Held October 7, 1985 19_ The regularly scheduled meeting of the Dublin Village Council was called to order by Mayor James E. Lewis at 7:30 P.M. on Monday, October 7, 1985. "...... I Mr. Thornton led the Pledge of Allegiance. ~ Members of Council present were: Mr. Amorose, Mr. Close, Mrs. Headlee, Mayor Lewis, Ms. Maurer, Mr. Sutphen, and Mr. Thornton. Mr. Stephen J. Smith, Law Director, and Mr. Sherman Sheldon, Village Manager were also present as were Mr. Bowman, Ms. Jordan, Ms. Prushing, and Mr. Warner of the Village Staff. Mr. Amorose moved to approve the minutes of the September 16th meeting of Council. Mrs. Headlee seconded the motion. The vote was as follows: Mr. Amorose, yes; Mr. Close, yes; Mrs. Headlee, yes; Mayor Lewis, yes; Ms. Maurer, yes; Mr. Sutphen, abstain; Mr. Thornton, yes. Mr. Sutphen moved to approve payment of the bills. Mr. Thornton seconded the motion. The vote was unanimous in favor. ".... Correspondence Requests received for one of Liquor Control. 1. There were no objections from members of Council to either request. '-" - Public Hearing Ordinance No. 49-85 Rezone 12.25 Acres on South Side of Dublin-Granville Road. Mayor Lewis said that at the last Planning and Zoning Commission Meeting the classification for the rezoning was changed and that approval at the meeting would be for the concept plan. Mr. Bowman said that at the September meeting of the Planning and Zoning Commission the zoning classification was amended from the Community Commercial District to the Planned Unit Development District. The Plannin~ and Zoning Commission reviewed the plan at that meeting and approved it in concept only as provided for in the Planned Unit Development regulationE. Mr. Bowman noted that the concept must be approved by both the Planning and Zoning Commission and Council. After approval of the concept, the plan will be brought back in preliminary development plan form for the actual rezoning ordinance. Mr. Bowman said that given the roadway and corridor district issues involved, he said that he felt that Council should be aware of all factors surrounding the development of this particular parcel. He mentioned that the parcel is 12.25 acres, consti- tuting about nine lots on the south side of West Dublin-Granville Road. He noted that the Plaza Properties rezoning was approved by the Planning and Zoning Commission. Mr. Bowman said that the preliminary plat will be brought back to the Planning and Zoning Commission in November, and then will be brought to Council in late November or early December. Mr. Leslie, the applicant, made the following points: 1. The site is approximately 900' west of Sawmill Road. 2. There is approximately 840' of frontage. 3. There are eight owners, nine parcels. 4. The depth of the parcels does create a problem. The objective will be to identify a mixture of uses which will allow them to take full advantage of the full depth of the parcels. 5. The road will be part of a network that will connect S.R. 161 to Martin Road, The width of the road came under discussion, whether or not the 26' width was sufficient, some suggesting that 36' would be a more appropriate width. It was noted that the right-of-way will be 38', and that no major utilitie~ are planned along the road. Mr. Leslie said that uses for the parcels have yet to be determined (not for another two or three months). He noted that there could be one or two uses on the east side of the road and as few as tow or as many as six uses on the west side of the road. Mr. Leslie indicated that businesses expressing interest in the site have been car dealers and banks. I""'" . '-- Responding to a question from Mr. Sutphen it was noted that the road would be curbed and guttered. Mr. Leslie mentioned the future possibility of the property south of the proposed road along Martin Road being developed in the future, the potential being to "straddle" the property line. Mr. Field, an adjoining resident on Martin Road, said that they had no objection to the road if they can also get a favorable rezoning. Mr. Bowman mentioned the Martin Road properties. The roadway development servicing all the properties in the area should either be timed or planned in such a way so that each developer pays his fair share of the cost. Mr. Leslie said that the cost of a road through the middle of his site would be prohibitive. Answering a question from Ms. Maurer, Mr. Leslie said that of the original 16 property owners of the Sharp property (said covenant saying that only single family residences could be built on the property), 11 owners signed an affidavit indicating that they do not want that covenant in their deeds. Mr. Thornton commented regarding the width of the road, mentioning that said road would probably have to handle large truck traffic as well as other traffic and that it would be foolish to consider a road width of just 26'. ..- Ordinance No. 64-85 - Industrial Revenue Bonds for Conquest Corporation. Second Reading. Public Hearing. Mr. Daniel Schoedinger, an attorney with Vorys, Sater, Seymour and Pease registered as a proponent of the ordinance. There were no registered opponents. Mr. Schoedinger had been asked to serve as bond counsel. Mr. Schoedinger made the following comments: 1. A Public Hearing was being held as required by the Internal Revenue Code in order for bonds issued by the Village to be tax exempt (Section 103K of the Internal Revenue Code). 