Mayor Keenan called the Monday, November 2, 2015 Regular Meeting of Dublin City
Council to order at 6:30 p.m. at the Dublin Municipal Building.
ROLL CALL
Members present were Mayor Keenan, Vice Mayor Gerber, Ms. Chinnici - Zuercher, Mr.
Lecklider, Mr. Peterson, Mr. Reiner and Ms. Salay.
ADJOURNMENT TO EXECUTIVE SESSION
Mayor Keenan moved to adjourn to executive session to discuss the purchase of property
for public purposes and conferences with an attorney for the public body concerning
disputes involving the public body that are the subject of pending or imminent court
action.
Vice Mayor Gerber seconded the motion.

• Veterans Week
Mayor Keenan read and presented a proclamation in honor of Veterans Week, November 8
- 14 to Lt. Col. Jeff Noble and many other local veterans present at the meeting.
Lt. Col. Noble invited everyone to join the veterans on Wednesday, November 11 at La
Chatelaine for breakfast, followed by a procession to Dublin Veterans Park for the
!ceremonies. Brigadier General Dana McDaniel will be the keynote speaker this year. He
urged all to attend. [A photo of the entire group was taken.]
• Recognition of Norm Smith, Veteran, United States Army Air Force
Mayor Keenan stated that Norm Smith, a veteran of the U.S. Army Air Force is present
tonight with his family for special recognition.
He praised Mr. Smith for his leadership in establishing the Military Round Table in 2001 at
the Dublin Community Recreation Center. Dublin residents and veterans Mack Parkhill and
'Gene Bostic approached the City and encouraged Council to recognize Mr. Smith for his
efforts in providing a venue for veterans to share their wartime stories. At this time, over
50 veterans participate in the meetings. In large part, this is due to Mr. Smith's efforts, as
he calls everyone on the roster and reminds them of the meetings.
Mayor Keenan then read a proclamation declaring Tuesday, November 3 as "Norm Smith
Day" in Dublin and presented it to him, together with a special personalized Dublin jacket.
He invited Mr. Smith to comment.
Norm Smith, Veteran, U.S. Army Air Force, Dublin Military Round Table thanked Council
for the recognition and for the jacket. For the benefit of the many youong people at the
meeting, he clarified that the Battle of the Bulge was NOT a weight loss program! Any
success of the Military Round Table is due to great guest speakers and very loyal veterans.
He thanked Council and everyone present for this recognition.

,CITIZEN COMMENTS
'Wallace Maurer, 7451 Dublin Road, Dublin:
1. Stated that in the packet material, he noted a reference to "preventing tobacco
addition." This should be corrected to "addiction."
2. Noted that he and Scott Dring, DCVB Executive Director now enjoy cordial
relations, even though they do not agree on all things. Last time Mr. Dring spoke,
he referred to the Top Gun Football Camp and indicated it is sponsored by Football
University. He asked for clarification about Football University.
j Ms. Chinnici - Zuercher explained that former NFL players have put together this program,
and thus the name "Football University."
Mr. Maurer stated that his prime contention is that football has nothing to do with the
mission of a university. He told a story about Woody Hayes who called the head of the
English department and said that a student in the professor's class works very hard,
attending all of the classes, and could there be some recognition for that. The English
department head responded to Woody that when OSU plays Michigan in a close contest,
'with the home state losing, and the coach has in hand a game winning play, does the
coach give that play to the player who has been on the bench all season but who has tried
hard? Or will the play be given to the player who knows how to execute the play? After a
pause, Woody responded "touche."
Mr. Lecklider stated that he appreciates and respects his opinion regarding Top Gun
Football Camp. However, he cannot believe Mr. Maurer is otherwise not appreciative of
'the job that Mr. Dring has done as Executive Director of the Bureau.
Mr. Maurer clarified that he does appreciate his work, and respects that they disagree
about some things.

SECOND READING /PUBLIC HEARING - ORDINANCES
!Ordinance 73 -15
Authorizing the City Manager to Enter into a Contract for Public Health Services
with the District Advisory Council of the Franklin County General Health District
for 2016.
Mr. McDaniel stated that in August, the Franklin County Board of Health approved a per
capita rate of $7.51 for the public health services provided to participating jurisdictions.
This rate reflects a 4.89 percent increase over the 2015 per capita rate. The City's cost for

the 2016 contract will be $333,455.94. This covers services related to public health care
as well as plumbing inspections. The contract does not include the mosquito control and
management program, which is done under a separate contract.
Staff recommends approval of Ordinance 73 -15.

