procedures contained in Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances), the
City of Dublin Zoning Code and amendments thereto.
Section 4. That application, Exhibit "B", including the list of contiguous and affected property
owners, and the recommendations of the Planning and Zoning Commission, Exhibit "C", are all
incorporated into and made an official part of this Ordinance and said real estate shall be
developed and used in accordance therewith.
Section 5. That this Ordinance shall take effect and be in force from and after the earliest period
allowed by law.

SUMMARY•
As part of the "Area Rezoning" project, Ordinance #94-03(Amen~ed) will formally
establish the Dublin R-l, Restricted Suburban Residential, R-2, Limited Suburban
Residential, or R-4, Suburban Residential Districts for residential properties in the
southeast portion of Dublin (south of I-270, east of the Scioto River) in an area known as
the CDD, Corridor Development District. Staff held two informational meetings for this
area with the property owners listed in this application and some zoning designations
were changed along Martin Road based on resident input and additional staff research.
One condition -was added to this application stating: that if the Warner/Vogel office
rezoning application (Application No. 03-1042) is approved by City Council prior to this
area rezoning moving forward, that the site will be deleted from this rezoning. This
property has not been removed from this ordinance.
Ordinance #108-03(Amended) will establish the OLR, Office, Laboratory, and Research,
CC, Community Commercial, SO, Suburban Office and Institutional Districts, and LI,
Limited Industrial Districts in an area along the inner ring of I-270, west of the Scioto
River, north of Rings Road. Properties listed in this ordinance include several
commercial, retail, and office establishments, including Ashland Incorporated, Embassy
Suites, and OCLC.
Ordinance #109-03(Amended) will establish the Dublin, R-1, Restricted Suburban
Residential District zoning for residential properties located south of Waterford Drive,
north of Hayden Run, east of Paul G. Blazer Parkway, and west of the Scioto River,
mostly along Dublin Road. Properties include "estate-lot" residential properties and
subdivisions (many along the west side of the Scioto River), City-owned land, and the
Thomas Elementary School.
Ordinance #119-03 will establish the Dublin R, Rural District, R-1, Restricted Suburban
Residential District, and R-2, Limited Suburban Residential District for several properties
located south of Brand Road, north of West Bridge Street, east of Coffman Road, and
west of the Scioto River. Properties listed in this ordinance include the Junior Academy
Day Care, which is located on the east side of Coffman Road, several "estate lots" along
Indian Run Drive and Dublin Road, one city-owned parcel just south of the I-270 bridge,
and Sells Middle School on West Bridge Street.
The staff has held public informational reviews of these proposals and several residents
have attended, given comments, and expressed thanks to the staff for the presentation and
informational meeting.
On January 8, 2004, the Planning Commission approved each rezoning application
individually (7-0) for the first three ordinances and (6-1) for the Indian Run Et. Al.
application (Ordinance #119-03).
RECOMMENDATION:
Approval of Ordinances 94-03(Amended), 108-03(Amended), 109-03(Amended) and
119-03 as recommended by the Planning and Zoning Commission.

UPDATE:
This case was tabled on November 6, 2003 to allow the property owners an additional
opportunity to meet with staff to discuss concerns. Since that time, a second infornlational
meeting was held on November 25, 2003, at the Dublin Christian Church, with about hventy-five
residents attending. As a result of this meeting and discussions with the residents, some zoning
designations along Martin Road were changed from R-4, Suburban Residential District to the R-
2, Limited Suburban Residential District on the map. Additional questions regarding annexation
histories, roadway/bikepath connection to Welland Street in Columbus, Martin Road bikepaths
and speed bumps were also discussed. Staff has since drafted a response letter to these
questions. (See attached letter dated December 5, 2003.) In addition, some of the land originally
listed in this application was involved in other pending rezoning cases. Since these parcels have
received separate zoning approvals, they have been withdrawn from this application.
[3ACKGROUND:
On the advice of Dublin's Law Director, staff has systematically researched all Dublin zoning
activity on all parcels annexed into Dublin. Through this investigation of written records, staff
has found several areas where zoning was not established via a rezoning ordinance. The
Planning Division is responsible for compiling and processing these "area rezoning" applications
to formally establish Dublin zoning wherever there is an question about the zoning history.