2. The purpose of the hearing being to consider the nature of the project, the location of the project and the issuance of the bonds. ,...... The bonds are to be for a medical office facility at 4351 Dale Drive. It is to be developed by Conquest/Dublin Limited Partnership. It is to contain approximately 14,000 sq. ft. of floor space, and be a 1~ story split level, along with related site improvements, including parking. Mr. Schoedinger also had a form of approval which is necessary for the approving public authority to sign, which members of Council did sign. Noted that the inducement ordinance had been approved by Council on July 1, 1985. Mr. Close moved to do away with the three time reading rule and treat as an emergency. Mr. Sutphen seconded the motion. The vote was unanimous in favor of doing away with the three time reading rule and treating as an emergency. The vote on the ordinance was 7-0 in favor. 4. 5. Resolution No. 16-85 - Proposed Sewer and Water Payback Agreement. Third Reading. Mr. Smith said that he and Mr. Sheldon, who had been involved in negotia- tions regarding the agreement, recommended approval of the resolution. The vote was unanimous in favor of the resolution. ,... c \.. Resolution No. 17-85 - Accept Quit Claim Deed for 5.25 Acres of Park Land. Third Reading. Ms. Jordan, Parks and Recreation Director, said that she had received a letter from Mr. Arnos of the Republic Development Corporation, putting in writing the verbal agreement made that they (Republic Development Corpora- tion) will build the bicycle path and will have the weeds cut initially on the acreage. The vote was 7-0 in favor of the resolution. ....- Resolution No. 19-85 - Intent to Plan Boulevarding at West Dublin-Granville Road. Third Reading. Dr. Donn Griffith, a property owner on West Dublin-Granville Road, was given an opportunity to express his concerns; those being the following: 1. A 26' road will not solve the problem. 2. Ingress and egress to his property - the limiting of left hand turn lanes. 3. Possible future reduction in value of property. Dr. Griffith noted that Dale Drive is 36' wide; he said that he thought that this particular service road at one time was planned to be 50'. Ms. Maurer noted that she thought that the boulevarding would assist those making left turns. Mr. Close said that what Council was considering was the theory of boulevarding as something to explore, allowing the Village to get enough acquisition of right-of-way now or the option to boulevard will never be there. -- Dr. Griffith said that he wanted to go on record as being opposed to the plan until he can see definite plans. Mrs. Headlee commented that a number of members of the Planning and Zoning Commission were in concurrence with members of Council who thought that the 26' road was too narrow. Mrs. Headlee introduced the Ms. Maurer moved to do away an emergency. Mr. Thornton The vote was 7-0 to do away as an emergency. The vote on the resolution was unanimous in favor. First Reading. Emergency. Mrs. Headlee introduced the Resolution. Mr. Warner said that the sanitary sewerline had been moved; therefore, this easement is no longer required. Mr. Close moved to do away with the three time reading rule and treat as an emergency. Mr. Sutphen seconded the motion. The vote was 7-0 in favor. The vote on the resolution was unanimous in favor. c Request for Eight (8) Street Lights in Muirfield. It was noted that Muirfield Ltd. has requested eight additional street lights. Seven of the lights will be on Glick Road entrances or north of Glick Road, and one on Memorial Drive West. Mr. Sutphen moved to approve the request. Mrs. Headlee seconded the motion. The vote was unanimous in favor. Final Plat Approval - Llewellyn Farms - Section II. Mrs. Headlee made a motion to approve the request. Mr. Thornton seconded the motion. The vote was 7-0 in favor. Final Plat Approval - Earlington Village Part 1, Section 1. Mrs. Headlee moved to approve the request for final plat approval. Mr. Sutphen seconded the motion. The vote was unanimous in favor. ".. ( '- Main Sewage Lift Station. Mayor Lewis referred to the memorandum submitted by the Village Engineer regarding the above subject. Members of Council have visited the main lift station. Subsequently, a meeting was held with the Village Manager, Village Enginee , Mr. Thornton, and Mr. McClory in attendance. Mr. Thornton presented the following comments: 1. The West Branch Sewer will not do anything to solve the Village's problems - the construction of same is too far off into the future. The timing of construction of same being tenuous, with pending possible lawsuits, etc. 2. The present system is overloaded - the definition of overloading being that two pumps are often in operation. When the second pump is called into operation, by definition, the system is theoretically overloaded. 