The regularly scheduled meeting of the Dublin Village Council was
called to order by Mayor James E. Lewis at 7:30 P.M. on August 5, 1985.
Mr. Thornton led the Pledge of Allegiance.
Members of Council present were: Mr. Amorose, Mr. Close, Mrs. Headlee,
Mayor Lewis, Ms. Maurer, Mr. Sutphen, and Mr. Thornton.
Mr. Smith, Law Director, and Mr. Sheldon Village Manager were also
present as were: Mr. Bowman, Ms. Jordan, Ms. Prushing, and Mr. Warner
of the Village Staff.
Mr. Amorose moved to approve the minutes of the July 15, 1985 meeting.
Mr. Thornton seconded the motion. The vote was as follows: Mr. Thornton,
yes; Mr. Sutphen, abstain; Ms. Maurer, yes; Mayor Lewis, yes; Mrs.
Headlee, yes; Mr. Close, yes; Mr. Amorose, yes.
Mrs. Headlee moved to pay the bills. She asked whether the payment to
Nicholas M. Savko for the Avery Road Waterline was the final payment.
Mr. Warner said that the retainer of approximately $37,000.00 was still
being held by the Village. Mrs. Headlee said that she wanted to be sure
the ditch was draining properly and grass growing before releasing the
retainer. Mr. Sutphen seconded the motion to pay the bills. The vote was
unanimous in favor.

Public Hearing
Ordinance No. 31-85 - Rezone .549 Acre Tract on West Side of Sawmill Road.
Second Reading.
Ordinance No. 32-85 - Rezone 1.0 Acre Tract on South Side of Dublin-
Granville Road. Second Reading.
Mayor Lewis announced that the two ordinances would be considered together.
Mr. Harrison Smith, Jr. and Mr. Larry Helman registered as proponents.
Dr. Donn Griffith, Mr. Michael Gunner, and Rev. John Webb registered as
opponents.
Mr. Harrison Smith reminded Council members of the center core parcel
which is already zoned community commercial, the request being for a
change of zoning from SO to CC on those two small parcels located on
either side of the core parcel. He said that they appeared before the
Planning and Zoning Commission with the two rezoning requests and an
overall plan for the whole parcel, those requests being denied. He
indicated that the request at this meeting was for the rezonings only,
and a new plan would be presented to the Planning and Zoning Commission.
Mr. Steve Smith, the Law Director, explained that Staff had recommended
treating the two smaller parcels as well as the larger center parcel as
one unit in terms of the plan. He indicated that the initial presenta-
tion and vote probably should have been only on the rezonings and then
the plan subsequently presented to the Planning and Zoning Commission.
He said that it was the recommendation of staff that the Planning and
Zoning Commission approve the rezonings but not the plan, because the
plan was not in a form to be approved. Mr. S. Smith said that it was
his recommendation that Council consider the rezonings of the two out
parcels and then recommend the plan go back to the Planning and Zoning
Commission with a new plan for the "entire development".
Mr. Harrison Smith said that they had been so notified and agreed to
proceed thusly if that be the will of Council.

Mr. Helman presented comments on land use of the development and the
attempt to consolidate the smaller tracts into larger ones.

