Residential District and shall be subject to regulations and procedures contained in
Ordinance N o. 21-70 (Chapter 153 o f t he C odified O rdinances) the C ity o f D ublin
Zoning Code and amendments thereto.
Section 2. That application, Exhibit "B", including the list of contiguous and affected
property owners, and the recommendations of the Planning and Zoning Commission,
Exhibit "C", are all incorporated into and made an official part of this Ordinance and
said real estate shall be developed and used in accordance therewith.
Section 3. That this Ordinance shall take effect and be in force from and after the
earliest period allowed by law.

Consistent with the "Area Rezoning" project, these ordinances will formally establish the
Dublin R-1, Restricted Suburban Residential, CC, Community Commercial or SO,
suburban Office and Institutional Districts for individual properties.
The staff held a public informational forum of these proposals on August 26, and
September 10, 2003 for the property owners. Several residents attended, gave comments,
and expressed thanks to the staff for the presentation and informational meeting.
On October 2, 2003, the Planning Commission approved each rezoning application
individually (7-0).
RECOMMENDATION:
Approval of Ordinances 95-03, 96-03, and 97-03, as recommended by the Planning and
Zoning Commission.

BACKGROUND:
On the advice of Dublin's Law Director, staff has systematically researched all Dublin zoning
activity on all parcels annexed into Dublin. Through this investigation of written documentation,
staff has found several areas where zoning was. not established via a rezoning ordinance. The
Planning Division is responsible for compiling and processing these "area rezoning" applications
to formally establish Dublin zoning wherever there is an question about the zoning history.
The subject sites in this case were annexed between the years of 1980 and 2001; there is no
history of a formal rezoning ordinance for these areas since that time. Ordinance #97-03 was
introduced at City Council on August 18, 2003. It will establish Dublin R-1, Restricted
Suburban Residential District zoning on these properties. A special informational meeting was
held on August 26, 2003 at the Dublin Recreation Center, and a few property owners from this
neighborhood attended.
After the Planning Commission makes its recommendation, the case will be forwarded to City
Council for a public hearing and final vote. With a positive recommendation from the
Commission, a simple majority vote is required for passage. A negative Commission
recommendation requires five votes for passage. If the ordinance is approved, it will take effect
in 30 days.
CONSIDERATIONS:
Site Characteristics:
The subject area is 76 parcels comprised five subdivisions and 15 estate lots along the
northern end of Bellaire Drive and the east side Dublin Road, north of I-270. It includes
133 acres. The subdivisions included in the rezoning are Dublin Estates, Lancashire,
Dublin Manor, Galway Estate, and three lots from Luther Mitchell's Scioto Shores.
Streets within the subdivisions include Bellaire Avenue, Limerick Lane, Bellaire Court,
Manor Court East and West, and Browning Court. The lots range in size from about one
to three acres.

