AN ORDINANCE TO ESTABLISH DUBLIN ZONING FOR 19
PARCELS COMPRISING AN AREA OF APPROXIMATELY
144 ACRES, AS ANNEXED FROM WASHINGTON AND
JEROME TOWNSHIPS IN 1973 AND 1999, GENERALLY ON
THE NORTH SIDE OF POST ROAD, SOUTH OF BRAND
ROAD, BETWEEN HYLAND-CROY AND MUIRFIELD
DRIVE, AS R-1, RESTRICTED SUBURBAN RESIDENTIAL
DISTRICT OR R, RURAL DISTRICT(CASE NO. 03-0702 -
POST ROAD TO BRAND ROAD, WEST OF MUIRFIELD
DRIVE AND EAST OF HYLAND-CROY ROAD).
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, '~ of the elected members concurring:
Section 1. That the following described real estate (listed as parcel numbers)
273000298, 273000361, 273000363, 273000368, 273000378 (part of), 273000385,
273000388, 273000390, 273000418, 273000430, 273000443, 273001586,
273001821, 273001909, 273004485 (part of), and 273007471 (part of), and (see
attached map marked "Exhibit A Post Road to Brand Road, West of Muirfield Drive
and East of Hyland Croy Road (Case 03-0702)") situated in the City of Dublin, State
of Ohio, is hereby rezoned R-1, Restricted Suburban Residential District and shall be
subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter 153
of the Codified Ordinances) the City of Dublin Zoning Code and amendments
thereto.
Section 2. That the following described real estate (listed as parcel numbers)
1470000013000, 1470000015000 and 1470000015001 (see attached map marked
"Exhibit A Post Road to Brand Road, West of Muirfield Drive and East of Hyland
Croy Road (Case 03-0702)") situated in the City of Dublin, State of Ohio, is hereby
rezoned R, Rural District and shall be subject to regulations and procedures contained
in Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City of Dublin
Zoning Code and amendments thereto.
Section 3. That application, Exhibit "B", including the list of contiguous and affected
property owners, and the recommendations of the Planning and Zoning Commission,
Exhibit "C", are all incorporated into and made an official part of this Ordinance and
said real estate shall be developed and used in accordance therewith.
Section 4. That this Ordinance shall take effect and be in force from and after the
earliest period allowed by law.

East of Hyland-Croy Road
Location: 18 parcels comprising an area of approximately 1150 acres, as annexed from
Washington Township in 1973 and 1999, generally on the north side of Post Road, south
of Brand Road, between Hyland-Croy and Muirfield Drive.
Existing Zoning: Washington Township Districts.
Request: Review and approval of an ordinance to establish Dublin R-1, Restricted
Suburban Residential District, and R, Rural District.

BACKGROUND:
On the advice of Dublin's Law Director, staff is systematically researching Dublin zoning activity
on all parcels annexed into Dublin. The Planning Division is responsible for compiling and
processing these "area rezoning" applications to formally establish Dublin zoning wherever there
is ~ question about the zoning history. The first major area rezoning was undertaken in 2001,
and it covered the northeast quadrant of Dublin. City Council has introduced additional rezonings
since last year.
.-- The subject sites in this case were annexed in 1973 and 1999; there is no history of zoning action
since that time. The parcels have reflected R-1, Restricted Suburban Residential Dsitrct and U-1,
b Rural (Jerome Township) on Dublin's zoning map for many years. Ordinance #87-03 was
introduced at City Council on July 21, 2003. It will establish Dublin R-1, Restricted Suburban
Residential and R, Rural Districts on these properties. A special informational meeting was held
on August 26, 2003 at the Dublin Recreation Center and only a few property owners from this
area attended.
After the Planning Commission makes its recommendation, the case will be forwarded to City
Council for a public hearing and final vote. With a positive recommendation from the
Commission, a simple majority vote is required for passage. A negative Commission
recommendation requires five votes for passage. If the ordinance is approved, it will take effect in
30 days.