Responding to a question from Mr. Close, Mr. Steve Smith said that
nothing can be done on the tracts without CDD approval and that there
would be one series of buildings on all three parcels.
Mr. Michael Gunner, an attorney representing Dr. Donn Griffith, a property
owner on W. Dublin-Granville Road, spoke before Council. Dr. Griffith's
property is zoned so. mr. Gunner noted that they had appeared before the
Planning and Zoning Commission, objecting to the rezoning and the Corridor
Development District, for several reasons. He said that some of those
reasons have been corrected from the standpoint of seeing some revised
drawings. He said that his client was not opposed to the rezoning as such,
but did ask, however, that Council consider whether the proposed service
road from S.R. 161 to Martin Road would be a usable road (the one going
behind the shopping center) - more than just a narrow driveway.
Mr. Harrison Smith said that the road would be built to Dublin specifica-
tions, a requirement which is part of the corridor review.
Dr. Griffith said that he plans to keep his veterinary clinic on the
property but has a continuing interest in seeing that the road be built
properly.
John Webb, minister of the Martin Road Christian Church expressed his
concerns to members of Council. He noted that the church property of
5.76 acres is presently zoned residential. He said that separating the
issues (zoning and plan) made it more difficult for them to speak directly
to the issue. Rev. Webb noted that the church parsonage is within 18'
of the property line, and once "that zoning is in place" will make the
parsonage almost unlivable (parking, noise, lights, etc.).
He also said that another concern was the configuration of the road; how
they would fit into the road plan itself. He said that they are opposed
to the rezoning as long as it does not consider the residence, and until
and unless the corridor is drawn, know exactly where the road will be and
how it will affect their property.
Mr. Gunner told Ms. Maurer that he is representing both Dr. Griffith and
the Sawmill Civic Association.
Mr. Harrison Smith pointed out that the request for the rezonings doesn't
bring the commercial any closer to the parsonage - the existing CC (center
parcel) zoning is closer to the parsonage. He also said that he thought the
road connection has always been Dublin's idea.
Mr. Steve Smith told Ms. Maurer that the Planning and Zoning Commission had
denied the rezoning request as well as disapproved the plan.

Third Reading.
The vote was unanimous in favor of the ordinance.

Ordinance No. 35-85 - ADlend Section 1183.03 - Bui1ding Lines A10ng Pub1ic
Rights-of-Way. Third Reading.
Mr. Amorose moved to amend Section 1.,(b) of the ordinance as follows:
"Setback of Buildings Along Freeways or Expressways. The setback for all
buildings and accessory buildings and parking along freeway and expressway
wight-of-ways shall be 50 feet." - omitting the next two sentences in that
section. Mr. Thornton seconded the motion. The vote was as follows:
Ms. Maurer, yes; Mr. Thornton, yes; Mayor Lewis, no; Mrs. Headlee, yes; Mr.
Amorose, yes; Mr. Close, no; Mr. Sutphen, yes.
The vote on the ordinance, as amended, was 7-0 in favor.

Ordinance No. 47-85 - Accept Bid to Construct Shier-Rings Waterline.
First Reading.
Mrs. Headlee introduced the ordinance, moved to do away with the three
time reading rule, treat as an emergency, and accept the recommendation
of the Village Manager and award the bid to Kingsley-Dunbar in the amount
of $106,573.45. Mr. Amorose seconded the motion. The vote on the
motion was 7-0 in favor. The vote on the ordinance was unanimous.

Ordinance No. 48-85 - Accept Bid on "Package" Insurance. First Reading.
Mr. Close introduced the ordinance.
Mr. Sheldon commented that there were no bids received on the general
liability, umbrella insurance. He said that since the current insurance
expires on August 12, 1985 he would contact several persons and attempt
to obtain coverage for five or six months until, hopefully, sovereign
immunity will be restored.
"Per Section 735.051 of the Ohio Revised Code, in the case of a real and
present emergency the legislative authority may, by a two-thirds vote
of all members elected thereto, authorize the Village Manager to enter
into a contract for insurance coverage without formal bidding or
advertising."
I, David Amorose, move that the Manager be authorized to enter into a
contract for insurance coverage under this specific section of the Ohio
Revised Code. Mr. Sutphen seconded the motion. The vote was unanimous
in favor.

