AN ORDINANCE TO PETITION THE COUNTY COMMISSIONERS OF UNION COUNTY, OHIO FOR ANNEXATION OF APPROXIMATELY 1.319 ACRES OF LAND, LOCATED ON AND NEAR POST ROAD JUST EAST OF LIGGETT ROAD, TO THE CITY OF DUBLIN, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin has a strong interest in controlling and maintaining the right- of-way on its borders. The Post Road roadway and some of the surrounding land, as described in the attached Exhibit "A" and depicted in the attached Exhibit "B," currently is on the border of the City, but is not within the corporate limits; and WHEREAS, the City of Dublin has an interest in annexing land that is adjacent and contiguous to the City and that is owned by the City; and WHEREAS, the land that is proposed to be annexed is adjacent and contiguous to the City of Dublin and is owned by the City of Dublin; and WHEREAS, it is necessary to annex the subject property to the City of Dublin for the purposes of maintaining the roadway and providing emergency services to the roadway; and WHEREAS, the municipal annexation procedure must be initiated by petition to the Union County Board of Commissioners pursuant to Ohio Revised Code Sections 709.14 through 709.16; and NOW, T EREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring: Section 1. Council considers it necessary to annex the subject property to the City of Dublin for the purposes of maintaining the roadway and providing emergency services to the roadway. Section 2. The Law Director of the City of Dublin is hereby directed to petition the Union County Commissioners for annexation of 1.319 acres of land located in Jerome Township, Union County, Ohio, in accordance with Ohio Revised Code Sections 709.14 through 709.16, and to serve as the City of Dublin's agent in this annexation proceeding. Section 3. The City Manager of the City of Dublin is hereby directed to sign the petition. Section 4. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The reason for such necessity is that the prompt annexation of this portion of Post Road and surrounding area is necessary to allow local maintenance and control over this portion of roadway, as well as uniform emergency response services. Therefore, this ordinance shall go into immediate effect. SMITH, CITY OF DUBLIN LAW DIRECTOR, SCHOTTENSTEIN, ZOX & DUNN, AGENT OF THE PETITIONERS A motion was made by Don Fraser and seconded by Jim Mitchell to approve the following resolution: Whereas, the Board of County Commissioners of Union County, Ohio proceeded in open hearing on the 13~' day of May, 2002 to consider the petition of the City of Dublin, filed on April 17, 2002 pursuant to Ohio Revised Code, Section 709.16 (B) and having considered all the facts with reference thereto, being fully advised, and Whereas, the Commissioners make the following fmdings based upon the petition, description and plat, the latter having been amended to address the concerns cited in the May 8, 2002 recommendation from Steve A. Stolte, Union County Engineer: 1. The petition contains all the matters required by Ohio Revised Code a. A full description and accurate map or plat of the territory to be annexed; b. The map or plat and the description of the territory contained in the petition are accurate. 4. Ohio Revised Code, Section 709.16 (B) requires the Board to approve said annexation. The agent's authority includes, but is not limited to, the authority to make any amendment and/or deletion in order to correct any discrepancy or mistake noted by the Union County Engineer in his/her examination of this Petition, description and plat. An amendment for that purpose shall be made by presentation of an amended plat and description to the Board of County Commissioners on, before, or after the date set for hearing of this Petition. Dublin City Council enacted Ordinance No. 49-02 on April 8, 2002 authorizing the Law Director to file this Petition to annex the territory. A certified copy of Ordinance No. 49-02 is attached hereto as Exhibit "C."
