AN ORDINANCE TO REZONE APPROXIMATELY 15.788

BALLANTRAE SECTION 3 AND KENDALL RIDGE
SECTION 2 SUBDIVISIONS, NORTH OF THE WOERNER-
TEMPLE COMMUNITY PARK, FROM R, RURAL
DISTRICT, TO PUD, PLANNED UNIT DEVELOPMENT
DISTRICT (REZONING -THE GLADE AT BALLANTRAE
- CASE NO. OS-157Z).
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, Jr' of the elected members concurring:
Section 1. That the following described real estate (see attached map marked Exhibit
"A") situated in the City of Dublin, State of Ohio, is hereby rezoned PUD, Planned
Unit Development District, and shall be subject to regulations and procedures
contained in Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City
of Dublin Zoning Code and amendments thereto.
Section 2. That application, Exhibit "B", including the list of contiguous and affected
property owners, and the recommendations of the Planning and Zoning Commission,
Exhibit "C", are all incorporated into and made an official part of this Ordinance and
said real estate shall be developed and used in accordance therewith.
Section 3. That this Ordinance shall take effect and be in force from and after the
earliest period allowed by law.

RE: Second Reading for Rezoning Ordinance:
Ordinance 04-06 (Case No. 05-1572 -The Glade at Ballantrae -Woerner-Temple
Road)
SUMMARY:
Rezoning application OS-1572 for the Glade at Ballantrae, located between the Ballantrae and Kendall
Ridge subdivisions, north of the Woerner-Temple Community Park, is being forwarded for second
reading. This application requests a change in zoning for 15.75 acres from R, Rural District to PUD,
Planned Unit Development District to amend the development standards to accommodate 28 single-
family lots and 3.58 acres of open space.
The Planning and Zoning Commission unanimously approved this rezoning on January 5, 2006 with nine
conditions. The applicant has fulfilled Condition 1 and staff has verified that all agreements are finalized.
Conditions 2, 3, 7, and 9 have been addressed in the development text. Conditions 4 and 6 will be
monitored as the site develops, and Conditions 5 and 8 will be addressed at the time of final development
plan approval.
Conditions:
1) That all landscaping agreements be finalized and signed by both parties prior to scheduling this
rezoning at City Council;
2) That the plans be revised to show the northern bikepath terminating at the eastern property line and
that the applicant subtrrit a letter committing to install the southern bikepath connection through Ciry
property (Ballantrae Park);
3) That the applicant obtain an easement for the construction and maintenance of the bikepath within
Ballantrae Park or arrange for the City to accept them as their responsibility;
4) That this site comply with the current City of Dublin's Stormwater Regulations, to the satisfaction of
the City Engineer;
5) That the applicant consult with the City Forester prior to the final development plan submittal to
verify the preferred street tree species along with installation dates and scheduling;
6) That an amended plat for Ballantrae Section 3 indicating the right of way for Street "A" and the
removal of Lot 322 be approved by Planning Commission and City Council prior to filing for
building permits;
7) That all text and plan revisions be completed prior to scheduling this rezoning at City Council;
8) That the applicant work with the City to restore the two existing stub streets in Kendall Ridge to pre-
development conditions (lawn} at the expense of the developer, subject to staff approval; and
9} That the text he revised to state that the homeowners association is an extension of the existing
Ballantrae Homeowners Association.
RECOMMENDATION:
Motion to approve the second reading of Ordinance 04-06 with the nine conditions adapted by the
Planning and Zoning Commission on January 5, 2006.

SUMMARY:
Rezoning application OS-1572 for the Glade at Ballantrae, located between the Ballantrae
and Kendall Ridge subdivisions, north of the Woerner-Temple Community Park, is being
forwarded for first reading. This application requests a change in zoning for 15.75 acres
from R, Rural District to PUD, Planned Unit Development District to amend the

space.
Additional information regarding this case is available for public viewing at 5800 Shier-
Rings Road in the offices of Land Use and Long Range Planning.
Following approval of the first reading, City Council then is to set a date for the public

The proposed development is just east of the 624-acre Dublin golf course community,
Ballantrae. Section 3 of Ballantrae is directly west of the proposed development and consists of
41.279 acres and 85 single-family lots_ East of the proposed development is Kendall Ridge. To
the south is Ballantrae Park and to the north is the Dublin Municipal facility. Homesites for this
development are sized from a minimum of 70 feet to 90 feet at the building. The proposal
includes aneight-foot bike path connecting both open space to the north and south_

Number 3004, being a part of the 36.748 acre tract conveyed to City of Dublin by deed of record in
Instrument Number 200211180294003, and part of Kendall Ridge Boulevard, as recorded in Plat Book
90, Page 38, (all references are to the records of the Recorder's Office, Franklin County, Ohio) and being
more particularly described as follows:
BEGINNING at the common corner of Reserve "B" of "KENDALL RIDGE SECTION 2", as
recorded in Plat Book 93, Page 85 and said 36.748 acre tract, being in the south line of the 16.96 acre
tract conveyed to The Board of Education, Dublin City School District by deed of record in Instrument
Number 199709170095760;

UPDATE:
On November 10, 2005, the Commission tabled this case after extensive discussion regarding
traffic calming efforts on Baronscourt Way and contacting adjacent property owners about
screening to counteract headlight trespass. The applicant and staff met with the neighborhood on
December 14, 2005 to discuss traffic calming. A summary letter of the meeting outcome was
sent to the invited residents indicating that traffic calming would not be utilized on Baronscourt
Way (See letter dated December 19, 2005). The applicant has since revised the text to address
the headlight trespass screening and provided letters of agreement from two of the three adjacent
property owners. Staff understands that the third property owner and the applicant are currently
finalizing an agreement as well.
BACKGROUND:
Case Summary:
This is a request to rezone a 15.75-acre site from R, Rural District, to PUD, Planned Unit
Development District. The applicant is proposing 28 single-family lots and 3.58 acres of open
space. A Concept Plan for this development was heard at the Planning and Zoning Commission
on July 21, 2005 (See Case 04-153CP). Staff is recommending approval of this application with
conditions.

Case Procedure:
As described in Section 153.050, the purposes of the new Planned Development District
regulations are to:
1) Provide an opportunity for a mix of land uses otherwise not permitted within the standazd
municipal zoning district classifications;
2) Allow the creation of development standazds that respect the unique characteristics, natural
quality and beauty of the site and the immediate vicinity and protect the community's natural
resources by avoiding development on, and destruction of sensitive environmental areas;
3) Enable greater review of design chazacteristics to ensure that the project is properly
integrated into its surroundings and is compatible with adjacent development;
4) Assure compatibility between proposed land uses within and around the Planned
Development District through appropriate development controls;
5) Pursue the housing and economic development goals of the City;
6) Promote economical and efficient use of land and reduce infrastructure costs through unified
development;
7) Provide for supporting community facilities; and
8) Establish objective criteria for development plan review that ensure conformity to
community and district standazds and allow for consistent treatment throughout.
The procedures established for the new Planned Development Districts continue to provide for
proper site planning in a coordinated and comprehensive manner, consistent with accepted land
planning, landscape architecture, and engineering principles, using imaginative azchitectural
design and flexibility in building styles. The new PUD process may consist of up to three basic
stages:
1) Concept Plan (Staff, Commission, and/or City Council review and comment);
2) Zoning Amendment Request (Preliminary Development Plan; Commission
recommends and City Council approves/denies); and
3) Final Development Plan (Commission approves/denies).
A preliminary development plan shall be reviewed by staff and forwarded to the Planning and
Zoning Commission for review and action. The Planning and Zoning Commission shall review
the application to determine compliance with the approval criteria set forth in 153.055(A) and
repeated below. Upon review the Planning and Zoning Commission shall ultimately forward the
plan to City Council with a recommendation for approval, a recommendation for approval
subject to conditions, or a recommendation for disapproval. City Council shall review the
proposal and conduct a public hearing before rendering its decision. Adopting the plan shall
constitute a rezoning of the property and allow the applicant to proceed with detailed preparation
of the final development plan.
Review Criteria:
In accordance with Section 153.055(A) Plan Approval Criteria, the Code sets out the following
criteria of approval for a preliminary development plan (rezoning):
1) The proposed development is consistent with the purpose, intent and applicable standards of
the Dublin Zoning Code;
2) The proposed development is in conformity with the Community Plan, Thoroughfare Plan,
Bikeway Plan and other adopted plans or portions thereof as they may apply and will not
unreasonably burden the existing street network;

3) The proposed development advances the general welfare of the City and immediate vicinity
and will not impede the normal and orderly development and improvement of the
surrounding areas;
4) The proposed uses aze appropriately located in the City so that the use and value of property
within and adjacent to the azea will be safeguarded;
5) Proposed residential development will have sufficient open space azeas that meet the
objectives of the Community Plan;
6) The proposed development respects the unique characteristic of the natural features and
protects the natural resources of the site;
7) Adequate utilities, access roads, drainage, retention and/or necessary facilities have been or
are being provided.
8) Adequate measures have been or will be taken to provide ingress and egress designed to
minimize traffic congestion on the surrounding public streets and to maximize public safety
and to accommodate adequate pedestrian and bike circulation systems so that the proposed
development provides for a safe, convenient and non-conflicting circulation system for
motorists, bicyclists and pedestrians;
9) The relationship of buildings and structures to each other and to such other facilities provides
for the coordination and integration of this development within the PD and the larger
community and maintains the image of Dublin as a quality community;
10) The density, building gross floor area, building heights, setbacks, distances between
buildings and structures, yard space, design and layout of open space systems and parking
areas, traffic accessibility and other elements having a bearing on the overall acceptability of
the development plan's contribution to the orderly development of land within the City;
11) Adequate provision is made for storm drainage within and through the site so as to maintain,
as far as practicable, usual and normal swales, water courses and drainage azeas;
12) The design, site arrangement, and anticipated benefits of the proposed development justify
any deviation from the standard development regulations included in the Dublin Zoning
Code or Subdivision Regulation, and that any such deviations are consistent with the intent
of the Planned Development District regulations;
13) The proposed building design meets or exceeds the quality of the building designs in the
surrounding area and all applicable appeazance standazds of the City;
14) The proposed phasing of development is appropriate for the existing and proposed
infrastructure and is sufficiently coordinated among the various phases to ultimately yield the
intended overall development;
15) The proposed development can be adequately serviced by existing or planned public
improvements and not impair the existing public service system for the azea; and
16) The applicant's contributions to the public infrastructure are consistent with the
Thoroughfare Plan and are sufficient to service the new development.
CONSIDERATIONS:
Site Characteristics:
Site Description. The 15.75-acre site is rectangular in shape, with a width of
approximately 425 feet from east to west and a length of 1,620 feet. It is the northern
portion of a lazger, 36.75-acre L-shaped tract located between the Ballantrae and Kendall
Ridge subdivisions, north of the Woerner-Temple Community Park. The only natural
feature on this property is a partial tree row at the southwest comer of the site.