The subject sites in this case ~~~cre annexed between 1961 and 1972; there is no history of a
fonmal rezoning ordinance for these areas since that time. Ordinance #94-03 was Introduced at
City Council on August 18, 2003. It will establish Dublin R-l, R-2, or R-4 Districts. An initial
informational meeting was held on August 26, 2003 at the Dublin Recreation Center, and several
property owners from this area attended. Staff has also spoken with a number of residents by
phone regarding this rezoning.
After the Planning Commission makes its recommendation, the case will be forwarded to City
Council for a public hearing and final vote. With a positive recommendation from the
Commission, a simple majority vote is required for passage. A negative Conlmissioll
"~ ` recommendation requires five votes for City Council passage. If the ordinance is approved, it
will take effect in 30 days.
CONSIDERATIONS:
Site Characteristics:
The subject area is comprised of 82 parcels, totaling approximately 115 acres. Most of
the parcels are located in an area known as the CDD, Corridor Development District.
Two remaining parcels are located along the Scioto River, outside of the CDD District.
This application includes several established neighborhoods that include: Sunnydale
Estates (along Lilly Mar Court and Braxmar Place) Colony Estates (along Martin Place)
Village of Scioto, and Riverside Glen North (both located on Martin Road) and homes
along David Road. Other properties included in this application are the Dublin Christian
Church, parkland along the river (owned by the City of Columbus) and several acres of
undeveloped land. Parcels range in size from roughly one-half to 19 acres. The
proposed ZOIlIIlg classifications selected indicate what has been shown on Dublin's
zoning map for over 15 years, and what was discussed and agreed upon by the property
owners.
Two narrow parcels totaling about ten acres along West Dublin-Granville Road are part
of a cur~ent rezoning application for an office development (See Case #03-1042
Warner/Vogel Property). If this rezoning is approved prior this application moving
forward, they will be withdrawn from this rezoning.
One of the properties originally listed in this application staff was proposed for the CC
District, consistent with the historical zoning maps. However, in accordance with
Columbus' wishes, the R-1 District will be requested here. This property was removed
from the CDD Commercial Area Rezoning application and will be designated with the R-
1District (See Case #03-081Z).
This rezoning proposes to establish the Dublin R-l, R-2, or R-4 Districts. All legally
non-conforming uses will be subject to the requirements of Section 153.004(C) of the
Dublin Zoning Code.
Three letters were mailed to the listed property owners (see attached), and staff held two
infornlational meetings for the property owners.
Staff has received a memo dated, September 10, 2003, G-om a Martin Road resident who
is opposed to this rezoning. However, since this letter was received staff held a second
infonmational meeting and has changed some zoning designations based on these and
other discussions. Staff is unaware if this particular resident objects.

Community Plan, Land Use and toning Issues:
• On August 12, 2002, City Council amended the Future Land Use map (Map 8) of the
Community Plan. Most of these properties are designated with existing land uses of
"Residential" or "Non-Residential". Some properties have a classification of
"Residential-High Density (2-Sdu/ac)" "Mixed use-Emplo}nnent emphasis" or "Office."
• This rezoning is a housekeeping issue only, and will have no immediate impact. Legally
non-conforming uses cannot be expanded, and they cannot be re-established after being
discontinued for a period of two years.
• Most of Dublin's development standards will apply even if this rezoning is not adopted.
A 1976 ordinance requires adherence to Dublin standards, wherever they are stricter,
following annexation. However, the failure to establish Dublin zoning on the property ~~
will make administration and enforcement extremely difficult.
The properties listed in this application were annexed from Perry Township between
1961 and 1972. Section 153.004(D) of the Code states that: "Territory annexed to the
municipality after the effective date of the zoning ordinance shall continue to be
governed by the zoning regulations which governed the territory annexed immediately
prior to annexation." Relying on the prior township or county zoning district(s) is not
precise or advisable.
Utilities:
This is an action to establish Dublin zoning. No development is proposed as part of this
application, and it has no effect on utilities. Currently, municipal water and sanitary
services reach some of these properties. The zoning does not affect utility status.
New development anywhere in Dublin, including on these parcels, must comply with
adopted stormwater management regulations and other development standards for the
City of Dublin.
STAFF RECOMMENDATION
Staff research indicates these properties were not placed in a Dublin zoning classification by
passage of a fornlal rezoning ordinance. They have been reflected as R-1, R-2, or R-4 on the
zoning map for many years. This area rezoning is intended to avoid any future Code
Enforcement problems arising from township or county classifications and inconsistencies within
the Dublin zoning map. This action provides proper zoning and is primarily a housekeeping
effort. Staff recommends approval of this rezoning with the following condition.
Conditions:
1) That if the Warner/Vogel office (Application No. 03-1042) rezoning application
is approved by City Council prior to this area rezoning moving forward, that the
site will be deleted from this rezoning.
Bases:
1) This rezoning will provide an appropriate Dublin zoning classification for land
within the City limits to provide for the effective administration of development
standards, procedures, etc.
2) The rezoning will maintain the established development pattern that has been in
place for many years and reflects land uses consistent with those listed in the
Community Plan.

