AN ORDINANCE TO ESTABLISH DUBLIN ZONING FOR THREE
PARCELS COMPRISING AN AREA OF APPROXIMATELY 28.4 ACRES,
AS ANNEXED FROM WASHINGTON TOWNSHIP IN 2001, ON THE WEST
AND EAST SIDES OF COSGRAY ROAD, APPROXIMATELY 975 FEET
NORTH OF RINGS ROAD, AS R, RURAL DISTRICT (CASE N0.02-070Z).
WHEREAS, under former Dublin Code Section 153.004(D), territory annexed to the City of
Dublin continues to be governed by the zoning regulations which governed the territory annexed
immediately prior to the annexation, as enacted by a Board of County Commissioners under R.C.
303.01 to 303.25, or enacted by a Board of Township Trustees under R.C. 519.02 to
519.25, as the case maybe;
WHEREAS, this section of the Dublin Code was amended on April 8, 2002 by Ordinance 52-02,
which provides the automatic rezoning of newly annexed Township property to the R, Rural
District;
WHEREAS, land included in this rezoning was annexed to the City and effectively became part
of the corporate boundary on October 4, 2001;
WHEREAS, consequently this land was not automatically rezoned to the R, Rural District as
Ordinance 52-02 was not yet effective;
WHEREAS, the land included in this rezoning must be rezoned to change the current Township ~
zoning classification to a Dublin zoning classification;
WHEREAS, to remain consistent with Ordinance 52-02, this land should be rezoned from its
previous Township zoning classification to the Dublin R, Rural District;
WHEREAS, this ordinance and application have been reviewed by the Law Director; and
WHEREAS, this rezoning will ensure consistent administration and equal enforcement of City
Codes to protect the health, safety and welfare of its citizens.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 7
of the elected members concurring:
Section 1. That the following described real estate (see attached marked Exhibit "A" and map
marked "E 1 situated in the City of Dublin, State of Ohio, is hereby rezoned R, Rural District,
and shall be subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter
153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto.
Section 2. That application, Exhibit "B", including the list of contiguous and affected property
owners, and the recommendations of the Planning and Zoning Commission, Exhibit "C", are all
incorporated into and made an official part of this Ordinance and said real estate shall be
developed and used in accordance therewith.
Section 3. That this Ordinance shall take effect and be in force from and after the earliest period ail
allowed by law.

Rezoning Ordinance 108-02 (Case No. 02-0702 -Rezoning of Land Under
Ordinance 99-O1)
SUMMARY:
On June 5, 2003, the Planning Commission approved this rezoning application without
conditions. The site is comprised of three parcels, covering a total area of 28.4 acres. The
parcels along the west side of Cosgray Road comprise the majority of the subject site and are
associated with the McCoy and Jude Tree Service. On the east side of Cosgray Road is the
remainder of the site and it consists of a very small right-of--way stretch and railroad land. On
May 21, 2003, staff held an informational meeting for the property owners listed in this
rezoning application. No residents or property owners attended this meeting. Staff is unaware
of any opposition to this proposal.
The first major area rezoning of this type was undertaken in 2001, and it covered the Northeast
Quadrant of Dublin. Although this systematic rezoning method has proven to be a very time-
d intensive undertaking, progress is being made. The goal is to have this project completed by the
end of the year.
RECOMMENDATION:
The application is being forwarded with a recommendation for approval of this area rezoning to
the R, Rural District.

sponsored rezoning to establish Dublin zoning. This application will set forth the