Zoning Description. The site is currently zoned R, Rural District. To the east is the
Kendall Ridge subdivision and to the west is the Ballantrae subdivision both zoned PLR,
Planned Low-Density Residential District. To the north is the Dublin City Schools' Bus
Complex, zoned LI, Limited Industrial District, and to the south is the Woerner Temple
Community Park, zoned R, Rural District.
• Neighborhood Meeting. Based on concerns raised by the Commission, the applicant and
staff held a meeting with adjacent property owners on December 14, 2005 regazding the
need for traffic calming on Bazonscourt Way. Five of the 25 invited households attended
and reviewed possible traffic calming devices (See Sign-Up Sheet). The residents in
attendance were unanimously opposed to the implementation of any traffic calming
device on Bazonscourt Way. The residents believed that the issue with speeding is
temporary, and felt that targeted, increased enforcement by Dublin Police would
encourage speed limit compliance. Staff has contacted the Police Chief to relay this
information and informed all invited households of the outcome of this meeting (See
letter dated December 9, 2005).
Property Owner Contact. Staff has been in contact with the property owners of Lot 340,
the Proegler family, by phone and email to advise them of the recent developments in this
case. The Proeglers met with staff on December 21, 2005, to review the plans and the
minutes from the November 11, 2005 Planning and Zoning Commission meeting. An
agreement has been reached between the developer and the Proeglers for compensation of
landscaping to alleviate headlight trespass (See letter dated December 28, 2005).
Community Plan and Land Use:
• Land Use and Density. The Future Land Use Plan within the Community Plan (Map 8)
identifies the preferred land use for this site as "Residential-Medium Density (1-2
du/ac)." The proposed use of the site matches the intended use as specified by the Future
Land Use Map. Plans indicate a density of 1.77 dwelling units per acre with open space
and parkland dedication of 3.58 acres.
Site Layout:
• General Layout. As proposed, the site plan indicates 28 single-family lots. A short street
connects into the site from Bazonscourt Way to the west. The street terminates at the
north-south double ended cul-de-sac, which is the main street for the site. All lots back
up to the two existing subdivisions east and west of the site. The proposed 3.58 acres of
open space is located to the north of the site, adjacent to the existing open space within
Kendall Ridge.
Road Layout/Access Management. Vehicular access to this site is proposed from the east
off Bazonscourt Way in the Ballantrae subdivision. A platted and unbuilt residential lot
(Lot 322) within Ballantrae Section 3 located on the east side of Baronscourt Way will be
utilized as public right-of--way to connect to the proposed "Street A." The northern cul-
de-sac terminates at the proposed open space, and the southern cul-de-sac terminates at
the Woerner-Temple Community Park. Both cul-de-sacs open to the park and open
space, providing physical and visual access.
• Parkland/Open Space. The plans indicate 3.58 acres of open space that will be dedicated
to the City of Dublin adjacent to the future Kendall Ridge Park. Cul-de-sac islands
containing Reserves B and C will be owned and maintained by the Homeowners'

Association. An eight-foot bike path is indicated within this proposed open space,
connecting the northeast portion of the cul-de-sac through the open space to the
intersection of Meaghan Drive and Varwyne Drive within Kendall Ridge. Staff
recommends that the plans be revised to show this bikepath terminating at the property
line and that the applicant work with the City regarding future bike path connections.
An additional eight-foot bike path is shown connecting the southern cul-de-sac to the
northeast portion of the pazking area of the Woerner-Temple Community Pazk. Staff
recommends that the applicant submit a letter committing to install this connection
through City property.
Architecture. The text states that four-sided architecture will be utilized with design
elements and details repeated on all four sides of a home. The building materials
permitted by the text include brick, stone, stucco, wood, and cementitious siding. The
applicant has revised the text to also include cultured stone as a building material. The
text states that the applicant reserves the right to present newly engineered/developed
exterior materials to the Commission for review and approval. The text also states that
azchitecturally designed homes using all stucco may be permitted, subject to the review
of the Architectural Review Committee (ARC) and design treatments consistent with the
architecture must also be incorporated.
Transportation:
Public Streets. Three new public streets will be created with 50 feet ofright-of--way and
28 feet of pavement back-to-back of curb. All streets will be required to have sidewalk
on both sides. The applicant will need to provide curb ramps at both points where the
proposed bike path connects to the public street.
Traffic Control. Stealth Stat data collected by staff in February 2005 on this section of
Bazonscourt Way shows that the 85~' percentile speed was determined to be 29 miles per
hour. The residents that attended the December 14, 2005 meeting with the applicant and
staff regarding traffic calming were unanimously opposed to the implementation of any
traffic calming device on Bazonscourt Way. The residents suggested increased
enforcement by Dublin Police and staff has contacted the Police Chief to relay this
information. The plans have been revised to exclude traffic calming devices.
Headlight Trespass. Based on concerns raised by the Commission, the text has been
revised to include an agreement to work with property owners of Lots 339-341 to provide
appropriate landscape screening for headlight trespass. The applicant has provided staff
and the Commission with letters of agreement to compensate two of the three property
owners for these landscape enhancements (See Landscape Agreements). Staff is awaze
that the developer and the third property owner, Raymond Romero, aze in the process of
finalizing an agreement and requests that all agreements be finalized and signed by both
parties prior to scheduling this rezoning at City Council. The landscape enhancements
will consist of evergreen trees and shrubs and this detail will be presented at the final
development plan stage.
Development Text Standards:
• Density/Setbacks. The development text permits 28 homesites on 15.75 acres at a density
of 1.77 units per acre. The proposed lots are to have a lot width between 70 and 90 feet.
The text requires varied front yard setbacks between 25 and 35 feet, a 25-foot No-Build

Zone at the rear, and seven-foot minimum side yards with the total side yard requirement
of 15 feet. All lots abutting pazkland will have a 10-foot No-Build Zone.
Bikepaths/Pedestrian Circulation. The development text states that four-foot sidewalks
will be installed in accordance with Code. Bikepaths will be eight feet and are shown on
the plans within the open space to the north and connecting to the Woerner-Temple
Community Park to the south. Staff recommends that the applicant work with the City to
obtain an easement for the new path within Ballantrae Park or arrange for the City to
accept them as their responsibility.
Parkland The required open space and pazkland dedication for this development is 1.92
acres. The proposed development shows 3.58 acres.
• Fence. The submitted plans show a fence along the northern property line of Lot 22 and
23. The text states that fencing will meet Code. A detail of this fence will be provided at
the final development plan stage.
Landscaping:
• Street Trees. The text does not specify a street tree for this site and the applicant should
consult with the City Forester prior to the final development plan to verify the preferred
street tree species and installation dates and scheduling. The text has been revised to
reflect the maximum spacing for street trees at 45 feet on center.
Tree Preservation. The site has scattered trees along the west property line that will be
protected by a 25-foot Tree-Protection-Zone along impacted lots. All existing trees must
be indicated on civil engineering drawings, and a tree replacement plan and landscaping
details will be submitted as part of the final development plan.
• Buffering/Screening. Landscape buffers are indicated on the plan along lots 8, 9, 23 and
24 adjacent to open space. In addition, the plans note that an existing buffer between this
property and the Dublin City Schools Bus Complex will be enhanced with deciduous
trees.
Utilities and Stormwater Management:
• Sanitary Sewer. An existing eight-inch sanitary line in Kendall Ridge south of Meaghan
Drive will provide sanitary sewer service. No additional sanitary flows will be directed
into the existing sanitary line along Bazonscourt Way.
Water Supply. An eight-inch water main on the east side of Bazonscourt Way will
provide the public water service.
Stormwater Management. This development will be required to comply with the current
Stormwater Regulations. A 24-inch storm sewer is located on the northwest portion of
the site, this sewer line moves eastward across the site connecting to a 42-inch storm
sewer line. This utility, along with any associated easements should be located and
shown on subsequent plans.
Platting Issues:
Plat Requirements. A revised plat for Ballantrae Section 3 will be required indicating the
removal of Lot 322 for the right-of--way dedication of proposed "Street A." The plat
should include any easements that need to be dedicated to the City.

STAFF RECOMMENDATION:
The proposed preliminary development plan matches the Community Plan's density and land use
recommendations, and the applicant has worked with staff and adjacent residents to fulfill the
Commission's requests and address previous comments and suggestions. This proposal is an
extension of Ballantrae, a successful residential development and staff believes that the
development will be consistent with this high-quality subdivision. Staff recommends approval
of this rezoning with the following seven conditions:
Conditions:
1) That all landscaping agreements be finalized and signed by both parties prior to
scheduling this rezoning at City Council;
2) That the plans be revised to show the northern bikepath terminating at the eastern
property line and that the applicant submit a letter committing to install the
southern bikepath connection through City property (Ballantrae Park);
3) That the applicant obtain an easement for the construction and maintenance of the
bikepath within Ballantrae Park or arrange for the City to accept them as their
responsibility;
4) That this site comply with the current City of Dublin's Stormwater Regulations,
to the satisfaction of the City Engineer;
5) That the applicant consult with the City Forester prior to the final development
plan submittal to verify the preferred street tree species along with installation
dates and scheduling;
6) That an amended plat for Ballantrae Section 3 indicating the right of way for
Street "A" and the removal of Lot 322 be approved by Planning Commission and
City Council prior to filing for building permits; and
7) That all text and plan revisions be completed prior to scheduling this rezoning at
City Council.
Bases:
1) The proposed development will be an extension of a successful residential
development.
2) The proposal is consistent with the recommendations of the Community Plan.
3) The proposed development provides parkland in a convenient location, which will
facilitate a consolidated open space plan that includes the future Kendall Ridge
Park.

5. Rezoning - OS-1572 -The Glade at Ballantrae
Rick Gerber swore in those who intended to testify in regards to this case.
The Commissioners chose to forego the staff presentation for this case.
Mr. Gerber asked for a brief update on this case.
Claudia Husak said the case was tabled on November 10, 2005 after an extensive discussion
concerning property owners in the vicinity of this site as well as traffic calming along
Baronscourt Way. She said staff and the applicant have initiated a meeting with residents along
Baronscourt Way to discuss traffic calming. Ms. Husak said five households attended that
meeting and the overwhelming response was that they did not want traffic calming, and they
perceived speeding along this road to be a temporary problem with construction traffic and
people who had not yet bought into the neighborhood. Ms. Husak said staff agreed with the
property owners to contact the police department and request their increased presence and
enforcement to see if that would alleviate the problem. She said staff has sent a letter
summarizing these results to all the residents on the street.
Ms. Husak said another issue was headlight trespassing for residents adjacent to the new street
going into and out of the new subdivision. She said the applicant has revised the text to include
language reflecting an agreement to work with those residents and compensate them for extra
landscaping. She said two affected property owners had come to an agreement with the
applicant, and a finalized landscape plan is still being designed for the third property owner.
Ben W. Hale, Jr., attorney representing the applicant, confirmed that two residents had agreed to
their landscape plans and the agreements were included in the Commission packets. He said he
thought the applicant had worked on everything the Commission requested at the last hearing.
Mr. Hale said they had met with the residents. He said it was discovered after the November 10
hearing that notices were not mailed. Therefore it was a good thing that the case was tabled.
Charles Driscoll, The Edwards Company, said they had ongoing discussions with the neighbors.
Kurt Proegler said issues were well covered in the minutes of the July meeting and the staff
Report. He thanked the staff for a good meeting to make up for not being able to attend the
previous meeting. He said just after Thanksgiving, his neighbor had raw sewage back up which
was a concern. Mr. Proegler said he received conflicting responses. He said he asked somebody
to provide an explanation in writing to go on record for the City, very specifically in terms of
how much, if any part of this proposed development will affect that problem. He said Aaron
Stanford provided an E-mail today stating that this proposed development will have no impact
because it is linked to a different system.
Mr. Gerber recalled that it was represented to the Commission by the applicant that there was an
agreement between Mr. Proegler and the applicant. He referred to a letter dated December 28,
2005, and asked if that was the only agreement made with the applicant.

Mr. Proegler said it was the only written agreement. He said they were talking since the July
meeting and certainly understood from a verbal perspective that they had assurances that some
landscaping would be done.
Mr. Proegler said that they were under the impression in November that the street was going to
be one lot to the south. He said since they found out it was to be somewhere else, they have had
to develop a second landscaping plan and that in part contributed to why it has taken a while to
get that signed agreement.
Mr. Gerber asked if the only written agreement that Mr. Proegler had with the applicant was
reflected in the letter dated December 28, 2005.
Mr. Proegler said that was correct.
Mr. Gerber recalled that at the November meeting, the Commission was told that Mr. Proegler
had an agreement with the applicant.
Mr. Proegler said they expected that it was something to be worked out.
Mr. Gerber asked again if Mr. Proegler had a written agreement with the applicant regarding
landscaping.
Mr. Proegler said he did not.
Mr. Gerber asked staff about the sewer backup in that area. He asked if there was enough
capacity for this proposed new development. He said it was suggested that there was not.
Aaron Stanford said Mr. Proegler had made him aware of the Ballantrae situation. He said he
explained to Mr. Proegler that from the description, it was a localized single-residence that had
become backed up in the basement. He said staff had seen this problem in other developments.
He said it could be caused from localized blocking in the lateral from when the sewer lines were
initially tapped. Mr. Stanford said construction debris causes this. He said usually, with a little
maintenance and flushing, staff can alleviate the problem. He did not think this would be
classified with any means being a system's capacity problem. Mr. Stanford said with this new
development, no further problems are anticipated in Ballantrae to the west as this sanitary will all
flow east into Kendall Ridge.
Mr. Gerber asked how many sewer backups had been reported to the City in this area.
Mr. Stanford said his investigation discovered three sewer backups.
Mr. Gerber asked when they occurred.
Mr. Stanford replied that they were within the last year.
Mr. Gerber asked if the City, the homeowners, or the builders were responsible to take care of
the situation.

