Form No. 30043 Ordinance No. 12f-(l~ (Amy Passed 20 AN ORDINANCE AMENDING CHAPTER 35 OF THE CODIFIED ORDINANCES TO REVISE THE FEE AND SERVICE CHARGE REVENUE/COST COMPARISON SYSTEM AND ESTABLISHING A SCHEDULE OF FEES AND SERVICE CHARGES FOR CITY OF DUBLIN SERVICES WHEREAS, the City of Dublin, Ohio has conducted an analysis of its services, the full costs of providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for the services; and, WHEREAS, based on this analysis, a cost analysis document, dated November 2003, has been prepared; and, WHEREAS, the specific fees to be charged for City provided services must be adopted by the City Council. hj¢uV, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, members of the elected officials concurring: Section 1. Chapter 35 of the Codified Ordinance of Dublin, Ohio is hereby amended to read as follows: Chapter 35 FEE AND SERVICE CHARGE REVENUE/COST COMPARISON SYSTEM AND FEES Section 35.80 "Full Costs" Defined For the purpose of this subchapter, the following definition shall apply unless the context clearly indicates or requires a different meaning. "Full Costs" includes the following elements: (1) All applicable direct costs including, but not limited to salaries, wages, overtime, employee fringe benefits, services and supplies, maintenance and operating expenses, contracted services, special supplies, and any other direct expense incurred. (2) All applicable indirect costs including, but not restricted to, building maintenance and operations, equipment maintenance and operations, communications expenses, computer costs, printing and reproduction, vehicle expenses, insurance, debt service, and like expenses when distributed on an accounted and documented rational pro-ration system. (3) Fixed asset recovery expenses, consisting of depreciation of fixed assets, divided by the approximate life expectancy of the fixed asset. (4) General overhead, expressed as a percentage, distributing and charging the expenses of the City Council, including the Clerk of Council, Department of Law, City Manager, Division of Accounting and Auditing, Division of Taxation, Information Technology, Economic Development, the Division of Human Resources and Procurement, and City promotional programs, and all other staff and support service provided to the entire City organization. Overhead shall be prorated between tax-financed services and fee-financed services on the basis of said percentage so that each tax-financed service and fee-financed service shall proportionately defray such overhead costs. 5 De artmental overhead ex ressed as a ercenta e, distributing and charging the cost of each I', P p p g department head and his or her supporting expenses as identified in subsections 1, 2, 3, and 6 of ~I i this Section. (Continued) Section 35.81 Findings and Intent (a) It is the intent of the City Council to ascertain and recover the specified percentages of full costs from fees, charges, and regulatory license fees levied in providing the regulation, products, or services set forth in this Chapter. (b) The fee and service charge revenue/cost comparison system set forth in this Chapter provides a mechanism for ensuring that fees adopted by the City for services rendered do not exceed the reasonable estimated cost for providing the services. (c) It is the intent of the City Council to achieve a more equitable and fair mix for financing services set forth in this Chapter in order to reduce or eliminate subsidizing these services with general tax revenue; thereby, allowing those general tax revenues to be used for general services, including infrastructure maintenance and replacement. Section 35.82 Delegation of Authority and Direction to the Ci Manager (a) The City Manager is hereby delegated the authority and directed to provide documents to the City Council to implement its policy to adjust fees and charges to recover the percentage of full costs as established in this Chapter. (b) The City Manager is hereby delegated authority to issue Orders defining terms, setting out administrative, fee collection, and financial procedures, definitions, and establishing effective dates of all fees set by the City Council by Ordinance. All Orders shall be signed by the affected department head, shall be signed by the Director of Finance certifying the financial requirements of this Chapter have been met, and shall be signed by the City Manager specifying the effective date of the Order. (c) "Full costs" shall be as defined in Section 35.80. In adjusting fees and charges, the City Manager shall act in an administrative and ministerial capacity and shall consider only the standards and criteria established by this Chapter and the applicable State laws. All Orders issued shall comply in all respects with this Chapter, and the schedule of fees and rates as set by the City Council ~ Section 35.83 Schedule of Fees and Service Charges (a) The City Manager, Director of Finance, and each City department head, under the ~ direction of the City Manager, shall review annually the fees and service charges listed in Appendix A- Schedule of Fees and Service Charges, and provide an adjusted fee or charge schedule to the City Council for its consideration so as to recover the listed percentage of full costs necessary to provide the listed regulation, product or service as modified by the Anotes- following the list of services. These fees, unless otherwise specified, are for City of Dublin services and are in addition to any charges made by any other governmental agencies. (b) The services as listed in this Section shall be as defined in the document entitled "Cost Study for the City of Dublin, Ohio", as produced by the City of Dublin. (c) All fees and charges set pursuant to this Chapter and Section shall take effect as specified in each Order. I (d) The City Manager may vary the review schedule listed in the Section if, in the judgement of the City Manager and a directly affected and requesting department head, a gross inequity would be perpetrated by not revising a fee or charge prior to the next rate review. Any such ~ special rate review shall be reported to the City Council at its next succeeding meeting where the City Council may revise the fee or charge by Ordinance. II, (e) If fees are not collected at the time that the service is provided, the City has the right to pursue collection of any of the fees listed in this Ordinance, including certification to the County Auditor, remittance to a collection service, or any other appropriate pursuit for payment. 2 RECORD OF ORDINANCES Dayton Legal Blank, Inc. (Continued) Section 35.83 Schedule of Fees and Service Charges (Continued) (f) Should it become necessary to establish a new service fee or charge during the year, the City Manager may set the fee administratively. Any such fees set by the City Manager shall be reported to the City Council at its next succeeding meeting where the City Council may revise the fee or charge by Ordinance. The new service will then be included and analyzed in the next rate review. Section 35.84 Fee Appeals and Waivers Irrespective of the percentage of recovery and the "notes" in Section 35.83 -Appendix A, the City Council reserves the right to waive any fee in order to encourage development projects that enhance the City's tax base as outlined in the City's Economic Development Strategy. The City Manager may recommend further waivers or fee adjustments, based on hardship, to be accepted or rejected by City Council at its next regularly scheduled meeting. Section 2. SEVERABILITY If any portion of this Chapter is found to be unconstitutional or invalid the City Council hereby declares that it would have enacted the remainder of this Chapter regardless of the absence of any such invalid part. Section 3. REPEALER All Ordinances, the Codified Ordinances of Dublin, Resolutions, City Council Motions, and all actions of all City Boards and Commissions in conflict here within are hereby repealed. The fees and charges established by this Chapter shall supersede all previously established fees or charges for the same regulation, product or service, and all such previous fees and charges are hereby repealed on the effective date of the Order of the City Manager. Section 4. EFFECTNE DATE That this Ordinance shall take effect and be in force on January 1, 2004. The percentage of recovery is dependent on the agreement negotiated between the parties. 6. Rather than a percentage of recovery, the City Council has specified a fee structure to be adopted. 7. There is to be no recovery of costs for Police Officers subpoenaed. 8. In general, the recreation program will attempt to recover, on a aggregate basis, 50%, while recognizing that some programs may be somewhat less than that for certain reasons and some more than that. This to be based on the nature of the program. This will ensure that individual fees are reviewed annually, and any set unusually high/low are flagged. 9. At the February 8, 1999 meeting of the Committee of the Whole to discuss storm drainage utilities, the consensus was not to proceed with implementation of storm drainage fees. 12. The ordinance is amended due to a change in the "youth" age range for the DCRC daily pass from 3-12 yrs to 3-17 yrs highlighted at the November 17 City Council meeting. This change was proposed in an effort to encourage more teenage participation at the community center. This modification was prompted by resident input, DCRC administrative staff input, and a suggestion made by Healthy Communities, an association for community health improvement. Following is the information we gathered to address the issues. Dublin Community Recreation Center (DCRCI Amended "Youth" Age Range For Daily Pass Pursuant to input from residents and suggestions made by DCRC Administrative Staff, the ordinance has been amended to change the age of the youth daily pass from 3-12 yrs to 3-17 yrs. This is being done in an effort to encourage more