AN ORDINANCE AUTHORIZING THE PURCHASE OF A 0.597
ACRE, MORE OR LESS, PERMANENT BIKEPATH EASEMENT
AND A 0.006 ACRE, MORE OR LESS, TEMPORARY
CONSTRUCTION EASEMENT, FROM AMERICAN ITALIAN
GOLF ASSOCIATION, LOCATED EAST OF AVERY ROAD,
CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO.
WHEREAS, the City of Dublin is preparing to construct a bikepath along Avery Road;
and
WHEREAS, said improvement will require the City of Dublin to obtain a permanent
bikepath easement and temporary construction easement in and to the premises
described in the attached Exhibits "A" and "B" located in the City of Dublin, Franklin
County, Ohio,
NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin, State
of Ohio, ~ of the elected members concurring that:
Section 1. The City Manager is hereby authorized to obtain a permanent bikepath
easement and temporary construction easement in and to the premises described in the
attached Exhibits "A" and "B" located in the City of Dublin, Franklin County, Ohio.
Section 2. There has been appropriated from the Capital Improvements Tax Fund
Twenty Five Thousand Dollars ($25,000.00) to account 401-0314-780-2510, for the
purpose of acquiring the 0.597 acre, more or less, permanent bikepath easement and 0.006
acre, more or less, temporary construction easement, and paying any related acquisition
costs.
Section 3. This Ordinance shall take effect and be in force from and after the earliest
date permitted by law.

SITUATED IN THE STATE OF OHIO, COUNTY OF FRANKLIN AND DELAWARE, TOWNSHIP OF
WASHINGTON, CITY OF DUBLIN, BEING A 0.450 ACRE PERMANENT EASEMENT OUT OF THE
FIRST, SECOND, THIRD, AND FOURTH PARCEL OF LAND AS CONVEYED TO AMERICAN ITALIAN
GOLF ASSOCIATION, AN OHIO CORPORATION OF RECORD IN DEED BOOK 2600, PAGE 393 AND
BEING MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS:
BEGINNING FOR REFERENCE, AT A POINT IN THE SOUTHEASTERLY CORNER OF SAID FOURTH
PARCEL AND THE CENTERLINE OF SAID AVERY ROAD.
THENCE, SOUTH 74°40'00" WEST, 30.00' FEET WITH THE SOUTHERLY LINE OF SAID FOURTH
PARCEL TO A POINT IN THE WESTERLY RIGHT-OF-WAY LINE OF SAID AVERY ROAD AND TO THE
