HomeMy WebLinkAbout12-04 Ordinance RECORD OF ORDINANCES Dayton Legal Blank, [nc, Form No. 30043 Ordinance No. 12-04 Amended Passed . 20 AN ORDINANCE AMENDING SECTIONS 93.03(20) (PRIVATE HYDRANTS), 93.80 (PRIVATE HYDRANTS), 150.193 (HYDRANT PERMITS) AND APPENDIX A OF CHAPTER 35, FEE AND SERVICE CHARGE REVENUE/COST COMPARISON SYSTEM OF THE CODIFIED ORDINANCES OF THE CITY OF DUBLIN WHEREAS, the City of Dublin, Ohio (the "City") is vitally concerned with preservation of the public peace, health, safety and welfare of its citizens, and; WHEREAS, fire hydrants, both public and private, are vital to the safety, health and welfare of Dublin residents; and WHEREAS, Dublin City Council desires to ensure the safety and security of the water distribution system by requiring certain hydrant maintenance standards and use requirements be upheld; and WHEREAS, Dublin City Council desires to clarify code sections to ensure they are mutually supportive and consistent in the protection of life and property; and WHEREAS, City Council has adopted Ordinance 126-03 on December 15, 2003 which established its policy as to the recovery of costs and, more particularly, the percentage of full costs to be recovered from users of the City services and established a schedule of fees and charges for City services which complied with the policy set forth in that Ordinance; and WHEREAS, the Department of Service has completed a review of private fire hydrants and hydrant permit signs as detailed in a memo dated February 10, 2004 and has recommended a modification to the current procedures for permitting hydrants causing deposits for equipment to be necessary; NOW, THEREFORE, IT BE ORDAINED by the Council of the City of Dublin, State of Ohio ~ of the elected members concurring that: Section 1. §93.03 (20) of the Code of Ordinances be amended as follows: (20) Section 508.5.3: Delete existing text and substitute: Section 508.5.3 Private fire service mains and water tanks. Private fire service mains and water tanks shall be periodically inspected, tested and maintained in accordance with NFPA 25 and the following requirements: (a) Private fire hydrants of all types shall be inspected annually and after each operation. Inspection shall include a flow test and maintenance checks. 1. Private fire hydrants shall be flushed at least once between April 1 and October 31 of each year, and private fire hydrants maybe pumped dry at this time or not later than October 31 of each year. 2. An appropriate backflow prevention device shall be required to be used during all uses of a hydrant except firefighting. The city shall make available a backflow prevention device, when requested. A refundable deposit shall be required for use of such backflow prevention device. 3. A permit shall be obtained for any use other than firefighting or annual flushing and pumping in accordance with §150.193. RECORD OF ORDINANCES Dayton Legal Blank, Inc. The fee for this permit shall be as set forth from time to time by ordinance establishing the city's schedule of fees and service charge. 5. Private fire hydrants shall be checked every three weeks of each year during the period between November 1 and March 31. 6. Any private hydrant determined to be "out of service" shall be "bagged" to notify the fire department that the hydrant is not functioning. The private hydrant owner or designated representative shall notify the Washington Township Fire Department whenever a private hydrant is "out of service." 8. All private fire hydrants on private lines shall be painted white with green tops and caps. 9. All private fire hydrants shall be visible, accessible to Fire Department apparatus and kept in working condition at all times. 10. A maintenance record shall be kept for each private hydrant. Such records s hall b e m ade a ccessible t o Fire Department personnel upon request. At minimum, records shall include: a. Dates of flushing and pumping b. Inspection reports including dates of inspection, name of inspector, and inspection findings c. Repair records including dates work performed, replacement/repair ofparts, fixtures, and painting 11. Private hydrant owners shall submit proof of hydrant maintenance annually to the Washington Township Fire Department. Such proof shall be provided no later than November 1 and shall include all maintenance performed in the preceding twelve (12) months. (b) Fire service main piping shall be flow tested every five years. (c) Fire service main piping strainers shall be verified free of defects or obstructions after each use. Section 2. §93.80 of the Code of Ordinances be amended as follows: (A) For the purpose of this section, private fire hydrants shall be defined as a hydrant connected into a private waterline. (B) For the purposes of public safety, health and welfare, it is the private hydrant owner's responsibility to ensure hydrants are visible, accessible, and in working condition at all times. (C) For purposes