Mr. Stanford said the City had done so in the past. He said the City could send a camera into the
line to investigate to see if there is any additional blockages, identifying any further problems in
that line along Bazonscourt Way.
Mr. Gerber said the investigation could identify that the City system was not the culprit and
asked for assurance that the City will check this situation to check to see if it is at fault.
Mr. Stanford agreed that it would be camera investigated for additional blockages in the main
line along Bazonscourt Way.
Ms. Jones asked if the City offered any assistance as far as cleanup or help to the residents
affected.
Mr. Stanford said through his investigation, he did not think there had been any claim made to
the City by this resident and that staff would meet with any affected resident. He said this
particular resident had not contacted the staff. He said he found out about the problem
secondhand through Mr. Proegler. Mr. Stanford said via E-mail he let him know that staff would
be glad to meet with him to see what the City can do.
Mr. Gerber requested that in the next Director's report there be a status report regarding the
camera investigation of the backed up sewers in this area.
Mr. Gunderman agreed.
Ms. Husak promised to provide the Commissioners with a copy of the a-mail sent to Mr.
Proegler by the Engineering Staff.
Mr. Saneholtz asked if one of the conditions addressed the reconstruction and appearance issues
with respect to the existing stubs in Kendall Ridge.
Mr. Zimmerman said it would have been easy to put the two streets in Kendall Ridge together to
make a loop street and run one down to the court instead of going out into the other street.
Mr. Hale said they looked at was the right way for this subdivision to develop, and while the
Kendall Ridge subdivision is very nice, the price points in Ballantrae are at least $100,000,
perhaps $150,000 more. He said the economically prudent and right thing to do for the residents
is to put the higher valued product in there and that they could not do that connecting the streets
through Kendall Ridge.
Mr. Saneholtz azgued that this was a benefit to Kendall Ridge because what would have
otherwise been a through street with additional traffic and additional home sites will no longer
go past their front doors. He said his only concern was that with adequate work, the unsightly
stubs could be eliminated in the neighborhood and benefit Kendall Ridge as much as lead to its
detriment. Mr. Saneholtz said he thought it was a very attractive plan. He said he agreed with
the applicant that the lots are more conducive to lazger homes and the way it is laid out.

Mr. Gerber recalled that this had been previously discussed and the main concern was the traffic
onto Ballantrae. He said the residents did not expect this. He said the concern had been with the
residents.
Mr. Gerber asked if the Kendall Ridge stubs were going to be eliminated.
Ms. Wanner said that was something that the City could agree to since the roads were owned by
the City.
Ms. Boring asked that a condition be made that developer be responsible for the restoration of
the area of the stubs.
Mr. Hale agreed.
Ms. Boring said that the proposed text was not clear that this homeowners association would be
part of the original Ballantrae subdivision. She requested Condition 9: That the homeowners
association will be an extension of the current homeowners association of Ballantrae.
Ms. Boring clarified that letters were sent to every Baronscourt Way resident explaining that
they did meet and the traffic calming was not wanted. Ms. Boring thanked Ms. Husak for going
to that detail which will provide a record for the future.
Ms. Boring said she was somewhat unsettled about the last time because she was left with a
distinct feeling that the Proeglers had not been contacted.
Mr. Hale said the Proeglers had been contacted. He presented a letter sent to them by the
developer on February 15~'. He said they told the Proeglers that they felt they had an
understanding with them, although they had not completed their landscaping plan and that the
applicants would make their good faith effort to get a letter from them that they would settle this
issue. Mr. Hale said another lot owner present, who owned the lot to the north of the road, had
agreed about compensation because of their landscaping, etc. He presented a letter dated June
20, 2005 from him to the applicants acknowledging that they had an agreement. Mr. Hale said
he did not feel the meeting was misrepresented -there was an administrative error in the City
and the wrong property owners were notified.
Ms. Boring said she was lead to believe that the Proeglers had signed off on what was proposed
that night.
Mr. Hale said they had an oral agreement with them that they would landscape, subject to them
completing their landscaping which has been completed. He said the work is complete and the
applicant has agreed to do the landscaping work requested.
Charles Driscoll, The Edwards Group, Inc., apologized if he mixed up the two property owners
because he had the agreement from the Mehtas next door, but not a written agreement from the
Proeglers. However, he said he thought there was an oral understanding that they would do
whatever landscaping the Proeglers wanted in their front yard.

Ms. Reiss noted that a letter in the Commission packet included a very specific dollar amount for
the landscaping.
Mr. Proegler said that was a cost estimate for the landscaping plan which he had submitted to the
applicant.
Ms. Husak said an agreement from the Mehta family had also been included in the Commission
packet.
Mr. Hale said they would not go to City Council until the agreement is completed.
Mr. Saneholtz made the motion to approve this rezoning (Preliminary Development Plan)
because this proposal extends Ballantrae, a successful residential development, will provide

Thank you for your letter dated May 25th, 2005 regarding proposed road
adjacent to our lot, No 321, Baronscourt Way.
V'Je are pleased to confirm our acceptence of your offer and in token thereof are
mailing to you under cover of this letter the original of your offer letter dated 25th
May, 2005 with our agreement and acceptence endorsed thereon.
Whilst we appreciate your undertaking to construct an additional driveway out to
the new road, a preliminary study of the Departmental Administration Order
regarding Development Code, Section 153.210 (A), indicates that our request
would not violate any of the code requirements. The procedure prescribed
therein would however require to be complied to obtain the formal approval of

This letter is intended to inform you of the outcome of the meeting. The residents
in attendance were unanimously opposed to the implementation of any traffic
calming device on Baronscourt Way. The residents believed that the issue with
speeding was temporary, and felt that targeted, increased enforcement by Dublin
Police would encourage speed limit compliance. Staff has contacted the Police
Chief and relayed this information.
The results of the meeting with the residents will be presented to the Planning
and Zoning Commission on Thursday, January 5, 2006 at 6:30 p.m. at City Hall
as part of the Glade at Ballantrae rezoning application (Case #05-157Z). Staff
encourages all residents to attend this meeting for an opportunity to be part of
the public process.

2. Rezoning OS-1572 -The Glade at Ballantrae
Location: 15.75 acres located between the Ballantrae, Section 3 and Kendall Ridge,
Section 2 subdivisions, north of the Woerner-Temple Community Park.
Existing Zoning: R, Rural District.
Request: Review and approval of a rezoning to PUD, Planned Unit Development
District, under the provisions of Section 153.053.

2. Rezoning OS-1572 -The Glade at Ballantrae
Mr. Gerber swore in all those who intended to testify.
Ms. Wanner presented slides and the staff report for this Preliminary Development Plan. She
stated that the case was heard in July 2005 as a Concept Plan, and the applicant had addressed
the conditions of the approved Concept Plan. Ms. Wanner said she would also address the items
mentioned at the meeting which were not necessarily conditions.
Ms. Wanner indicated that Lot 23 had been relocated to create more of a symmetrical,
consolidated parkland space. She stated that landscape buffers have been added along the
parkland as well. She also stated that the existing stubs from Kendall Ridge at Meaghan Drive
and Kendall Ridge Boulevard would not be platted as new lots, but that they may be acquired by
the applicant in the future.
Ms. Wanner stated that the access point has not been moved due to the existing homes and the
homes under construction that have been permitted. She indicated that staff has added a
condition so that the developer can coordinate some landscape treatment for the owner of Lot
340 to provide the appropriate landscape screening.
Ms. Wanner said that the applicant has added bumpouts to calm traffic on Baronscourt Way and
the intersection.

Ms. Wanner said staff is recommending approval of this rezoning request with the nine
conditions and three bases, as listed in the Staff Report.

Mr. Messineo asked if there was an ordinance prohibiting vehicles from pazking along the curb
within a certain distance of an intersection.
Ms. Wanner said that usually there is a "No Parking" sign posted.
Mr. Gerber asked if the bumpouts were concrete.
Ms. Wanner replied that the lower portion of them was usually concrete. She indicated they are
similaz to the bumpouts seen around traffic circles, with a tier of curbing.
Mr. Gerber recalled that when this application had come to the Commission as a Concept Plan,
the Commissioners discussed possible traffic calming on Bazonscourt Way and asked if any of
their comments at that meeting had been taken into consideration.
Ms. Wanner said when staff discussed these two cul-de-sacs it was found that the design of
Courts B and C do not meet the necessary criteria for the requirements of traffic calming due to
the length, the number of homes they served, and the fact that they are cul-de-sacs.
Mr. Gerber was concerned about the Proegler property and wanted to be sure that a condition
was added to prohibit headlight glare.
Mr. Zimmerman asked if the entry could be moved further south.
Ms. Wanner indicated that the applicant contended the entry could not be moved.
Ms. Jones added that was one of the chief issues the Commission discussed at the Concept Plan
and wondered if another option could be explored.
Ms. Boring asked what was the desirable maximum length of a cul-de-sac. She asked if this
street was longer because of safety issues.
Ms. Wanner replied the cul-de-sac length conforms to City standazds.
Ms. Boring suggested that it looked like too many lots exiting on one street. She suggested
utilizing the stubs.
Mr. Gerber asked if these were good, accepted traffic planning principles, and whether these
devices had been used in Dublin.
Aaron Stanford stated that an example of a similar bumpout arrangement is at Quin Abbey
Court, located north of Brand Road and west of Avery-Muirfield Drive. He said there were
others in Dublin.
Ben Hale, Jr., Smith and Hale, explained that this piece of property currently belongs to the City
of Dublin. He added that there had been discussion about what these lots should be; an extension
of Kendall Ridge, or an extension of Ballantrae, adding that the price points in both
developments aze substantially different. The decision was made that the best thing to do with

the site was to join it with Ballantrae. The lot widths are much deeper than the other lots in
Ballantrae. Mr. Hale said that the same Ballantrae builders will be building in this subdivision.
Mr. Hale indicated that the property owner to the north of the entry point may want a side loaded
garage, which would require access onto the street. He said he was cautious about the median
discussed in the staff report.
Charlie Driscoll, The Edwards Companies, said they discussed moving that driveway. He said
they concluded that is already in the best place for Mr. Proegler, because it came out opposite his
driveway. He said if it were located elsewhere, it would be in front of the house. He stated there
was only one lot to adjust, and there was not room to move the driveway. He indicated that they
have agreed to landscape the property any way Mr. Proegler wanted to minimize the effect.
Ms. Reiss asked how the applicant was mitigating the headlight trespass for the property north of
the Proegler property. She asked if they would landscape that property.
Mr. Driscoll said they were willing to do landscaping.
Joe Bruggeman, 6105 Tuswell Drive, stated that he lived in Kendall Ridge on Tuswell Drive.
He said he had spoken with staff about connecting this project through their subdivision. He said
residents got comfortable with the Concept Plan because of the price points, and the lack of
connection to Kendall Ridge. He stated that he was concerned about a traffic volume increase if
connections were made through Kendall Ridge.
Mr. Bruggeman said buffers created with Kendall Ridge are much better than in the Concept
Plan. He said Kendal Ridge residents need to be notified if the Commission is going to consider
an access point to their subdivision.
Mr. Zimmerman asked Ms. Wanner if she had talked with Mr. Proegler about the landscaping.
Ms. Wanner said staff and the applicant had spoken with him. She said she understood that Mr.
Proegler is willing to work with them on the landscape buffer design.
Mr. Gerber asked if there was anything in writing.
Mr. Driscoll said he had written Mr. Proegler a letter stating that he would plant whatever
landscaping was necessary to screen the property.
Mr. Hale said that they consent to the conditions listed below.
Mr. Gerber was concerned that the landscaping issue had not been resolved.
Mr. Hale agreed to fmalize landscaping plans with Mr. Proegler.
Ms. Boring asked if other property owners present at the Concept Plan hearing had contacted the
staff and if they were notified about this hearing.

