AN ORDINANCE TO ACCEPT
AN ANNEXATION OF 60.4+/- ACRES IN JEROME TOWNSHIP,
UNION COUNTY, TO THE CITY OF DUBLIN
. WHEREAS, on January 14, 2002, the Union County Commissioners approved the
annexation petition filed by Robert E. Albright, 600 South High Street, Columbus,
OH 43215, Agent for H.C. Associates, Jerome Solove, Managing Partner, 141 E.
Town Street, Suite 101, Columbus, OH 43215; and
WHEREAS, this area lies within the negotiated expansion area for water and sewer
services under the existing agreements between the City of Columbus and the City of
Dublin, and on February 11, 2002, the City of Columbus approved Ordinance No.
0142-02, giving their consent to Dublin's annexation of this 60.4+/- acres; and
WHEREAS, Council is of the opinion that this territory should be annexed to the
City of Dublin.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Dublin,
State of Ohio, ~ of the elected members concurring:
Section 1. That the petition for the annexation of 60.4+/- acres (see attached legal
description, Exhibit "A") to the City of Dublin, Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in force from and after the
earliest date allowed by law. _

ACRES, MORE OR LESS, TO THE CITY OF DUBLIN, JEROME TOWNSHIP -
ROBERT E. ALBRIGHT, AGENT FOR THE PETITIONERS
A motion was made by Don Fraser and seconded by Jim Mitchell to approve the
following:
WHEREAS, a petition for annexation was filed on October 22, 2001, naming Robert E.
Albright, Agent for the Petitioners, and praying for annexation to the City of Dublin, Jerome
Township, Union County, Ohio and
WHEREAS, said petition represents real estate situated in Jerome Township, Union
County, Ohio being a total of 60.4 acres, more or less, and being contiguous and adjacent to the
City of Dublin. There are 3 owners of real estate in the territory sought to be annexed to the City
of Dublin, Ohio.
THEREFORE, BE IT RESOLVED, that said petition for annexation be and is hereby
received, and pursuant to Section 709.02 of the Ohio Revised Code, shall be advertised by
publication as required by law and that a public hearing on said petition shall be held in the
Commissioners Hearing Room, County Office Building, 233 West Sixth Street, Marysville, Ohio
on Monday, January 14, 2002 at 1:00 p.m.

Now come the undersigned, petitioners in these premises and being the owners
of a certain area as hereinafter described, consisting of 60.4 acres, more or less, in
Jerome Township, Union County, Ohio, which is contiguous and adjacent to the City of
Dublin, Ohio, according to the statutes of the State of Ohio. Said area is situated in the
Township of Jerome, County of Union and State of Ohio, and an accurate description
of said territory is attached hereto and made a part hereof as Exhibit "A".
A plat of the above-described territory in Jerome Township, Union County, Ohio,
s attached hereto and made a part hereof as Exhibit "B".
The number of owners in the territory sought to be annexed is three (3).
Robert E. Albright, of 600 South High Street, Columbus, OH 43215, is hereby
appointed agent for the undersigned petitioners, as required by Section 709.02, Ohio
Revised Code; and said agent is hereby authorized to make any amendments by way of
additions or deletions which in his absolute and complete discretion are proper under
the circumstances then existing, and in particular to make such deletion(s) or
amendment(s) in order to correct any discrepancy or mistake noted by the Union
County Engineer in his examination of the petition and plat. Said amendment shall be
made by the presentation of an amended plat and description to the Board of County
Commissioners of Union County, Ohio, on, before, or after the date set for hearing on
this petition.

duly filed on October 22, 2001 by Robert E. Albright, 600 South High Street, Columbus,
OH 43215, Agent for Petitioners H.C. Associates and Richard S. Valentin; and
i WHEREAS, a public hearing has been scheduled before the Union County Commissioners
~ on Monday, January 14, 2002 at 1'00 p.m.; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing
of the annexation petition, the Municipal Authority shall adopt a statement indicating what
I services, if any, the Municipal Corporation will provide to the territory proposed for

WHEREAS, the area proposed for annexation lies within the negotiated expansion area
'i for Dublin's water and sewer service extension area, as provided under the agreements

i WHEREAS, the City of Dublin has petitioned the City of Columbus to remove this from
I the negotiated expansion area and to allow Dublin to provide water and sewer services to
this area upon annexation; and
WHEREAS, the proposed annexation is in conformance with the annexation strategy
contained in the Dublin Community Plan, adopted by Council on November 17, 1997.
' NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State

60.4+/- acres in Jerome Township, Union County upon the annexation of the area to the

Police. The City provides Police and Communications service on a full twenty-
° four hour basis and also has mutual aid agreements with other jurisdictions. The
annexation area lies approximately 2.5 miles northwest of Dublin Police Division
a ~ headquarters. Dublin operates with a minimum of four cruisers on duty. A
response time of approximately 3 minutes for an emergency situation should be
a
expected for this area.