1. Area Rezoning 03-0802 -CDD Residential Area Rezoning
Anne Wanner said this case was tabled on November 6, 2003, to allow property owners an
additional opportunity to meet with staff to discuss concerns. Since that time, a second meeting
was held on November 25, 2003. She said the attendance was good with approximately 25
residents attending. As a result of that meeting and discussions, staff has changed some of the
zoning districts on the map, mainly due to existing uses. A memo was issued after the meeting
that discussed some other concerns that residents had regarding some annexation histories,
bikepath questions, Martin Road speed bumps, and a small roadway connection along Welland
Street. She showed several slides. She said this area is located in the southeast area of Dublin in
the CDD, Corridor Development District.
Two parcels have been removed from this application due to the fact that they were rezoned
separately. She said 4444 Tuller Road was rezoned to SO, Suburban Office District, and the
Dublin Commons project was rezoned PUD, Planned Unit Development District.
Properties with single-family homes were originally proposed by staff to be R-4. Consistent
with the residents' concerns, staff has changed them to R-2 to match the single-family homes, as
well as another large lot single-family home to R-1. The Villages of Scioto will remain R-4.
Dublin Christian Church, Martin Place, and both Lilymar Courts are included in this area
rezoning.
Ms. Wanner said staff is recommending approval with following the condition: That if the
Warner/Vogel office (Application No. 03-1042) rezoning application is approved by City
Council prior to this area rezoning moving forward, that the site will be deleted from this
rezoning.
Ms. Boring asked why the Villages of Scioto development was being rezoned so soon after the
Commission had approved their case. Ms. Wanner said no City rezoning records indicated that it
was zoned other than R-4.
Mr. Gundernzan guessed that if the staff thought it was R-4 all along, he suspected that what
would have come in would have been something that would have needed a Commission review
because it was in the CDD, not because it was being rezoned.
Pat Hitesman, a Riverside Drive resident, said at one time an office building was preferred at that
site, but there was an adjustment made and the condominiums were built. Behind the R-1 is
higher density apartments in Columbus and the R-4 is an excellent transitional zoning. He
thought the residents of Martin Road were more concerned for their own properties and a similar
density was desired. He speculated that they wanted to match the south side of the street. The
Martin Road residents wanted what had been R-4 to be R-2. Mr. Hitesman said he thought the
greatest concern of David Road residents went back to when Dublin promised to buy their
properties, but this gives them good transitional use. He said the R-1 also provides a transition.
Ms. Boring said a commitment had been made to David Road residents, and the Commission
reviewed it, but it was tabled. She asked if there was a rehearing timeframe. Ms. Wanner said
the case is still pending. She said if direction was given to staff to pursue it again, another
meeting with the residents would be necessary. She said some property ownership had changed.
Ms. Boring said she would like to see that meeting reinitiated by the Commission. She was
appreciative of Ms. Warmer's patience in meeting with the residents again for this case. It was
obvious she had worked hard to explain to the residents what the City was doing.

Ms. Reiss asked about the two large properties along Tuller Road that she thought were both ~'
vacant. She asked since the City is going through the effort of rezoning, why wouldn't these
properties be rezoned to what the City would like to see. She did not think they were envisioned
to be developed as R-1.
Ms. Wanner said the purpose of these area wide rezonings was to establish Dublin zoning where
none had existed before. This property was reflected on the zoning map as R-l. There is an
extensive Tuller Road area plan that calls for mixed use along Tuller Road, however there is not
a true site plan to use. She said it was premature at this point to zone the property to a
commercial or office use because a mixed may be wanted later (a planned district).
Mr. Gerber explained that as part of this general housekeeping project, the perceived zoning has
been kept as opposed to some other zoning.
Mr. Banchefsky agreed that this was just a housekeeping item: i.e. these types of zonings should
have happened as soon as practicable following annexation and that it would receive the closest
Dublin zoning district. Based on research, that may or may not have happened. However, there
was a court case that was problematic, and the recommendation from the Law Director's office
was that the entire City be studied. For any areas where there was no absolutely clear
documentation as to the zoning history, an area wide rezoning would be done. The purpose of
this project was to create a formal documentation on rezonings. He thought it would be
premature to try to rezone these properties to a plamled district because it would be based on
land use speculation and property rights would be changed.
Mr. Banchefsky said rezoning according the Community Plan recommendations would create
lots of "taking" arguments and concerns. A wholesale change argument will not hold up in court
in ternls of why Dublin is doing it. This procedure is attempting to encapsulate the history of
what everybody thought had been there for many years.
Mr. Hitesman, speaking as a Trustee of the East Dublin Civic Association, said one of the
concerns with rezoning the large farm to commercial today and the other R-1, was that it was not
easy to go backwards. He said that area has been slow to develop, but that the R-1 could be
developed in some sort of eastern village fashion center as the shopping center is reworked. If it
is office/commercial, it will be rezoned as such and no one will ever do houses. He said a village
pattern could be set instead of residential. He said the Association members would want him to
request that the City slow down and keep the concerns of the East Dublin Civic Association in
mind.
Mr. Gerber made a motion to approve this area rezoning because it will apply an appropriate
Dublin zoning classification, provide for effective development administration, maintain the
established development pattern, and is consistent with the Community Plan with one condition:
That if the Warner/Vogel office rezoning application (Application No. 03-1042) is approved by
City Council prior to this area rezoning moving forward, that the site will be deleted from this
rezoning.
Mr. Zimmerman seconded the motion, and the vote was as follows: Ms. Reiss, yes; Ms. Boring,
yes; Mr. Sprague, yes; Mr. Saneholtz, yes; Mr. Messineo, yes; Mr. Zimmerman, yes; and Mr.
Gerber, yes. (Approved 7-0.)