teenage participation at the community center. Administrative Modification of the DCRC Corporate Pass An administrative charge was discussed for the DCRC corporate pass. Currently, a corporate pass holder can access the facility on Monday -Friday from 6:00 a.m. until 6:00 p.m. The expansion of the current benefits will allow for corporate pass holders to access the facility during regular hours of operation on Saturdays and Sundays. Peak usage times were reviewed, and it was determined that expanding the corporate pass to Saturdays and Sundays will benefit the pass holder yet not cause an undue burden on the DCRC at peak usage times. The need for exploration of a modification to the pass grew out of an economic development out-reach visit to several of the local businesses that expressed a need for more flexibility. A detailed memo addressing this change was included in City Council's November 21, 2003 packet and a copy is attached. Non-Resident Senior DCRC Pass Fees A concern was raised regarding the non-resident senior DCRC annual pass fee, and the fact the fee is lower than the individual resident's fee. It was suggested that perhaps the rate should be raised to discourage non- resident seniors if this sector is adding to the capacity problems. Upon review, we found the following information for consideration: • The DCRC non-resident senior rate has through the years been consistently lower than the individual resident fee. This is true for other recreation fees, such as the outdoor swimming pool fees. It has always been a City Council policy to subsidize senior activities and programs. This accounts for less than 10% of the total of all DCRC annual passes issued. Of these senior pass holders, 58% are residents, l5% are school district residents, and 27% are non-residents. Usage information indicates that average daily senior attendance on Monday -Friday is 130 folks. Average daily senior attendance on Saturday -Sunday is 36 folks. Graphs are attached for review that indicates the senior peak usage occurs in the morning around 8:00 a.m. Overall DCRC peak usage occurs in the late ~ afternoon from 4:30 p.m. to 8:00 p.m. ~1/month ACH Debit Fee for Processing Monthly Account Debits For DCRC Annual Pass Holders A question was raised as to the validity of the $1/month fee charged to DCRC annual pass holders who wish to make payment with monthly ACH debits from a savings or checking account. This fee is imposed to assist in recovering the bank fees, paid by the City, in order to offer this convenience. Reviewing the current contractual agreement with Bank One, to process these transactions the City is charged a $.15 ACH transaction fee, and a $.10 fee for credit posting to our account plus some on-going maintenance-type charges for notifications and account changes. Of course we also have some implicit internal costs associated with accounting for and tracking the ACH deposits, and Staff time spent chasing after rejected or NSF-type transactions. We asked the DCRC Staff to contact some similar public/City facilities as well as several public facilities to see how the ACH debit fees are handled. Information re: monthly debit plan Public/City facilities Westerville -offers annual membership, 1-month trial membership and 3-month memberships. Currently do not offer a monthly payment/debit plan. Worthington -annual memberships available. Currently do not offer monthly payment/debit plan. Kettering - no monthly debit plan. All fees must be paid up front. Private facilities Sawmill Athletic Club - offer a monthly payment option, which is 10% higher than paying in full. World Gym -offer annual memberships at a "discount" if paid in full up front. They have a monthly payment/debit plan, but it is more expensive than if paid in full. Example: Annual membership is $416, if on monthly plan it is $35.23 per month or $422.76, an annual difference of 6.76, less than $1 per month. Thus they don't call the extra charge a service fee, but the fully paid membership is "discounted." California Fitness -annual membership fee is required to be paid in full up front. There is no monthly payment/debit plan. If a member renews their membership the following year, they receive a discount. Curves -yearly membership, offer a monthly debit plan with an up-front 10% service fee. Columbus Athletic Club -annual dues/membership. Members may pay quarterly or semi-annually, but no debit plan is available. Brautigam, City Manager Date: November 20, 2003 Initiated By: Colleen Gilger, Economic Development Specialist Re: Expansion of Dublin Community Recreation Center Corporate Pass Holder Access Background Through concerns raised during three recent business outreach visits, Economic Development staff determined a need to re-evaluate the Dublin Community Recreation Center (DCRC) corporate pass holder benefit offerings. One company with over 1,000 employees, covering around the clock shifts, recently completed a $250,000 fitness center within their