Ordinance No. 49-85 - Rezone 5.07 Acres (4 lots) South Side of Dublin-
Granville Road. First Reading.
Mr. Close introduced the ordinance.
Mr. Close moved to refer the rezoning request to the Planning and Zoning
Commission. Mrs. Headlee seconded the motion. The vote was 7-0 in
favor.
Ordinance No. 50-85 - Note Issue for Construction of Shier-Rings Waterline
First Reading.
Mrs. Headlee introduced the ordinance, moved to do away with the three
time reading rule, treat as an emergency, award the bid to the Huntington
National Bank at an interest rate of 5.67% with no premium. Mr. Close
seconded the motion. The vote was unanimous in favor of the motion.
The vote on the ordinance was 7-0 in favor.

Approve Preliminary Plat - The Woods of Dublin.
Mayor Lewis referred to the memorandum from the Village Planner regarding
this subject. Mr. Bowman noted that Council approved all aspects of
the preliminary plan, except for the sewerline, on June 17, 1985. Since
that time the developers of Donegal Cliffs and The Woods have met and
worked out an agreement regarding the sewerline.
Mrs. Headlee moved to approve the sewer portion of the preliminary plan.
Mr. Sutphen seconded the motion. The vote was 7-0 in favor of approval.

Representative of School Board to Parks and Recreation Committee.
Mrs. Headlee moved to appoint to the Parks and Recreation Committee, as
a representative of the Dublin Board of Education, JoAnn Zipf to serve
through 1987. Ms. Maurer seconded the motion. The vote was unanimous
in favor.
The Dublin Spring
After discussion Mr. Close moved that the Village Council authorize the
Law Director to proceed in the determination of the status of the legal
title of the real estate known as the Dublin Spring, initiating
discussion with the surrounding property owners. Ms. Maurer seconded
the motion. The vote was unanimous in favor.

Council Discussion on Proceeding to Cover a Ditch in Waterford.
Mayor Lewis referred to the report from the Village Enginner regarding
this proposed project. Mr. Warner said that the total estimated cost
for the project was $25,110.00 with the Village paying half of the
cost. Mr. Giorgione, a resident of Waterford, stated via a letter to
Mr. Warner that the estimated cost of $1395.00 per lot owner was acceptabl
stating, however, a ceiling of $77.00/half for 10 years would be necessary
Mr. Thornton said that he felt this was a good approach - the Village
and private property owners working together.
Mrs. Headlee expressed concern regarding the possibility of a precedent
being set - other areas of the Village possibly asking for assistance in
similar projects.
Mr. Warner said that the Village has easements on the ditch. The
property owners have been maintaing the ditch area.
Mr. Close said that it should have probably been tiled all the way
initially.
Mr. Amorose noted the gentle swale in the area and asked whether you
might actually be reducing the retention capabilities of the swale.
Mr. Warner stated that the swale does not act as a retention basin.

Ms. Maurer requested a delay in a decision on the matter for further
study.
Mr. Thornton moved to accept the recommendation of the Village Engineer
to proceed with preparing detailed construction plans and specifications,
preparing assessment roll and proceeding with the appropriate legislation
for an assessment project.
Mr. Close seconded the motion.
The vote was as follows: Mr. Thornton, yes; Mr. Close, yes; Mr. Sutphen,
yes; Mayor Lewis, yes; Mrs. Headlee, no; Ms. Maurer, no; Mr. Amorose, no.

Discussion Regarding School Board and Designated Park Land.

Mr. Bob Harris, President of the Dublin Board of Education, said that the
Board was informed that Council was willing to make some land available
to the School Board adjacent to some land the School Board might be able
to purchase. Mr. Harris also said the School Board will work with
Council in any way that they can. He said that they would want to
obtain sufficient rights to the land to put a school building on it.
He said that they will, in addition, work with the Village to help
develop the remainder of the land for purposes of parks and recreation.
Mr. Harris said they appreciated the offer.
Mayor Lewis reported with regard to background information. He said
that he had met with Mr. Wall and Mr. Dan Smith several months ago on
several subjects. One subject that was discussed was the five acres
on Muirfield Drive in Indian Run Meadows adjacent to the five acres
that had been made available to the schools from the developer. He
noted that in the course of the conversation, which went in the direction
of longer range planning for the school system, the comment was made
that there was an intention, depending on the success of the bond issues,