Speed bumps along 1\'[arti~i Road -
The City Engineer, Paul Hammersmith, has indicated that although the Initial
installation of the speed bumps along Martin Road was mcoiYect, they have since been
reshaped, painted, and striped to fit City standards. This project is considered complete
and additional work on the speed bumps is not plaruled at this time. However, we are
considering planting landscaping material on the sides of the speed bumps to deter
vehicles from steering around them. Unfot~tunately, there isn't -„uch tl,e city can do
about drivers honking their horns as they go over the speed bumps.
1\1artin Road [3ikcpatti .
- According to the I3ikewa}~ Plan in the 1997 Community Plan, a bikepath is planned on
the noilh side of Martin Road. Since primarily single-family homco~vncrs own the land
along Marlin Road, the City will need to purchase bikepath easements from these
property owners to construct the path. The funds for this type of mass land acquisition
are t}~,icall~~ included in the five-year Capital h„proveme„ts Plan (CIP) as a budgetary
item- Although this bikepath was not included in the 2004 five-year CIP, a new CIP s
adopted h~~ City Council each year and tt may be included m subsequent years.

Annexation History
The land included in the rezoning application (Case No. 03-0807) was annexed between
1961 and 1972. The ordinances, which approved these annexations, are ordinances #01-
61, #08-64, #14-65, and #45-72. During those years, annexation law required that a
majority of the property owners (51 percent) must sign an annexation petition before the
county could grant annexation approval Full copies of these annexation ordinances arc
located in the Municipal Building at 5200 Emerald Parkway for your review. Certified

Anne Wanner said this is part of the area rczonings project. This area is in the southeast portion
of Dublin. The area is bounded by 1-270 on the north, the Scioto River on the west, the southern
boundary line of Dublin on the south, and Sawmill Road on the east. She showed an aerial slide
showing the 83 parcels totaling approximately 142 acres proposed for this area rezoning. These
pazcels were annexed to Dublin sometime between 1961 and 1972. Most of the parcels are in
the CDD, however some parcels on the west side of Riverside Drive are not included. This
application includes several established neighborhoods including the Sunnydale Estates, Colony
Estates, The Village of Scioto Condominiums, and Riverside Glen North. The parcels range in
size from approximately one-half acre to 27 acres. This rezoning is to establish the R-1, R-2, or
R-4 Districts as indicated on the slide of the zoning map shown.
Ms. Wanner said one property originally listed on this application is leased to Dublin by the City
of Columbus as part of a 99-year parkland lease. It is used as a riverside boardwalk and park.
She said originally, staff included a portion in the CC, Community Commercial District,
however, after further research, it was found to be this is part of the park. Therefore, staff
applied the R-1 District for that land. It was further withdrawn from the other area rezoning
which included all the commercial land.
Ms. Wanner said staff held an informational meeting for the residents on September 10, and
although only 1 S property owners signed in, other residents attended_ Issues were raised at the
meeting by some of the David Road, Martin Place and Martin Road residents. Staff received
numerous calls regarding the proposal for the R-4 zoning along Martin and David Roads.
Additional rezoning applications for 4444 Tuller Road and the Vogel Property, which were
approved by the Commission are scheduled for the final readings at City Council on November
17. An application is also pending for the two long parcels along west Dublin-Granville Road.
An older PCD, Plaruled Commerce District application known as the David Road
Redevelopment was tabled on February 3, 2000, and remains tabled. Because of these pending
applications, these properties may be withdrawn from this application as they continue forward.
Ms. Wanner said Dublin considers this a housekeeping effort to establish Dublin zoning on land
which has been annexed. It is intended to avoid future Code Enforcement problems arising from
inconsistencies within the Dublin Toning Map. She said staff recommends approval of this area
rezoning. She showed slides which depicted the character of the areas being rezoned.
Ms. Boring asked if R-4 was proposed at Martin Place. Ms. Wanner agreed_
Ms. Wanner said the rczonings proposed are what have been reflected on the Dublin Zoning Map
for a number of years ~fhat is how staff arrived at some of the zoning proposals_
Ms_ Boring said evidently residents did not realize what was going on when the public meeting
was held. She believed there had been some misinformation going on between the neighbors
that was not clear. Shc was also concerned that there is a pending commercial zoning that the
City was instructed to help David Road out with that has been tabled for two years. Shc knew
people were concerned about that. "therefore, she asked that in the interest of time that Ms.
Wanner would meet with those people again and table this particular area rcz_oning to listen to
their concerns. In particular, they were concerned about the area being zoned R-4_