This rezoning proposes to establish the Dublin R-1, Restricted Suburban Residential
District for all properties. All legally non-conforming uses will be subject to the
requirements of Section 153.004(C).
This area has a very complex annexation and zoning history. Properties that were
annexed prior to 1996 retain the Washington Township zoning of R-lA, Restricted
Suburban Residential District. However, in 1996, Washington Township passed a
different zoning resolution and adopted new zoning categories. The new Washington
Township ordinance eliminated the R-lA District and created the R-SR, Suburban
Residential District in its place. Properties annexed from Washington Township into
Dublin after 1996 retained the R-SR zoning district. Lots in Dublin Estates were annexed
over a period of eight yeazs, and there are minute differences from lotto lot.
The azeas were platted between the years of 1925 and 1984 through Franklin County.
They were annexed into Dublin generally as complete and maturing neighborhoods.
Sanitary is available to all properties and water was installed in 2001 down to Manor
Court West and East. A 24" water line does run along the west aside of Dublin Road.
A letter was mailed to the affected property owners listed in this application. A sample
copy is attached, and it outlines the circumstances, procedures, and proposed zoning, as
well as dates for public meetings. An informational meeting was held on August 26,
2003, for the Bellaire azea property owners. Several residents attended this meeting and
were interested in the different aruiexation dates and the zonings that affected their
property. Staff did create and distribute a map illustrating the many different annexation
dates and subdivisions in this area.
Community Plan, Land Use and Zoning Issues:
On August 12, 2002, City Council amended the Future Land Use Map (Map 8) of the
Community Plan. Most of this area is listed on the Community Plan as "Existing
Residential". A few vacant lots, are shown asResidential-Low Density (0.5-ldu/ac).
Implementation of this rezoning will ensure conformity with all adopted Dublin
standazds, protecting the health, safety, and welfare of the residents.
This rezoning is primarily a housekeeping issue, and will have no perceptible impact on
the vast majority of those involved. Legally non-conforming uses cannot be expanded,
and they cannot be re-established after being discontinued for a period of two yeazs.
Most of Dublin's development standards would apply, even absent this area rezoning. A
1976 ordinance requires adherence to Dublin standards, wherever they are stricter,
following annexation. However, the failure to establish Dublin zoning on the property
makes administration and enforcement difficult for staff, and difficult and confusing for
landowners.
Development Standards:
The properties were annexed from Washington Township over 20 years in nine different
annexations. During 1996, the Township eliminated the R-lA District and replaced it
with the R-SR District. Section 153.004 (D) of the Code states that: "Territory annexed
to the municipality after the effective date of the zoning ordinance shall continue to be
governed by the zoning regulations which governed the territory annexed immediately
prior to annexation." Relying on township zoning for these areas would require a review
of nine different iterations of the Washington Township Zoning Code. This is not
practical or advisable. Since the zoning of these properties is unclear, a comparison chart
of the zoning districts has not been included in this report. However, based on

discussions and research with the township zoning officers and township codes, the
current property uses are consistent with historically permitted uses at the time of
annexation.
Utilities:
This is an action to establish Dublin zoning. No development is proposed as part of this
application, and it has no effect on known utilities. Currently, municipal water and
sanitary services reach some of these properties. Undeveloped parcels will need to tap
into the existing utilities per City Code.
New development on any of these parcels must comply with adopted stormwater
management regulations for the City of Dublin.
STAFF RECOMMENDATION:
Following annexation, staff research indicates these properties were not placed in a Dublin
zoning classification by passage of a formal rezoning ordinance. They have been reflected as R-
1 on the zoning map for many years. This application is City-sponsored and legally advisable. It
is intended to avoid any future potential Code Enforcement problems arising from township
classifications and inconsistencies within the Dublin zoning map. This action provides proper
zoning and is primarily a housekeeping effort. Staff recommends approval of this rezoning.
Bases:
1) This rezoning will prgvide an appropriate Dublin zoning classification for land within the
City limits to provide for the effective administration of development standards,
procedures, etc.
2) The rezoning will maintain the established development pattern that has been in place for
many years and establishes land uses consistent with those listed in the Community Plan.

3. Area Rezoning 03-0832 -Bellaire Area Rezoning
Anne Wanner showed several slides. She said this area rezoning included 76 parcels within five
subdivisions. There are 15 estate lots at the north end of Bellaire Drive and the east side of
Dublin Road. The total acreage is 133 acres. Streets within the subdivisions include Bellaire
Avenue, Manor Court East and West, Limerick Lane, and Bellaire Court. The lots generally
range in size from one to three acres.
Ms. Wanner said the annexation and zoning history was complex. The properties were annexed
in different years, and they reflect different iterations of the Washington Township Zoning Code
for Rl-A and RSR zoning. These zones are, however, very similaz to Dublin's R-1 Most of the
land was developed as estate lots and homes many yeazs ago. She said a few residents attended

Ms. Wanner said this was a housekeeping effort and is intended to avoid any Code
administration problems. This will establish the R-1 District and staff recommends approval.
Mr. Gerber made the motion for approval because it will apply an appropriate Dublin district,
provide for effective development administration, maintain the established development pattern,
and is consistent with the Community Plan. Mr. Zimmerman seconded the motion, and the vote