of the public safety, health and welfare, the City Manager is authorized to implement the necessary administrative regulations to ensure the efficient administration of this section. The following rules and regulations shall apply for proper private hydrant maintenance within the city at a minimum: (1) Private fire hydrants shall be flushed at least once between April 1 and October 31 of each year, and private fire hydrants maybe pumped dry at this time or not later than October 31 of each year. Ord. 84-02, passed 6-17- 02) Penalty, see ~ 93.99 Section 3. § 150.193 of the Code of Ordinances be amended as follows: (A) A permit shall be obtained from the city to use a fire hydrant for any purpose other than firefighting or flushing and pumping for maintenance purposes. (B) The fee for this permit shall be as set forth from time to time by ordinance for each day of usage in winter months (November 1 through March 31) and for up to 30 days usage during non-winter months, which is in addition to the cost of the water used. (C) A hydrant permit sign shall be obtained from the city and prominently displayed on the permitted hydrant during use. (D) A refundable deposit shall be collected at the time of issuance of the hydrant permit sign. Deposits shall be forfeited for failure to return the sign within five (5) days of permit expiration or for returning the sign in usable condition. (E) An appropriate backflow device shall be used any time a hydrant is used for other than firefighting purposes. (F) Under this permit, the person to whom the permit is issued shall be responsible for all damages caused by the use or freezing of the hydrants. The user shall call the City Division of Streets & Utilities for inspection of the hydrants after each use. (G) There shall be a fee, as set forth from time to time by ordinance, imposed if the City is required to pump the hydrant after use by the contractor or if the final inspection by the Division of Streets & Utilities reveals that the hydrant has not been properly pumped. (H) The City Manager may designate a specific hydrant(s) to be used during winter months. (I) A valid permit shall bear signatures of the City Manager, or his designee, and the Washington Township Fire Department Chief, or his designee. RECORD OF ORDINANCES Dayron Legal Blank, Inc. Chapter 35, FEE AND SERVICE CHARGE REVENUE/COST COMPARISON SYSTEM AND FEES, Appendix A - SECHEDULE OF FEES AND SERVICE CHARGES, of the Codified Ordinances be amended to read as follows: Percentage of Full Costs to Regulation, Product or Service Be Recovered Fee 5-145 Fire Hydrant Permit 100% $50 (fee to be doubled if City (public or private) is required to pump hydrant) Plus refundable deposits: $350 -hydrant wrench and backflow prevention device $50 - hydrant permit sign Section 5. McDaniel, Deputy City Manager/Director of Service INITIATED BY: Sara Ott, Accreditation/Training Coordinator RE: Amendment to Proposed Ordinance #12-04 to Include Related Fee Schedule Additions Introduction As advised in earlier communication to City Council, it is necessary to revise the City's schedule of fees and service charges to accommodate proposed changes in the City's hydrant programs. Specifically, it is necessary to establish a fee for private hydrant permits and add deposits on city-owned hydrant equipment. Discussion Currently the City requires a $50.00 public hydrant permit fee. This fee is estimated to recover 100% of the cost associated with issuing permits and tracking permittee use. A similar $50.00 fee is recommended to recover 100% of the cost associated issuing private hydrant permits and tracking permittee use. The proposed hydrant code changes also require permittees to display a hydrant permit sign to increase security of the water distribution system. These signs can be manufactured by the City sign shop at an estimated cost of $50.00 for labor and materials. Staff recommends establishing a $50.00 refundable deposit on each permit sign to encourage permittees to return the signs timely and in good condition. Finally, the hydrant code makes backflow prevention devices available for public use to ensure the safety of the water distribution system. Staff also recommends including a hydrant wrench with backflow prevention devices to minimize damage to hydrants when being opened and closed. Staff recommends establishing a $350.00 refundable deposit on a backflow prevention device and hydrant wrench. This deposit is the same amount as City of Columbus Division of Water requirements. Recommendation: Staff recommends approval of amended ordinance #12-04 to establish a $50.00 fee for private hydrant permits, $50.00 refundable deposit for hydrant permit signs, and $350.00 refundable deposit for hydrant backflow prevention devices and hydrant wrenches. These fees and deposits are in addition to code changes initially proposed during first reading of this ordinance at the February 17th Council meeting.