Dear Ms. Wanner,
Thank you for the telephone discussion today regarding the proposed rezoning of lots in south-east
Dublin, particularly the Martin Road area. I plan to attend the Planning & Zoning Committee's public
meeting on Thursday, 06NOV03.
To review, here are my concerns:
#1. On the map we received, about half of Lilly-Mar Court and Martin Road are proposed to be R4, and
the other half R2. Why the difference, as the neighborhood is homogenous: single family homes on good
size lots? The noticeable exceptions are the Zachary Court PUD, the Village of Scioto R4, and the red
brick condos at the corner of Martin and Dublin Village Center Drive.
#2. Why suggest R4 in this neighborhood? Why "give away" the most dense zoning category instead of
protecting these lots with the most restrictive zoning R1? It is my understanding that Lilly-Mar Court
began development in 1956 as the Sunnydale Estates. Each lot is about an acre, with one single-family
house on each lot. That's the definition of R1, and that's what was built and what remains today. If we
finally have the chance to officially "zone" this neighborhood with an ordinance, why not call it like we see
it: R1? If any landowner tore down a 40 year old ranch home and replaced it with "4 to 8 units" because in
2003 the City decided R4 was appropriate, the character of the neighborhood would be affected
negatively.
3. As for Martin Road, I suggest the same philosophy be applied for all the same reasons: R1 on lots of
40,000 sq. ft. (an acre), or R2 on lots less than an acre but more than 20,000 sq. ft.
4. I have had long-time residents of Lilly-Mar Court tell me that even in the mid-1960s, Martin Road was
"way out in the country." It would seem reasonable to believe that the township and/or Franklin County
had it classified as Rural-Agricultural, and may have "rezoned it" to an R-1 type classification to allow this
development of single family homes in the 1950s and 1960s. That's likely the zoning that the City of
Dublin inherited at time of annexation, and the zoning that should be approved by ordinance today. It
seems hard to believe that sometime over the past forty years, after most of these lots were improved with
single-family homes, that a government rezoned these lots to an R-4 density.

SUMMARY:
As part of the on-going "Area Rezoning" project, Ordinance #94-03 will establish the
Dublin R-1, Restricted Suburban Residential District, R-2, Limited Suburban Residential
District, and R-4, Suburban Residential District zoning for properties in the southeast
portion of Dublin (south of I-270, east of the Scioto River) in an area known as the CDD,
Corridor Development District.
Ordinance #95-03 will establish the CC, Community Commercial and SO, Suburban
Office and Institutional Districts in this same CDD area. Properties listed in these
ordinances include several commercial and retail establishments, including Wendy's
International, a hotel, and undeveloped land along the Dublin-Granville Road corridor.
The last two ordinances, #96-03 and #97-03, will establish the Dublin, R-1, Restricted
Suburban Residential District zoning for residential properties located between Dublin
Road and the Scioto River, mostly along Bellaire Avenue, and in the Deer Run Estates
region. Properties include "estate-lot" residential properties and subdivisions (many
along the west side of the Scioto River), parkland, and undeveloped land.
An introductory letter will be mailed August 15, 2003, to all of the affected landowners,
along with the applicable zoning regulations and a copy of the attached map(s). An
informational forum for the property owners listed in Ordinances 96-03 and 97-03 is
scheduled for August 26, 2003. The meeting for the property owners listed in Ordinances
94-03 and 95-03 is scheduled for September 10, 2003.
RECOMMENDATION:
Introduction of the ordinance and referral to the Planning and Zoning Commission.
