AN ORDINANCE AUTHORIZING THE PURCHASE OF A 0.008
ACRE, MORE OR LESS, UTILITY EASEMENT, AND A
COMBINED 0.249 ACRE, MORE OR LESS, TEMPORARY
CONSTRUCTION EASEMENT, FROM LOWES HOME CENTERS,
INC., LOCATED SOUTH OF VILLAGE PARKWAY, CITY OF
DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO.
WHEREAS, the City of Dublin is preparing to extend Shamrock Boulevard and realign
Village Parkway to improve related traffic circulation; and
WHEREAS, said improvement required the City of Dublin to obtain a utility easement
and temporary construction easement in and to the premises described in the attached
Exhibits "A" and "B" and "C" located in the City of Dublin, Franklin County, Ohio; and
WHEREAS, the City desires to enter into an agreement to purchase a 0.008 acre, more or
less, utility easement and a 0.249 acre, more or less, temporary construction easement for
the extension of Shamrock Boulevard and realignment of Village Parkway for $13,000.00;
and
WHEREAS, the aforementioned objectives will require the City of Dublin to obtain a
utility easement in the 0.008 acre, more or less, and a 0.249 acre, more or less, temporary
construction easement, located south of Shamrock Boulevard, in the City of Dublin,
Franklin County, Ohio, as described in the attached Exhibits "A" and "B" and "C"; and
WHEREAS, it is necessary to amend the annual appropriations ordinance to provide
funding authorization for the acquisition of the property.
NOW, T1~iEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of
Ohio, of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute a Real Estate Purchase
Contract and any necessary closing documents related to the acquisition of the 0.008 acre,
more or less, utility easement and a 0.249 acre, more or less, temporary construction
easement and paying any related costs.
Section 2. There be appropriated from the unappropriated balance in the Shamrock
Boulevard TIF Fund Thirteen Thousand Dollars and 00/100 Cents ($13,000.00) to account
444-0314-780-2551, for the purpose of acquiring the 0.008 acre, more or less, utility
easement and a 0.249 acre, more or less, temporary construction easement and paying any
related costs.
Section 3. This Ordinance shall take effect and be in force from and after the earliest
date permitted by law.

RE: Shamrock Boulevard Extension -Ordinance No. 50-06
SUMMARY:
This project requires appropriation ofright-of--way, utility easements and temporary construction
easements from seven (7) property owners for the extension of Shamrock Boulevard and
realignment of Village Parkway. An agreement has been reached with Lowes Home Centers,
Inc. for compensation of this acquisition. The agreed upon compensation was based on an
independent appraisal. A drawing of the proposed utility easement and temporary construction is
attached for your review. Ordinance No. 50-06 has been submitted to Council for approval of
this acquisition.
RECOMMENDATION:
Legal Staff recommends approval of Ordinance 50-06 authorizing this acquisition.

DESCRIPTION of a 0.008 Acres Permanent Easement
Being a 0.008 acres parcel of land located in the City of Dublin, County of Franklin,
State of Ohio, being a part of 15.399 acres in Quartertownship 3, Township 2 North,
Range 19 West, United States Military Lands, as conveyed to Lowes Home Centers, Inc.
per Instrument Number 1990423010182 and also being part of "Reserve C" per Plat
Book 69, Pages 18 , 19 and 20, this and all fiuther references being to the records of the
Franklin County Recorder's Office, said 0.008 permanent easement being more
particularly described as follows;
BEGINNING FOR REFERENCE at a point at the Grantor's northwest corner, said
point also being the northwest corner of Reserve C per Plat Book 69, Pages 18, 19, and
20;
thence, South 86° 28' 02" East, 75.56 feet, with the northerly property line of the Grantor
and the northerly line of said Reserve C, to a point, said point also being the TRUE
POINT OF BEGINNING of Pazcel 7-PEl being described herein;
thence, continuing South 86° 28' 02" East, 68.13 feet, with the northerly line of the
Grantor and the northerly line of said Reserve C, to a point;
thence, South 03° 31' S8" West, 5.00 feet and perpendiculaz to the Grantor's north
property line, to a point;
thence, North 86° 28' 02" West, 68.13 feet, pazallel with and 5.00 feet southerly of the
Grantor's north property line, to a point;
thence, North 03° 31' S8" East, 5.00 feet, to the TRUE POINT OF BEGINNING. The
permanent easement, as described above, contains 0.008 acres, more or less, subject to all
legal highway and other easements of record.
