The regularly scheduled meeting of the Dublin Village Council was called to order by Mayor James E. Lewis on Monday, December 1, 1985 at 7:30 P.M. Mr. Thornton led the Pledge of Allegiance. '-.. Members of Council present were: Mr. Amorose, Mr. Close, Mrs. Headlee, Mayor Lewis, Ms. Maurer, Mr. Sutphen and Mr. Thornton. Mr. Stephen Smith, Law Director, was also present. Mr. Sheldon, Village Manager, was absent. Mr. Bowman, Ms. Clarke, Ms. Jordan, Ms. Prushing and Mr. Warner of the Village Staff were also present. Mr. Amorose moved to approve the minutes of the November 18, 1985 meeting of Council. Mr. Thornton seconded the motion. The vote was 7-0 in favor. Mrs. Headlee made a motion to approve paying the bills. Mr. Sutphen seconded the motion. The vote was unanimous in favor. Mayor Lewis mentioned that one item of correspondence that will be brought up at the next meeting was an application for a liquor permit about which there was some question and lack of information. He noted that the Law Director will investigate the request further and report at the next meeting. ",..... '-' Ordinance No. 75-85 - Approving I.D.R.B. - Metro Medical Park. Public Hearing. Mayor Lewis said ~hat the public hearing was not only being held for presentation of information to the public, but also to satisfy the rules of the Internal Revenue Service. He also noted that the induce- ment ordinance was passed in .Tuly of 1985. Ms. Kim Rothermel and Mr. Dan Schoedinger registered as prODonents of the ordinance. There were no opponents. Hr. Schoedinger of Vorys, Sater, Seymour and Pease presented ~he following points: 1. ,The project is a medical office building on Blazer Memorial Parkway. 2. It is approxinately two acres of land. 3. The parking will be behind the building with the landscaping around it. 4. The building will have approximately 18,500 sq. ft. of floor space, two stories. 5. Tt is anticipated that the project will generate employment of approximately 20 people. 6. A major portion of the project will be rented to Rogers and Rothermel, a medical professional organization, as well as to Mt. Carmel Health. "".... Responding to a question from Mr. Close regarding the "parking situation' Mr. Schoedinger said that one of the reasons that the bond ordinance was not being considered this evening was that it was recently worked out that instead of taking a total of four acres and dividing it up into two two acre tracts is what has been done is taking a total of a three acre tract and dividing it up into two 1~ acre tracts. He indicated that what they have done is taken a two acre tract which will give them the required space. Mr. Schoedinger indicated that the land to the north has been retained by TechMart; access to the property would come off of Dublin TechMart. "-' With regard to the status of the lending agencies, Mr. Schoedinger said that they have worked out the documents for all the transactions _ it was simply a matter of not being able to get those documents completed in time for the meeting. He indicated that those documents would be available for consideration by Council Members by the end of the week or the beginning of the following week for Council's deliberation at the meeting of December 16th. Mr. Amorose suggested that with the continued development along Blazer Memorial Parkway that consideration, in the best interest of the Village, be given to construction of curb and gutters along the roadway. Mr. Schoedinger said that the information would be passed along to the borrower. He also indicated that no formal action was required by Counci at this meeting. Ordinance No. 72-85 - Proposed Appropriations for Fiscal 1986. Second Reading. There were no comments. ,-. Ordinance No. 73-85 - Adopt 1984-1985 Amendments to Fire Prevention Code. Second REading. There were no comments. ,-". Ordinance No. 74-85 - Approve the Updating of the Codified Ordinances. First Reading. Mrs. Headlee introduced the ordinance. Mrs. Headlee moved to do away with the three time reading rule and treat as an emergency. Mr. Amorose seconded the motion. The vote was unanimous in favor. It was noted by Mr. Smith that a meeting has been scheduled for December 10, 1985 with representatives of the Walter H. Drane Company to discuss possible reorganization of the land use sections of the Code as well as other possible suggested changes. The vote on the ordinance was 7-0 in favor. ,.... Other Subject of Appointing an Interim Manager for the Village of Dublin During the Disability of Mr. Sherman Sheldon. Mr. Smith, the Law Director, announced that an emergency meeting of Council had been held on Monday, November 25, 1985 due to the illness of Mr. Sheldon. At that meeting the Dublin Village Council appointed the Mayor, by motion, to act as an interim manager during Mr. Sheldon's absence. He noted that Mr. Sheldon's illness had occurred over the weekend and immediate action was required, thus the meeting was not advertised. Mr. Smith said that the motion was put on the agenda to ratify publicly what was done in the emergency session. Mr. Close moved that Council ratify in open session the action taken on November 25th, finding the Village Manager unable to pursue, at the present time, his responsibilities, and appointing James E. Lewis as acting manager of the Village. She said that since the emergency meeting of Council she had studied the Village Charter. She also noted that she had been a member of the Charter Commission and commented that she had a concern about appointing the Mayor as Village Manager. Ms. Maurer referred to the Charter, Section 5.03 which states the following - "If such a designation has not been made and the Manager is absent from the Municipality or unable to perform his or her duties or to make such designation, the council may, by motion, appoint any qualified administrative officer of the Municipalit~ to perform the powers, duties, and functions of the City Manager until he or she shall return to the Municipality or the disability ceases." Ms. Maurer said that since the meeting she had discussed the meaning of those words and the Charter as a whole with several members of the Charter Commission. She said that she felt that the legal question was, "who is an administrative officer of the Village?" She also indicated that the Village's Law Director felt that the Mayor or Vice-Mayor are indeed administrative officers. Ms. Maurer said that based on the discussions with the members of the Charter Commission