The regularly scheduled meeting of the Dublin Village Council was called
to order by Mayor James E. Lewis at 7:30 P.M. on Monday, August 19, 1985.

Mr. Thornton led the Pledge of Allegiance.

Members of Council present were: Mr. Amorose, Mr. Close, Mrs. Headlee,
Mayor Lewis, Ms. Maurer, Mr. Sutphen, and Mr. Thornton.
Mr. Smith, Law Director, and Mr. Sheldon, Village Manager, were also
present as were: Mr. Bowman, Ms. Jordan, Ms. Prushing, and Mr. Warner of
the Village Staff.
Mr. Amorose moved to approve the minutes of the August 5, 1985 meeting
of Council, with the following amendment to page 2 regarding Ordinance
No. 35-85, amending Section 1.(b). Said section to be amended to read:
"Setback of Buildings Along Freeways or Expressways. The setback for all
buildings and accessory buildings and parking along freeway and express-
way right-of-ways shall be 50 feet."
Mr. Sutphen seconded the motion.
The vote was unanimous in favor of approving the minutes with the
amendment.
Mrs. Headlee moved to pay the bills with the exception of the $37,117.88
payment to Savko & Sons, Inc. She said that the job is still not finished
and payment should be withheld. Mr. Thornton seconded the motion. The
vote was 7-0 in favor.

Mr. Harrison Smith, Jr., speaking on behalf of the applicant, made the
following comments:
1) Site is located in northwest quadrant of S.R. 161 and Sawmill Road.
2) It is across Sawmill Road from the Federated site.
3) Resulting in the evolution of a total street system.
4) No buildings planned as yet.
5) Commitment to total review process before Planning and Zoning
Commission (each phase).
6) Regarding David Road residents:
a) Buffer - have agreed to whatever is reasonable.
b) No connection of David Road to site.
c) Traffice - the emergence of signalization will create a basic
ability to get in and out of David Road.
Larry Helman presented the following information:
The existing commercial zoning primarily falls around the Federated
zoning; the existing zoning in Dublin which is 650' back covers
the entire frontage of Sawmill Road.
The Dublin quadrant is the only one that has not really been finalize~.
The Federated site (which will be under construction shortly) will
have a major five lane road (called the outer loop), a major five
lane connector to Snouffer Road, etc.
A similar system will be developed in the Dublin quadrant.
"Off site dollars" will be spent on Sawmill Road itself.
Had to work with four separate ownerships.
Kentucky Fried Chicken and Swad car dealership blocked access to
Sawmill Road, the ability to integrate being made difficult. By
shifting of pieces they were able to provide access to signals.

8) Created a major four lane roadway facility which parallels Sawmill
Road.
9) The major retail activity would occur in the center area.
10) There would be service type uses adjacent to the freeway (motels,
restaurants, etc.).
11) Tuller Road will remain right in and out.
Mr. Harrison Smith said that the Snouffer Road connection, the Tuller Road
connection, and Sawmill Road (if the zonings are approved) to the "tune
of about $700,000.00 will be completed by private contribution before
any building is begun. The entire street system will be in before any
building will be in.
Responding to a question from Mr. Amorose regarding the spending of off
off site dollars Mr. Helman said that it would be exclusively a traffic
control median - a concrete divide from intersection to intersection.
Rev. Roger A. Vogel, a resident of David Road, spoke of concerns regarding
the development (letter attached) and discussed their three basic concerns,
trying to protect their property values.
1) Buffer zone. In talking with the Electric Company it was determined
that the easement for the powerline starts at the back of the
properties. The line has been put to the west edge of the easements.
Rev. Vogel said that a buffer zone, they felt, must start east of
the powerline.
He also said that they feel included in that buffer zone, that they
need a fence on the development side.
2) Traffic. They are not convinced that the proposed signalization will
solve traffic problems.
3) Water - drainage. They want to make sure that the water problem is
taken care of.
The width of the powerline easement is 50'.
Mr. Smith said that "when they're ready, we're ready" to discuss the
buffer area. They also agree to the fence.
Mr. Mel Shaver, a resident of David Road, said that they were not ready
to meet with the applicant. He said that they would want to meet with
Mr. Drew Todd, the Urban Forester, again before meeting with Mr. Smith.
He also said that they wanted it understood that maintenance of the buffer
zone would be the responsibility of the developer.
Mr. Amorose suggested that they might want to include responsibility for
replacement of any trees that might die.
Mr. Smith suggested it be done via a unilateral declaration covenant
for the benefit of each of the David Road residents. He again reiterated
that they will require one common uniform buffer area requiring unanimous
approval of the residents.
It will also be so stated in the text.
Mr. Shaver also asked about the portion of the acreage labeled "independent
use". Mr. Smith said that they would be willing, with the residents of
David Road, to prepare a list of uses that would not be acceptable on
the site.
Mr. Thornton said that when the Final development Plan comes in, his
affirmative vote will depend on the following:
1) A minimum of 100' buffer adequately landscaped and maintained by
the development.
2) To include a strong security fence to minimize trespassing on the
home sites.
3) The developer continue to listen and evaluate the input of the
residents.