3. There have been approximately seven spills in the last year. 4. Fonn No. 1097 ~ Held October 7, 1985 19 Page Six r ~ Mayor Lewis said that as a result of funding, the Law Director may desire to amend the resolution granting the right to build the force main. Mayor Lewis made reference to a memorandum from the Village Engineer regarding the waterline from the Booster Station along Post Road. He commented that Council took action this evening on the Earlington Village and Brandon waterline and sewerline. He noted that there is a contingency in the Brandon portion to loop the waterline into the existing waterline at Donegal Cliffs - the reason for that being to bring the water pressure up along the river all the way to the Muirfield line from Summitview. In considering the eventual expansion of the McKitrick property along with the added additions to the high school as well as additional expansior in other areas, conversations have been held about the advisability of taking the Coffman Road line around to the output of the pump on Post Road. Mr. Warner proposed proceeding with an engineering study regarding the above subject. Mayor Lewis said that the subject would be considered in further detail at the October 21st meeting of Council. Mayor Lewis suggested that members of Council review the applications of response for Council Representative to the Dublin Fund and be prepared for further discussion at the October 21st Council Meeting. \.... It was noted that Lorraine King has resigned as Council Representative to the Dublin Arts Council. Mr. Sheldon will advertise in the paper, seeking interested candidates. "..... Mayor Lewis noted a copy of a letter received from the Dublin Schools addressed to the Dublin Foundation and suggested that members of Council read same. Referred to was an invitation from the Washington Township Fire Department inviting members of Council to a luncheon at the Riviera Country Club on Wednesday, October 9, 1985 in recognition of Fire Prevention Week. Council Roundtable Discussion 1. Mr. Close ,..- Mr. Close reffered to the memorandum from Mr. Sheldon and a report from Chief R. F. Mayer regarding accident on S.R. 745. He noted that there have been approximately 2+ accidents per month in the last eighteen months in that area, seemingly the majority of accidents occurring between Limerick Lane and Memorial Drive. Mr. Close moved that the Village request a traffic study from the Ohio Department of Transportation along S.R. 745, moving toward the possible signalization of two areas - Glick Road and S.R. 745 and south of Memorial Drive at Brand, Donegal Cliffs Drive, or perhaps Limerick Lane. Mrs. Headlee seconded the motion. The vote was unanimous in favor. '-- 2. Ms. Maurer Ms. Maurer, a member of the Board referred to correspondence received by members of Council from the North Area Mental Health Services and their movement toward setting up a more centralized system, providing services on a more direct basis rather than contracting. -- RECORD OF PROCEEDINGS Meeting Minutes of Dublin Villa e Council Meetin -~ National Graphics Corp., Cols., O. Fonn No. 1097 ~ Held October 7, 1985 19_ Page Seven f" ~ Ms. Maurer referred to the minutes of the Parks and Recreation Committee meeting, and especially the vote regarding the Needs Assessment Survey, specifically the following motion: "The major priority or focus of the survey will be to determine the community's feelings towards an indoor/outdoor swimming pool, community center and financing methods." Ms. Maurer recalled that that was not what the survey was to determine _ that is she felt that the survey was to address the broader needs and wishes of the community, those needs of the community which are not being met presently. The Clerk of Council will provide to members of Council copies of the minutes of those Council Meetings at which this issue was discussed. '-- 3. Mr. Amorose Mr. Amorose mentioned a problem along S.R. 257, specifically the northbound lane which lies under an inch or two of water when it rains. He said that he would consult with the Maintenance Department to try to get some positive drainage in the area. 4. Mrs. Headlee ..--.. Mrs. Headlee mentioned the recently held 1985 Franklin County Health Fair in Dublin. She said that it was very well done and well organized, but that it was a shame that more people did not attend, suggesting that perhaps better advertising would have helped the attendance at this worthwhile function. ........... Mrs. Headlee said that the Golden Gatherings trip to Amish country in Holmes County on this day was an activity enjoyed by all who attended, and thanked Ms. Jordan for a fine job in organizing the trip. Mrs. Headlee asked members of Council to review the rough draft of a proposed day care center ordinance when they receive same, and also review Mr. Bowman's draft of a Development Check List. - 5. Mr. Sutphen Mr. Sheldon told Mr. Sutphen that the Brand Road Bridge area will be closed some time in November for repairs - it was originally to have been closed in mid September. Mr. Warner told Mr. Sutphen that work will be done on Avery Road when Ohio Bell moves their holding pole. Mr. Warner told Mr. Sutphen that the "rough spot" on S.R. 745 near Donegal Cliffs will be smoothed out after it has been dug up again and the sewerline put in - the first job was for the blasting only. Mr. Sheldon said that plans are underway to move into the new building on Monday, October 14, 1985. The meeting was adjourned by Mayor Lewis at 8:58 P.M. .......... /J -XU-t<?~.