Authorizing the City Manager to Execute Necessary Conveyance Documents to
i Acquire a 0.031 Acre, More or Less, Temporary Easement from Realty Income
'Properties 8, LLC, for the Property Located at 6000 Perimeter Boulevard for the
Construction of a Shared -Use Path.
Mr. McDaniel stated that the City is preparing to construct a shared -use path adjacent to
Discovery Boulevard and continuing onto Wall Street. The map provided in the packet
depicts this project. After engaging in amicable discussions, the City has come to
agreement with the grantor to acquire a temporary easement at the appraised value of
$1,275. Staff recommends approval of Ordinance 74 -15.

Mayor Keenan thanked staff for providing the area locator maps with the legislation to
'assist with identifying the location of projects.

Amending Chapter 51 Establishing User Fees and Capacity Charges for the
Sanitary Sewer and Water Systems.
Ms. Mumma stated that when the 2016 -2020 Capital Improvements Program was
presented to Council in August, she noted at that time the plan to propose an increase in
the sewer fees for both 2016 and 2017. As Council is aware, the Sewer Fund has a
significant amount of debt, namely from the Upper Scioto West Branch Interceptor. That
loan was taken out in 1999 and was $19.7 million. The annual debt service on that loan is
approximately $1.4 million. The final payment will be made in 2018. In addition to that
debt payment, the Sewer Fund has significant ongoing maintenance expenses in order to
keep the system operating properly. Every other year for approximately the next 15
years, it is expected that the sewer lining and manhole rehabilitation program will
:continue. That cost usually ranges about $2.5 million each year. As a result of these
expenditures as well as future ongoing expenditures, including the lining of the sewer
lines, staff is recommending that in 2016 Council increase the sewer charge by $0.25 per
,1,000 cubic feet as well as reallocate $0.25 from the water charge to the sewer charge.
In that way, the net increase is $0.25 per 1,000 MCFs. Based on the average usage, the
quarterly surcharge will go from $47.52 for both water and sewer to $48.35, an increase
of $0.83. In 2017, staff is recommending an additional $0.25 increase to the sewer
surcharge, taking the charge per 1,000 cubic feet to $11.85. This would then take the
ewer surcharge from $48.35 to $49.18, an increase of $0.83. This level of increase is
appropriate, based on ensuring that the City can continue to operate the water and sewer
funds. As previously discussed, the Water Fund is very healthy and can absorb this
reallocation and no increase in the rate. Until the Upper Scioto Branch debt is paid off, the
,City does need to have additional funds going into the Sewer Fund.
Mayor Keenan noted that Council has discussed these increases previously and thanked
staff for their work on this.

Wallace Maurer, 7451 Dublin Road, Dublin stated that Council recently discussed the rising
desire for sewer service. How does this fee increase relate to those with problematic
septic systems who are waiting for sewer service? At what time is the fee levied — when
residents are connected to the systems?
Mayor Keenan stated the fees are a separate item from the sewer extensions.

Ms. Mumma stated that a resident is not assessed these charges until they are a user of
the system. The extensions of the water and sewer lines to the unserved areas is funded
by either capital improvement tax fund dollars or General Fund allocation — not from
increasing the rates for the existing water and sewer users.
'Mayor Keenan stated that the proposal is that the City would extend the main lines for the
i utilities, and the property owner would be required to pay the cost to connect via laterals
and the tap fees for both Columbus and Dublin. Council is still working through details on
this matter, and there was a provision being considered that 50 percent of Dublin's portion
of the tap fees could be waived as an incentive. That discussion is ongoing.
Mr. Maurer stated that his septic system is failing. Should he continue to repair it until the
sewer lines are extended?
Mr. McDaniel suggested that Mr. Maurer meet with Engineering staff to review the
deployment plan as proposed to Council for the main lines to developed but unserved
areas. Staff could review the maps and timeframes for the extensions with him.

;Ordinance 76 -15
Amending Chapter 35 of the Codified Ordinances to Revise the Fee and Service
Charge Revenue /Cost Comparison System and Establishing a Schedule of Fees
and Service Charges for City of Dublin Services.
• Mr. Stiffler stated that there was some discussion of this matter at the Finance
Committee. To recap, this year an inflationary measure is being applied of 1.2
percent to the fees for services. This results in no or only inflationary changes for
all of the departments.
• Staff is proposing one new service — after -hours plan review. It is modeled after
the after -hours inspection fee. These inspections are by request only as is the plan
review. Typical examples are fire alarm inspections, safety inspections, generator
tests, etc. where an empty building is preferred.
• One fee changing by more than inflationary rate is the Mayor's Court computer fee.
Staff is recommending this fee be increased from $5 to $8. That would allow the
fund balance to increase slightly in future years for anticipated upgrades. The fee
level at $8 puts the Dublin fee well in line with other Central Ohio communities.
Mayor Keenan noted that the caseloads in Mayor's Courts in other cities on the chart are
considerably higher, although the cities are similar in size.
Mr. Stiffler responded that the 2013 caseload in Dublin does seem low, and is lower than
!what the cost study estimated. It could relate to how the December and January cases
are counted. The caseload projected for 2015 will be around 3,000 cases, and Dublin had
approximately 3,000 cases last year. The caseload report for communities came from a
{Supreme Court report.

