AN ORDINANCE AUTHORIZING THE EXCHANGE OF LAND
WITH THE BOARD OF EDUCATION OF THE DUBLIN CITY
SCHOOL DISTRICT FOR THE PRESERVATION OF THE
INDIAN RUN SCENIC CLIFFS AND OTHER UNIQUE
NATURAL FEATURES.
WHEREAS, a goal of Dublin City Council is to continue to preserve the natural beauty
of the City; and
WHEREAS, the City of Dublin ("City") and The Board of Education of the Dublin City
School District ("Board") desire to exchange certain tracts of real property for the
preservation of the Indian Run scenic cliffs and other unique natural features; and
WHEREAS, the City owns an approximate 0.016 acre tract of unimproved real
property situated in Franklin County, Ohio (the "City Swap Tract"), which City Swap
Tract comprises a portion of a larger tract of real property commonly known as Tax
Parcel No. 273-5258 (the "City Property"), and is legally described on Exhibit "A"
attached hereto and incorporated by this reference herein. For a graphical depiction of
the City Swap Tract, see Exhibit "B" attached hereto.
WHEREAS, the Board owns an approximate 0.550 acre tract of unimproved real
property situated in Franklin County, Ohio (the "Board Swap Tract"), which Board
Swap Tract comprises a portion of a larger tract of real property commonly known as
Tax Parcel No. 273-1, and is legally described on Exhibit "C" attached hereto and
incorporated by this reference herein. For a graphical depiction of the Board Swap Tract,
see Exhibit "D" attached hereto.
WHEREAS, the Board further owns an approximate 3.951 acre tract, 11.339 acre tract
and a 4.353 acre tract of real property situated in Franklin County, Ohio, which tracts
are commonly known as Tax Parcel Nos. 273-115, 273-279 and 273-11, respectively,
and are collectively referred to herein as the "Board Property." For a general graphical
depiction of the Board Property, City Swap Tract and Board Swap Tract, see Exhibit
"E" attached hereto.
WHEREAS, a portion of the Board Property is located adjacent to Indian Run and
contains a number of scenic cliffs and other unique natural features. The Board desire
to preserve such portion of the Board Property, but does not desire to incur the costs in
connection with maintaining the property in its natural state.
WHEREAS, the City currently maintains the Board Swap Tract as if it were owned by
the City and the Board has constructed a fence over a portion of the City Property which
effectively separates the City Swap Tract from the City Property.
WHEREAS, the City has agreed to convey to the Board, the City Swap Tract, and the
Board has agreed to convey to the City, the Board Swap Tract and a scenic easement
over a portion of the Board Property.
WHEREAS, the City and the Board will execute the necessary conveyance documents
to complete the above real estate transfer; and
WHEREAS, the City and the Board agree that no money shall exchange hands for the
exchange of land described above; and
NOW, THEREFORE, BE IT RESOLVED by Council of the City of Dublin, State of
Ohio, ~ of the members concurring that:

Section 1. The City Manager is hereby authorized to execute the conveyance
documents necessary to complete the exchange of land with The Board of Education of
the Dublin City School District for the preservation of the Indian Run scenic cliffs and
other unique natural features .
Section 2. The land being relinquished by the City is not needed for a public purpose.
Section 3. Pursuant to Charter Section 8.04(c), the City waives any competitive
bidding required by O.R. Chapter 721, since it is not in the best interest of the City.
Section 4. This Ordinance shall take effect and be in force from and after the earliest
date permitted by law.