unilateral declaration covenant. Mr. Smith said he would do so.

Third Readings.
Mr. Thornton said that the more he hears of the rezoning the more skeptical
he becomes. He noted that there are three parties involved - the developer,
the church and the Village. The Village wants to complete an adequate
service road (a bypass road). In the approach to the situation, it seems
as though there is not a good solution for any of the parties involved.
Mr. Thornton said that he could not envision a shopping center sitting
on this "horseshoe type collection of lots". He also said that the best
he can visualize for the Village and the other area developers is an alley
behind the center to Martin Road. He also said that he felt that there was
not enough room to properly construct a service road through there.
Mr. Thornton said that he felt that an obvious solution would be for the
church to sell the corner of their property (the parsonage) to the developer.
The developer would have enough room to put in his center properly as a
money making operation. The church parsonage, although not in existence,
would not be encroached upon. There would be room for an acceptable road
connecting S.R. 161 and Martin Road.
Mr. Thornton suggested tabling Ordinance Nos. 31-85 and 32-85 allowing
parties one and two to sit down (developer and church) and try to reach
an agreement. The Village should offer any assistance possible to
facilitate this action.
Therefore, Mr. Thornton moved that Ordinances No. 31-85 and 32-85 be
tabled until the interested parties can meet and discuss it further. Mr.
Amorose seconded the motion.
Mr. Close noted that this is commercial property; the request is for a
rezoning; in any event, the plan must be submitted and approved before
anything can be built.
Mr. Thornton said that tabling the ordinances might give impetus to the
parties involved to sit down and negotiate.
Mr. Harrison Smith said that they had met with the church, it did not work
out; the demands were exhorbitant. He noted that the center piece,
which is already zoned CC, is the part that encumbers the church site (the
parsonage). That situation is not an issue in the rezoning.
Mr. Helman pointed out that the property was zoned commercial in Perry
Township prior to the construction of the parsonage.
Mr. Smith said that in order for the plan to be submitted the rezoning
must be approved.
Mr. Thornton suggested starting negotiations again with the church.
Mayor Lewis reminded those present that there are two issues involved _
the rezoning and the CDD review. He noted that the Village is encouraging
the development of larger parcels in the area. He said that he felt
that the zoning should go forward and noted that the plan is the critical
issue, not the rezoning.
Mr. Bowman noted that the commercial zoning would increase the opportunity
that the road will happen.
Mr. Close noted, essentially, that with the exception of these two parcels
and Dr. Griffith's property everything along S.R. 161 from Sawmill Road
to Wendy's will be commercial.
Mrs. Headlee said that one of the reasons Planning and Zoning turned down

the request was that the service road was not wide enough to adequately
serve the area behind the shopping center.
Mr. Bowman said that staff and the developer have worked together and
the plan has changed.
The vote on Mr. Thornton's motion to table the request was as follows:
Mr. Close, no; Mr. Sutphen, no; Mr. Amorose, no; Mr. Thornton, yes;
Mayor Lewis, no; Ms. Maurer, no; Mrs. Headlee, no.
The vote on the rezoning was unanimous in favor.
Ordinance No. 49-85 - Amended - To Include More Acreage on Dublin-Granville
Road. First Reading.
Mrs. Headlee introduced the Ordinance.
Mr. Close moved to forward the Ordinance to the Planning and Zoning
Commission. Mr. Amorose seconded the motion. The vote was 7-0 in favor.