BACKGROUND:
On the advice of Dublin's Law Director, staff is conducting a systematic establishment of
Dublin zoning on all parcels annexed into Dublin. The Planning Division is responsible
for compiling and processing these "area rezoning" applications. The first major azea
rezoning was undertaken in 2001, and it covered the Northeast Quadrant of Dublin. City
Council has introduced additional rezonings since last yeaz.
The subject site became an effective annexation azea in October 2001 and has not been
rezoned since that time. Ordinance #108-02 was introduced at the July 22, 2002 Council
meeting to change the site's R-SRR, Semi-Rural Residential, R-SR, Suburban Residential
District and NC, Neighborhood Commercial Township zoning to the Dublin Rural
District zoning.
After the Planning Commission makes its recommendation, the case will be forwazded to
City Council for a public hearing and fmal vote. With a positive recommendation from
the Commission, a simple majority vote is required for passage. A negative Commission
recommendation requires five votes for passage. If the ordinance is approved, it will take
effect in 30 days.
CONSIDERATIONS:
Site Characteristics:
• The subject area is comprised of three parcels, covering a total area of 28.4 acres.
The pazcels along the west side of Cosgray Road comprise the majority of the
subject site. These parcels, which are adjacent to the railroad and front onto
Cosgray Road, aze 18 acres (northern parcel) and eight acres (southern parcel).
On the east side of Cosgray Road is the remainder of the site and consists of a
very small right-of--way stretch and railroad land.

• The front pazt of the 18-acre parcel (approximately 2.69 acres) is zoned for NC,
neighborhood commercial uses associated with the McCoy and Jude Tree Service.
The reaz portion of this same parcel, which is vacant, cazries the Washington
Township zoning of R-SRR, Semi- Rural Residential District. The southern eight
acre parcel, also vacant, is zoned R-SRR. The portion of the site on the east side
of Cosgray Road along the railroad is zoned R-SR, Suburban Residential District.
This rezoning proposes to establish the Dublin R, Rural District for all properties.
All legally nonconforming uses will be subject to the requirements of Section
153.004 (C).
• The area used for the McCoy and Jude Tree Service is currently occupied with an
asphalt pazking area, a 720 squaze foot building with brown wood siding, some
dilapidated greenhouse structures and a number of abandoned and "for sale"
vehicles. It is cleaz portions of this area have been used as a construction
dumping grounds for some time.
• To the north, south, and west of the area is farmland land outside the City. To the
east is the southwest portion of the Ballantrae Golf Development zoned PLR,
Planned Low Density Residential and additional land still within Washington
Township.
• The Table attached compares perntted uses, conditional uses, and basic
development standards of the current township R-SRR and the proposed Dublin
R, Rural zoning. Comparisons for the R-SR, or NC category were not included
in the Table. For reference, the development standards for these township
categories have been included as part of the staff report attachments. The most
typical permitted uses occurring in the R-SRR or R zoning includes: agriculture,
low density residential which refers to farm residential housing units, and isolated
residential development. Conditional uses are listed in the attached Table.
• A letter was mailed to the affected property owners listed in this application. It is
attached, and it outlines the circumstances, procedures, and proposed zoning, as
well as dates for public meetings. Staff held an informational meeting on May 21,
2003, for the property owners listed in this rezoning application. No residents or
property owners attended this meeting.
Community Plan, Land Use and Zoning Issues:
• On August 12, 2002, City Council amended the Future Land Use map (Map 8) of
the Community Plan. Portions of this site aze listed on the Community Plan as
"Residential -Medium Density (1-2 dwelling units per acre)." The northern
parcel is designated as "Non-Residential". Implementation of this rezoning will
ensure conformity with all adopted Dublin standards, protecting the health, safety,
and welfare of the residents.
• This rezoning is primarily a housekeeping issue. And will not have an immediate
impact on the majority of the surrounding residents and property owners. Legally
non-conforming uses cannot be expanded, and they cannot be re-established after
being discontinued for a period of two years.
• Even without Dublin zoning, most of Dublin's development standards would
apply. A 1976 ordinance requires adherence to Dublin standards, wherever they

are stricter, following annexation. However, the failure to establish Dublin
zoning on the property makes administration and enforcement difficult for staff,
and difficult and confusing for landowners.
Development Standards:
The Table illustrates the zoning comparisons for the proposed Dublin R, Rural District
listed in and the Washington Township R-SRR, Semi-Rural Residential District.
Generally, more permitted and conditional uses are listed in the Dublin Rural District.
Restrictions listed for minimum lot sizes and widths, and minimum yard dimensions are
more restrictive in the Washington Township regulations.