Appropriating a 0.013 Acre, More or Less, Permanent Easement, and a 0.007
Acre, More or Less, Temporary Easement from Kevin D. Mullins and Jocelyn
Mullins, from the Property Located at 8600 Hyland -Croy Road for the
Construction of a Shared -Use Path Connection.
Mr. McDaniel stated that the City is prepared to construct a shared -use connection path
adjacent to Hyland -Croy Road, and hopes that an amicable resolution can be reached with
the grantors. This ordinance authorizes the Law Director's office to file a complaint for
appropriation in the Court of Common Pleas in the event that negotiations are
unsuccessful. The appraised fair market value for the property interest was determined to
be $1,275.00. Staff recommends approval.

Ordinance 78 -15
Appropriating a 0.62 Acre, More or Less, Parcel and a 1.186 Acre, More or Less,
Parcel from BET Investments I, LLC and Riverview Street Investments, Ltd.,
Respectively, for the Property Located along the East Side of North Riverview
Street, for the Public Purpose of Providing and Preserving Needed River
Fronting Park Land along the Scioto River in and around the Dublin Historic
District.
Mr. McDaniel stated that a map has been provided in the packet as well. The City is
prepared to implement a plan to preserve and provide needed public parkland along both
sides of the Scioto River in and around the Dublin Historic District. The City hopes to
reach an amicable agreement with this grantor. Should that not occur, this ordinance
authorizes the Law Director's office to file a complaint for appropriation in the Court of
Common Pleas. The City is contemplating an appropriation of approximately .62 acres,
more or less, and another 1.186 acres, more or less, of two combined parcels at the fair
market value of $320,000. Staff recommends approval.

Authorizing the Provision of Certain Incentives to Doucet & Associates Co., LPA
to Induce it to Retain an Office and Associated Operations and Workforce
within the City, and Authorizing the Execution of an Economic Development
Agreement.
Ms. Ray stated there are no changes since the last reading. Troy Doucet, Principal of the
firm is present tonight as well.
Troy Doucet, Doucet & Associates stated that he appreciates the incentives that the City
has offered. They are a firm of 12 lawyers practicing predominantly consumer litigation.
They represent clients facing foreclosure as well as debt collectors, credit reporting
agencies, and other mortgage or financial institutions. They have experienced recent
.growth and plan to grow further. The site for their office building construction is next to
their current location at 700 Stonehenge -- Site 100.

,Authorizing the Provision of Certain Incentives to XPO Intermodal Solutions,
Inc. to Induce it to Retain and Expand an Office and Its Affiliated Entities,
(Associated Operations and Workforce within the City, and Authorizing the
Execution of an Economic Development Agreement.
Mr. Gracia stated there is no additional information to report at this time. He introduced
the President of Intermodal and XPO Logistics.
Paul Smith, 4385 Wyandotte Woods Boulevard, Dublin thanked the City for the support
they have provided over the years. XPO Logistics is a supply chain logistics company that
was once known as Pacer International. Pacer was acquired by XPO Logistics about 18
months ago. At the time, XPO had a large brokerage operation and then they became the
Intermodal operation. They have since grown rather considerably. At the time, the
,combined entity was just over $2 billion in revenue. Today, as of Friday's closing on the
acquisition of Conway, they are now a $15 billion entity. Dublin has supported the
'company throughout their growth and from a community and organizational standpoint,
,Dublin aligns with their emphasis on technology and being progressive. As an entity, they
,will spend over $400 million in IT, growing the backbone of their platform. They are very
(,excited to be able to remain and expand in Dublin.

mayor Keenan commentea that their logistics footprint is international.
Mr. Smith responded that the company has 1,500 locations housed in 82 countries.
Mayor Keenan thanked the company for expanding in Dublin.

