AN ORDINANCE AUTHORIZING THE PURCHASE OF AN
0.447 ACRE, MORE OR LESS, TRACT OF LAND, FROM JOHN
D. KEITH, JR., LOCATED AT 6101 AVERY ROAD, CITY OF
DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO.
WHEREAS, the City of Dublin is preparing to improve Avery Road south of Shier
Rings Road and improve related traffic circulation; and
WHEREAS, the City desires to enter into an agreement to purchase a 0.447 acre, more
or less, tract of land for road widening purposes for $320,000.00; and
WHEREAS, the aforementioned objectives will require the City of Dublin to obtain a
fee simple interest in the 0.447 acre, more or less, premises located at 6101 Avery Road,
in the City of Dublin, Franklin County, Ohio, as described in the attached Exhibit "A";
and
WHEREAS, it is necessary to amend the annual appropriations ordinance to provide
adequate funding authorization for the acquisition of the property.
NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin, state
of Ohio, ~_ of the elected members concurring, that:
Section 1. The City Manager is hereby authorized to execute an Agreement to
Purchase and any necessary closing documents related to the acquisition of the 0.447
acre, more or less, tract of land and paying any related costs.
Section 2. There be appropriated from the unappropriated balance in the Capital
Improvements Tax Fund Three-Hundred Twenty Five Thousand Dollars ($325,000.00)
to account 401-0314-780-2550, for the purchase of acquiring the 0.447 acre, more or less,
tract of land and paying any related acquisition costs.
Section 3. This Ordinance shall take effect and be in force from and after the earliest
date permitted by law.

Situated in the State of Ohio, County of Franklin, City of Dublin,
in Virginia Military Survey No. 3004, and being a portion of an
original 4.36 acre tract of land (4.370 acres bq recent survey)
coaveyad to Shamrock Lane Development Co. by deeds of record is
Official Record 14643, Page F 09 (Exhibit B) and Official Recozd
14543, Paga H 20, Recorder's Office, Franklin County, Ohio, and
bounded and described as follows: -
Beginning, for reference, at a P.E. Nei]. set in the old centerline
of Avery Road, at the northeast corner of said original 4.370 acre
tract. at the northeast corner of a 0.461 acre tract of lead
conveyed out of said original 4.370 acre tract to City of Dublin,
Ohio, for Avery Road right-of-way purposes by deed of record in
Official Record 17628, Page F 14, Recnrder's Office, Franklin