Ordinance No. 51-85 - Accept Bid for Avery Park IlIlprovem.ents. First
Reading. Em.ergency.
Mr. Amorose introduced the Ordinance.
Mr. Close moved that the award be given to George J. Igel & Company in
the amount of $208,239.30, wave the three time reading rule and treat as
an emergency. Mrs. Headlee seconded the motion. The vote was 7-0 in
favor.
The vote on the Ordinance was unanimous in favor.

Ordinance No. 52-85 - Accept Bid for Garbage and Rubbish Collection.
First Reading. Emergency.
Mr. Amorose introduced the Ordinance.
The recommendation of the Village Manager was to accept the bid of
Central Ohio Disposal in the amount of $9,173.52 per month, plus $3.699
for each residence added during the contract period.
Mr. Thornton moved to accept the recommendation of the Village Manager,
wave the three time reading rule, and treat as an emergency. Mr. Close
seconded the motion. The vote was unanimous in favor of the motion.
The vote was 7-0 in favor of the Ordinance.
Mr. Thornton commented that he hoped that their service would be as good
as the service provided by Flower Garbage.
Ordinance No. 54-85 - Rezone 1.84 Acres South Side of Post Road just East
of Coffman Road. First Reading.
Mr. Amorose introduced the Ordinance.
Mr. Amorose moved to refer the Ordinance to the Planning and Zoning
Commission. Mr. Sutphen seconded the motion. The vote was 7-0 in favor.

Ordinance No. 55-85 - Rezone 2.041 Acres on Northeast Corner of Post and
Avery Roads. First Reading.
Mrs. Headlee introduced the Ordinance.
Mrs. Headlee moved to refer the Ordinance to the Planning and Zoning
Commission. Mr. Close seconded the motion.
The vote was unanimous in favor (7-0).

First Reading.
Mrs. Headlee introduced the Resolution.
Mrs. Headlee moved to do away with the three time reading rule and treat

Mayor Lewis confirmed that the Parks and Recreation Committee had reviewed
the plat.
Mr. Close had a question regarding the restriction on land use, limiting
it to public parks, recreation, open space, roadway, walkway. He suggested
a for instance - a joint project with the Board of Education or perhaps
if there would be some other public use. Technically, the Village would
be in violation of the terms of the restrictive convenant.
Mrs. Headlee pointed out that if it were used for anything else it would
be a violation of the Village's ordinance.
Mr. Smith, the Law Director, will investigate the matter further.
The vote was unanimous in favor to do away with the three time reading
rule and treat as an emergency.
The vote on the Resolution was 7-0 in favor.
Resolution No. 16-85 - Enter into a Sewer and Waterline Cost Reilllburseaent

Mrs. Headlee introduced the Resolution.

Mrs. Headlee commended Flower Garbage on their service to the Village
of Dublin during the terms of their contract.
Mr. Smith told Mrs. Headlee, responding to her question, that if the
service of Central Ohio Disposal is unacceptable the Village can give
them 30 days notice and can terminate the contract if they continue
not to perform in an acceptable manner (under the terms as outlined in
the contract).
Mr. Sutphen concurred with Mrs. Headlee and commended the services
rendered by Flower Garbage.
Ms. Maurer said that she would be making available to members of
Council a copy of a form that is used by the City of Worthington
when outside organizations request funds from the City coffers.
Mr. Close mentioned that he was aware of the services provided by
Central Ohio Disposal and indicated that he thought the Village would
be satisfied with their service.
Regarding the implementation of 911 number on a countywide basis.
Mr. Close noted that it could cause some problems in this area be-
cause the Village has some "pockets" under the old numbering system.
He said that he felt that the Village should, in the very near future,
examine the situation so that Dublin would be ready to respond to
the 911 number.
The Village is currently advertising for an Income Tax Administrator.
5. Mr. Bowman said that he would be proposing a Resolution which would
gear all planning efforts into a median along S.R. 161.