complex. Its employees aze charged a very minimal monthly rate for a full range of services including seven-days-a-week access to fitness equipment, aerobic classes, physical training, wellness classes, massage, etc. Unfortunately, to accommodate the building of this new fitness center, the company relocated SO employees to leased space in the Hilliard area. Economic Development staff realized by limiting corporate member access to weekdays, the benefit was only reaching two-thirds of their employee base. Another company with over 100 employees covering 24-hour operations is facing skyrocketing healthcare costs because of an increase in the diagnosis of chronic illnesses, obesity and work- related stress among employees. Funds are not available within the company to create a wellness program for its staff. Company employees inquired about the City's willingness to adjust corporate membership hours to include their second shift and weekend employees. Upon an additional outreach visit, Economic Development staff was made aware of the company's employees having total influence over where their company is located. As this appears to be the current trend, we see a need to make Dublin as desirable a work location as possible not only by addressing corporate needs but also increasing corporate employee benefits within the community. Action Item The corporate annual pass allows access into the DCRC Monday through Friday from 6 a.m. to 6 p.m. The expansion of current benefits will allow for corporate pass holders to access the DCRC during regular hours of operation on Saturday and Sundays. As is currently provided to those registering for classes/programs, the corporate pass holder receives a 10 percent discount off the non-resident rate. Currently, 540 corporate residents take advantage of the corporate pass option, and only 350 used the facility regularly in a sampled 30-day period. Corporate pass holders account for less than 5 percent of the total number of annual passes. The majority of their usage occurs between the hours of 11:00 a.m. and 1:00 p.m. DCRC staff has determined that capacity issues should not be affected by allowing corporate pass holders weekend access, as you can see on the attached graphs of overall fitness floor usage Monday through Sunday. The peak hours of weekday operation on the fitness floor are 6:00 a.m. - 7:00 a.m., 11:00 a.m. - 1:00 p.m. and 4:00 p.m. - 6:00 p.m. These high peak hours do not exist on Saturdays and Sundays. We are excited about the opportunity to address the concerns of our corporate residents, and feel this modification will be well received. Currently, the City has 169 service titles included in its annual review. During the 2002 Fnance Committee meeting for the Cost of Services Study, the Committee recommended to City Council a fee change or modification in 58 of those services. That comprised a 34% change in fees for the 2003 fiscal year, most of which were increases. As the local economy has slowed, so has the expansion period of the Gty. This has resulted of dedine in the growth of additional staff positions the last two years, , a slowing in the growth of the units of service the various City Divisions perform, and a conscious effort by City Staff to keep daily operating costs of the City as flat as possible. Subsequently, our preliminary analysis from the 2002 fiscal year data has concluded the need for a minimal change in fees. After review, we have concluded there to be approximately 10 services where the fees are not recovering the targets established by City Council. For most of those services, the fees have not been increased in the past several years (listing attached.) Based on the volume of fee changes being suggested, we are proposing that a modified review of the fee schedule be completed by focusing on the 10 or so fees that are not meeting their target recoveries. A Fee Comparison Report is attached summarizing fees for all City-provided services. We do not plan to prepare the more detailed binder and worksheets for review by the Finance Committee of City Council. The Ordinance reflects the fee changes suggested. Over the past year, we have discussed the time-cycle of the annual update to the Cost of Services Study, and have considered the effects of preparing either a condensed review, or completing the review in a two-year cycle earlier in the fiscal year. Based on current economic trends, and the limited recommended fee modifications, we believe a modified review of the Cost of Services Study is appropriate this year. A Fnance Committee meeting is scheduled for November 19, 2003 to review the City's fee waiver policy for use of the Dublin Community Recreation Center. The proposed fee modifications can be reviewed by the Finance Committee at that time if they desire to do so. Recommendation: We recommend passage of Ordinance No. 126-03 on December 15, 2003. The fees for services will be effective on January 1, 2004, unless otherwise stated in the Ordinance.