that to appoint the Mayor as Acting Village Manager was a violation of the intent of the Village Charter. She said that she did not question the competence of the current Mayor to assume the responsibilities of the position of the Village Manager. Ms. Maurer referred to another section of the Charter which describes the duties of the Mayor - to serve as president of the Council: to exercise all judicial powers and functions granted to mayors; to perforn ceremonial duties and functions as necessary: to exercise military powers and functions granted to mayors of municipal corporations by the laws of Ohio or the laws of the United States; to perform or exercise such other powers, duties and functions as provided by this Charter and the rules of the Council, to the extent such rules of the Council are consistent with this Charter. r- ,,-. Ms; Maurer then described the duties of the Manager as described in Section 5.04 (noting that the Manager has clearly administrative duties She also mentioned Section 5.05 which is a discussion of Council Manager Relations which was put in the Charter because the Commission clearly did not want to have an interference by Council in the duties of the Manager, noting that she felt that Council and its members are very different from administrative officers, and are forbade from interfering with appointment of administrative officers by the Manager. She further said that department heads are administrative officers. She also indicated that the Charter Commission felt very strongly that the person responsible for the hiring and firing and promoting police officers should not be in a position where they have to determine whether or not those police officers are telling the truth or not, or whether or not they are living up to their responsibilities. They (the Commission) were also very strongly in favor of a separation of administrative and legislative powers. M11' Maurer further stated the following - 1 Allow the Council to reconsider and act upon a new appointment upon the accession of the new Council. There will be two new Council Members in January. 2) In the interim Council make it possible for one of the Village's administrative officers (probably the Finance Director) to take over those responsibilities temporarily. ..... The Village should proceed with the recommendation of the Manager for an Assistant Village Manager to the extent that the Village advertise and accept applications for the position. Ms. Maurer moved to amend the motion of Monday night (November 25th) so that the appointment of the Acting Manager would terminate upon the date of the first meeting of Council in 1986, at which time the new Council would have the opportunity to reconsider the appointment to continue it, to discontinue it, or to appoint another Acting Manager. At that time the Village Council could reconsider or reappoint or appoint another person as Manager. Mr. Close asked Mr. Smith that since Council would have to elect a new Mayor and Vice-Mayor that this would have to be done irrespective of the motion. Mr. Smith said that was correct. There was no second to the motion by Ms. Maurer. The vote was as follows on the first motion: Mr. Sutphen, yes; Mr. Amorose, yes; Mr. Thornton, yes; Mrs. Headlee, yes; Ms. Maurer, no: Mr. Close, yes; Mayor Lewis, abstain. Council Roundtable Discussion Mr. Thornton r- Mr. Thornton thanked Catherin and George Headlee for the lovely Christmas tree in the lobby of the Municipal Building and said that he was sure that it would be appreciated by many people in the future as well. ~ Mayor Lewis said that he was sure that Mr. Thornton spoke not only for members of Council but for the community as well. Mrs. Headlee Mrs. Headlee said that she would like to see available in the Municipal Building the Franklin County water and sewer service computer print-- outs which are available and which she had asked about in March of 1985. Responding to a question from Mr. Amorose, Mrs. Headlee said that the printouts have information regarding the water, the depth of soil, the type of soil, suggestions regarding the number of houses per acre, where houses should/should not be built, etc. Mr. Sutphen Responding to a question from Mr. Sutphen regarding the "opening up" of Avery Road (the loop), Mr. Warner said that as soon as the weather gets warmer it would be striped down and be opened up (hopefully this weekend) . - Mr. Amorose ..... Mr. Amorose mentioned Blazer Memorial Parkway and the increasing truck and bus traffic creating problems with the berm along the roadway. Mr. Amorose had some comments regarding the usage of the temporary vacant lot at 220 w. Bridge Street (formerly the Bank One site). The site has been used for a Christmas tree lot, pumpkin sales, etc. The site, when vacated, has not been cleaned up and restored to its original condition in a timely manner. Mr. Amorose said that he thought, with this site in particular, since it is on the main street in Dublin that the Village should have some kind of requirements - a specific time limitation for temporary sales and some conditions as to how they will 'leave" the site. Fonn No. 1097"" Held m uDece_mbeI"?'ul~8 5 19 Page Five ~ , ''ilIr Mr. Amorose told members of Council that he and Mr. Sutphen have been meeting regulary as liaisons with the School Board and will report back to Council after the first of the year with some recommendations. Ms. Maurer Ms. Maurer suggested that the job description for the Assistant Village Manager be placed on the agenda for the next Council meeting. She also suggested that the job description be included in the Council packets prior to the next Council meeting. Mayor Lewis said that he wanted it understood that he has no intention of proceeding in interviewing or hiring for that position as long as he is Acting Village Manager. Mr. Close ,..... t: Mr. Close said that with regard to the job description for an Assistan Village Manager that the only comment he would have is that the salary range suggested be examined more closely. Mr. Close mentioned the difficulty that people have, at times, in getting assistance at the police station during late evening and early morning hours. He suggested that the Village explore the possibility of installing an emergency telephone outside of the police entrance. ~ Mayor Lewis expressed his appreciation to members of Council for the confidence they expressed in asking him to act as Acting Manager in Mr. Sheldon's absence.
