AN ORDINANCE ADOPTING THE 2004 RESIDENTIAL CODE OF THE STATE OF OHIO WHEREAS, it has been determined that Chapter 150 of the Dublin Codified Ordinances, which adopted the 1999 Ohio Residential Code, be amended; and WHEREAS, Dublin City Council, by reference on March 5, 2001 adopted the 1999 Ohio Residential Code, NOW~HEREFORE, BE IT ORDAINED, by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That Chapter 150: Building Regulations, § 150.001, § 150.002 (A), (B), (C), (D), (E), (F), (G), and (H) be deleted. Section 2. That § 150.001 of the Dublin Codified Ordinances be replaced with: There is hereby adopted by reference the 2004 Residential Code of Ohio for One, Two-and Three-Family Dwellings including Appendixes A through G, Which shall be known as the One, Two, and Three Family Dwelling Code for the City, save and except such portions as are hereinafter deleted, modified or amended by this Chapter. One copy of said Code has been and is now filed in the office of the Clerk of Council. Said Code is hereby adopted and incorporated as if fully set out at length herein, and from the date on which this chapter shall take effect, the provisions thereof shall be controlling within the limits of the City. Section 3. That § 150.002 of the Dublin Codified Ordinances be replaced with: §150.002 Amendments, Deletions, And Additions. The Residential Code of Ohio shall be amended as follows: Section 4. Delete Section Rl 12, Board of Appeals. (For appeal process refer to City of Dublin Codified Ordinance 153.231). Section 5. That a new Section 302.4 be added as follows: of the City of Dublin 302.4 CERTIFICATION. The elevation and location of all new buildings shall be certified by a registered land surveyor or a person under the direct supervision of a registered land surveyor. Section 7. That Section 305 Ceiling Heights be amended to read as follows: SECTION 305 CEILING HEIGHT 305.1 Minimum height. Habitable rooms, hallways, corridors, bathrooms, toilet rooms, laundry rooms and basements shall have a ceiling height of not less than RECORD OF ORDINANCES Blank. Inc. 85-04 Ordinance No. Passed Page~~ 7 feet 6 inches (2186 mm). The required height shall be measured from the finished floor to the lowest projection from the ceiling. 1. Beams and girders spaced not less than 4 feet (1219 mm) on center shall be permitted to project not more than 6 inches (152 mm) below the required ceiling height. 2. Ceiling heights in basements shall not be less than 7 fee 6 inches (2186 mm) clear, except under beams, girders, ducts or other obstructions where the clear height shall be 6 feet 8 inches (2032 mm). (a) All building prior to December 19, 1983, are exempt from this requirement. (b) All buildings built between December 19, 1983 and June 19, 1995 shall have a ceiling height in basements of not less than 6 feet 8 inches (2032 mm) clear except under beams, girders, ducts or other obstructions where the clear height shall be 6 feet 4 inches (1930 mm). 3. Not more than 50% of the required floor area of a room or space shall be permitted to have a sloped ceiling less than 7 feet 6 inches in height with no portion of the required floor area less than 5 fee (1524 mm) in height. Section 8. That Section R309.2 be amended to read as follows: That § 150.002(D) of the Dublin Codified Ordinances be added to modify the Ohio Residential Code, to include Section R309.2 which shall be amended as follows: The garage shall be completely separated from the residence and its attic area by means of five-eighths inch gypsum "fire-rated" board or equivalent applied to the garage side. Section 9. That Section 310.4 be amended by adding the following sentence: Fall protection consisting of bars, grills, protective covers or screens are required for any window well or stairwell where there is a differential from grade to the bottom of the well that is greater than 30 inches. Such protection shall not be required where guardrails or landscape elements preclude close approach to the open well. Section 10 That Section R311.5.3 shall be amended to require a maximum riser height of 7 3/a" and a minimum tread depth of 10". Section 11. That a new Section 324 CARBON MONOXIDE DETECTION be added as follows: SECTION 324 CARBON MONOXIDE DETECTION 325.1 Requirement. Carbon Monoxide detectors shall be installed in all new one, two and three family dwellings that are heated by one or more central fossil fuel powered heating units as hereinafter provided. Said carbon monoxide detectors shall be capable of detecting the presence of 100 ppm of carbon monoxide in ambient air and providing a suitable audible alarm; further they shall be installed in the manner provided in the manufacturers specifications and shall comply with applicable federal and state regulations, and shall bear the label of a nationally recognized standard testing laboratory, and shall meet the standard of UL 2034. 325.2 Installation. The carbon monoxide detectors shall be installed in accordance with the manufacturer's instructions and in the location outside each separate sleeping area in the immediate vicinity of the bedrooms. 325.3 Power Source. Carbon monoxide detectors or alternative systems directly connected (permanently wired) shall be permanent and without a disconnecting switch other than those required for over current protection. Carbon monoxide detectors may be battery operated when installed in existing structures. RECORD OF ORDINANCES Blank. Inc. Ordinance No. 85-04 Passed Pag20 Section 12. That Section R1001.6.1 be amended to read as follows: R10016.1 Spark arrestors. Aspark-arresting screen and rain cap shall be installed on all masonry chimneys. The spark arrestor shall meet all of the following requirements: (Requirements 1 thru 4 remain unchanged as printed in the Code) Section 13. That this Code be modified by adding the provisions of Technical Bulletin 10- 01 as published by the Federal Emergency Management Agency, dated May 2001. The provisions of this bulletin shall apply to a structure built in areas removed from SFHA by filling and for which a valid FEMA map revision has been issued. The designated Flood Plain Administrator for the City of Dublin shall enforce the provisions of this bulletin. Section 14. This Ordinance shall take effect and be in force in accordance with Section 4.04 of the Dublin City Charter. Passed this day of o 0 C 1 /TYl Pll ~~~~~~.
