AN ORDINANCE TO ACCEPT THE LOWEST/
BEST BID FOR THE
DUBLIN ROAD BIKEPATH -RESERVE DRIVE TO GLICK ROAD
AND DECLARING AN EMERGENCY
WHEREAS, after advertising, receiving and opening six (6) bids on August 13, 2003 for
the Dublin Road Bikepath -Reserve Drive to Glick Road; and
WHEREAS, Council has determined that the lowest and best bid for said project is from,
Fort Defiance Construction and Supply, Inc. and C. J. Mahan Construction Company,
Joint Venture, in the amount of $482,039.20; and
WHEREAS, Council has determined that there may be a legitimate need to declare the
relocation of the utilities in connection with the above-referenced project as a "single
source" procurement, for reason that the company owning the utilities in question has the
exclusive rights to relocate such utilities; and
WHEREAS, it is in the best interest of the City to execute this contract as soon as
possible so that construction can be completed during favorable weather.
NOW THEREFORE BE IT ORDAINED by the Council of the City of Dublin, Ohio,

Section 1. That the bid from Fort Defiance Construction and Supply, Inc. and C. J.
Mahan Construction Company, Joint Venture, in the amount of $482,039.20 be, and
hereby is, accepted.
Section 2. That the City Manager is hereby authorized and directed to execute a
contract with Fort Defiance Construction and Supply, Inc. and C. J. Mahan Construction
Company, Joint Venture, for completion of said project pursuant to the bid specifications
and documents on file in the office of the City Engineer.
Section 3. That this Ordinance be, and the same hereby is, declared to be an
emergency measure for the preservation of the public peace, health or welfare of the
residents of this City, and, therefore, this Ordinance shall take effect and be in force
immediately upon its passage.

Dublin Road Bikepath -Reserve Drive to Glick Road
Project No. 03-002-CIP
Summary:
On August 13, 2003 six (6) bids were received and publicly opened and read for the Dublin Road
Bikepath -Reserve Drive to Glick Road project. A summary of the bids is shown on the attached bid
tabulation. All bids have been reviewed by Division of Engineering staff. The engineer's estimate for
this project is $600,000. These improvements, as depicted on the attached exhibit, consist of
constructing 4,500 feet of Bikepath, pre-fabricated bridge, ditch enclosure/storm drainage on the west
side of Dublin Road from Reserve Drive to Glick Road.
Fort Defiance Construction and Supply, Inc. and C. J. Mahan Construction Company, a joint venture,
submitted the lowest and best bid of $482,039.20, which is $117,960.80 less than the engineer's
estimate. Fort Defiance Construction and Supply Company satisfactorily completed Coffman Road
Improvements - 1993, Dublin Storm Sewer - 1999 and the North Fork of Indian Run Bikepath Bridges
- 2001. They performed well and work was completed on schedule. C. J. Mahan Construction
Company successfully completed the Rings Road Bridge over I-270 project in 2002. As a result, there
are no concerns with these two companies performing this project. All work is within existing right-of-
way, thus not requiring any land acquisition.
Recommendation:
Staff recommends this ordinance accepting the bid of Fort Defiance Construction and Supply Inc. and
Mahan Construction Company, Joint Venture be adopted by Council. Emergency action upon adoption
is requested to allow the work to commence immediately and be mostly performed during the remaining
favorable summer and early fall weather, and thus be substantially completed by the final project
completion date of November 14, 2003.
I recommend this contract be awarded to Fort Defiance Construction and Supply Company and C. J.
Mahan Construction Company, Joint Venture, the lowest and best bidder.
Attached is an emergency ordinance for approval by City Council prior to awarding the contract to Fort
Defiance Construction and Supply Company.