to build a swimming pool at some future date. Mayor Lewis said that he
raised the question, if the Village would consider the five acre
transfer to the school district, could the Village have a commitment
then that such a swimming facility would be built. There were no offers,
no commitments, just a conversation. Mayor Lewis said that Mr. Wall
asked if Council would agree to that. Mayor Lewis said that he would
present the subject for Council consideration if he had a letter to that
effect. A letter was received from Mr. Jeff Rich, outlining that
conversation. The second part of the conversation was regarding the
acreage in Earlington subdivision, the suggestion being made in the
letter that the School Board be given 15 acres; it was suggested that
10 acres might be more reasonable; that clearer language would have to
be pursued in that matter. The matters were brought to the attention
of Council without additional information than that which appeared in
the letters. The response of Council was that further discussions and
conversation was needed.

Mr. Harris reported that 8-10 acres is required for an elementary school;
up to 18-25 acres for a middle school. He said that land surrounding
buildings is needed for recreational aspects, not for the buildings them-
selves. With regard to the land/swimming pool situation, Mr. Harris
said that they do not yet know the legal aspects but are willing to work
with Council in that regard. He said they very definitely need the land.
Mrs. Headlee said that with regard to the five acres in Indian Run
Meadows that she would be willing to work with the School Board on
developing a park site provided the School Board would have purchased
an additional five acres. Mr. Harris said that they would need to
purchase the additional acreage.
Mr. Close said that it makes sense to jointly develop school and
recreation sites together.
It was agreed that the Law Director would continue to work with the
Dublin School Board representatives on this matter. Mrs. Brooks asked
that a representative from Parks and Recreation also be included in
the discussions.

Council Roundtable Discussion

Ms. Maurer
A commitment was received from the previous Parks and Recreation Departmen
Director to have prepared a needs assessment study for parks and
recreation (community center, future parks, etc.). Mrs. Brooks said
that that commitment is being followed up on and the study should be
completed by the end of October.
Ms. Maurer also noted that the recommendations will be made to the Village
Manager regarding the expectations of the Parks and Recreation Committee
for the Parks and Recreation Director.

Mr. Thornton requested followup information on the location of the
proposed access road in the S.R.161/Sawmill Road/Martin Road area.
Have all the property owners met and discussed same?
Mr. Bowman reported that a meeting has not been held; that the issue is
complex; attempts are being made to consolidate the smaller lots into
larger parcels; that further study with regard to the road and signal
locations is being pursued.

West Branch Sewer
Mr. Thornton said that it appears the west branch sewer will not be in
place for some time and the Village needs to make some contingency
plans. He asked where is the cutoff point for issuing permits and
should the Village be looking into increasing the capacity of the line
crossing the river. He also asked about the possibility of an all
weather pumping station; what happens when the electricity is off for
longer periods of time.
Mr. Close said that he had recently discussed the situation with Mayor
Rinehart and Mr. Long of the City of Columbus. He said that their
thoughts are being directed toward the third alternative; that being
of putting the line in by tunneling between the roadway and the river.
He noted also that there are "plans on the table" for a second east
branch trunk because of continued development in the Sawmill area.
Mr. Close also said that Mr. Long said that during the Memorial Tourna-
ment this year the east branch sewer was at capacity.
Mayor Lewis said that the Village Manager and Village Engineer are
following the situation almost daily; there are no easy answers, but
the situation is being monitored constantly and closely.

Mrs. Headlee reported that the Planning and Zoning Commission requested
that the loudspeaker ordinance be considered once again; the first
consideration being in 1982.

Mr. Sheldon announced that Arlene Shoemaker, a member of Columbus City
Council, will be making a presentation before the Dublin Village
Council on September 3, 1985.