Utilities:
• New development on any of these parcels must comply with adopted stormwater
management regulations for the City of Dublin.
• Currently, no municipal water and sanitary services reach these properties. Wells
or on-site septic tanks currently serve them and this rezoning action will not affect
utility services in place or any planned for the affected area. If additional
development takes place on these parcels, utility extensions will be needed.
STAFF RECOMMENDATION
At annexation, these properties were not placed in any Dublin zoning classification. This
application is City sponsored and follows the request from Dublin's Law Director to
systematically establish "Dublin zoning" throughout the municipality. It is advised that
this rezoning will resolve any Code enforcement problems arising from Township
classifications and inconsistencies within the Dublin zoning map. This action provides
proper zoning for an annexation and is primarily a housekeeping effort. Following these
area rezonings, staff will finalize and present an official revision of the Dublin Zoning
map to City Council. Staff recommends approval of this rezoning with the following two
bases.
Bases:
1) This rezoning will provide an appropriate Dublin zoning classification to land
within the City limits to provide for the effective administration of development
standards procedures etc.
2) The rezoning will maintain the established development pattern that has been in
place for many years and establishes land uses consistent with those listed in the
Community Plan.

protect the health, safety, and welfare of its citizens.
According to Township records, this property is currently zoned R-SR, Limited Suburban
Residential District (Washington Township). It is proposed that the classification be changed to
the Dublin R, Rural District. The impacts of this rezoning will vary from property to property,
and will depend upon the current uses of the property. For most properties the impact will be
minimal. The basic R, Rural regulations are attached for your reference.
Ordinance #108-02 initiating this zoning change was introduced at the July 22, 2002 Dublin City
Council meeting. The next step in the process is a public meeting at the Planning and Zoning

(B) Conditional use. The following uses shall be allowed in the Rural District subject to approval
in accordance with § 153.236.
(1) Mobile Home. A mobile home or house trailer for a period not to exceed 18 months.

(a) Private school or college,•with students in residence provided it occupies a lot of not
less than ten acres or more and there is one acre or more per 25 day students, and one acre or more per

(b) Kindergarten or child care as an accessory use of a dwelling or as a principal use of
the lot provided it occupies a lot of not less than one acre and there shall be an outdoor play area of 200
square feet or more per child. Such play area shall be arranged in accordance with the provisions of this
district for accessory uses and shall be enclosed with a chain link fence or its equivalent in strength and

(3) Cemetery. Cemeteries hereafter established, following the adoption of the zoning
ordinance, shall occupy a parcel of not less than 40 acres, excepting those parcels added to an existing
cemetery, which may be less than 40 acres.
(a) Interment shall not be within 100 feet of any property line.
(b) A mausoleum, crematory or other structure shall not be within 300 feet of any property
line.
(4) Associated sales. Associated sales as accessory to and in association with an agricultural
permitted use, such associated sales to cease upon cessation of the agricultural activity. This shall
include, but is not limited to garden supplies with a nursery or greenhouse, milk products with a dairy,
or imported produce with a permitted produce stand.
(5) Boarding and care of animals. Office of veterinarian and animal hospital, kennel or other
facilities for care or boarding of an'unals provided it occupies a lot of not less than five acres and building
pen or other enclosure so used shall not be within 200 feet of any property line.
(6) Commercial grain elevatoroperations. Commercial grain elevator operations, provided that
Planning and Zoning Commission determines adequate lot area is available for such operation.
(7) Wireless communications facilities as conditional uses in all applicable districts.
(C) Development standards. In addition to the provisions of 153.070 through 153.076, the
following standards for arrangement and development of land and buildings are required in the Rural
District.
(1) Lot area and coverage. For agricultural purposes in the determination of accessory and
associated uses, the lot area shall be five acres or more. But this shall not exclude agricultural use of
any smaller lot.
(a) For each dwelling unit there shall be a lot area not less than 40,000 square feet per
dwelling unit.
(b) For each permitted use and conditional use, the lot area shall be adequate to meet the
sanitation requirements of the County Board of Health but shall not be less than that prescribed for such
use.
(c) Only one principal use shall be permitted on a lot, and such lot shall not be covered
more than 20% by structure.
(2) Lot width. For aone-family dwelling there shall be a lot width of 150 feet or more at the
front line of the dwelling, and such lot shall have access to and abut on a public right-of-way for a
distance of 60 feet or more.