I SUBJECT: Rezoning Case Z285-011 - S.R. 161/Sawmill Road/I-270

Twenty-one residents of David Road attended the July 30, 1985 meeting of the
Dublin Planning and Zoning Commission, at which time, the subject of this
letter was addressed. It is our request that all concerns expressed by us,
comments stated by Attorney Harrison Smith, who is representing Residential
Services, and responses by Council Members at that meeting, be made a matter of
record at this meeting tonight. The issues of great concern were traffic
congestion, run-off/drainage and the buffer zone adjoining David Road
properties.
We are concerned about the existing traffic congestion experienced when exiting
from David Road to Dublin-Granville Road (State Route 161). The development
could increase traffic at this point, making an exit next to impossible for
David Road residents. A reduction from the present Route 161 50 MPH, from
Sawmill to Route 33, to 35 MPH could provide some much-needed relief in this
area. We respectfully requested that The Planning and Zoning CommissLon, "keep
an open mind" about options for David Road, should proposed road-way plans not
solve our traffic problems.

An existing drainage problem will be compounded by the proposed development.
Council-woman Catherin Headlee, liason to the Commission, asked Harrison Smith
\....... if he was working with Federated Realty on drainage. She said other Federated
projects, including Northland, have created swamps. "I don't want any area in
Dublin, includi~g David Road, to be flooded out". We agree whole-heartedly
with her statement.
Establishment of a buffer zone between the residential and commercial areas is
another very grave concern. The buffer zone must complement the residential
area and individual residences. It must enhance or maintain the present
property values. Harrison Smith, spokesman for the property owned by
Residential Services, made the following statement to the Commission and David
Road residents: "The residential area needs a complete buffer. The David Road
residents must agree to a covenant for a consistent plan and allow the
developer to maintain the entire buffer area." We, the residents, want to add
to his statement in that the arrangement he is suggesting regarding maintenance
of this buffer be forever, and not for any specified time, such as one, five or
ten years. Mr. Smith, publiCly, committed the developer of this plan to work
with David Road residents and invited us to attend private sessions to work out
what ever needs to be done in constructing this buffer to our satisfaction.

We want to direct your attention to some remarks made by members of the
Planning and Zoning Commission at the July 30, 1985 meeting. Ron Jezerinac
said, "Mr. Smith usually puts pressure on the board to make decisions before
there has been enough time to look at all sides of the issue at hand. We can't
reverse this (rezoning) decision, once it has been made.". John Reiner said
"It could be a beautiful thing, or another fight over each project, as we
usually have. It. Bill Callahan said, "I regret Dublin does not have more
control over S.R. 161 improvements.". Catherin Headlee interjected her
concerns again with the drainage problems that "beset" Dublin with each new
development. These remarks make it eviqent that there must be some

project.
The property owners on David Road stand to be the financial losers on the
proposed development. We respectfully request we be given the right of imput
during the entire development procedure. We will need you, our concerned
Dublin Village Council, to assist, protect and enforce all agreements made now
and at any future dates.
We have asked Mr. Drew Todd, Urban Forester, Ohio Department of Natural
Resources, to assist us wi th the buffer zone details. He has planned to view
the site August 15, 1985. We, as spokesmen for David Road residents, are
meeting with him, with the combined ideas we discussed at our David Road
Residents' meeting August 3, 1985. He will suggest the kind of foliage, trees,
shrubs, etc. that would best control sound, reduce exposure from commercial
lighting and afford pleasant general eye appeal from adjoining properties. We
believe there is a need to install a fence on the development side of the
buffer to restrict trespassers from entering or exiting the area by way of the
residents' properties and to keep debris from blowing into the residential
areas. The size and pi tch. of the dirt buffer will be an important factor in
obtaining the desired results. He said it will eventually be a joint project,
working with residents, Planning and Zoning, Residential Services and you, The
Dublin Village Council.

Council Meeting.
