AN ORDINANCE TO ACCEPT THE LOWEST/BEST
BID FOR THE CONSTRUCTION OF PHASE II
OF THE COMMUNITY RECREATION CENTER,
APPROPRIATING FUNDS AND DECLARING AN EMERGENCY
WHEREAS, after advertising, receiving and opening bids for the construction of Phase II
of the Community Recreation Center of October 7, 1998; and
WHEREAS, it has been determined the lowest/best bid was from Gutknecht Construction
in the amount of $5,598,100.00; and
WHEREAS, it is necessary to amend the annual appropriations ordinance to provide
sufficient funding for the project.
NOW, TI~EREFORE, BE IT ORDAINED, by the Council of the City of Dublin, State
of Ohio, (~ elected members concurring:
Section 1. That the bid from Gutknecht Construction in the amount of $5,598,100.00 for
the construction of Phase II of the Community Recreation Center be, and hereby is,
accepted.
lion 2. That the City Manager and the Director of Finance be, and hereby aze,
authorized to enter into a contract with Gutknecht Construction for construction of Phase
II of the Community Recreation Center pursuant to the bid specifications.
Section 3. That there be appropriated from the unappropriated balance in the General
Fund the amount of $1,866,330.00 to account 101-02-30-810-2724, for the purpose of
transferring funds to the Community Recreation Center Construction Funds.
~,ction 4. That there be appropriated from the unappropriated balance in the Community
Recreation Center Construction Fund in the amount of $5,866,300.00 to account
411-03-14-780-2530 for the construction of the facility.
Section 4. That this ordinance be, and the same hereby is, declazed to be an emergency
measure for the preservation of public peace, health or welfaze of the residents of this
City, and therefore this ordinance shall take effect and be in force immediately upon its
passage.

RE: Appropriations for Dublin Communi Recreation Center, Phase II
Date: October 15, 1998
We recommend award of the construction contract for the Dublin Community Recreation Center,
Phase II to Gutknecht Construction. Included in the contract will be Alternate Items 1-6, for a total
of $5,598,100.00.
Gutknecht is familiar to the City of Dublin, having been the contractor for the outdoor pool, the
justice Center'and the Carport Addition at City Hall.
The additional $4,000,000 in funding will be obtained from the bond issue that we will be closing
on by the end of the month.

We are writing in regard to our bid submitted earlier today for the above project. We did not
acknowledge receipt of Addendum #3 on our bid form. This was an error. We did receive and
review Addendum #3, the omission on our bid form is only the result of a clerical oversight.
We ask you to regard this omission as a `minor irregularity' as cited in the Instruction to
Bidders, Article 4.D.3.

Please be advised that your bid, with an apparent low base bid, has been rejected
for cause.
Although your base bid is lower, the total bid from Gutknecht Construction comes
in about $100,000.001ower when all the addenda are considered, with a final
tabulation of $5,638,300.00, your total tabulation is $5,726,000.00.
Your bid failed to identify major subcontractors to be utilized on this project, as
specified in Section 2.08.
Your bid failed to identify, as required in Section. 1.03, the receipt of, and
acknowledgment of, Addenda #1-3. Your bid indicated only Addenda #1 & 2
~^ were received and recorded.
~r Since these items were requirements of the bid, we are notifying you that the bid
will be awarded to Gutknecht Construction. On the basis of review, Gutknecht
appears to have submitted a complete and whole bid, with all required sections
included and is also low bidder for the contract which will be awarded.
Thank you for your consideration and efforts, I hope you will continue to bid
projects for the City of Dublin.