Ms. Wanner said surrounding property owners had been notified of this hearing, and to her
knowledge, none had contacted staff.
Ms. Boring was concerned about incorporating traffic calming devices on Bazonscourt Way.
She said she was hoping for a more creative, neighborhood-enhancing type of traffic calming
device, and perhaps more than one along that area.
Ms. Wanner explained that staff reviewed this application with the traffic engineer who wrote
the standazds for traffic calming. She said it was the conclusion of the Engineering department
that the speed and the number of houses on this roadway did not require traffic calming at this
time.
Mr. Gerber added that he was Chairman of the Community Services Advisory Commission when
that policy was presented to City Council and there was a lot of discussion. He said Dana
McDaniel and he gave a presentation to Council saying that that the smartest thing for the City to
do was be proactive and take care of these problems before they become bigger problems.
Ms. Boring said she did not believe that all the traffic calming criteria will be met, because of the
current traffic numbers. She hoped that traffic calming devices could be employed first, if
needed.
Mr. Gerber asked why the traffic calming occurred in front of the attractive Proegler property.
Ms. Wanner stated that it was in response to some of the traffic at this intersection, which the
traffic engineer believed would be an issue.
Ms. Reiss said she felt this bumpout not only slowed down the people turning left and right out
of cul-de-sacs A and B, but it slowed traffic on Bazonscourt Way. She said she was concerned
about placing bumpouts along the entire street and wanted to make sure all residents were
notified of the changes.
Mr. Zimmerman asked if this was a common mode of traffic calming.
Ms. Wanner said this is one mode of traffic calming which mentally acts as though there were a
parked car present which requires caution and a slower speed. She indicated that staff looked at
a traffic circle, but that the roadway was too small.
Mr. Messineo asked what happened if one of the bumpouts was hit.
Mr. Hale said it was a mountable curb and instead the tire would go up on the curb.
Mr. Bird recalled from the previous hearing the gentleman that lived on the curve and said he
was concerned about existing traffic speeding up and going around that curve. He said he was
aware of Dublin streets, such as Monterey Drive, with speed bumps. However, he said this is a
solution the traffic engineers suggested to slow the traffic down mid-point before they get to the

curb. He said as he understood their solution, given the amount of traffic and the current
situation, and even with the projected traffic, it is not warranted for traffic calming devices.
Mr. Bird said perhaps the conclusion on this is to move forward with the zoning, but before the
Final Development Plan have a full report from Engineering that satisfies the concerns and
answers the questions of the Commission. He said it is not just be for this case, but future cases.
Mr. Gerber asked what this land was initially intended for, and how was it to be developed.
Ms. Wanner said the Future Land Use map indicated a residential land use.
Ms. Jones asked how often the situation occurs where a street is proposed through a platted
residential lot. She was concerned that this could set a precedent.
Mr. Gerber explained it was not common and it had happened previously.
Ms. Jones said she understood they wanted to build homes off of Ballantrae because it was a
very successful subdivision. She stated her personal struggle is with putting a street in front of
someone's house when they thought they were going to have a lot there.
Ms. Boring gave a brief history about the property. She stated that it was intentionally sought
after in order to make the Ballantrae project work.
Mr. Hale added that the property was acquired to provide a front door for the Ballantrae
development. He stated that the property was developed as parkland to improve the character of
the area. He said the City contributed $8M or more, including $3M on the Woerner-Temple
pool. He stated that the project was a partnership between the City and the developer to try to
really change what was happening in the area.
Mr. Gerber said he respects the Kendall Ridge residents' concern. He said the layout seemed to
satisfy their concerns as related to additional traffic and made sense.
Mr. Gerber noted his concerns were with the traffic calming effort on Baronscourt Way and the
effort made to contact adjacent property owners about the headlight trespass.
Mr. Gerber asked Mr. Driscoll if he had called the adjacent property owner and suggested that he
work a little more closely with the landowner.
Mr. Driscoll said he had called and thought they had everything worked out. He agreed to obtain
a letter from the homeowner to this effect.
Ms. Reiss asked where the water and sewer were coming from for this area.
Aaron Stanford replied that a water line exists along Baronscourt Way, and a sewer stub exists at
the end of Kendall Ridge Boulevard. He stated that another sewer stub is located to the north.
Discussion continued about the application of easements for the utilities.

Ms. Boring said she did not like the bumpouts at the curb. She said she understood the applicant
had worked with the engineering staff, and that was her biggest disappointment. She said she
had been listening to her fellow Commissioners and the property owners when they came in the
last time, and empathized with them. She wanted to work out a situation with this developer that
would be the best thing for the area.
Mr. Zimmerman stated he would like to table the application. He wanted Mr. Proegler involved
as well as the property owner to the north regarding the bumpouts. He felt the traffic calming
plan may affect the Proegler driveway when backing out. He reiterated that the adjacent
property owners should be contacted.
Mr. Gerber restated his concerns that the proposed traffic calming solutions were not creative
enough and more options needed to be considered, and that Mr. Proegler was not present.
Ms. Reiss said she agreed with Mr. Gerber, but felt staff needed to work with the neighborhood
on the traffic calming.
Ms. Boring said she would like to incorporate that idea, but not to hold up the applicant. She felt
the adjacent residents needed to be involved, but that should not holdup the development.
Mr. Gerber asked if a 90-day tabling was needed. He agreed that the case should not be delayed.
Ms. Reiss agreed, but suggested that due to holidays it would not be good timing for meetings.
Ms. Boring asked Ms. Readler if the traffic calming could be listed as a condition.
Ms. Readler said a condition regarding traffic calming and buffering for the adjoining
landowners could be made for the Final Development Plan stage.
Mr. Gerber explained his preference was to consider these elements now at the rezoning stage.
Ms. Boring said because it was so difficult to get everyone's consensus on the traffic calming,
she was not sure it was appropriate to hold up the rezoning for that.
Mr. Gerber said he did not want to wait until the Final Development Plan to determine the traffic
calming measures. He also wanted assurance that the applicant has worked with the adjoining
property owners to find acceptable solutions to the light trespass and traffic calming.
Ms. Jones agreed. She said she would be more comfortable if there was communication from the
neighbors that they are satisfied.
Mr. Zimmerman said, and Ms. Jones agreed, that if a resident could not attend, a letter could be
sent instead.

Ms. Boring responded that it was prudent to make sure meeting notification is sent to all
residents on the street and to call if there are questions or comments. She said a great job was
done by removing the lot and creating a more open vista into the parkland.
Mr. Zimmerman said his biggest concerns are the entranceway and the lighting that would affect
the Proegler property and the bump-outs. He said the layout of the development is fine.
Discussion continued about the different types of traffic calming devices.
Ms. Wanner stated that the bumpout design had the availability to add landscaping.
Mr. Zimmerman asked if it had been done at any Dublin intersection.
Ms. Wanner replied not in Dublin, but staff had seen pictures of them, and it was something that
everyone thought was acceptable.
Mr. Messineo asked Ms. Wanner if she had said they could add landscaping.
Ms. Wanner said yes, small crescent-shaped islands can be added so it becomes almost an entry
feature to the subdivision.
Mr. Messineo was concerned about the sight triangles.
Ms. Wanner explained they would not block the vision, and there were other street trees planted
along there which would also be out of the line of the sight triangles. She said landscape
materials would be low-growing that added visual interest.
Discussion followed about the design of the bumpout schematic.
Mr. Hale said if there are other alternatives that make sense, they can bring them to the
Commission. He stated that Mr. Driscoll would create a landscape drawing for Mr. Proegler
instead of asking him to do the drawing.
Mr. Gerber asked if the Commissioners had copies of the agreements with Mr. Proegler
regarding landscaping.
Ms. Wanner said these agreements were not available at the time of packet distribution.
Mr. Zimmerman asked if the agreements also included the resident to the north.
Mr. Driscoll stated they said they would help that property owner obtain approval for the
driveway fronting onto the proposed entry street.
Ms. Reiss asked if the City had problems with that, and Ms. Wanner responded it did not.
Mr. Hale stated his concerns with the timing and delays.

Ms. Reiss asked if the property to the south of the new street near Baronscourt Way was
currently vacant.
Mr. Driscoll said it was vacant.
Ms. Reiss noted that they would not have to obtain an agreement with that property owner.
Mr. Driscoll said he is the property owner.
Mr. Gerber said he was agreeing with Mr. Zimmerman that they need a tabling to look at the
issues discussed and return to the Commission quickly. He felt this was part of what they talked
about at the Concept Plan, and he was frustrated with it, hoping to see a little more than this.
Mr. Hale said they sat down and reviewed all the options and thought this was best.
Ms. Boring asked about the homeowner's association, and whether they will be blended into
Ballantrae, or have their own.
Mr. Driscoll said he thought it would be part of Ballantrae's homeowner's association.
Ms. Boring asked that it be reflected in the proposed text that this development will be merged
into Ballantrae's homeowner's association.
Mr. Zimmerman moved that the Commission table this rezoning application to allow the
applicant to address traffic calming with the adjacent property owners and all relevant contracts
and agreements with surrounding property owners regarding any screening plans for headlight
trespass.
Ms. Jones seconded the motion.
Mr. Hale agreed to the tabling.

3. Concept Plan 04-153CP -The Glade at Ballantrae
This case was on the Consent Agenda because Charles Driscoll, The Edwards Company, agreed
in writing to the three conditions listed in the staff report prior to the meeting.
Mr_ Gerber said this is a request for review of a Concept Plan fora 29-lot, single-family
residential development with 3.58 acres of open space. The Concept Plan is the first step in the
Planned Distract approval process, and the next step is rezoning_
Mr. Phillabaum explained this was a request for feedback on a Concept Plan fora 15.78 acre
residential development consisting of 29 single family lots_ The site is located in the southwest
portion of the City of Dublin, between the existing Kendall Ridge and Ballantrae Subdivisions,
and north of the Woemer-Temple Community Park (Ballantrae Park). The site is flat and
possesses no significant natural features, and is part of a larger 36.75 acre tract purchased by the
City in 2001, with the lower portion parallel to Woemer-Temple Road developed as the
Woemer-Temple Community Park_ This remaining acreage was projected as future residential

development within the Community Plan_ This is the first development application for the site_
The site is zoned R, Rural and adjacent properties to the east and west are zoned PLR, Planned
Low-Density Residential District_ The Dublin School Bus Complex to the north is zoned LI,
Limited Industrial District_
Mr. Phillabaum explained that the City of Dublin and Edwards Land Company are co-applicants
for this Concept Plan_ He said staff has held meetings with the adjacent residents of the
Ballantrae, Kendall Ridge and Dan-Sherri neighborhoods to discuss this proposal and identify
the residents' concerns_ With the input obtained from these meetings, staff has worked with the
developer to address these concerns and modify the Concept Plan accordingly_ Additionally, a
copy of the Concept Plan was included with the meeting notice mailed to the adjacent residents_
Mr. Phillabaum stated the Concept Plan proposes 29 single-family lots on two cul-du-sacs, at a
density of 1.84 units per acre, which is consistent with the future land use designation of Medium
Density Residential (1-2 units per acre). The lots are accessed via the removal of a platted tot
within Ballantrae, Lot 322, to be replatted as right-of-way_ The cul-de-sacs are open to the
proposed 3_S8 acre open space area to the north, as well as to Woerner-Temple Community Park
to the south, to provide both physical and visual access to these open spaces_
Mr. Phillabaum noted two existing stub streets within Kendall Ridge, east of the site, are not
being extended into the site out of the developer's desire for this development to be an extension
of Ballantrae with the same general development standards_ The City Engineer has determined
that inter-connectivity of these two neighborhoods is not necessary as both areas have adequate
and multiple access points. Were these streets to be connected, the potential for cut-through
traffic in Kendall Ridge, going toward Avery Road, would increase, creating a situation which
may have required future traffic calming_
Mr_ Phillabaum said that due to the site context, surrounding uses and lack of existing natural
features, the site is not considered a prime candidate for conservation design and the applicant
intends to rezone this parcel to a planned district, using the same general development standards
of Ballantrae, Sub area G_ The proposed Concept Plan matches the Community Plan
recommendations for land use and density and the development is consistent and compatible
with adjacent land uses. He said staff recommends approval of this Concept Plan with three
conditions:
1) That the applicant coordinate the locations of both eight-foot bike paths with the Director of
Parks and Open Space;
2) That landscape buffers be included along lots adjacent to open space, subject to staff
approval; and
3) That an amended plat for Ballantrae Section 3 indicating the right-of--way for Street "A" and
the removal of Lot 322 be submitted prior to filing for building permits_
Ben Hale, Jr., Smith and Hale, representing the applicant, mentioned that Edwards has been
working with the City for a year planning on how to develop the site_ He said the basic idea that
came out of all those meetings was that there would be one street, and because of the width of
the piece of property, with very deep lots_ Mr_ Hale continued that the lots have been sized so
that houses that are comparable in terms of square footage and value that exist in Ballantrae

