fact that they discussed the Post Road study at great length with the architect and came to the conclusion that they wanted to present the ordinance in a revised form to Council (P.I.D. Ordinance), and then to consider rezoning the entire Post Road area as a P.I.D. At the same time, then, to establish clearly that there was to be an east/west road connector through the area so that the future developers can plan around the road. Mr. Bowman will revise the P.I.D. Ordinance and will have it ready for review at a joint meeting of the Land Use Committee and the Planning and Zoning Commission on May 13, 1986, 7:30 P.M. Ms. Maurer also said that at the regular meeting of Council on June 2, 1986, the committee will place on the agenda a resolution to rezone the Post Road area. She said that what is anticipated is that the resolution go through, then the rezoning, and then the establishment of the street plan. Ms. Maurer also noted that she had presented to Council members the minutes of the Goal Setting Committee meeting of May 1, 1986. She reminded members of the Council that the surveys should be completed and returned to the Municipal Building by May 8, 1986.
