RECORD OF ORDINANCES Dayton Legal Blank Co. Form No. 30043 '1~rn 118-98 (Amended) Ordinance No------------------------- Passed--------------------------------------------------19------- Section 1. (Continued) Section 35.81 Findings and Intent (a) It is the intent of the City Council to ascertain and recover the specified percentages of full costs from fees, charges, and regulatory license fees levied in providing the regulation, products, or services set forth in this Chapter. (b) The fee and service charge revenue/cost comparison system set forth in this Chapter provides a mechanism for ensuring that fees adopted by the City for services rendered do not exceed the reasonable estimated cost for providing the services. (c) It is the intent of the City Council to achieve a more equitable and fair mix for financing services set forth in this Chapter in order to reduce or eliminate subsidizing these services with general tax revenue; thereby, allowing those general tax revenues to be used for general services, including infrastructure maintenance and replacement. (a) The City Manager is hereby delegated the authority and directed to provide documents to the City Council to implement its policy to adjust fees and charges to recover the percentage of full costs as established in this Chapter. (b) The City Manager is hereby delegated authority to issue Orders defining terms, setting out administrative, fee collection, and financial procedures, definitions, and establishing effective dates of all fees set by the City Council by Ordinance. All Orders shall be signed by the affected department head, shall be signed by the Director of Finance certifying the financial requirements of this Chapter have been met, and shall be signed by the City Manager specifying the effective date of the Order. (c) "Full Costs" shall be as defined in Section 35.80. In adjusting fees and charges, the City Manager shall act in an administrative and ministerial capacity and shall consider only the standards and criteria established by this Chapter and the applicable State laws. All Orders issued shall comply in all respects with this Chapter, and the schedule of fees and rates as set by the City Council. (a) The City Manager, Director of Finance, and each City department head, under the direction of the City Manager, shall review annually the fees and service charges listed in Appendix A- Schedule of Fees and Service Charges, and provide an adjusted fee or charge schedule to the City Council for its consideration so as to recover the listed percentage of full costs necessary to provide the listed regulation, product or service as modified by the "notes" following the list of services. These fees, unless otherwise specified, are for City of Dublin services and are in addition to any charges made by any other governmental agencies. (b) The services as listed in this Section shall be as defined in the document entitled "Cost Study for the City of Dublin, Ohio," dated October 1998, as produced by the City of Dublin. (c) All fees and charges set pursuant to this Chapter and Section shall take effect as specified in each Order. (d) The City Manager may vary the review schedule listed in the Section if, in the judgement of the City Manager and a directly affected and requesting department head, a gross inequity would be perpetrated by not revising a fee or charge prior to the next rate review. Any such special rate review shall be reported to the City Council at its next succeeding meeting where the City Council may revise the fee or charge by Ordinance. (e) If fees are not collected at the time that the service is provided, the City has the right to pursue collection of any of the fees listed in this Ordinance, including certification to the County Auditor, remittance to a collection service, or any other appropriate pursuit for payment. 2 RECORD OF ORDINANCES Dayton Legal Blank Co. The Ordinance has now been amended to reflect the recommendations made by the Finance Committee during their meetings of October 26 and November 23. Detailed recap worksheets with results from those meetings are attached for your review. Following is a summary of changes made to Ordinance #118-98 pursuant to the Finance Committee's recommendations: Page, 5-040, Major BLilding_Plan Revision `„ The Division of Building Standards had requested the fee include language in a footnote so that their Commercial Plans Examiner could be billed back to a project. Since this position was new during 1998, it was not included in the data for the Cost Study. Subsequently, the Finance Committee recommended dropping that language and using the language used in previous Ordinances (footnote #14.) Page 6, S-066, Annexa ion P .titinn Prn~PSSing The Finance Committee recommended 100% cost recovery (previously a $750 fee with 41% recovery) with a fee of $2,050 with the understanding that this fee can be waived for hardship situations when necessary. Page 7, 5-085, Witness fiub~Q .na PrncPSCinu This fee was calculated to increase from $10 to $20. The Division of Court Services expressed their concern for increasing this fee, and have instituted procedures to make the process more efficient to save costs. Subsequently, the Finance Committee agreed to a fee of $15. Members of City Council page -2- Page 7, ~-088 through -161, Recreation ervice The Finance Committee is recommending an increase in the fee for season passes to the Community Recreation Center (CRC) in an effort to keep pace with increasing operational costs. The fee schedule in Appendix A-2 on page 14 was added to the Ordinance and will supersede section 2 of Ordinance ~ #126-95 which originally set the season pass rates. If approved by City Council, the updated fee for season passes will not be effective until July 1, 1999. The Finance Committee felt it would be appropriate to move the effective. date of the fee due to any inconvenience that maybe caused to CRC passholders during construction of phase II of the facility. Additionally, the Finance Committee recommended that a 10% discount be given to CRC members for programs held at the CRC facility as a membership incentive. The ten percent (10%) discount has been reflected in footnote #27 in the Ordinance. A ten percent (10%) increase, or a minimum of $5 will apply to the tiers currently in-place for recreation programs for Non-Resident participants. This has also been reflected in footnote #27. Unless otherwise specified by City Council, the fees in Ordinance #118-98 will become effective on January 1, 1999. For this reason, we are asking that this Ordinance be passed as an emergency. Should you have any questions or concerns about the Ordinance, please do not hesitate to contact the Department of Finance. Filename: t:\per\~nmk\study98\memo2.wpd