would be built there. He said Edwards has held a couple of lots off of the market so that there
can eventually be a street through Ballantrae_ He said they aze exceeding the park requirement_
He said to the north end, there will be a park connecting to the Kendall Ridge Pazk. Mr. Hale
explained that they are proposing a bike path so that the people can get into both of these parks
without having a bike path between lots_
Mr. Gerber invited public comment_
Kurt Proegter, 5867 Baronscourt Way, said they are on Lot 340, opposite the proposed street.
He said was never an indication -zoning, plat, or any materials that a road would be there. He
said when they expressed that to Mr. Driscoll, he explained that the City requires it. Mr.
Proegter said they expressed at the public meeting that they prefer it not to be located there due
to headlight encroachment, safety concerns, view, etc. Mr. Proegter added they would like any
alternatative location to be explored_ However, if the street should be where it is now shown,
they would like to request that the developer mitigate those impacts to their satisfaction as a
condition of approval.
Mr_ Gerber commented that this Concept Plan is non-binding on both sides. It is a chance for it
to be discussed. He said there will be other hearings and other opportunities to raise concerns.
Kevin Reilly, 5923 Baronscourt Way (Lot 344), across from the pocket park, said the Ballantrae
Master Plan, does not include a street at Lot 322, and it seems very unDublin-like that it was not
addressed a year or two ago, as the development was being developed_
Mr. Reilly was concerned about traffic passing the pocket park causing a tragedy. He
recommended stop signs at both the entrance and both sides of the park.
Cathy Boring said Mr. Reilly's comment about the traffic was interesting, because the traffic is
generated from the neighbors. She suggested he ask that their association send a letter asking
that the traffic/speed pattern on this site be observed_ Ms. Boring said there has to be a way
remove the stub and make it look more attractive. She said both stubs need to be turned into
something attractive.
Mr. Phil(abaum replied that there is a median at the stub for Kendall Ridge Boulevard, and there
is ample width that could be platted as a residential lot with the pavement removed. He said the
stub to the north does not have sufficient width to plat as a lot.
Ms_ Boring noted the density matches Ballantrae, but Lot 23 needs to be removed because it does
not fit with the green space and park area.
Mr. Saneholtz was concerned about the headlight glare from Megan Drive_ He said now, instead
of shining into the rear of the house at Lot 23, they are shining into the front windows of the
house on Lot 24_
Ms_ Jones asked what was customary, a stop sign or a three-way stop sign on Baronscourt Way_

Barb Cox replied that there would be a stop sign installed for the traffic coming westbound on
`Street A' before turning onto Baronscourt Way.
Ms. Jones asked if there would also be stop signs on Baronscourt Way_
Ms_ Cox responded that a stop sign would not typically be put on Baronscourt Way at that
location_
Ms_ Boring inquired why the street is so straight without traffic calming devices_
Ms_ Cox said staff has not gotten to that level of detail, but it could be explored with the
applicant if Ms. Boring wished.
Ms_ Boring indicated traffic calming should be explored, because traffic calming as part of the
plan had previously been discussed.
Ms. Cox stated that from the intersection at `Street A' and `Street B' southward, it is
approximately 700 feet to the center of the cul-du-sac.
Ms. Boring suggested that traffic calming devices like chokers be included with this plan so they
become routine to request as a standard.
Ms. Cox responded that it was something staff could explore.
Mr. Saneholtz said his concerns were what was actually going to happen to the stubs in Kenda(i
Ridge, and that everything possible should be done to make that appear tike it was designed
instead of by accident, ending up with a stub into nothing. He said the Commission would like
the staff and the developer to look into some creative treatment at the new proposed intersection
that could be used for two purposes: 1) to redirect the headlights out of Lot 340; and 2) slow the
traffic on Baronscourt Way_
Ms_ Boring agreed trafc calming needed to be installed in Baronscourt Way since this was an
addition to the development by the same developer. She said it had to be intense, with traffic
calming measures every 300 feet, similar to Tara Hill_
Mr_ Zimmerman asked Mr_ Phillabaum how did `Street A' end up in its location and what
criteria were used. He noted it was not centered.
Mr_ Phillabaum showed an exhibit indicating the level of development within Ballantrae_ He
said based on the degree of build-out, there are limited alternate locations for that street.
Mr_ Gerber asked what was originally planned for this parcel.
Mr_ Phillabaum replied this was designated as Future Residential in 1997, and then the Woerner-
Temple Park was developed.

Mr_ Gerber then asked at that time where was the road contemplated.
Mr. Phillabaum stated there was nothing indicated on the Thoroughfare Plan.
Ms. Boring commented that the land was purchased in 2001 to ensure that there would be the
huge park along Woerner-Temple Road. She said nothing was pictured -the idea was just to get
the maximum "pop_"
Ms. Cox said that when the Kendall Ridge subdivision was preliminarily platted, Woerner-
Temple Road still went from Avery Road to Cosgray Road. She said Kendall Ridge Boulevard
was created with the idea and the intent that it would continue west and probably tie in to
Woerner-Temple Road at some direction westward. As Ballantrae was proposed, the idea
changed a little from what was anticipated, and over the years this land ended up being a swath
that didn't get included with either subdivision.
Mr_ Zimmerman asked if there was a way to center the street on Lots 322 and 323 so that it
would be centered between existing homes in Ballantrae.
Mr_ Gerber replied that this is a Concept Plan, and did not need to get into details. He said there
is a problem with that street and other places for it need to be considered along with traffic
calming. He said the invasion of lights onto adjacent property is also a concern.
Mr. Zimmerman stated he would like to see those lots not sold at this time so any adjustments
could be made if necessary_
Mr. Gerber did not know if that could be made a condition.
Carol Proegler, 5867 Baronscourt Way, asked if a different entry at Lots 319 and 320 would be
explored_
Mr_ Zimmerman questioned if the proposed road were to be aligned between Lots 322 and 323,
could any headlight trespass fall between lots 339 and 340 across Baronscourt Way_
Mr. Bird said staff would take a look at the possible entry locations and discuss them with the
developer when it comes back in preliminary form_
Ms_ Reiss brought to staff s attention the need for water and sewer easements_ She asked if they
were needed in Kendall Ridge to service this new area_

Mr. Ciarodu seated that this ordinance will authorize the development of the park along
the worth side of Woemer-Temple Road as it enters into the Baltanttae subdivision. He
noted that two drawings have been provided to Council: a schematic of the entire panic
area and a schematic of some of the walls.
He added that cortstnrction of the park will involve City appropriation in the capital
improvements budget, and the developer has a presentation of the proposed development
plan.
Pete Edwards. Edwards Land Company. stated that Dublin's original objective was to
raise the bar for the quality of development in the southwest azea, in particular along
Avery Road_ [t is more difficult to change a developed area than to start with an
undeveloped area. Because of this, Dublin needed a massive deveMpment with a great
entrance approach The entrance approach takes on added significance because of a tack
of character in the other 642 acres and the undesirable existing uses along Avery and Shier
Rings roads. There was only one possible approach, and that is the park being presented
to Council tonight it is a vital element in helping Dublin reach its objective and should
not be compromised The panic presentation team will answer questions at the conclusion
of lice presentation. Mike Fite of Bird-Houk Associates will outline the overall theme of
the development; the theme ties the development and the patio together. He will be
followed by Keith Myers of Myets-Schmalenberger, who will provide park details.
Michael Fite. Bird-Houk Associates. stated that their vision for Ballantrae is taken from
the Irish iandscape_ Research of Irish landscapes identified four distinct categories, and
those elements are included throughout the Ballantrae development: open space, water,
stone, and ruins. Mr_ Fite accompanied his presentation with a slide presentation with
character images of those elements. Tonight's focus is on the parks. There are i9 parks
throughout the development with over SO acres of parkland, and the 209-acre golf course
provides a substantial contribution of open space. He noted that the traffic circle contains
a unique 2.65-acre park, which is built on the concept of an agrarian landscape -- seasonal
Gelds of color contained by three bisecting walls. A double row of trees around the edge
contains the bikepath, and the central focus of this park is a small ruin and perennial
garden. The traffic circle is located at the end of Woemer Temple Road just past the
entrance park.
Keith Myers. Meets-Schmalenbereer Associates, stated that the entrance panic has the
potential of becoming a world lass park. Creating an Irish landscape theme is a
challenge, as central Ohio landscape is flat. This area has only afoot-foot drop over the
entire eleven acres. They worked hard to create an interesting framework with the Irish
theme. The site is bounded by the Kendall Ridge subdivision on one side, and open space
that is part of the Kendall Ridge plat on another side. The park will include: three to four
acres of lakes with a stone weir creating a waterfall; a tong stone wall arcing around the
park; a reforestation area; and the centerpiece of the pack - a 20-foot hillock with a stone
face "calved away over time, an active play fountain in front and at the end of a winding
path to the top, a stone sculpture replica of "The Dancing Hares," of the Hague. He hopes
[hat this park is something the City is proud of and a tasting contribution to the
community.
Mrs. Boring inquired•how "kid friendly" the sculpture is_
Mr_ Myers stated that the original of this sculpture is at The Hague in the Netherlands, and
many children played around it_
Mrs_ Boring inquired if there were many areas that weren't "kid friendly "
Mc_ Edwards stated that they have talked with the water and stone designers and have
emphasized this need, and as the park is built they wilt continue to communicate with the
City's grounds and facilities department to assure this.
Mts. Boring stated that some of the City's public art is designed to attract children, yet is
labeled "do not touch"

Mr. Edwazds stated that this worldclass sculpture is not in the City's budget- The
Edwards Land Company will buy the sculpture and rent it to the City for five years for

determine if the sculpture will remain in the park If the City does not want the sculpture,
then, or at any time, the satlpture can be removed.
Mr_ Boring inquired what activities are to be permitted at the lakes~
Mr_ Hahn stated that the takes would be stocked- At some time in the Cutwe, the City may
develop a pavilion or shelter house, similar to the one in Coffman Patk, which wuM be
rented by the residents. In addition, to meet the safety standards for children, the lakes
will be constructed with shelf areas along the shorelines~
Mrs_ Boring inquired if seating areas are proposed for the current development.
Mr. Myers responded that benches will be at the top of the hillock near the sculpture and
seating areas will be constructed in the stone at the base of the fountain~
Mr_ Adamek stated that previous discussions indicated a substantial hedge around the crest
of the hill, which will be 20-25 feet high~
Mr. Myers stated that the hillock does slope down- From the top of the fence to the
bottom is twelve feet- There is a bodge and a small fence buried in the hedge~
Ms_ Chinnici-Zuercher inquired about tfte projected completion date~
Mr. Edwards stated that the opening of the Baltantrae development is planned for next
June with the June "Parade of Homes"
Mr_ Reiner inquired about the cost of "The Dancing Hazes," should the City want to
purchase the sculpture~
Mr. Edwards stated that, although the artist's price for that sculpture has now risen to
$400,000.00, his company was able to lock in an earlier purchase price of 5300,000.00.

Mrs- Boring inquired why there is a need for emergency approval of a park development~
She understands that the Parade of Homes occurs in June but does not believe that should
dictate the timeline_ This may not be in the best interest of the citizenry.
Mr_ Ciazochi stated that, originally, a July date was projected for the golf course, but now
the project is being hurried along to meet the Parade of I-Tomes timeline_ Also, the City
does have a partnership with The Edwards Company on this project, and both parties
already have money invested in the project

contractor and equipment are on the site, the construction needs to be done~

Site Overview:
The site is presently agricultural land with generally flat and featureless terrain. The site
offers little in the way of natural features to add interest, other than several small tree
lines. No active streams are present, with existing drainage being achieved through the
use of tiles and ditches.
Provision of Utilities:
Sanitary sewer is available to the area through two existing lines in the Kendall Ridge
subdivision.
Water is also available through Kendall Ridge and Ballantrae.
Stormwater management for the site will outlet into Kendall Ridge. There is already
adequate stormwater retention capacity in the Kendall Ridge basins.
Homesites for this development are sized from a minimum of 70' up to 90' at the building
line. There are 28 homesites on 15.788 acres.