~ Fire. Fire and emergency medical services protection is currently provided by
U ° o well-staffed departments in Jerome and Washington townships. They, too, have

o. ~ mutual aid agreements with other jurisdictions. This annexation would not change
' o p ? fire department jurisdictional boundaries, and therefore response times for fire and
- emergency medical services will not be affected. The Jerome Township Fire
~ Station is located approximately 2.5 miles from the annexation area, and normal
- v .v response time would be approximately 3 minutes. However, due to an existing
v ~ automatic response agreement, the area is also served by the Washington Township
' !p = Fire Station 93 which is located approximately 1.5 miles to the east, and normal
response time would be approximately 2 minutes.

provides excellent service in the area of street and road maintenance.
Section 2. The City has SEWER and WATER service area contracts with the City
of Columbus, and the subject property is within the negotiated expansion area.
Conditioned on the City of Columbus agreeing to remove this property from the
negotiated expansion area to allow the City of Dublin to serve it, and the ability of
the City of Columbus to provide WATER and sufficient SEWERAGE disposal

receipt of the notice of publication of an annexation, the municipal
authority is required to pass, either by ordinance or resolution, a statement
indicating what services, if any, the municipal authority will provide to the
area to be annexed upon annexation. That resolution or ordinance must be
passed prior to January 14, 2002, the date of the hearing before the Board
of County Commissioners of Union County, Ohio, on the above-captioned

PUBLIC HEARING -PETITION FOR ANNEXATION TO THE CITY OF DUBLIN,
JEROME TOWNSHIP, OF 60.4 ACRES, MORE OR LESS -ROBERT E. ALBRIGHT,
AGENT FOR THE PETITIONERS
A public hearing was held at 1:00 p.m. in the office of the Union County Commissioners
for the purpose of considering a Petition for Annexation of 60.4 acres, more or less, to the City of
Dublin, Jerome Township, Union County, Ohio.
In attendance at the hearing were the 3 county commissioners; commissioners clerk,
Rebecca Roush; Mr. Robert Albright, Agent for the Petitioners; Cindy Brake, Journal Tribune;
and Tammy Howard, Court Reporter.
Commissioner Fraser chaired the hearing. Mr. Albright presented all the particulars
regarding the Petition. The hearing was adjourned at 1:19 p.m.
Commissioner Fraser made the motion that all the requirements have been met with no
disputes and to approve the annexation. Commissioner Mitchell seconded the motion.

RESOLUTION N0.25-02 RE: PETITION FOR ANNEXATION TO THE CITY OF
DUBLIN, JEROME TOWNSHIP, UNION COUNTY, OHIO - 60.4 ACRES, MORE OR
LESS -ROBERT ALBRIGHT, AGENT
A motion was made by Don Fraser and seconded by Jim Mitchell to approve the
following resolution:
DECISION
The present annexation proceeding before us today was brought about by the application
of the owners of real estate adjacent to a municipal corporation. As such, it is governed by the
procedures set forth in Ohio Revised Code Sections 709.02 - .12. This kind of annexation is
initiated by the filing of a petition with the board of county commissioners of the county in which
the territory is located. The petition must be signed by a majority of landowners in the territory
adjacent to the municipal corporation. In addition the petition must contain a full legal
description and accurate map or plat of the territory to be annexed, a statement of the number of
real estate owners in the territory, and the name of the person or persons acting as agent for the
petitioners. The board of county commissioners conducts a public hearing on the petition,
accepting evidence and hearing testimony in support of and against the proposed annexation.
The statute mandates that the board of county commissioners shall enter an order upon its
journal allowing the annexation if it finds that: (1) the petition contains all matter required in
section 709.02 of the Revised Code; (2) notice has been published as required by section 709.031
of the Revised Code; (3) the persons whose names are subscribed to the petition are owners of
real estate located in the territory in the petition, and as of the time the petition was filed with the
board of county commissioners the number of valid signatures on the petition constituted a
majority of the owners of real estate in the territory proposed to be annexed; (4) the municipal
corporation to which the territory is proposed to be annexed has compiled with division (B) of
section 709.031 of the Revised Code; (5) the territory included in the annexation petition is not
unreasonably large; (6) the map or plat is accurate; and (7) the general good of the territory
sought to be annexed will be served if the annexation petition is granted. The legislative
authority of the municipal corporation (city council) then must accept the application for
annexation by resolution or ordinance. The annexation takes effect and the territory becomes part
of the municipality 30 days after passage of the resolution or ordinance.

