Form No. 30043 40-06 (Amended) Ordinance No. Passed , 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ACCEPT A DONATION OF 0.029 ACRE, MORE OR LESS, LOCATED APPROXIMATELY 150 FEET SOUTH OF BALLANTRAE DRIVE ON THE EAST SIDE OF MARMION DRIVE, CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO. WHEREAS, the Woodlands at Ballantrae Condominiums has notified the City of Dublin of the desire to donate an approximate 0.029 acre parcel of land located on the south side of Marmion Drive, south of Ballantrae Drive, as depicted on the attached Exhibits Al and A2 to the City; and WHEREAS, the City desires to accept the donation from Woodlands at Ballantrae Condominiums; NOW, THEREFO BE IT ORDAINED by the Council, of the City of Dublin, state of Ohio, of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute any necessary closing documents related to the donation of the Marmion Drive parcel from Woodlands at Ballantrae Condominiums to the City. Section 3. This ordinance shall be effective upon the earliest date permitted by law. Gunderman, AICP, Assistant Director of Land Use and Long Range Planning Re: Ordinance 40-06 -Acceptance of Land Donation Summary The attached ordinance would accept the donation of a 0.029 acre parcel along the east side of Marmion Drive. This parcel is adjacent to a sliver of land owned by the City that was acquired as a part of the Golf Club of Dublin prior to the dedication of the Marmion Drive right-of-way. Discussion City staff is interested in accepting this donation of land to secure the option for a potential access for property to the east. Currently, this property is vacant and only has access off of Rings Road. The development plans for the Hilliard School site and the existing Ballantrae development have eliminated access in all other directions. Development of the property to the east will require a rezoning and development review sometime in the future. If accepted by the City, this property would accommodate a secondary street access to the property to the east, a private street connection if condominiums were built on this site, or at a minimum, an emergency secondary access to the property. Should the City decide not to implement any of these options in the future, this land could then be transferred back to the condominium association. The reason for requesting emergency action at this time is to acquire ownership prior to ongoing sales of condominiums in this area. Acquisition of the property at a later date would be complicated by the number of owners required for approval. During the first reading of this ordinance, Steve Hadden, representing the current owner, described material he had used in reviewing this potential access location with adjacent residents. The applicant indicated that the material would be submitted and it is attached. Gunderman, AICP, Assistant Director of Land Use and Long Range Planning Re: Ordinance 40-06 -Acceptance of Land Donation Summary The attached ordinance would accept the donation of a 0.029 acre parcel along the east side of Marmion Drive. This parcel is adjacent to a sliver of land owned by the City that was acquired as a part of the Golf Club of Dublin prior to the dedication of the Marmion Drive right- of-way. Background City staff is interested in accepting this donation of land to secure the option for a potential access for property to the east. Currently, this property is vacant and only has access off of Rings Road. The development plans for the Hilliard School site and the existing Ballantrae development have eliminated access in all other directions. Development of the property to the east will require a rezoning and development review sometime in the future. If accepted by the City, this property would accommodate a secondary street access to the property to the east, a private street connection if condominiums were built on this site, or at a minimum, an emergency secondary access to the property. Should the City decide not to implement any of these options in the future, this land could then be transferred back to the condominium association. The reason for requesting emergency action at this time is to acquire ownership prior to ongoing sales of condominiums in this area. Acquisition of the property at a later date would be complicated by the number of owners required for approval. Recommendation: Staff recommends approval of Ordinance 40-06, accepting the donation of 0.029 acre, more or less, to the City of Dublin.