CONSIDERATIONS:
Site Characteristics:
The subject area is comprised of a number of parcels along the east and west side of Avery
Road, and along the north side of Post Road, east of Hyland-Croy Road. The total area
being rezoned is 150 acres. The parcels consist of six single-family homes, mostly located
along Avery Road, parkland including Avery Park, and part of M.L. Red Trabue Nature
Reserve, three churches, and farmland adjacent to the Post Preserve subdivision. The
parcels range in size from one to almost 53 acres.
• This rezoning proposes to establish the Dublin R-1, for all parcels except for land to the
east of Post Preserve, which was not included in that original rezoning. This land will be
designated with R, Rural District zoning. All legally non-conforming uses will be subject
to the requirements of Section 153.004 (C).
• The parcels on the west side of Avery Road are bordered by single-family subdivisions
including Westbury, Wyndham Village, Wexford Estates, and Lowell Trace. Properties on
the east side of Avery Road are surrounded by subdivisions including Hawk's Nest,
Dublinshire, and Indian Run Meadows. The properties along the north side of Post Road
are nestled within M.L. Red Trabue Nature Reserve, the Northwest Presbyterian Church,
the Gordon Farms apartments, and the Post Preserve subdivision, which is currently
under construction.
• Two of the properties listed in this application are known as the Humbert
Property/Freshwater subdivision. They are subject to a pending PUD, Planned Unit
Development concept plan for a small development adjacent to Wyndam Village Section 5
(See Case #03-092CP). The concept plan is the first step in a PUD rezoning. If the concept
plan is approved the applicant may file a rezoning application. Staff is aware of the
conflicting requests. If the Freshwater PUD rezoning is approved prior to this area
rezoning moving forward, that 5.26 acres will be withdrawn from this City-sponsored
application.
A letter was mailed to the affected property owners listed in this application. A sample
copy is attached, and it outlines the circumstances, procedures, and proposed zoning, as
well as dates for public meetings. An informational meeting was held on August 26, 2003,
for the affected property owners. Less than five property owners from this area attended
the informational meeting.
Community Plan, Land Use and Zoning Issues:
• On August 12, 2002, City Council amended the Future Land Use Map (Map 8) of the
Community Plan. All of the properties in this application, except for the large piece of
property east of Post Preserve, are shown on the Future Land Use Plan as having an
existing land use as "Residential", "Public/Private Park" or "Public/ Institutional." The
large property adjacent to Post Preserve land is designated with "Residential -Medium
Density (1-2 du/ac)." An access point to this land is planned within the Post Preserve
subdivision.
• This rezoning is primarily a housekeeping issue and will not have an immediate impact on
the majority of the surrounding residents and property owners. Legally non-conforming
uses cannot be expanded, and they cannot be re-established after being discontinued for a
period of two years.
• Even without Dublin zoning, most of Dublin's development standards would apply. A
1976 ordinance requires adherence to Dublin standards, wherever they are stricter,
following annexation. However, the failure to establish Dublin zoning on the property

could make administration and enforcement difficult in some circumstances. It can also be
rather confusing for landowners.
Development Standards:
• The properties listed in this application were annexed from Washington Township
(Franklin County) in 1973 and Jerome Township (Union County) in 1999. Relying on the
correct township zoning district for these areas is not precise or advisable. Since the
zoning of these properties is unclear, a comparison chart of the zoning districts has not
been included in this report. However, based on discussions and research with the
township zoning officers and township codes, the current property uses are consistent with
historically permitted uses at the time of annexation.
Utilities:
• This is an action to establish Dublin zoning. No development is proposed as part of this
application, and it has no effect on utilities.
• New development anywhere in Dublin, including on these parcels, must comply .with
adopted stormwater management regulations for the City of Dublin.
• Currently, municipal water and sanitary services reach some of these properties. The
zoning does not affect utility status. Undeveloped parcels will need to tap into the existing
utilities per City Code.
STAFF RECOMMENDATION:
Following annexation, the staff research indicates these properties were not placed in a Dublin
zoning classification by a formal rezoning ordinance. They have been reflected as R-1, and U-1
on the zoning map for many years. This application is City-sponsored and legally advisable. It is
intended to avoid any future potential Code enforcement problems arising from township
classifications and inconsistencies within the Dublin zoning map. This action provides proper
zoning and is primarily a housekeeping effort. Staff recommends approval of this rezoning.
Bases:
1) This rezoning will provide an appropriate Dublin zoning classification for land
within the City limits to provide for the effective administration of development
standards, procedures, etc.
2) The rezoning will maintain the established development pattern that has been in
place for many years and establishes land uses consistent with those listed in the
Community Plan.

Anne Wanner said this area includes 150 acres and estate lots on Avery Road, parts of Avery
Park and the Trabue Nature Preserve, and several churches. She said these pockets were not part
of an adjacent zoning plan, and R-1, Restricted Suburban Residential District is proposed for
most parcels. R, Rural District is proposed for the agricultural piece east of Post Preserve.
Ms. Wanner said this application involves the Humbert property, on which there is a pending
PUD request. If the Humbert property is rezoned first, staff will withdraw it from this case. A
few residents attended the informational meeting. Several church representatives called her.
This is consistent with the Community Plan and staff recommends approval.
Mr. Gerber moved for approval of this area rezoning because it will apply an appropriate Dublin
zoning classification, will provide for effective development administration, will maintain the
established development pattern, and is consistent with the Community Plan, provided that the
Freshwater/Humbert tract of 5.26 acres (File No. 03-092CP) will be deleted from this ordinance
if it has been approved by City Council prior to this case moving forward. Mr. Zimmerman
seconded, and the vote was: Mr. Ritchie, yes; Ms. Boring, yes; Mr. Sprague, yes; Mr. Saneholtz,

SUMMARY:
As part of the on-going "Area Rezoning" project these rezoning applications will
establish Dublin zoning for properties in the middle portion of Dublin bounded by Brand
Road, Dublin Road, I-270/161 and Hyland-Croy Road. These properties, listed in
Ordinances 84-03 85-03, 86-03, and 87-03, include "estate-lot" residential properties,
parkland, Coffinan high school, and a few churches.
Although this systematic rezoning method is very time-intensive undertaking, progress Is
being made. The goal is to have this project completed by the end of the year.
