AN ORDINANCE TO REZONE APPROXIMATELY 14.847
ACRES, LOCATED AT THE SOUTHWEST CORNER OF
THE INTERSECTION OF POST ROAD AND EITERMAN
ROAD, FROM RI, RESTRICTED INDUSTRIAL
DISTRICT, TO PUD, PLANNED UNIT DEVELOPMENT
DISTRICT (BUCKEYE CHECK CASHING - 7001 AND
7003 POST ROAD -CASE N0.06-119Z).
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, of the elected members concurring:
Section 1. That the following described real estate (see attached map marked Exhibit
"A") situated in the City of Dublin, State of Ohio, is hereby rezoned PUD, Planned
Unit Development District, and shall be subject to regulations and procedures
contained in Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City
of Dublin Zoning Code and amendments thereto.
Section 2. That application, Exhibit "B", including the list of contiguous and affected
property owners, and the recommendations of the Planning and Zoning Commission,
Exhibit "C", are all incorporated into and made an official part of this Ordinance and
said real estate shall be developed and used in accordance therewith.
Section 3. That this Ordinance shall take effect and be in force from and after the
earliest period allowed by law.

SUMMARY:
Rezoning application 06-1192 is for 14.847 acres located at the southwest comer of the
intersection of Post Road and Eiterman Road. This application requests a change in zoning
from RI, Restricted Industrial District, to PUD, Planned Unit Development District. The
proposed PUD zoning will allow for permitted uses under the SO District (to allow medical
offices and make administrative offices a permitted use), as well as to permit the existing
storage building at its current size.
The Planning and Zoning Commission recommended approval of this rezoning request on
August 17, 2006, as a consent item with no conditions, as noted in the attached Record of
Action. This request will maintain current structures on the site, but redefine and broaden
permitted uses consistent with ongoing planning efforts for the Central Ohio Innovation Center
(COIC). The PUD text also indicates that the property will be voluntarily rezoned in the future as
part of the overall standards for the COIC.
Additional information regarding this case is available for public viewing at 5800 Shier-Rings
Road in the offices of Land Use and Long Range Planning.
The public hearing (second reading) on the requested zoning change is scheduled for
September 18, 2006.
RECOMMENDATION:
Staff recommends approval of Ordinance 52-06.

State briefly how the proposed zoning and development relates io the existing and potential future land use character of the vicinity:
Although the existing zoning is RI, the property is being used
as office under a conditional use. This zoning will make that
a permitted use, allow the use of space for medical services
(dialysis) and preserve the permitted use of the storage barn
on the side of the property away from the freeway (U. S. Route 33)
State briefly how the proposed zoning and development relates to the Dublin Community Plan and, if applicable, how the proposed rezoning
meets the criteria for Planned Districts [Section 153.052(6)]:
The new zoning will make this proerty consistent with the
surrounding tech park. The land, buildings, and uses will
remain essentially unchanged except to allow a dialysis lab
which will be compatible with the surround uses.

Preamble
The existing property is zoned RI, Restricted Industrial District, with a
conditional use that permits the present office use. Such use, however, prohibits a
dialysis treatment center. A dialysis center is compatible to the medical-related uses
being currently developed with UMC Ventures Corporation and the City of Dublin. The
surrounding office zoning is therefore desirable.
A rezoning to SO, Suburban Office and Institutional District, would make an
existing storage building on the western portion of the property a nonconforming use.
This application, therefore, is submitted as a PUD, Planned Unit Development District, to
permit medical offices in addition to the existing administrative offices on the site.
Text
Permitted uses within the Post Road PUD shall include those permitted uses as
listed for the Suburban Office and Institutional (SO) District specified in Section
153.026(A) of the Dublin Zoning Code. All requirements of the Dublin City Ordinances,
as it relates to properties within the SO District, shall be applicable to this site except in
the following two regards:
1. The 8,656 squaze-foot storage building on the northwest corner of the site shall
be a permitted use under this PUD zoning; and
2. As the application anticipates no change in any of the building, structures or
grounds, a site plan of existing conditions shall serve as the development plan for this
site. It is anticipated that the site will be subdivided and platted in conjunction with
UMC Ventures and the City of Dublin in the future to accomplish major infrastructure
improvements for the Central Ohio Innovation Center (CO[C)_ Upon completion of
future development standards, the property will be rezoned as a component of the larger
research and technology-related development within the COIC.