General Terms:
Front Yard Setbacks: Setbacks from the dedicated road rights-of--way in the subdivision
will vary from 25' to 35' in order to stagger the homesites along the streetscape to add

The Architectural Review Committee (ARC) shall be responsible for the administration
of varied setbacks in accordance with the approved text.
Side Yard Setbacks: The minimum side yard setback shall be a total of 15' with a
minimum of 7' on one side. Where a side yard is adjacent to a public street, the side yard
must adhere to the platted building line.
~! No Build Zones: A No Build Zone to keep those areas free from obstructions shall cover
the rear 25' of all lots within the subdivision and 10' on side yards abutting park areas. A
definition is contained within the City of Dublin Codified Ordinance Section 152.002.
Landscaping may be permitted in No Build Zones with advance approval from the
Architectural Review Committee (ARC). Nothing herein shall prohibit the installation of
utility lines and structures necessary to serve the subdivision. No Build Zones will be
indicated on the subdivision plat on each lot.
Permitted Materials:
I) Permitted materials for all subareas and product types include: Brick, Stone, Stucco,
Wood Siding and Cementitious Siding (Nardi-Plank).
Due to the size and anticipated duration of this project and the constant advances in
technology, the Applicant reserves the right to present newly engineered/developed
exterior materials to the Planning Commission for their approval and inclusion on the
approved materials list for this project.
Architecturally designed homes using all stucco on the exterior may be permitted, subjCct
to the review of the ARC. Appropriate application methods, as well as the use of primary
and/or secondary design treatments consistent with the architecture, must be incorporated
into the design.

Architectural Detailing:
• Design elements and details must be repeated throughout all faces of the structure.
• Windows must be present on all four sides of the structure in a manner consistent
with the treatment used on the front of the home.
• Blank walls are prohibited.
• All windows must be trimmed with wood on all four sides of the structures using
stucco, wood siding, Hardi-Plank or vinyl on the exterior. (No wood trim is required
when windows are surrounded by brick or stone).
• When brick or stone are used on the front elevation of the home, it must be repeated
in some form (water table, chimney, corner wrap, or similar treatment) on the
remaining faces of the home.
Colors:
Colors shall be used to "pull together" and provide a sense of visual unification of the
exterior materials. Natural earthtones or neutral colors on the warm scale that blend with
the natural landscape (tans, browns, warm grays, etc.) are preferred. White is considered
an acceptable neutral color.
Chimneys:
No "cantilevered" or "through the wall" chimneys are permitted. All chimneys must be
built on an integral foundation using brick or stone on the exterior. Homes constructed
using thematic architecture that require all stucco on the exterior, may be permitted to use
stucco as a chimney material with ARC approval. Other variations not expressly
permitted must be approved by the Planning Commission.

Accessory Structures:
Architecturally designed accessory structures attached to the main structure or garage
within the building footprint and constructed of the same materials as the main structure
or garage, may be permitted with ARC approval.
Sidewalks, Bikepaths and Street Trees:
Four-foot sidewalks will be installed on both sides of the streets within the single family
subdivision to provide for pedestrian traffic. Street trees will be installed on every lot.
Bikepaths will connect the streets to the park areas on the north and south ends of the
subdivision.
Tree Preservation:
It is our intent to use our reasonable, good-faith efforts to conserve and protect the
maximum number of existing trees in the tree stands, fence rows, etc. within the project
area It is to the distinct benefit of the applicant, as well as our future homeowners and
the community at large, to do so:
• The applicant has incorporated existing tree stands, fence row and vegetation into the
plan in a manner intended to preserve them where possible.
• Tree preservation zones will be established where appropriate.
• Reasonable, good-faith effort, consistent with the plan, shall be made during site
engineering (utilities, roads, drainage, grading, etc.) to avoid the unnecessary removal
of trees and to protect critical root zones of trees in and adjacent to the project area.
• Construction activities shall be undertaken in a manner consistent with the protection
of existing trees. Protective fencing will be erected and maintained during the entire
construction period. Construction vehicles, materials, and spoils will be prohibited
within the tree preservation area or the critical root zones of protected trees.
• Trees located in areas where removal will take place may be relocated (if feasible and
appropriate) for use elsewhere on the site.
Tree Preservation Zones:
A tree preservation zone is an area that will not be physically disturbed in order to
preserve existing natural or new landscape features. Trees or other significant vegetation
must remain in their natural condition and may not be removed from such a zone.
Utilities may be located in a tree preservation zone, if necessary, and designed to
minimize impacts. All structures, including, but not limited to buildings, parking,
driveways, sidewalks, sheds, swimming pools, patios, decks or other accessory structures,
fences, antennae and basketball courts or other sport courts are prohibited within a tree
preservation zone.
Additional landscaping shall be permitted within the tree preservation zones, provided
that all planting is done outside of any critical root zone, as defined by the Dublin Zoning
Code.

Parks/Reserves
All Parks/Reserves shall be constructed, including fine grading and seeding, prior to
dedication to the city and prior to occupancy of the first lot by a homeowner within the
respective section. A landscape buffer will be planted along all adjacent park areas.

BACKGROUND:
Case Summary:
The concept plan was heard at City Council on December 12, 2005, and at the Planning and
Zoning Commission on October 6, 2005. The main issue discussed at both meetings regarded
the traffic impacts of the proposed uses on the road network, and the applicants request for a
right-in/right-out entrance on Emerald Parkway. The Commission specifically requested more
information regarding this issue and that the applicant work with staff to resolve the access
issues. The Commission suggested that the applicant meet with the residents and increase the
protection of the stream corridor. The Commission also recommended improvements to the
design of the office area and its density. The applicant has worked with staff to resolve these
issues and staff recommends approval with conditions.
Case Procedure:
The purpose of the PUD process is generally similar to the previous process, in that it encourages
imaginative architectural design and proper site planning in a coordinated and comprehensive
manner, consistent with accepted land planning, landscape architecture, and engineering
principles. The new PUD process can consist of up to three basic stages:
1) Concept Plan (Staff, Commission, andlor City Council review and comment);

2) Zoning Amendment Request (Preliminary Development Plan; Commission
recommends and City Council approves/denies); and
3) Final Development Plan (Commission approves/denies}.
The general intent of the preliminary development plan (rezoning) stage is to determine the
general layout and specific zoning standards that will guide development. The Planning and
Zoning Commission must review and make a recommendation on this preliminary development
plan (rezoning) request. The application will then be returned to City Council for a public
hearing and final vote. Atwo-thirds vote of City Council is required to override a negative
recommendation by the Commission. Tf approved, the rezoning will become effective 30 days
following the Council vote. Additionally, all portions of the development will require final
development plan approval by the Commission prior to construction.
Review Criteria:
in accordance with Section 153.055(A) Plan Approval Criteria, Code sets out the following
criteria of approval for a preliminary development plan (rezoning):
1) The proposed development is consistent with the purpose, intent and applicable standards of
the Dublin Zoning Code;
2) The proposed development is in conformity with the Community Plan, Thoroughfare Plan,
Bikeway Plan and other adopted plans or portions thereof as they may apply and will not
unreasonably burden the existing street network;
3) The proposed development advances the general welfare of the City and immediate vicinity
and will not impede the normal and orderly development and improvement of the
surrounding areas;
4) The proposed uses are appropriately located in the City so that the use and value of property
within and adjacent to the area will be safeguarded;
5) Proposed residential development will have sufficient open space areas that meet the
objectives of the Community Plan;
6) The proposed development respects the unique characteristic of the natural features and
protects the natural resources of the site;
7) Adequate utilities, access roads, drainage, retention and/or necessary facilities have been or
are being provided.
8) Adequate measures have been or will be taken to provide ingress and egress designed to
minimize traffic congestion on the surrounding public streets and to maximize public safety
and to accommodate adequate pedestrian and bike circulation systems so that the proposed
development provides for a safe, convenient and non-conflicting circulation system for
motorists, bicyclists and pedestrians;
9) The relationship of buildings and structures to each other and to such other facilities provides
for the coordination and integration of this development within the PD and the Iarger
community and maintains the image of Dublin as a quality community;
10) The density, building gross floor area, building heights, setbacks, distances between
buildings and structures, yard space, design and layout of open space systems and parking
areas, traffic accessibility and other elements having a bearing on the overall acceptability of
the development plan's contribution to the orderly development of land within the City;
11) Adequate provision is made for storm drainage within and through the site so as to maintain,
as far as practicable, usual and normal swales, water courses and drainage areas;

12) The design, site arrangement, and anticipated benefits of the proposed development justify
any deviation from the standard development regulations included in the Dublin Zoning
Code or Subdivision Regulation, and that any such deviations are consistent with the intent
of the Planned Development District regulations;
13) The proposed building design meets or exceeds the quality of the building designs in the
surrounding area and all applicable appearance standards of the City;
14) The proposed phasing of development is appropriate for the existing and proposed
infrastructure and is sufficiently coordinated among the various phases to ultimately yield the
intended overall development;
1 S) The proposed development can be adequately serviced by existing or planned public
improvements and not impair the existing public service system for the area; and
16) The applicant's contributions to the public infrastructure are consistent with the
Thoroughfare Plan and are sufficient to service the new development.
CONSIDERATIONS:
Site Characteristics:
• Site Description. The 8.8-acre site has frontage along Emerald Parkway and Innovation
Drive. The site is currently undeveloped with some large mature tree stands and
undergrowth and a stream along the northern property line. This site is located in the
southwest area of Dublin, with good visibility along Emerald Parkway.
• Zoning. The site is currently zoned RI, Restricted Industrial District. The current zoning
permits manufacturing and industrial uses, and office as a conditional use. The proposed
use for a funeral home and office complex is not permitted within this district and
therefore a rezoning is necessary. To the west and south is vacant land zoned RI. To the
north is an AEP facility zoned Ri and land to the east is currently zoned PCD, Planned
Commerce District, and also vacant.
Community Plan:
• Future Land Use. The Future Land Use Map in the Community Plan shows this site as
"Office." Land use designations were assigned based on comprehensive traffic studies
for the City. The proposed uses of funeral home and office are consistent with the Future
Land Use plan.
Site Layout:
• General Layout. The proposal is divided into two Subareas. Subarea A on the eastern
portion of the site includes an approximately 11,700-square-foot funeral home building
with an adjacent 3,000-square-foot reception center building. Subarea B on the western
portion of the site, includes a group of office buildings with a maximum square footage
of 32,000 square feet.
• Subarea A. The funeral home in Subarea A is proposed at the intersection of Emerald
Parkway and Innovation Drive. The funeral home is proposed at an angle to the
intersection in order to create a more interesting street aesthetic. The Subarea plan
indicates a reception center in association with the funeral home adjacent to the 2.5-acre
stormwater pond. Parking for the funeral home facility is proposed generally on the
north and west sides of the building. An additional stormwater pond is proposed at the
southeast corner of the site.

Subarea B. The office buildings are proposed along Innovation Drive, west of the funeral
home. A large pond is proposed to the north of the office buildings, along the creek area.
The parking will generally be south of the buildings.
Development Standards:
• Permitted Uses and Density. The proposed development text outlines the permitted uses
for the site by Subarea. Subarea A includes funeral home uses with no embalming or
cremating services, and a reception center with a remembrance garden. The total
maximum square footage for this Subarea is 14,700 square feet for a density of 3,340
square feet per acre. Subarea B includes the uses permitted in SO, Suburban Office and
Institutional District and will have a maximum total square footage of 32,000 square feet
for a density of 7,272 square feet per acre.
• Reception Center and Remembrance Garden. The reception center is intended for
private receptions associated with the funeral home; however, it may also be reserved for
various types of civic, business, and nonprofit organizations. The proposed remembrance
garden will be located close to the reception center and will be a small passive space with
benches and a walking path.
• Setbacks. The proposed setbacks are based on the existing right-of--way and are indicated
as 25 feet for pavement and 100 feet for buildings on Emerald Parkway and Innovation
Drive for both Subareas. The text indicates a zero pavement setback for the shared
driveway between the two Subareas. The setback for the reception center is 50 feet from
the north property line and the lot coverage maximum is 70 percent for both Subareas.
This is consistent with surrounding planned districts.
• Landscaping. The proposed text indicates that the site will include a naturalized pond
along the stream corridor with indigenous plant materials. The text states that both
ponds, including the pond at the southeast corner of the site will have ornamental trees
and flowering shrubs in groupings to create an informal planting.
• Landscape Buffer. The text also includes a 25-foot landscape buffer along Emerald
Parkway and Innovation Drive that will coordinate with existing landscape treatments on
Emerald Parkway. Further detail will be required at the final development plan. The
remaining landscaping will meet or exceed Code as outlined in the text.
• Parking. The text indicates that parking shall meet Code.
Traffic:
• Traffic Study. A traffic impact study has been submitted to the City. The applicant will
be responsible for re-striping the center lane on Innovation Drive to allow Ieft-hand turns
into the site at the shared access point for Subarea A and B. When Subarea B is built, the
applicant for that project will have to re-stripe Innovation Drive for alert-hand turn lane
at the western property line.
• Signalization Warrant/Intersection Improvements. The traffic impact study did not
include a signal warrant analysis based on the minimal intersection impacts derived from
the study. Staff is working with the applicant to create a supplemental study that will
determine if the site generated traffic will cause a signal warrant and require the
installation of a traffic signal at the Innovation Drive and Emerald Parkway intersection,
or if other intersection improvements are needed. If a warrant is not met, the applicant is
looking at the proposed developments in the area to determine if, and when warrants may

