AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
ENTER INTO A CONTRACT FOR PUBLIC HEALTH SERVICES
WITH THE DISTRICT ADVISORY COUNCIL OF THE
FRANKLIN COUNTY GENERAL HEALTH DISTRICT FOR 2016
WHEREAS, Chapter 3709 of the Ohio Revised Code states that a city constitutes
district and must provide health services for residents within that district; and
WHEREAS, the City contracts with the District Advisory Council of the Franklin
General Health District to provide health services as required by the Ohio Revise
and
WHEREAS, the previous contract authorized under Ordinance 104 -14 expires on
December 31, 2015.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, of the elected members concurring that:
Section 1. The City of Dublin desires to enter into a contract, attached hereto as an
Exhibit, with the District Advisory Council of the Franklin County General Health District to
provide health services to the residents of the City of Dublin.
Section 2. The City Manager and Finance Director be, and hereby are, authorized and
directed to execute said contract with the District Advisory Council of the Franklin County
General Health District.
Section 3. This Ordinance shall be effective at the earliest date permitted by law.

Memo
Ordinance No. 73 -15 authorizes the City Manager to enter into a contract with The District
Advisory Council of the Franklin County General Health District for the provision of public health
services and plumbing inspection services for 2016. Franklin County Public Health serves as the
public health agency for the City, including the portions of the City in Delaware and Union
Counties.
On August 11, 2015, the Franklin County Board of Health approved a per capita rate of $7.51 for
the public health services it provides to participating jurisdictions. This per capita rate reflects a
4.89% increase over the 2015 per capita rate. Based on MORPC's estimated population for Dublin
of 44,735, the City's cost for the 2016 contract is $333,455.94.
As outlined in the attached correspondence, last year Franklin County Public Health notified
jurisdictions about the need to raise an additional annual investment of $957,500 to address core
services and unfunded mandates. After input from jurisdictions and hearing their concerns, the
Board of Health opted to phase in this increase over time. In 2015, the per capita increase
generated only $559,000 of the needed $957,500. The 2016 per capita increase will generate an
additional $167,138, which results in meeting 76 percent of the goal of $957,500. In addition,
Franklin County Public Health has been aggressively pursuing grants and other funding options to
reduce the burden on the jurisdictions they serve, and will evaluate the needs again next year.
As Council is aware, the mosquito control and management program is handled under a separate,
three -year (2014 -2016) contract between Vector Disease Control Inc. and Franklin County Public
Health. After expiration of the contract on 12/31/16, the City has the option to extend the contract
for two additional one -year periods. VDCI invoices the City of Dublin for the work completed
under the contract. FCPH is responsible for the contract administration and monitors VDCI's
performance and compliance with the terms, conditions and specifications to the contract. The
cost for the City of Dublin under the contract between FCPH and VDCI is $39,714.50 per year.
Recommendation
Staff recommends that Council approve Ordinance No. 73 -15 at the second reading /public hearing
on November 2, 2015.

This letter is to notify you that Franklin County Public Health is requesting a 5% increase in
your charge for public health services in 2016. This is a per capita rate of $7.51.
Last year Franklin County Public Health notified jurisdictions about the need to raise an
additional annual investment of $957,500 to address core services and unfunded
mandates. After talking individually with many of you and hearing your concerns, the
Board of Health opted to phase in this increase over time. In 2015, the per capita
increase generated only $559,000 of the needed $957,500. This year the per capita
increase will generate another $167,138. This brings us to 76% of our goal. FCPH has
been aggressively pursuing grants and other funding opportunities to lessen the burden
on our jurisdictions. We will continue to do so in 2016 and evaluate our needs again next
year.
Based on the per capital rate of $7.51 approved by the Franklin County Board of Health
on August 11, 2015, the annual cost of your 2016 contract will be $333,455.94. Your total
cost is determined by multiplying your city's population figures by the per capita rate.
Based on the MORPC population estimate, the population figure for your city is 44,375.
Enclosed are three original contracts for your signature. Please sign and return all three
contracts to the attention of Deidra Wolf. Once all signatures are obtained, a fully
executed contract will be returned to you.

CONTRACT
BETWEEN THE CITY OF DUBLIN, OHIO AND THE DISTRICT ADVISORY COUNCIL OF
THE FRANKLIN COUNTY GENERAL HEALTH DISTRICT. AND FRANKLIN COUNTY
PUBLIC HEALTH
This contract is made and entered into by and between the City of
Dublin, Ohio, a municipal corporation constituting a city health district, and the
Board of Health of the Franklin County General Health District ( "Franklin County
Public Health "), as approved by the District Advisory Council of the Franklin
County General Health District pursuant to Ohio Revised Code section 3709.08,
and pursuant to Ohio Revised Code Section 3709.281.
WMESSETH
SECTION 1. Franklin County Public Health shall, for the consideration hereinafter
stated, furnish to the City of Dublin, Ohio, and inhabitants thereof, all such public
health services as are furnished to all villages and townships and the inhabitants
thereof, of Franklin County, Ohio. Said services shall include all services as
allowed by law according to the most current version of the Ohio Revised Code.
Said services shall include the minimum standards and optimal achievable
standards for boards of health and local health departments pursuant to Ohio
Revised Code Section 3701.342. Said services shall include enforcement of all
rules and regulations as allowed by law according to the most current version of
the Ohio Administrative Code.
Also, Franklin County Public Health shall provide other services, including the
enforcement of the following Franklin County Public Health Regulations:

(101) Collection Vehicle Registration, Inspection and Operation for
Prevention of Nuisances
(102) Property Health and Sanitation
(103) Plumbing for Commercial, Public, and Residential Buildings and
Places
(104) Rabies Control
(105) Approval of Building Plans
(106) Sewage Treatment Systems
(199) Administration and Enforcement

Pursuant to Revised Code 3709.08(C). once the director of health determines
that Franklin County Public Health is organized and equipped to provide the
services, the Franklin County Board of Health shall have the powers and shall
perform all the duties required of the board of health or the authority having the
duties of a board of health within the City of Dublin. And, the current version of
the above - described regulations of Franklin County Public Health shall apply to
and be enforceable within the jurisdiction of the Franklin County Board of Health,
including the Franklin County General Health District and the City of Dublin
Such services shall be rendered, if appropriate and necessary, when requested
by the citizens of Dublin, Ohio, officials of city government, school authorities or
medical personnel practicing in or around the City of Dublin, Ohio or when
required by state statute.
The City Attorney of Dublin, Ohio shall be responsible for any litigation involving
enforcement of Health Regulations within the corporate limits of said political
subdivision.
This Agreement and any claims arising in any way out of this Agreement shall be
governed by the laws of the State of Ohio. Any litigation arising out of or relating
in any way to this Agreement or the performance hereunder shall be brought
only in an Ohio court of competent jurisdiction in Franklin County, Ohio, and the
City of Dublin hereby irrevocably consents to such jurisdiction.
SECTION 2. Said public health services shall be furnished beginning January 1,
2016 and ending December 31, 2016 provided, however, that either party to this
agreement shall have the right to cancel the same upon four (4) months written
notice and the parties hereto may, by mutual written agreement, modify the
terms of this agreement.
SECTION 3. Franklin County Public Health will provide ongoing communication
with the Mayor /City Manager and his or her designees through a webinar or
conference call at least quarterly. This communication will provide information
on timely public health topics, upcoming events and featured services. Reports
and other information about direct services that are being provided to the
citizens of Dublin will be provided upon request.
SECTION 4. The City of Dublin, Ohio shall pay to Franklin County Public Health for
said public health services furnished to the City of Dublin, Ohio and the
inhabitants thereof, such sum or sums of money based on a per capita rate as
would be charged against municipal corporations composing the Franklin
County General Health District at a per capita rate of $7.51459.
SECTION 5. Said sum or sums of money shall be paid by the said City of Dublin,
Ohio to said Franklin County Public Health upon receipt of semi - annual invoices
by the Franklin County Board of Health on the first day of January, and June,

2016. The sum for 2016 shall not exceed $333,455.94, notwithstanding any fee
established pursuant to the sections set forth below.
SECTION 6. In any instance where Franklin County Public Health expends funds
to abate a nuisance pursuant to Section 1, above, within the City of Dublin,
Ohio, Franklin County Public Health may invoice the City of Dublin, Ohio for the
costs of such nuisance abatement. Further, the City of Dublin, Ohio, shall pay, in
addition to those sums set forth in Section 5, above, to Franklin County Public
Health the cost to abate the nuisance.
Franklin County Public Health agrees to certify such nuisance abatement costs to
the Franklin County Auditor to be recorded as a lien upon the property and shall
reimburse all funds recovered under such a lien to the City of Dublin, Ohio.
PLUMBING INSPECTION SERVICES:
SECTION 7. Franklin County Public Health shall, for the consideration hereinafter
stated, furnish to the City of Dublin, Ohio, all plumbing inspections as are
furnished to all inhabitants within the general health district of Franklin County.
Inspectors are to be state certified by the Ohio Department of Commerce.
SECTION S. The City of Dublin, Ohio, through its Building Department, shall issue
permits and collect fees for such plumbing inspections. The fee to be charged
shall be the most current fee charged by the Franklin County General Health
District. The City of Dublin, Ohio, shall forward sixty (60) percent of all plumbing
inspection fees collected by them to the Franklin County General Health District
after said Health District has submitted monthly statements of the amount due.
The City of Dublin, Ohio shall pay said amount, within thirty (30) days after receipt
of said statement.
SECTION 9. This contract is approved by a majority of the members of the
legislative authority of the City of Dublin, pursuant to the provisions of Ordinance
dated
SECTION 10. The City of Dublin, Ohio has determined that Franklin County Public
Health is organized and equipped to adequately provide the service that is the
subject of this contract.