BACKGROUND:
Case Summary:
This is a request for review and approval of a rezoning (preliminazy development plan) to
PUD, Planned Unit Development District, for an existing development on 14.847 acres
located at the southwest corner of Eiterman Road and Post Road. The established office
development is currently zoned RI, Restricted Industrial District, which requires
conditional use approval for administrative office uses. The current administrative office
tenants obtained conditional use approval from the Planning and Zoning Commission in
November 2004; however, medical offices are not allowed in the current zoning. The
proposed rezoning retains the site in its current state but will hermit administrative and
medical offices consistent with the 1997 Dublin Community Plan and ongoing planning
efforts for the Central Ohio Innovation Center (COIC). Staff recommends approval of this
rezoning request.

Case Procedure for Rezoning (Preliminary Development Plan):
The purpose of the PUD process is to encourage imaginative architectural design and
proper site planning in a coordinated and comprehensive manner, consistent with accepted
land planning, landscape architecture, and engineering principles. The PUD process can
consist of up to three basic stages:
1) Concept Plan (Staff, Commission, and/or City Council review and
comment);
2) Zoning Amendment Request (Preliminary Development Plan;
Commission recommends and City Council approves/denies); and
3) Final Development Plan (Commission approves/denies).
The general intent of the preliminary development plan (rezoning) stage is to determine the
general layout and specific zoning standards that will guide development. The Planning
and Zoning Commission must review and make a recommendation on this preliminary
development plan (rezoning) request. The application will then be returned to City
Council for a public hearing and final vote. Atwo-thirds vote of City Council is required
to override a negative recommendation by the Commission. If approved, the rezoning will
become effective 30 days following the Council vote. Additionally, all portions of the
development will require final development plan approval by the Commission prior to
construction.
Review Criteria for Rezoning (Preliminary Development Plan):
In accordance with Section 153.055(A) Plan Approval Criteria, Code sets out the
following criteria of approval for a preliminary development plan (rezoning):
1) The proposed development is consistent with the purpose, intent and
applicable standards of the Dublin Zoning Code;
2) The proposed development is in conformity with the Community Plan,
Thoroughfare Plan, Bikeway Plan and other adopted plans or portions
thereof as they may apply and will not unreasonably burden the existing
street network;
3) The proposed development advances the general welfare of the City and
immediate vicinity and will not impede the normal and orderly development
and improvement of the surrounding areas;
4) The proposed uses are appropriately located in the City so that the use and
value of property within and adjacent to the area will be safeguarded;
5) Proposed residential development will have sufficient open space areas that
meet the objectives of the Community Plan;
6) The proposed development respects the unique characteristic of the natural
features and protects the natural resources of the site;
7) Adequate utilities, access roads, drainage, retention and/or necessary
facilities have been or are being provided;
8) Adequate measures have been or will be taken to provide ingress and egress
designed to minimize traffic congestion on the surrounding public streets
and to maximize public safety and to accommodate adequate pedestrian and
bike circulation systems so that the proposed development provides for a

safe, convenient and non-conflicting circulation system for motorists,
bicyclists and pedestrians;
9) The relationship of buildings and structures to each other and to such other
facilities provides for the coordination and integration of this development
within the PD and the larger community and maintains the image of Dublin
as a quality community;
10) The density, building gross floor area, building heights, setbacks, distances
between buildings and structures, Yazd space, design and layout of open
space systems and parking areas, traffic accessibility and other elements
having a bearing on the overall acceptability of the development plan's
contribution to the orderly development of land within the City;
11) Adequate provision is made for storm drainage within and through the site
so as to maintain, as far as practicable, usual and normal swales, water
courses and drainage areas;
12) The design, site arrangement, and anticipated benefits of the proposed
development justify any deviation from the standard development
regulations included in the Dublin Zoning Code or Subdivision Regulation,
and that any such deviations aze consistent with the intent of the Planned
Development District regulations;
13) The proposed building design meets or exceeds the quality of the building
designs in the surrounding area and all applicable appearance standards of
the City;
14) The proposed phasing of development is appropriate for the existing and
proposed infrastructure and is sufficiently coordinated among the various
phases to ultimately yield the intended overall development;
15) The proposed development can be adequately serviced by existing or
planned public improvements and not impair the existing public service
system for the area; and
16) The applicant's contributions to the public infrastructure are consistent with
the Thoroughfare Plan and aze sufficient to service the new development.
CONSIDERATIONS:
Site Characteristics:
• Site Description/Existing Conditions. The 14.847-acre site is divided into two
parcels, with 7001 Post Road and an associated storage building located to the
north in Union County and 7003 Post Road located to the south in Franklin County.
The site is generally flat and contains two office buildings totaling approximately
98,500 square feet with associated parking and aesthetic ponds. An 8,656-squaze-
foot building was constructed at the northwest corner of the site in 2005 and is used
for storage purposes.
Community Plan Issues:
• 1997 Community Plan. This site is designated as part of the US33/SR 161 Area
Plan within the 1997 Dublin Community Plan. The plan calls for office and
research/development uses within the immediate area. This rezoning request would