possibly be met or what other intersection improvements may be needed. As a result, the
City Engineer will determine if the applicant will need to contribute to the signal
installation or other intersection improvements and what percentage is the applicant's
responsibility. The Applicant needs to continue to finalize this supplement to the traffic
impact study to the satisfaction of the City Engineer.
Access Management. The approved and constructed roadway plans do not allow for a
curb cut along Emerald Parkway. Emerald Parkway was built to be a minor arterial with
controlled access points. Extensive research and forethought went into the design of
Emerald Parkway to ensure traffic flow is optimal. The traffic study submitted does not
show that the curb cut will benefit the roadway system and therefore, the City Engineer is
not inclined to allow a curb cut on this road. The applicant has agreed that the access on
Emerald Parkway is not necessary far their operations and staff requests that this access
be eliminated from all plans.
Private Streets. Pavement within the parking areas should meet the City Engineer's
requirements for strength and durability. Turning movements of waste hauling and
emergency vehicles must be accounted for in designing curves and turning radii. Private
drives should be a minimum of 22-feet wide (this is our standard for drive aisles in
parking lots).
Utilities:
• Water Supply. There is a 16" waterline on the west side of Emerald Parkway and a 12"
waterline on the North side of Innovation. The applicant is indicating that they will
utilize the water main on the north side of Innovation Drive.
• Sanitary Sewer Service. A 21" sanitary sewer runs long the north side of the creek that
borders the northern property line of this property. The applicant is indicating that they
will tie into this line to service both Subareas.
• Stormwater Management. The project will be required to meet the requirements of the
Stormwater Regulations. A portion of the site is located in the Cosgray Creek watershed
of the Stormwater Master Plan and a very small portion is in the Cramer Creek
Watershed. The applicant has not submitted preliminary calculations, however, water
features are shown on the plan, which may be providing Stormwater controls. Staff
recommends that the applicant meet with the Division of Engineering to discuss
stormwater management on the site. The plans show that the pond at the corner of
Innovation Drive and Emerald Parkway is partially in a utility easement, this will have to
be eliminated from the easement.
• Floodplaln. The property has a substantial creek running along the northern property line
with associated Floodplain. The applicant will need to comply with the Flood Control
Ordinance. The pond towards the northern property line is shown in the Floodway + 20
feet and will have to be moved out of that area.
Architecture:
• Architecture. The proposed text indicates that the architecture and color palette will be
similar to the Thomas Kohler PCD and will consist of earth tones and muted natural
tones and materials. The text also states that the scale of the buildings will be aided by
the use of porticos, dormers, recesses, awnings and other elements to break up the
massing of the building. The applicant has submitted preliminary architecture for the

funeral home and reception center. Staff believes that the proposed architecture begins to
address the intent of the text and incorporates the required design elements such as
porticos, dormers, and natural earth tone materials. However, the architecture includes
some Colonial-type architectural design elements, including a cupola with a bell, that do
not coordinate with the style of surrounding developments. Staff does not believe that a
bell is appropriate for this area in such close proximity to residents. Staff believes that
the proposed site is a prominent location and should utilize dramatic and striking
architecture. Staff believes that the funeral building should utilize varied roof pitches and
massing to create a more interesting and impressive facade at the intersection. Staff will
continue to work with the applicant to create high quality signature architecture
throughout the development.
Architectural Materials. The proposed materials in the text include stone with limestone
detailing, wood, engineered wood products, stucco, tile, and other similar materials used
as accents with brick or stone veneer. The applicant has not listed brick as a permitted
building material and staff recommends that the text be revised to include brick. Roofing
materials are indicated as standing seam, cedar shake, or asphalt shingles. Staff
recommends that the text be revised to state that the asphalt shingles will be dimensional.
Signage:
• Proposed Signs. The site is permitted by Code to have one sign in Subarea B, and two
signs in Subarea A. The applicant is proposing that all signage utilize muted colors and
coordinate with the architecture. The text indicates that Subarea B signage will meet
Code. The two signs in Subarea A are required to face each right-of--way and be no
closer than two-third the length of the longest street frontage, or 250 feet. The applicant
is proposing that one monument sign shall be located on Emerald Parkway, toward the
northern edge of Subarea A, and the other monument sign will generally be at the corner
of Emerald Parkway and Innovation Drive, angled at the intersection. The proposed
locations of these two signs are facing generally the same right-of--way and do not meet
the minimum distance separation. The applicant contends that they will assist in way
finding as because of the difficult southbound visibility on Emerald Parkway. The
applicant is also proposing a directional sign along Innovation Drive indicating the
location of the entrance and the Schoedinger name. This sign also does not meet Code.
STAFF RECOMMENDATION:
The proposed uses are consistent with the Community Plan, compatible with the surrounding
development, have adequate services, and will create a needed service within the city. Staff will
continue to work with the applicant to create high quality architecture, signage, gateway
#reatments, and refine the overall character of the development at the final development plan
stage. Staff recommends approval of this preliminary development plan (rezoning) with eight
conditions.
Conditions:
1) That all plans be revised to eliminate the access point on Emerald Parkway;
2) That text be modified to include brick as a permitted building material;
3) That the text be revised to state that the asphalt shingles will be dimensional;

Bases:
4) That the applicant revise the architecture to create a high quality dramatic
architecture for the development;
5) That the applicant comply with our Stormwater Management Regulations and
Flood Control Ordinances;
6) That plans be revised to move the southeast pond out of the utility easement along
Emerald Parkway and that the larger northwest pond be moved out of the
floodway + 20 feet on the plans;
7) That the applicant comply with any requirements for contribution to signalization
or other intersections improvements as determined by the City Engineer, and
based on the traffic study; and
8} That the site comply with all applicable requirements of the traffic study, subject
to approval by the City Engineer.
1) The proposed project will provide a needed funeral service and additional high
quality office space within the City.
2) The proposed development plan is consistent with the goals and objectives of the
Dublin Community Plan.
3) This preliminary development plan generally complies with the review criteria
outlined in Section 153.053 of the Zoning Code.

introduction
"l~he site is approximately 8.8~ acres and zoned Restricted Industrial ("RI"). It is located
northwest of the intersection of Innovation Drive and Emerald Parkway. The property is
intended for development in two subareas. Subarea A will consist of a funeral home, a
reception center, and a remembrance garden. Subarea B shall consist of suburban office
uses totaling 32,000 square feet. The proposed uses are appropriate for this location due
to the development patterns of adjacent properties and the proximity of State Routes 33
and 161 and the Interstate 270 freeway interchanges. Upon approval of this rezoning
application, the owner and/or applicant shall have five (5} years from the effective date of
this rezoning to have a final development plan approved.
Subarea A Funeral Home and Reception Center
A1.01 llescription and Acreage:
Subarea A is approximately 4.4t acres. Subarea A may contain a funeral
home, a reception center, and a remembrance garden.
A1.02 Permitted Uses:
Subarea A may contain the following uses: a funeral home; a reception center,
used in conjunction with the funeral home; and a remembrance garden- A
crematory shall not be permitted on site. The reception center may be used
for private receptions and by users including but not limited to: business
associations, professional membership organizations, labor organizations,
civic, social and fraternal associations, political organizations, charitable
organizations, and nonprofit membership organizations. The remembrance
garden will be located in the vicinity of the reception center and is designed to
be a passive park-like setting which may include a path and benches. A
remembrance garden shall conform to all licensing requirements and
municipal regulations.
A1.03 Permitted Density:
1. Two buildings shall be located in this subarea and total building coverage
shall be approximately 14,700 square feet. The funeral home shall be

any portion of the parcel outside the permitted structure. Mechanical
equipment or other utility hardware on roof, ground, or buildings shall be

Ai.iO Landscaping:
Landscaping shall be in accordance with Dublin City Code. "The northern
environs of the proposed pond nearest the north property line shall assume a
naturalistic design direction. The intent is to tie this part of the site with the
stream corridor to the north making a seamless transition to the developed
site. The use of indigenous plant materials, including trees, shrubs and
perennials will constitute the plant pallet. On the southern edge of this
northern pond along with the pond at the intersection of Innovation Drive and
Emerald Parkway, ornamental trees grouped with flowering shrubs and
perennials will be arranged to create informal, causal planting beds. A lawn
will run to the edge of the pond where no planting beds are planned.
2. A 25-foot landscape buffer shall be installed and/or maintained along the
Emerald Parkway and Innovation Drive frontage as depicted on the attached
Landscape Plan. The landscape buffer will be compatible with existing
developments and approved plans along Emerald Parkway.
3. Plant material when installed shall meet the following minimum size
requirements as follows:
a. Deciduous trees 2-inch caliper minimum
b. Evergreen trees G-foot height minimum

2. Building materials shall consist of:
a. Stone veneer or stucco stone with limestone or simulated limestone
detailing.
b. On pitched roofs, standing seams, cedar shakes, or asphalt shingles
with no Iess than 325 pounds per square weight shall be used.
c. Wood, engineered wood products, stucco, tile, and other similar
materials may be used as an accent with brick and/or stone veneer.
3. Roof:
a. Pitched roofs with gabled or hipped ends are required with a slope
equal to 6/ 12 or greater.
b. Minimum 8" overhangs are required.
c. Flat roofs are permitted provided they are proportionately integrated
with parapets that adequately screen mechanical rooftop equipment.
4. Scale:
a. Structures should be designed to harmonize with each other and the
landscape.

5. Wall ArticuiationlFenestration:
a. In addition to using building elements to articulate the building mass,
individual watts must be articulated with fenestration, pattern, or
structural expression equally on all sides of each structure.
b. ~i'he amount of fenestration should be aesthetically balanced with the

A1.12 Signage and Graphics:
All signage shall use muted colors and shall coordinate with the architectural
style of the building. Since Subarea A has frontage along two roadways, two
(2} monument signs and directional signage shall be permitted for the funeral
home. One (1) monument sign shall be located at the intersection of Emerald
Parkway and Innovation Drive and one (1) monument sign shall be located
along Emerald Parkway toward the northern edge of Subarea A. Directional
signage shall be located at the Innovation Drive entrance. Manufacturer
specification sheets shall be provided at the time of the Final Development
Plan.

B1.01 Description and Acreage:
1. Subarea B is approximately 4.4~ acres. Subarea B shalt be comprised of
suburban office type uses totaling 32,000 square feet. Tfie architectural style
shall be similar to the styles permitted by the Thomas / Kohler development
plan which is to the south of the site.

153.025, Suburban Office and Institutional District.

