The regularly scheduled meeting of the Dublin Village Council was called
to order by Mayor James E. Lewis at 7:30 P.M., on Monday, November 18,
1985.

Mr. Thornton led the Pledge of Allegiance
Members of Council present were: Mr. Amorose, Mr. Close, Mrs. Headlee,
Mayor Lewis, Mr. Sutphen, and Mr. Thornton.
Ms. Maurer arrived at 7:33 P.M.
Mr. Sutphen made a motion to approve the minutes of the November 4, 1985
meeting. Mr. Thornton seconded the motion. The vote was 6-0 in favor.
Mr. Amorose made a motion to approve payment of the bills. Mrs. Headlee
seconded the motion. The vote was 6-0 in favor.
Ordinance No. 66-85 - Licensing of Day Care Centers. Third Reading.
The vote was 6-0 in favor.

Resolution No. 29-85. Appointing Village Bond Counsel. First Reading.
Mrs. Headlee introduced the resolution.
Mr. Thornton moved to accept the recommendation of the Finance Director
to accept the appointment of Squires, Sanders, and Dempsey as bond
counsel, do away with the three time reading rule and treat as an
emergency.
Mr. Sutphen seconded the motion.
The vote was 7-0 in favor of doing away with the three time reading rule
and treating as an emergency.
The vote on the resolution was 6-0 in favor; Mr. Close voting, no.

Ordinance No. 70-85 - Rezone 5.2 Acres at Martin Road and Sawmill Road.
First Reading.
Mr. Thornton introduced the ordinance.
Mayor Lewis referred to a memorandum from the Law Director to the Council
in regard to motions dealing with recommending ordinances for further
consideration for Planning and Zoning.
Mr. Close moved to refer the ordinance to Planning and Zoning, contingent
upon their meeting the requirements of the Planner prior to its being
placed on the agenda.
Ms. Maurer seconded the motion.
The vote was 7-0 in favor of the motion.
Mayor Lewis explained that the reason for the motion - the Planning
Department is instituting a checklist procedure - so that the various
land owners and developers might be informed of the change in the operatinl
procedure in order for items to move from the Council to the agenda of
the Planning and Zoning Commission.

Ordinance No. 71-85 - Inducement for I.D.R. Bonds - Discovery Systems.
First Reading.
Mrs. Headlee introduced the ordinance.
Mr. Phillip Johnston of Vorys, Sater, Seymour and Pease was present at
the meeting. Mr. Johnston introduced Mr. Mike Ward of Discovery Systems
who was also present.
Mr. Johnston referred to the Certificate of approval from the Dublin
Community Improvement Corporation; said certificate being signed by
the President and Secretary of the Community Improvement Corporation.
Mr. Johnston also said that Federal Law also permits them to start the
project before actually issuing the bonds.

Mr. Close moved to do away with the three time reading rule and treat as
an emergency.
Ms. Maurer seconded the motion.
The vote on doing away with the three time reading rule and treating as
an emergency was as follows: Mr. Thornton, yes; Mr. Close, yes; Mrs.
Headlee voted no for the reason that she had received no information on
the project prior to arriving for the meeting; Ms. Maurer, yes; Mayor
Lewis, yes; Mr. Sutphen, yes; Mr. Amorose, yes.
Mr. Smith, Law Director, informed Council that PERS was an equity partner
in the project.
The vote on the ordinance was as follows: Mr. Amorose, yes; Mr. Sutphen,
yes; Mayor Lewis, yes; Ms. Maurer, yes; Mrs. Headlee, no; Mr. Close,
yes; Mr. Thornton, yes.
Ordinance No. 72-85 - The Proposed 1986 Appropriations. First Reading.
Mrs. Headlee introduced the ordinance.

Resolution No. 30-85 - Waterford Village Storm Sewer Assessments. First
Reading.
Mr. Close introduced the resolution.
Mr. Warner said that the estimated assessment was slightly higher than
that in the agreement with the property owners (about $200 higher for
each property owner).
Mr. Warner also said that the property owners have not yet been notified
regarding the matter. He said that the owners have to be notified of
the estimated assessments.
Mr. Smith said that the property owners will be notified after the
resolution has been passed, and depending upon their reaction, a decision
will be made at the next meeting as to how the Village will proceed.
Mrs. Headlee made a motion to do away with the three time reading rule
and treat as an emergency.
Mr. Thornton seconded the motion.
The vote was 7-0 in favor.
The vote on the resolution was unanimous in favor.

Ordinance No. 73-85 - Adopt 1984-1985 Amendments to Fire Prevention Code.
First Reading.
Mrs. Close moved to waive the Council Rules of Order, add the item to
the agenda, and introduced the ordinance.
Mr. Sutphen seconded the motion.
The vote was unanimous in favor.

Mayor Lewis announced that so far this year the Village has issued
approved building permits in the amount fo $94,514,043.00, breaking
previous records, and from all appearances it may be repeated next year.
He commended members of Staff and Council for their outstanding job in
keeping pace with the rapid growth of development in the Village of Dublin.

Mayor Lewis congratulated former Mayor Joe Dixon of Dublin and his wife
Lois on their 50th Wedding Anniversary.

Mayor Lewis referred to the mememorandum from the Village Engineer re-
garding a requested building permit from the builders at "The Woods of
Dublin", asking for an exception to the requirement that a building
permit cannot be issued prior to completion of paving of the streets.
The request was being sought because of the recent rainy weather and
the imminent closing of the asphalt plants for the winter.
Mr. Warner said that it was possible that they could get the street
paved, and in that case would not require the waiver. He also said that
they have agreed to add extra stone to protect the stone base already
in place.
Mr. Close moved to grant the exception, conditional upon the developer
putting in an extra 2~" of gravel; conditioned fl,1rther on a sufficient
performance bond to secure the completion; conditioned further upon the
Engineer signing off that the gravel is not contaminated and is ready
for asphalt prior to the work being done in the spring.
Mr. Smith suggested saying "performance bond or a letter of credit".
Mrs. Headlee seconded the motion.
The vote was as follows: Mr. Close, yes; Mrs. Headlee, yes; Ms. Maurer,
yes; Mr. Amorose, no; Mayor Lewis, yes; Mr. Sutphen, yes; Mr. Thornton,
yes.
Mrs. Headlee commented favorably on the new chairs provided for Council
Members.

Mr. Close moved that all future items referred to Planning and Zoning
by Council not be placed on their agenda until the requirements of the
Planner have been satisfied, including such requirements as he might
make concerning a timely submission to him.
Mr. Sutphen seconded the motion.
The vote was unanimous in favor.
Mr. Sheldon recommended renewing the five year contract with the Walter
H. Drane Company for purposes of updating the Codified Ordinances for
the Village of Dublin.
There were no objections by members of Council.
Mr. Close suggested that the Village also ask the company to, at the
same time, submit a bid for the reorganization of the land use sections
of the code.
Mayor Lewis noted that the bids have been opened for the Scioto Bridge
Rehabilitation project and that the Village was looking forward to the
project getting underway.
The meeting was adjourned by Mayor Lewis at 7:57 P.M.