the intent of the plan to encourage "mixed-use employment emphasis."
• Central Ohio Innovation Center. The site is also part of on-going planning efforts
for the Central Ohio Innovation Center (COIC) and is being studied as part of the
Community Plan update. The site and surrounding areas are considered part of a
high-profile area of the COIC that will focus on major medical research and office
components. The proposed rezoning will permit more compatible uses until such
time as zoning and development standards are in place for the COIC.
Land Use and Zoning:
• Existing Zoning. The site is currently zoned RI, Restricted Industrial District,
which permits a wide range of manufacturing and wholesale uses. Laboratories
and administrative offices, which are anticipated uses for this portion of the Central
Ohio Innovation Center, are conditional uses under the current zoning.
Surrounding properties are zoned SO, Suburban Office and Institutional District
with conditional use approval for educational and research laboratories.
Surrounding properties will be rezoned in the future as part of the COIC.
• Proposed Zoning. The proposed PUD text permits those uses allowed within the
SO District (administrative and medical office, institutions, and organizations). It
also stipulates that the existing 8,656-square-foot storage building constructed in
2005 will remain as a legally permitted use.
Development Standards:
• SO Standards. The site includes a total of two office buildings and one storage
building with associated improvements. Applicable development standards as
noted within the PUD text will defer to those required by Code for SO District
properties. Following the completion of development standards for the COIC, this
site will be included with a larger rezoning for the research and technology park.
Site Layout:
• Site Modifications. This rezoning is proposed to address uses only, and no site
improvements are proposed. "As Built" drawings were required as part of a
conditional use approval in 2004 and will serve as the approved development plan.
Any future changes to the site will require approval for an amended final
development plan.
Access Considerations/Traffic Management:
• Access. The site currently includes one entrance on Post Road and a second on
Eiterman Road. The Post Road access will be located within limited access right-
of-way required by ODOT for the US 33/SR 16 i interchange improvements and
will be relocated to the west. Realignment of Eiterman Road as part of the public
infrastructure improvements for the COIC will also impact the second access and
some existing parking areas. All access issues will be addressed in the future as
part of the platting process for public road improvements and the subdivision of
land.

Landscaping:
Compliance Issues. Conditional use approval in 2004 for the administrative offices
of Buckeye Check Cashing required that all issues relating to non-compliant
landscaping and ADA signage be addressed. Those items were resolved in
conjunction with prior permit requests. Any future site modifications will require
compliance with Code and review by the Commission.
Signage:
Sign Conditions. Sign variances were granted for Adria labs in 1988 to permit a
total of 80 square feet of Signage instead of 66 squaze feet. As pazt of the
conditional use approval in 2004, any future Signage was required to meet Code
requirements. The proposed PUD text indicates that the site will comply with
Code requirements for the SO District, or as modified in the future as part of
development standazds for the COIC.
STAFF RECOMMENDATION:
This site is an established office development located on a site zoned RI, Restricted
Industrial District. Previously, the development standazds for this zoning district were
modified to include administrative offices as a conditional use. The proposed zoning to
PUD will permit a wide range of medical and administrative offices that aze intended as
compatible uses within the Central Ohio Innovation Center. `This request will eliminate
industrial zoning and will permit uses compatible with future development surrounding the
site until such time as the area is rezoned as part of the COIC. Staff recommends approval
of this rezoning request:
Bases:
1) The proposed uses are consistent with the general intent of the 1997 Dublin
Community Plan and ongoing planning efforts for the Central Ohio Innovation
Center.
2) The proposed zoning will provide for temporary and compatible zoning with
surrounding properties until such time as development standards are established for
the lazger Central Ohio Innovation Center.