302.030 Conditional Use. The following uses shat( be allowed in the SUBURBAN
RESIDENTIAL DISTRICT subject to approval in accordance with SECTION 815, ARTICLE VIII.
302.031 Community-Based Care Facilities. Placement of Community-Based Care Facilities in
accordance with Section 510, Article V and Section 815, Article VIII.
302.040 Development Standards. In addition to the provisions of ARTICLE V, GENERAL
DEVELOPMENT STANDARDS, the following standards for arrangement and development of land and
buildings are required in the SUBURBAN RESIDENTIAL DISTRICT.
302.041 Lot Area and Coverage. For each dwelling unit constructed as a permitted use there
shall be a lot area of not less than two acres.
For each Permitted Use and Conditional Use the lot area shall be adequate to meet the sanitation
requirements of the Franklin County Board of Health and the Ohio EPA, but shall not be less than that
prescribed for such use.
One (1) principal use shall be permitted on a lot or parcel, and such lot or parcel shall not be
covered more than twenty percent (20%) by structures.
302.042 Lot Width. For cone-family dwelling, there. shalt be a lot width of one hundred fifty
(150) feet or more at the front line of the dwelling, and such lot shall have access to and abut on a public
right-of--way for a distance of sixty (60) feet or more.
For Permitted Uses other than one-family dwellings, the frontage of the lot or parcel, which shall
have access to and abut on a public right-of--way, shall be not less than one-third (1/3) of the average
depth of the lot or parcel.
For Conditional Use, the lot width shall be adequate, as determined by the Board of Zoning
Appeals.
302.043 Side Yard. For dwellings or associated accessory buildings, there shall be a total of side
yards of fifty.(50) feet or more with a minimum ten (10) feet on one (1) side, and where a side yard is less
than twenty-five (25) feet, no structure shall be constructed closer to an existing structure on an adjoining
lot or parcel than fifty (50) feet.
For a Conditional Use, except dwellings and accessory buildings thereto, there shall be side yard
on each side of a building of twenty-five (25) feet or more.
302.044 Front and Rear Yards. For main buildings, there shall be a minimum building setback
of seventy-five (75) feet and a minimum rear yard of fifty (50) feet and, to the extent that SECTIONS
504.010 and 504.011 impose a requirement of a front yard greater than imposed by this SECTION,
SECTIONS 504.010 and 504.011 shall control.
302.045 Living Area. For aone-family dwelling structure there shall be not less than eighteen
hundred (1800) square feet of living space, calculated exclusive of garage area, breezeways, unfinished
attic space, and space more than one-half (1/2) below grade.
302.046 Soil Suitability. For main and accessory structures, evidence of suitability of the soil for
such development shall be required, in accordance with the Land Use Plan, including but not limited to
soil composition, drainage and slope.

requirements of the Franklin County Board of Health and the Ohio EPA, but shall not be less than that

For Permitted Uses other than one-family dwellings, the frontage of the lot or parcel, which shall
have access to and abut on a public right-of--way, shall be not less than one-third (1/3) of the average
depth of the lot or parcel.
For Conditional Use, the lot width shall be adequate, as determined by the Board of Zoning

306.043 Side Yard. For dwellings or associated accessory buildings, there shall be a total of side

306.044 Front and Rear Yards. For main buildings, there shall be a minimum building setback
of seventy-five (75) feet and a minimum rear yard of one hundred (100) feet and, to the extent that

306.045 Living Area. For aone-family dwelling structure there shall be not less than eighteen