Findings of Fact
There is no question and there was no dispute that the evidence established by a
preponderance that:
(1) The petition contains all matter required in section 709.02 of the Revised Code.
(2) Notice was published as required by section 709.031 of the Revised Code.
(3) The persons whose names are subscribed to the petition were, at the time of the filing
of the petition, the owners of real estate located in the territory in the petition, and as
of the time the petition was filed with the Board of County Commissioners, the
number of valid signatures on the petition constituted all of the owners of real estate
in the territory proposed to be annexed.
(4) 'The municipal corporation to which the territory is proposed to be annexed (City of
Dublin) has complied with division (B) of section 709.031 of the Revised Code; and
(5) The map or plat is accurate;
(6) The territory included in the annexation petition is not unreasonably large;
(7) The general good of the territory sought to be annexed will be served if the
annexation petition is granted.
Having concluded that there is a preponderance of reliable, probative and substantial
evidence to support the seven criteria, which must be found in order to grant an annexation
petition, we cast our vote for the annexation.

Park Commissioners: schools, and limited commercial operations on the subject property and have met with
Mr. Solove, his consulting landscape architect Brian Kinzelman, and a prospective client
Kenneth F. Danter pastor Doug Warburton. Based on our review of the current concept plan and the
Robert H. Jeffrey productiveness of our recent conversation with Mr. Solove regarding mutual interests and
Ellen L. Tripp concerns, Metro Parks is quite optimistic that this development will compliment our
activities in Jerome Township.

WTgEREAS, I:he Director of Public Utilities, entered into a Sewer Service Agreement with
the City of Dublin, on behalf of the City of Columbus, pursuant to the authorization granted
by Ordinance No. 2692-92, as passed by Columbus City Council oti December 14, 1992, for
thu discharge, transportation, pumping and treatment of sewage, industrial wastes, water or
other liquid wastes from the City of Dublin to and by the City of Columbus utilizing the
Sewerage System and Sewage Treatment Works of the City of Columbus; and
WHEREAS, khe Director of Public C~tilities, entered into a Water Service Agreement
with the City of Dublin, on behalf of the City of Columbus, pursuant to the authorization
granted by Ordinance No, X693-92, as passed by Columbus City Coutteil on December 14,
1992, for purposes of furnishing surplus water to the City of Dublin, Ohio and the inhabitants
thereof, from the municipal water system of the City of Colu~nbtts; and
WHEREAS, each of thc~-~forementioned contracts established a negotiated expansion
area within the defned service area, and further requires both parties to mutually consent to
either Party's annexation of property within the Negotiated Expansion Area; and
VIrHEREAS, the City of Dublin, has been notified that an attncxation petition has been
filed to annex approximately 60.4 acres of land located at the southwest corner of the
intersection ofMitchell-Dewitt Road and Hyland Croy Road, into the City of Dublin; and
WHEREAS, engineering personnel from ille Divisions of Sewerage and Drainage and
Water have concluded that Oily of Dublin can best provide both water and sanitary sewer
service to this approximate 60.4 acres of land, sand as such concurs with the City of Dublin's
request to annex this properly; and
WHEREAS, pursuant to the provisions of the Water and Sewer Services Agreeme~~ts
between. the City of Columbus and the City of Dublin, Ohio it is necessary for t}115 Council to
authorize the Director of Public Utilities i0 convey its consent to allow the City of Dublin to
annex the aforementioned property; now, therefore,
BE I"!' ORDA.TNED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be, and hereby is, authorized to convey to
the City of Columbus's consent to allow the City of Dublin, Ohio to annex approximately
60.4 acres of hind, identified as Pazcel No. 17-QO-28014.000 of Union County, Ohio, that is
located within the Negotiated Expansion Area of the Water and Sanitary Sewer Service
Agreements between Columbus and Dublin, Ohio.
Section 2. That this ordinance shall take effect and be in force from and after the earliest
period allowed by law.