Ms. Wanner stated that this is a concept for a funeral home located at Emerald Parkway
and Innovation Drive. On October 6, Planning Commission reviewed the plan. The main
issues of discussion were the traffic impacts for the proposed uses on the road network
and the applicant's request for a right in, right out access along Emerald Parkway. The
applicant is seeking feedback from Council regarding the concept plan.
She displayed aerials of the site. The site consists of 8.8 acres and some industrial uses
surround the north half of the site. There are some vacant parcels to the south and to the
east of the site. The northern portion includes a stream and some riparian vegetation.
The site is zoned Restricted Industrial, as are surrounding sites to the north and south.
There is a portion of land across Emerald Parkway that is zoned Planned Commercial
District. The site plan includes 11,1)00 square feet of building, including a funeral home
that is turned toward the intersection of Emerald Parkway and Innovation and an
associated reception center for use after funerals. There are also some office buildings
shown to the west of the proposal, including four one-story buildings and one two-story
building, for a total of 32,000 square feet of office area. The applicant has requested a
right in, right out curb cut along Emerald Parkway. The City Engineer is reluctant to allow
that curb cut, as the Emerald Parkway plans did not include that cut.
Other comments at Planning Commission related to the density of the office subarea.
Staff will be looking to cap this density somewhere close to 9,000 square feet per acre,
consistent with other office developments in the City.
She noted that staff has directed the applicant to pursue an access study in conjunction
with the traffic study.
Staff has encouraged the applicant to review the design of the office area as well as the
density, and continue moving forward with the rezoning. The applicant is seeking
comments and feedback from Council at this time.
Mayor Chinnici-Zuercher asked Ms. Wanner to identify the approximate location of the
curb cut on the slide shown and asked about the distance of the curb cut from Innovation
Drive.
Ms. Wanner stated that the curb cut is 240 feet from Innovation Drive.
Mayor Chinnici-Zuercher asked it staff is requesting that the applicant decrease the
density.
Ms. Wanner responded that staff has not requested that of the applicant ai this time. Staff
is seeking feedback from Council on the land use issue of a funeral home in this location
and the curb cut locations.
Mayor Chinnici-Zuercher commented that she is pleased that the City of Dublin wilt finally
have a funeral home in the community. Et has been needed for a long time and this is a
good location for one. She suggests that Council seriously consider allowing a right in,
right out from Emerald for reasons of access and because those coming from out of town
could more easily find She funeral home. She does not have a concern with a curbcut at
this location. She is intrigued with the concept of a reception center. Do these exist at
other locations in the area?
Randy Schoedinger, Schoedinger Funeral Home stated that there is not another area
location with this type of facility. They have observed a trend toward less traditional
services, with families requesting a variety of celebration of life services and gatherings.
This provides a separate facility for such a gathering. It could also be used for those
having a traditional funeral to have a space for a dinner immediately adjacent. It could
also be offered free of charge to community groups for meeting space at times the space
is not scheduled for the business.
Mr. Reiner asked if a kitchen would be included.
Mr. Schoedinger responded that it would have a kitchen area suitable for caterers to use,
but not fuEl cooking facilities.

would be difficult to exit funeral processions by looping around the back of the building '
onto Innovation Drive and then turning again. The additional turns involved extend the
width of the procession, backing up Emerald Parkway even more. 4

Mr. Reiner noted that it appears that there is adequate parking on the site.
Mr. Schoedinger responded that there are 180 spaces planned and this wilt generally I
meet their needs for all but an unusually large funeral service, lit
Mr. Keenan noted that Ms. Wanner addressed the office uses and he recalls that the
Planning Commission discussion related to reducing the density. {,
Ms. Wanner responded that the Commission wanted to cap the density at approximately j
9,000 square feet per acre. What is currently shown on the plan is around 10,000 square '
feet per acre.
Mr. Keenan asked if the 180 parking spaces are for the funeral home only. ~~
Mr. Schoedinger responded that this is correct. ti
Mr. Keenan noted that the Commission noted that a site just to the south is also zoned for ~k
a funeral home and will soon be a subject of discussion. At the Commission meeting. Mr.
Schoedinger responded to a question about having two funeral homes in close proximity. I
Mr. Keenan asked that he share those comments with Council. I
Mr. Schoedinger stated that the other applicant is Tidd Funeral Home, and as far as he
knows, that project is presently on hold. They do not believe it is a negative to gave two
funeral homes in a community of this size. In other areas of Central Ohio, there are ij
funeral homes adjacent to one another. Essentially, it will offer a choice to the consumer. (I
Ms. Salay stated that it is noF negative to have two funeral homes, but for a resident of this
area, it is a negative to have two funeral homes in such close proximity to their homes.
The site to the south on the Thomas Kohler development that is presently in contract with
Tidd Funeral Home was the subject of negotiation in 1995 with the neighborhood. A big
concession from the neighborhood's perspective was to allow the use of a funeral home.
In the case of the funeral home to the south, it is a conditional use. The conditions involve
the proximity to the park and the homes, and given the fact that it meets the conditions, it I~
will likely be considered a permitted use given Council's recent discussions about
conditional uses. The neighborhood's concern is with having a permitted funeral home in I
such close proximity. While it is something needed in Dublin, the neighborhood does not ~~
support having two in such close proximity. She could therefore not support this use in
this location unless the funeral home use on the Thomas Kohler site is eliminated in some
way. She is not certain how that could be done other than this applicant working out
something with the developer of the Thomas Kohler site. This is simply the wrong location
in her view. ~:
Mr. Schoedinger asked for clarification - is this because she believes the funeral home is ~~
a less attractive use than office? ~~
Ms. Salay responded that the business is not a pleasant use and ii is not desirable to I
have two funeral homes in such close proximity !o the neighborhood. The neighborhoods
have asked her to carry this message to Council. ~

zoned, it does not mean that the funeral home will be built on that site. She believes that
the proposal before Council tonight is a fabulous development of a site located adjacent to
a substation. She cannot imagine a better proposal for this site. She likes the reception
area proposed. Council should look positively on the natural experience of death. This
will be a nice neighbor for the adjacent substation.
Mr- Schoedinger provided some history of the process. They contacted the City two years
ago for assistance in identifying appropriate locations for a funeral home, and this was
one of the five sites identified by the City. From the standpoint of being a good neighbor,
homeowners in other communities have cited the same concerns about a proposed
funeral home. It is quickly realized that having an office use adjacent with heavy traffic at
rush hour is much less desirable than a funeral home with traffic at oft hours and which
offers a reception center that can be used by the community. They would love to be part
of the Dublin community.
Mayor Chinnici-Zuercher thanked Mr. Schoedinger, and noted that Council looks forward
to working with him.

6. Concept PIan - OS-155CP - Schoedinger Funeral Home -Emerald Parkway and
Innovation Drive
Mr. Gerber explained that this is an application. for review and approval of a Concept Plan for a
43,000-square-foot funeral home and office buildings on an 8.8-acre site. He said the Concept
Plan review examines the general design of the proposed development and this is anon-specific
review and the results are not binding on either the developer or the municipality. The
Commission is to provide feedback and then submit the application to City Council for its
review. He said if approved, the applicant is authorized to file a preliminary development plan
or rezoning, whichever is applicable within the next eight months. At a later date, City Council
will schedule a public hearing and subsequently vote to approve or disapprove the proposal. All
development plans will require approval by the Commission prior to construction.
Jamie Adkins highlighted the staff report and presented slides of the site. She said the proposed
site includes a funeral home building at the corner of Emerald Parkway and Innovation Drive. In
association with this use, is a reception center at the back portion of the site. She said one and
two-story office buildings are shown on the western portion of the site.
Ms. Adkins said a substantial creek exists along the north side of the property with associated
floodplain and floodway and, if the applicant proceeds, work cannot be done within this
floodway plus 20 feet. If work is done within the 100-year floodplain, a hydraulic study will be
necessary to indicate that they have compensating storage.

Ms. Adkins said staff supports this Concept Plan, believes the uses are generally consistent with
the development in the area, have adequate services, and will create a needed service within the
City. She said staff will continue to work with the applicant through the rezoning process to
refine the uses, architecture, signage, etc. Staff also believes that the Concept Plan is consistent
with the Community Plan.
Nick Cavaleris, attorney representing the applicant, added that the site was divided into two
subareas for the funeral home and office uses. He said an electrical substation exists to the north
and the applicant feels it is screened adequately from this use. '
Randy Schoedinger, Schoedinger Funeral Service, said they feel this is a needed service in
Dublin. He described his 150-year-old company.
Mr. Gerber explained that there will be ample opportunity later for those wishing to speak
regarding this proposed development at Commission and Council hearings if this project
continues forward.
Mr. Zimmerman noted that to the south of this site is the Thomas-Kohler PCD, and the text
allows the use of a funeral home. He had heard that an application had been received from the
Tidd Funeral Home in that area.
Ms. Adkins confirmed that an application of a Tidd Funeral Home had been received. She added
that a funeral home in the Thomas-Kohler text was considered a Conditional Use.
There was a discussion about the close proximity of the two funeral homes, and it was concluded
that it was not uncommon to have funeral homes located close to each other.
Mr. Gerber asked what "Existing Non-Residential" meant in the Community Plan.
Ms. Adkins replied that when the 1997 Land Use Map was created, this site was already zoned
RI, Restricted Industrial, therefore the future land use shown was "Existing Non-Residential."
Mr. Zimmerman inquired about the Schoedinger crematory.
Mr. Schoedinger clarified that all of the cremation and embalming operations are completed at
their downtown facilities.
Ms. Boring asked what the density of the office buildings was.
Ms. Adkins replied that the entire site density was just less than 5,000 square feet per acre. She
said the office area density had not been calculated.
Ms. Reiss asked what the overall Thomas-Kohler density was.
Ms. Adkins was unable to cite this density.

Mr. Schoedinger explained that their industry was moving away from traditional funeral
services, and more to a celebration of lives. He said memorial services are more prevalent, and
people are finding the need to have more of a gathering with refreshments. He said the reception
center would be offered free for daytime use of community groups during their off hours.
Ms. Boring said it was important that the bikepaths connect to this site.
Ms. Boring was concerned that thexe were too many separate, small offices in the concept. She
thought it looked too cluttered on the layout.
Greg Krobot, The Edge Group, explained that the footprints shown were the same as the office
buildings to the south. He said they were used as a model to study what other land uses might be
available. He said Schoedinger does not need the entire 8.8 acres.
Ms. Boring said this was a very attractive use next to the substation. She added that this is a very
necessary service to the community and she looked forward to having it in Dublin.
Mr. Saneholtz referred to page two of the site layout where it included an 11,000-square-foot
funeral home building and reception center, combined. He noted that the City Engineer was not
inclined to allow the curb cut on Emerald Parkway. 1-le encouraged the applicant to consider
eliminating the Emerald Parkway curb cut.
Mr. Saneholtz asked about the traffic flow of the funeral processions.
Mr. Schoedinger said the routes to the cemeteries have not been mapped out, but he thought the
majority of the time, Emerald Parkway would be used. He said funeral traffic occurred at times
other than rush hour, typically at 10 a.m. and 1 p.m., with calling hours in the afternoon or after
rush hour.
Mr. Saneholtz requested comments from staff on the anticipated impact upon Dublin's road
system, if any, with respect to the funeral home, especially since two are being discussed.
Ms. Adkins replied that a traffic study will be required at the rezoning, and it will take into
account the surrounding uses.
Mr. Gerber said he was also concerned as it related to traffic issues for the office uses
distinguished from those of the funeral home.
Mr. Saneholtz suggested that a buffer be considered between the parking lots for the office
buildings and the funeral home.
Mr. Gerber asked if the residents had been contacted.
Mr. Schoedinger indicated they had not since this was only a Concept Plan.
Mr. Gerber told him that they should contact the residents prior to coming back to the
Commission for review and approval.

Mr. Schoedinger said since the fiuteral home parking lot is not often full, it provides extra
parking for the offices.
Mr. Saneholtz said overall, this seemed like a very good location for the use.
Ms. Jones said this was a service that the community needed.
Ms. Reiss expected the off ce use would contribute to the rush hour traffic congestion at the
intersection of Emerald Parkway and Innovation Drive, and suggested staff consider
signalization.
Mr. Gerber agreed and said blocking of the intersection should be avoided so there is not
neighborhood cut-through traffic.
Ms. Reiss asked if the reception center would be available for non-funeral related parties.
Mr. Schoedinger said while it would not be the primary purpose, the reception center could
definitely be encouraged for small parties.
Ms. Reiss asked if there would be on-site food service.
Mr. Schoedinger said there would be refrigeration and a sink for caterers to use, but not a full
kitchen.
Ms. Reiss requested ample setbacks from the stream for pavement and during construction so
that the water quality would be protected.
Mr. Saneholtz said music and other limitations may need to be placed on the reception area use.
Mr. Zimmerman understood the staff position on the Emerald Parkway curb cut, but he
suggested it might be better for the funeral home processions because there is going to be night-
in/rigbt-out at the median there. He said that it was better to exit at Emerald Parkway than it was
to go to Innovation Drive and block the intersection. He requested that staff consider it.
Mr. Schoedinger agreed that would work better for them.
Mr. Gerber was concerned about the number of office buildings as it related to density and the
impact on the local neighborhoods as it related to the traff c in their area. He suggested removal
of a building might be considered.
Ms. Boring asked if there was any time that Emerald Parkway was at a C level for traffic.
Barb Cox said Emerald Parkway was designed for that capacity. She said a bottleneck is
experienced because when it changes into the Columbus jurisdiction, it does not have as many
lanes. She said there are still improvements along Tuttle that need to happen and it is all
interconnected. She said the possible impact of this project to the west has been discussed with
the applicant and will be worked through.