Preamble
The existing property is zoned Ri, Restricted Industrial District, with a
conditional use that permits the present office use. Such use, however, prohibits a
dialysis treatment center. A dialysis center is compatible to the medical-related uses
being currently developed with UMC Ventures Corporation and the City of Dublin. The
surrounding office zoning is therefore desirable.
A rezoning to SO, Suburban Office and Institutional District, would make an
existing storage building on the western portion of the property a nonconforming use-
This application, therefore, is submitted as a PUD, Planned Unit Development District, to
permit medical offices in addition to the existing administrative offices on the site.
Text
Permitted uses within the Post Road PUD shall include those permitted uses as
listed for the Suburban Office and lnstitutional (SO) District specified in Section
153.026{A) of the Dublin Zoning Code. All requirements of the Dublin City Ordinances,
as it relates to properties within the SO District, shall be applicable to this site except in
the following two regards-
1. The 8,656 square-foot storage building on the northwest comer of the site shalt
be a permitted use under this PUD zoning; and
2. As the application anticipates no change in any of the building, structures or
grounds, a site plan of existing conditions shall serve as the development plan for this
site. It is anticipated that the site will be subdivided and platted in conjunction with
UMC Ventures and the City of Dublin in the future to accomplish major infirastntcture
improvements for the Central Ohio Innovation Center (COIC)- Upon completion of
future development standards, the property will be rezoned as a component of the larger
research and technology-related development within the COIC.

John Talentino was the planner for this Code Amendment, but he gave no formal presentation.
Mr. McCash said office use makes sense, and is adown-zoning in an industrial district. He had
no problem having office uses within Restricted Industrial District areas.
Ms. Clarke said virtually all the permitted uses in the Restricted Industrial District are awful. If
office use is requested in the RI District, the owner is forced to rezone the land. For the
municipality, rezoning is a good thing because Dublin wants the old industrial zones to disappear.
On balance, this code amendment makes the old industrial district more usable, which is not good.
However, the Zoning Code will be totally revamped starting in 1999, and this is a temporary fix.
Mr. Sprague said developers can apply for a Restricted Industrial District to be rezoned for office
use. Ms. Clarke said rezoning is not always easy, and she cited the SuperAmerica site.
Mr. Fishman was not in favor of this amendment because it will allow a developer to build an
office in the Avery Road industrial area.
Ms. Clarke said buildings such as Adria Labs were built predominately as office structures as part
of a testing laboratory complex in the Restricted Industrial District. However, when the lab
moved out, office use was not permitted in the office building because it was no longer an
accessory. The staff denied a building permit to someone who wanted to rehab the space for
office use. Council, by motion, decided to permit office uses at the Adria site. This was only
a temporary fix of the problem. Ms. Clarke said staff would like this code amendment approved
as a temporary measure until the Zoning Code is revised.
Mr. Fishman wanted the conditional uses for office use to expire after one year. Ms. Clarke said
an office building built under a conditional use cannot be removed after one year. Mr. Fishman
understood. Ms. Clarke predicted that revising the Zoning Code would take more than a year.
Mr. L,ecklider had no problem with this Code Amendment.

absent from the meeting.
Mr. Jezerina moved, seconded by f~1r. Berlin, to approve the inutes of

Stu y. During a discussion f~1r. Miller suggested d~viding each of the

tion from this Commissi n as soon as possible t assist them in prepar-

l~lr. Jeff Brown, Attorney for Adria, was present to request a Conditional
Use Permit for laboratories for research and testing in the RI (Restricted
Industrial) zoning.
f~lr. Callahan moved, seconded by i-1r. Jezerinac, to recommend approval of
the Conditional Use Permit for all existing structures and uses requiring
such permit. He added that enlargement or expansion of any permitted use

expansion of conditional uses will require application for a specific
Conditional Use Permit covering the use and shall include specific plot

uses and other properties. Vote on the motion was unanimous for approval.
(Mr. O'Alonzo did not vote since he was not yet sworn in as a Commission
member.)

Mr. Callahan questioned ection A 3) "provided at the payment of suc
fee as hereinafter set orth by any person, fi m, corporation or asso ca-
tion enumerated herei shall be deemed in co liance with this Chapt r."
and said he interpre s it to mean if they p a fee they are in com liance.

responsible or there on the specifi property. Mr. Gunner aid the ordin-

Mr. Cal ahan questioned Sectio C (g) and (4)(b) (page ) and f1r. Miller

getting away from hat. fir. Gunner said y cannot prohibit elect onic
games in the Vil <ge, but you can control heir use.
After further iscussion, ilr. flacklin pointed fir. Reiner to place

gested the ommittee incorporate any changes and discuss it gain at the
April 6th eetinq.

trial District (RI) might be a better zoning in the event Adria would Nome

preferred in order to allow office use. Mr. WolFe added that changing
the use of a building cannot be done without coming back to the Village.
Mr. Hutchins moved, seconded by Mr. Mond, to approve the application.
Vote on the motion was unanimous for approval.