INTRODUCTION /FIRST READING — ORDINANCES
Ordinance 81 -15
Creating Chapter 38 of the Codified Ordinances of the City of Dublin Regarding
Municipal Income Tax.
j Vice Mayor Gerber introduced the ordinance.
Ms. Gibson stated that staff has been working on this issue for several years. In order to
comply with state law, the City is incorporating a new chapter, Chapter 38, which contains
all of the mandates set out by House Bill 5 and in ORC 718. Chapter 35 of the Income
Tax Code will continue to be in existence, as it will still be useful for the next 7 to 9 years.
Mayor Keenan thanked Ms. Gibson for her leadership role in Central Ohio in working on
these mandates.
Ms. Chinn ici-Zuercher asked about the potential cost to Dublin for this change.
Ms. Gibson responded that the first cost Dublin will have will be in 2018. In 2016, if things
remain static, the City will actually have an increase in tax revenue. The way the penalty
and interest is changing for 2016 versus the rates used now, the City would have had a
net increase in revenue and penalty and interest of $60,000. Next year, there will be five
estimated payments from individuals and businesses due to the way the due dates have
;changed. Staff will continue to monitor and project any impacts on the City's budget from
this new law.
Mr. Lecklider asked if tax payments would still be made directly to the municipality. He
recalls some discussion about central collection.
Ms. Gibson stated that central collection is off the table — at least at this time. The taxes
will still be collected locally.
There will be a second reading /public hearing at the November 16 Council meeting.
STAFF COMMENTS
i Mr. McDaniel:
1. Acknowledged and thanked the Ohio Senate President Keith Faber and Senator Jim
Hughes for the commendations forwarded to the City regarding the IFEA awards
and the bond ratings received from Fitch and Moody's.
2. Noted that the announcement of the Honorary Chair of the 2016 Dublin Irish
Festival, Ed Gaughan is on the dais. A press release has been provided to Council
regarding this news.
COUNCIL COMMITTEE REPORTS
• Mr. Reiner, Chair, Community Development Committee thanked Council for
creating a walkable City. Council has worked over the last five years to create the
Bridge Street District, which will be a great addition to the City. There have been
many naysayers who did not appreciate Council's vision, but he is appreciative of
Council's efforts.
• Ms. Chinnici - Zuercher, Chair, Finance Committee reminded everyone of the
operating budget workshop on Monday, November 9 at 6:30 p.m. She noted that
a meeting of the Committee is also scheduled at 5:45 p.m. that evening to hear
the funding requests from the Dublin Convention and Visitors Bureau and the
Syntero (Dublin Counseling Center).
• Ms. Salay, Chair, Public Services Committee noted that when Council discussed the
extension of water and sewer lines, there was information provided about
residences within 100 feet of existing lines and notification to these property

owners of the requirement to connect. She asked about the status of this
notification.
Mr. McDaniel stated that at the November 16 Council meeting, Ms. O'Callaghan will
provide an update on all matters related to that topic — connection, hardships, etc.

• Mr. Reiner, liaison to Dublin Arts Council reminded everyone to visit the exhibit at
the Dublin Arts Council of "Hate is Not the Answer." Alfred Tibor faced persecution
from Fascist governments and served in a concentration camp in the Soviet Union.
He survived with a very positive attitude about humanity. He encouraged all to
attend.
• Mr. Peterson, liaison to Dublin Board of Education reported that he, Mr. McDaniel
and Ms. Mumma attended the monthly meeting on Wednesday with
representatives of the School Board and School administration. The meeting is
very worthwhile, and he encouraged anyone interested to attend. A recent item
discussed was the Home2 Hotel on the former Cooker site and what is proposed in
terms of a new TIF. The Schools were supportive of this and appreciated the
heads up.
Vice Mayor Gerber commented that the Villager on Thursday included an article about the
excellent financial position of the Schools and talks of the Bridge Street District.
Mr. Peterson stated that in the meeting, the Schools praised the relationship they enjoy
with the City at the staff level as well. They are very committed to their portion of the
Bridge Street District cooperative agreement, and are very interested in the progress.
COUNCIL ROUNDTABLE
!'Mr. Peterson noted that he attended the Bright Road Area Plan meeting. It was well
attended, and he encouraged staff to keep this group engaged. They were very
supportive and were very appreciative of the communication.

Ms. Salay:
1. Asked if there is information online regarding the Bright Road Area Plan meeting
presentations? If not, she would appreciate a memo about this.
Mr. McDaniel stated he will check on this and ensure Council has the information.

