Form o. 30043 Ordinance No.....62.-03 Passed An Ordinance Authorizing The Purchase Of A 3.563 Acre, More Or Less, Parcel Of Land Located at 5800 Post Road, City of Dublin From Betty Jane Nyrop, Appropriating Funds Therefore, And Declaring An Emergency WHEREAS, a goal of the Dublin City Council is to continue to acquire land for parkland purposes; and WHEREAS, a 3.563 acre parcel of land located at 5800 Post Road is available from a willing seller; and WHEREAS, the City desires to enter into an agreement to purchase the property located at 5800 Post Road as identified on the attached Exhibit for the amount of $475,000; and WHEREAS, it is necessary to amend the annual appropriations measure to provide funding authorization to purchase property. NOW, THERE ORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute a Real Estate Purchase Agreement and any necessary closing documents related to the acquisition of 5800 Post Road. Section 2. There be appropriated from the unappropriated balance in the Capital Improvements Tax Fund the amount of $480,000 to account 401-0314-780-2510 for the purpose of acquiring the property at 5800 Post Road. Section 3. This Ordinance is declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety or welfare, and for the further reason to complete the transaction in accordance with the terms agreed to by the parties. Grigsby, Deputy City Manager/Director of Finance Re: Ordinance No. 62-03, An Ordinance Authorizing The Purchase Of 5800 Post Road SUMMARY: Betty Nyrop, the owner of the property located at 5800 Post Road, recently approached the City about her desire to sell her property. The parcel of land is surrounded on three sides by land currently owned by the City and the City desires to acquire the property for parkland purposes. The City had an appraisal of the property completed. The appraisal report stated the market value of the property was in the range of $450,000 to $500,000. As stated in Ordinance No. 62-03, the property owner agreed to sell the property for $475,000. The funding for the property will be available from money programmed for land acquisition in the Capital Improvements Tax Fund (Fund 401) for the year 2004. As you are aware, the City allocates and appropriates $500,000 a year in the Capital Improvements Program (CIP) and the Operating Budget for land acquisition in Fund 401. The funding that has been programmed and appropriated in 2003 for land and parkland acquisition has already been committed to specific acquisitions. The $500,000 that has been programmed for 2004 will be appropriated in 2003 as identified in Ordinance 62-03 and the CIP and 2004 Operating Budget will be adjusted accordingly. RECOMMENDATION: Staff recommends that Ordinance No. 62-03 be adopted as an emergency at the second reading scheduled for June 23, 2003.
