That the following described real estate (parcels) 60034114018000 (see attached map marked "Exhibit A Muirfield Outlots Area Rezoning (Case 03-O155Z)") situated in the City of Dublin, State of Ohio, is hereby rezoned R-1, Restricted Suburban Residential District, and shall be subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto. Section 2. That the following described real estate (parcel) 6003412802800, 60034405092000, and 60034405093000 (see attached map marked "Exhibit A Muirfield Outlots Area Rezoning (Case 03-O155Z)") situated in the City of Dublin, State of Ohio, is hereby rezoned R, Rural, and shall be subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto. Section 2. That application, Exhibit "B", including the list of contiguous and affected property owners, and the recommendations of the Planning and Zoning Commission, Exhibit "C", are all incorporated into and made an official part of this Ordinance and said real estate shall be developed and used in accordance therewith. SUMMARY: Consistent with the "Area Rezoning" project, these ordinances will formally establish the Dublin R, Rural, or R-1, Restricted Suburban Residential or LI, Limited Industrial District for individual properties. The staff held a public informational forum of these proposals on June 25, 2003 and August 26, 2003 for the property owners. Several residents attended, gave comments, and expressed thanks to the staff for the presentation and informational meeting. On September 18, 2003, the Planning Commission approved each rezoning application individually (7-0). A condition was added to Ordinance #87-03 that stated: that if the Freshwater/Humbert Property (File No. 03-092CP) concept plan and any subsequent rezoning applications are approved by City Council, prior to this case moving forward, that the 5.26 acre site be deleted from this rezoning. The PUD rezoning for the Freshwater Property is currently pending, and it will not be necessary to remove it from this R-1 area rezoning. RECOMMENDATION: Approval of Ordinances 66-03, 84-03, 85-03, 86-03, and 87-03 as recommended by the Planning and Zoning Commission. BACKGROUND: On the advice of Dublin's Law Director, staff is systematically researching Dublin zoning activity on all parcels annexed into Dublin. The Planning Division is responsible for compiling and processing these "area rezoning" applications to formally establish Dublin zoning wherever there is ~ question about the zoning history. The first major area rezoning was undertaken in 2001, and it covered the northeast quadrant of Dublin. City Council has introduced additional rezonings since last year. The subject sites in this case were annexed in 1973 and there is no history of zoning action since that time. The parcels have reflected R-1, Restricted Suburban Residential District on Dublin's zoning map for many years. Ordinance #66-03 was introduced at City Council on July 21, 2003. It will establish the Dublin R, Rural and R-1, Restricted Suburban Residential Districts on these properties. A special informational meeting was held on August 26, 2003 at the Dublin Recreation Center and approximately eight property owners attended. After the Planning Commission makes its recommendation, the case will be forwarded to City Council for a public hearing and final vote. With a positive recommendation from the Commission, a simple majority vote is required for passage. A negative Commission recommendation requires five votes for passage. If the ordinance is approved, it will take effect in 30 days. CONSIDERATIONS: Site Characteristics: The subject area is comprised of four parcels, which are all located between Dublin Road and Muirfield Drive, north of the Delaware County Line, south of the corporate limit. The total area being rezoned is 14.33 acres. Two of the parcels, which are located on Glick Road, have single-family houses. The other two parcels are surrounded by Muirfield Phases seven, eight and 12. This property has boarded horses in the past, although staff is uncertain if the property currently has livestock of any sort on the premises. • This rezoning proposes to establish the Dublin R-1 for all properties, except the property located at 6713 Glick Road which will receive the R, Rural zoning at the request of the Dublin Planning and Zoning Commission Staff Report -September 18, 2003 Page 6 property owner who wishes to retain the permitted agricultural uses of the land. All legally non-conforming uses will be subject to the requirements of Section 153.004 (C). These properties are bordered by single-family subdivisions, and condominium developments that were all built as part of the Muirfield development. One of the properties originally listed in this application has been withdrawn from this application at the request of the owner. This property has since been included in another City-sponsored application (See Case #03-071Z). A letter was mailed to the affected property owners listed in this application. A sample copy is attached, and it outlines the circumstances, procedures, and proposed zoning, as well as dates for public meetings. An informational meeting was held on August 26, 2003, for the affected property owners. A few property owners attended this meeting. In many cases, staff has spoken on the phone with the property owners or met with them in person. • Staff has also spoke with several adjacent property owners who initially thought this rezoning would result in a residential development plan. Once this rezoning project was clarified as a "housekeeping" measure, and not a development proposal, these residents were in support of the rezoning. Staff also received two letters in regards to a drainage problem along the backyards of properties on Loch More Court West (see attached letters). Staff has contacted Jay Herskowitz, assistant City Engineer, regarding this issue. Community Plan, Land Use and Zoning Issues: • On August 12, 2002, City Council amended the Future Land Use Map (Map 8) of the Community Plan. The properties listed in this application are shown as "Existing Residential." Implementation of this rezoning will ensure conformity with all adopted Dublin standards, protecting the health, safety, and welfare of the residents. • This rezoning is primarily a housekeeping issue and will not have an immediate impact on the majority of the surrounding residents and property owners. Legally non-conforming uses cannot be expanded, and they cannot be re-established after being discontinued for a period of two years. Even without Dublin zoning, most of Dublin's development standards would apply. A 1976 ordinance requires adherence to Dublin standards, wherever they are stricter, following annexation. However, the failure to establish Dublin zoning on the property could make administration and enforcement difficult in some circumstances. It can also be rather confusing for landowners. Development Standards: The properties listed in this application were annexed from Concord Township (Delaware County) in 1973. Relying on the correct township zoning from this time for these areas is not precise or advisable. Since the zoning of these properties is unclear, a comparison chart of the zoning districts has not been included in this report. However, based on discussions and research with the township zoning officers and township codes, the current property uses are consistent with historically permitted uses at the time of annexation. Utilities: This is an action to establish Dublin zoning. No development is proposed as part of this application, and it has no effect on utilities. New development anywhere in Dublin, including on these parcels, must comply with adopted storm water management regulations for the City of Dublin. The zoning does not affect utility status. Undeveloped parcels will need to tap into the existing utilities per City Code. STAFF RECOMMENDATION: Staff research indicates these properties were not placed in a Dublin zoning classification by a formal rezoning ordinance, following annexation. They have been reflected as R-1 on the zoning map for many years. This application is City-sponsored and legally advisable. It is intended to avoid any future potential Code enforcement problems arising from Township classifications and inconsistencies within the Dublin zoning map. This action provides proper zoning and is primarily a housekeeping effort. Staff recommends approval of this rezoning. Bases: 1) This rezoning will provide an appropriate Dublin zoning classification for land within the City limits to provide for the effective administration of development standards, procedures, etc. 2) The rezoning will maintain the established development pattern that has been in place for many years and establishes land uses consistent with those listed in the Community Plan. She said this 14.33-acre area rezoning involves land south of Glick Road, and west of Dublin Road in the middle of Muirfield Village. These areas were annexed around 1973 but were not part of the Muirfield PUD. Three of the four parcels contain houses. Staff proposes R-1, Restricted Suburban Residential District for the area north of Glick Road. R, Rural District is proposed for two other parcels. Ms. Wanner had received inquiries regarding future development of the property located south of Drake Road. Nothing is planned. She said staff recommends approval. Mr. Gerber said Ms. Wanner had done a nice job of summarizing this. These are primarily housekeeping efforts and do not affect most property rights. Mr. Ritchie made the motion to approve this area rezoning because it will apply an appropriate Dublin zoning classification, will provide for effective development administration, will maintain the established development pattern, and is consistent with the Community Plan.