Ms. Chinnici - Zuercher:
1. Noted that she attended the Chili Cook -off in Historic Dublin over the weekend. It
was well attended. It has become highly competitive among the restaurants.
2. Participated in the ODOT tour of the 270/33 project, together with staff and some
citizens. There were two tours on Friday, with more scheduled in the future.
Participants are able to understand the project better when viewing it versus
looking at plans, and great progress has been made. ODOT is very excited about
this unique project as well.
3. Reported that she attended the Neighborhood Leadership meeting hosted recently
by the City. The staff presentations were well received. The meetings also provide
a great venue for communication among the neighborhood representatives who
attend. The only suggestion she has is that anyone who asks a question should
identify themselves and their neighborhood.
Mr. Lecklider:
1. Noted that he also attended the Neighborhood Leadership meeting at the DCRC on
Wednesday. He thanked staff who prepared presentations for the meeting. Given
the election campaign discussions about transparency, this is another example of
how this City Council over the years has championed efforts such as this to make
sure that the neighborhood leaders of Associations are informed with respect to
the City's plans and provided with an opportunity to provide feedback.
2. Reported that he, too, visited the Historic District over the weekend for the Chili
Cook -Off. He encouraged the young people present at the meeting to spend their

monies locally during the holiday — gift certificates from local restaurants, gifts
from the various shops in the District.
3. Reminded everyone that tomorrow is Election Day, and encouraged everyone to
vote if they have not done so already. Good luck to Mayor Keenan and Vice Mayor
Gerber, as well as all the candidates.
Mr. Reiner:
1. Reported that he thanked Dublin resident Jeanette Paras, creator of the porch
"Trumpkin" — the story of which went viral. She is a cancer survivor who raises
money for cancer research. This is a wonderful and unusual piece of art. It will
remain on her porch for viewing!
2. Shared several photos of an international magazine that featured Dublin's
"Grounds of Remembrance." The publication is in Chinese, and he asked that the
City obtain a copy of the magazine. It demonstrates Dublin's excellence in the
arts and what the citizens have worked to create in Veterans Park to a global
audience.
Mr. McDaniel stated that Community Relations will obtain copies of this publication.
3. Wished Vice Mayor Gerber and Mayor Keenan the best of luck in the election!
Vice Mayor Gerber:
1. Asked for the public's benefit about where the City's leaf collection schedule is
published.
Mr. McDaniel responded it is on the website, in the Villager and on social media. The
website includes the map for the collection areas as well as the schedule.
2. Noted he received a call from a resident who is new to the City. She commented
that the City promotes bicycling and the bikepaths, yet when visiting the local
hospital, stores or offices, there are no bike racks available. He recalls that at one
time, the Community Services Advisory Commission studied the issue as well as the
Bicycle Advisory Task Force.
Mr. McDaniel stated that the City has aggressively added bike racks on public property.
He agrees that these should be promoted for private property as well. Staff will obtain
some information about this to share with Council.
Vice Mayor Gerber noted that this individual lives along Avery Road and indicated
there is no crosswalk from the eastern side of Avery Road over to the parks. She
added that there are a large number of children who frequent the parks and the
vehicles on Avery do not slow down to allow crossing. She moved to Dublin from
the west coast, where motorists yield immediately to pedestrians in the crosswalks.
Perhaps the City should devise an education campaign alerting residents of the
need to yield to pedestrians in the crosswalk.
Mr. McDaniel responded that staff will report back about this to Council.
Mr. Lecklider noted there is a marked crosswalk with a flashing light that is pedestrian
activated in this portion of Avery Road.
Ms. Chinn ici-Zuercher added that the City invested significantly in devices in Historic
Dublin to enhance pedestrian safety. Unfortunately, drivers are not aware of flashing
lights or pedestrians trying to cross. It is an issue of distracted driving, and perhaps that
can be focused upon again. It is very dangerous and involves drivers of all ages.
Mr. McDaniel agreed that these campaigns are needed on a regular basis to keep
reminding drivers of the need to slow down and yield to pedestrians.
Vice Mayor Gerber noted that this resident may live further north on Avery Road, not close
to the crossing referenced by Mr. Lecklider.
Mr. Lecklider added that another issue is the speed that vehicles travel through
roundabouts and the awareness needed of pedestrians crossing them as well.
Vice Mayor Gerber agreed, noting that all of this is critical to a walkable community.
Mr. Reiner, liaison to Dublin Arts Council stated the DAC will host a wine and cheese
fundraiser on Tuesday, November 10.
Vice Mayor Gerber reported that the Judge's Choice award for the Chili Cook -off was the
Dublin Village Tavern; the People's Choice award went to La Chatelaine.

Mayor Keenan encouraged everyone to vote in the election tomorrow. He has run for
election for many years, and it is important to understand how difficult it is to place one's
name on a ballot. He shared cell phone numbers for the candidates with all of Council,
and he encouraged Council members to welcome those elected to Council.
