Form No. 30043 Ordinance No. 45-04 Passed . 20 AN ORDINANCE AUTHORIZING THE PURCHASE OF A 0.92 ACRE, MORE OR LESS, TRACT OF LAND, FROM THEODORE M. DAROSKI AND KIMBERLY A. DAROSKI, LOCATED WEST OF DUBLIN ROAD AND NORTH OF BRAND ROAD, CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin is preparing to construct a modern roundabout at the Dublin Road/Brand Road intersection to improve related traffic circulation; and WHEREAS, the City desires to enter into an agreement to purchase a 0.92 acre, more or less, tract of land for construction and parkland purposes for $350,000.00; and WHEREAS, the aforementioned objectives will require the City of Dublin to obtain a fee simple interest in the 0.92 acre, more or less, tract of land located at 4640 Brand Road, in the City of Dublin, Franklin County, Ohio, as described in the attached Exhibit ..A.. NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Sectinn 1. The City Manager is hereby authorized to execute an Agreement to Purchase and any necessary closing documents related to the acquisition of the 0.92 acre, more or less, tract of land and paying any related costs. Sectinn 2. There has been appropriated from the Capital Improvements Tax Fund Three Hundred Fifty Thousand Dollars ($350,000.00) to account 401-0314-780-2510 for the purpose of acquiring the 0.92 acre, more or less, tract of land and paying any related acquisition costs. Sectinn 3. This ordinance is declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and welfare. The reason for such necessity is that a closing date of July 15, 2004 has been set. Therefore, this ordinance shall take effefctand be in force immediately upon passage.
