AN ORDINANCE ADOPTING THE 2005 EDITION
OF THE NATIONAL ELECTRICAL CODE
WHEREAS, it has been determined that Chapter 150.020 of the Dublin Codified Ordinances,
adopting the 2002 edition of the National Electric Code, be amended; and
WHEREAS, Dublin City Council, by reference on May 6, 2002 adopted the 2002 Edition of
the National Electric Code.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, ~ of the elected members concurring:
Section 1. That § 150.020 of the Dublin Codified Ordinances be replaced with:
§150.020 ADOPTION BY REFERENCE.
There is hereby adopted for the purpose of the practical safeguarding of persons,
buildings and dwellings and their contents from hazards arising from the use of
electricity, for light, heat, power, radio, signaling and for other purposes, that certain
code known as the National Electric Code, being particularly the 2005 edition thereof,
recommended by the National Fire Association, except for such portions as are herein
modified, amended or deleted. ('80 Code, §1349.01)(Ord. 02-87, passed 1-5-87; Am.

Section 2. That § 150.021 of the Dublin Codified Ordinances be replaced with:
§150.021 AMENDMENTS, DELETIONS AND ADDITIONS.
(1) In residential dwelling units the load side of the meter to the line side of the panel
shall be installed in a raceway, i.e., PVC conduit.
(2) The minimum service for a new single-family dwelling unit shall be 200 AMPS.
(3) In the kitchen area there shall be a separate circuit for the refrigerator.
(4) Circuits for kitchen counter outlets shall be alternately spaced so that no two
adjacent outlets are on the same circuit.
(5) Whenever any electrical wiring or any other electrical equipment shall have been
inspected and approved, it shall thereafter be unlawful for any person to alter,
damage or interfere with the same without the authority of the Electrical Inspector.
Section 3. This Ordinance shall take effect and be in force on and from March 1,
2005.

RE: ADOPTION OF NATIONAL ELECTRICAL CODE (NEC) -
ORDINANCE 87-04
SUMMARY:
During the December 6, 2004 meeting of Council a question was raised about the necessity of
adopting the National Electrical Code (NEC). Council member McCash stated that the NEC is
a referenced standard within the Ohio Building Code (the building code applicable to
commercial projects). He asked if the NEC is a referenced standard within the Residential
Building Code of Ohio (ORC). I responded that it is not; that was an incorrect response. The
NEC is referenced in Part Seven under "Electrical Requirements" instead of under Part Nine,
which is the "Referenced Standards" portion of the ORC. I apologize for the error.
I believe the purpose behind Mr. McCash's question was to establish that because the NEC is
referenced in both the residential and commercial building codes, it is not necessary to adopt
the NEC separately -- that it would be enforced through the provisions of the applicable
building code.
I agree that the NEC could be applied in any application covered by the scope of the building
codes because of the references to the NEC. There are, however, electrical installations that are
not associated with building construction. Because the scope of the NEC is broader than the
building code, I believe it is in the City's best interest to adopt the NEC.
Generally stated, the scope of the NEC includes all installations involving electrical power that
are outside the realm of the utility company providing the electrical service. Some examples of
projects for which we issued electrical permits and inspected last year where no building or
structure (no building permit) was involved include:
• Parking lot and area lighting
• Special events
• Fountains and pond aerators
Entry feature lighting
Well pumps
CATV power installations

• Stand alone temporary power poles
• Installations at City Parks
• Traffic signal installation.
Since neither building code applies to the above projects, we will be unable to enforce the
provisions of the NEC when these projects are completed unless we adopt the NEC, which has
a broader scope of application.
I continue to recommend that Council adopt the NEC.

RE: Ordinance 88-04 Regarding Driving Under the Influence of Alcohol or Drugs
Dublin Code, Section 73.01, provides that no person shall operate any vehicle under the
influence of alcohol, a drug of abuse, or a combination of them. This section is modeled after
Ohio Revised Code, Section 4511.19. R.C. §4511.19, was recently amended by the passage of
2004 House Bill 163, which took effect on September 23, 2004. The new state law requires a
twenty-year look back period of prior similar convictions and guilty pleas. H.B. 163 also made
minor "cosmetic" changes to R.C. §4511.19.
This office recommends for the Council to amend the Dublin Code section pertaining to
Driving Under the Influence of Alcohol or Drugs in order to be consistent with the recently
enacted state law regarding the same. As always, please contact this office if you have any