Mr. Sloan pointed out that for electric, the rates are known for the next two years. If an offer
is not received which will result in a savings to the resident, a proposal will not be brought
forward. For gas, with fluctuating rates, the options are to look for a fixed rate that will offer
price certainty or a rate that is simply less than the gas company's rate. It is possible that
another supplier may have a lower rate, such as a fixed one-year rate.
Ms. Chinnici-Zuercher stated that if a resident opted in and then decided to switch, the
documents indigte there is a switching fee.
Mr. Sloan stated that it would be in the form of an early termination fee. Typically, the fee for
early termination is in the range of $25. This can be negotiated with the supplier. It may
sometimes make sense for someone to switch, even with the $25 early termination fee.
Many don't understand the market and may trust the local government to negotiate for them
with the local utilities.
Mr. McDaniel added that, in general, these plans are fairly standard. AMP Ohio represents
30 or more other communities, and this is not "uncharted territory." He noted that staff may
request emergency action at the second reading to waive the 30~ay waiting period,
depending upon the market conditions.
There will be a second reading/public hearing at the September 2 Council meeting.

§ 153.020 RESTRICTI',D SUBURBAN RI;SIDI;NTIAL DISTRICT.
(A) Permitted use. Land and buildings in the Restricted Suburban Residential District
shall be used only for the following purposes: -
(1) Dwelling structures. One-family dwelling structures.
(2) Home occupation. Home occupation in association with a permitted
dwelling, and in accordance with the provisions of § 1183.04.
(3) Accessory uses. Accessory buildings and uses in association with
permitted dwellings as specified in § 153.074, including: Domestic servants' quarters (employed
on the premises).
(4) Public school and parks.
(a) Public school offering general educational courses and having no
rooms regularly used for housing or sleeping of students.
(b) Parks, playgrounds and playfields.
(5) Private school. Private school offering general educational courses similar
to those ordinarily given in public schools and having no rooms regularly used for housing or
sleeping of students, providing it occupies a lot of not less than five acres.
(6) Religious. Church or other place of worship provided it occupies a lot of
not less than five acres.
(B) Development standards. In addition to the provisions of §§ 153.070 through
153.076, the following standards for arrangement and development of land and buildings are
required in the Restricted Suburban Residential District.
(1) Lot area and coverage. For each dwelling unit there shall be a lot area not
less than 40,000 square feet per dwelling unit.
(a) For each permitted use and conditional use the lot area shall be
adequate to meet the sanitation requirements of the County Board of Health, but shall not be less
than that prescribed for such use.

(b) One principal use shall be permitted on a lot, and such lot shall not
be covered more than 20% by structure.
(2) Lot width. For aone-family dwelling there shall be a lot width of 150 feet
or more at the front line of the dwelling, and such lot shall have access to and abut on a public
right of way for a distance of 60 feet or more. For a conditional use the lcrt width shall be
adequate to meet the development standards of the Restricted Suburban Residential District.
(3) Side yard. For dwellings or associated accessory buildings there shall be a
total of side yards of 25 feet or more with a minimum of eight feet on one side. For a conditional
use, except dwellings, and accessory structures thereto, there shall be a side yard on each side of
a building of 25 feet or more.
(4) Rear yard. For main buildings, there shall be a rear yard of 20% or more
of the lot depth, except that a rear yard of more than 50 feet shall not be required.
(5) Maximum height. No dwelling structure shall exceed 35 feet in height.
Maximum height for other structures shall not exceed a safe height as determined by the Fire
Chief and as reviewed and accepted by the Planning and Zoning Commission.

It is proposed that this property be placed in the Dublin R-1, Restricted Suburban
Residential District. The impacts of this rezoning will vary from property to property, and
will depend upon the current uses of the property. For most properties the impact will be
minimal. The basic R-1, Restricted Suburban Residential District regulations are attached
for reference.
Ordinance #97-03 will initiate this process at Dublin City Council. This will be followed by
a public meeting at the Planning and Zoning Commission. Following that, it will be
forwarded to City Council for a public hearing and final vote. You will be notified of both
the Planning and Zoning Commission and City Council meetings.
