AN ORDINANCE TO ACCEPT
AN ANNEXATION OF 5.9+/- ACRES IN WASHINGTON TOWNSHIP,
FRANKLIN COUNTY, TO THE CITY OF DUBLIN
WHEREAS, on December 5, 2001, the Franklin County Commissioners approved
the annexation petition filed by Michael S. Yashko, Esq., c/o Roetzel & Andress,
155 E. Broad Street, 12th Floor, Columbus, OH 43215, agent for Petitioner Stanley
W. Woodruff, 2309 King Richard Drive, Grand Prairie, TX 75050; and
WHEREAS, Council is of the opinion that this territory should be annexed to the
City of Dublin.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Dublin,
State of Ohio, ~ of the elected members concurring:
Section 1. That the petition for the annexation of 5.9+/- acres (see attached legal
description, Exhibit "A") to the City of Dublin, Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in force from and after the
earliest date al>lowed by law.

OF FRANKLIN COUNTY OHIO:
The undersigned, petitioner in the premises, and being a MAJORITY OF OWNERS OF
REAL ESTATE in the territory described, consisting of 5.9 acres, more or less, in the Township
of Washington which area is contiguous and adjacent to the City of Dublin, does hereby pray that
said territory be annexed to the City of Dublin according to the statutes of the State of Ohio.
A full and accurate description and a plat of said territory so prayed to be annexed are
attached hereto and made part hereof.
In support of said Petition, your petitioner states that there is within the territory so prayed
to be annexed One (1) OWNER OF REAL ESTATE.

BEGINNING at a point in a line common to said 6 acre tract and a 2.562 acre
tract owned by National City Bank Tr., (Parcel Number 273-004538), said point being an
angle point in the existing City of Dublin Corporation Line, as established by Ordinance

WHEREAS, the Board of County Commissioners of Franklin County, Ohio, are
presented the petition for annexation of certain adjacent territory to the City of Dublin, Ohio,
filed by Stanley W. Woodruff, signed by Stanley W. Woodruff and appointing Michael S.
Yashko as agent for the said territory being described as follows:
Situated in the State of Ohio, County of Franklin, Township of Washington, and lying
in Virginia Military Survey No. 2543, and being part of a 6 acre tract owned by Stanley
Woodruff Afdt., (Parcel Number 270-000132), said 5.9 acres, being bounded and more
particularly described as follows:

WHEREAS, the Ohio Revised Code in Section 709.031 stipulates that the County
Commissioners can ask the County Engineer for a report on the accuracy of the map or plat;
now, therefore, upon the motion of Commissioner Kilroy seconded by
Commissioner Stokes ;
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN
COUNTY, OHIO:
Section 1. That a hearing upon said petition shall be held in the County Commissioners'
Hearing Room, 26th Floor of the Franklin County, Courthouse at 10:00 A.M. on April 4,
2001; and
Section 2. That the Zoning Director to the Board of County Commissioners be and hereby is
directed to notify the agent of the petitioners of the time and place of said hearing; and
Section 3. That the map or plat of Stanley W. Woodruff is hereby referred to the County
Engineer of Franklin County, Ohio, for the checking of its accuracy of description.

Dear Mr. Yashko:
Enclosed is a copy of the resolution adopted on February 13, 2001, by the Board of County
Commissioners, setting the time and place of public hearing for the annexation petition which
you, as agent, filed with this office on February 1, 2001.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised Code, you, as agent,
are responsible for the following:
(1) Notification of the date of filing of your petition with the Board of County Commissioners to
be delivered to the Clerk of the municipality to which annexation is proposed and the Clerk
of each township which is included in the annexation. (A map, description and a copy of the
petition should be presented to each clerk).
(2) Publication of the substance of the petition once a week for four consecutive weeks in a
newspaper of general circulation in the County. (The enclosed resolution may satisfy the
statutory requirements).
(3) Service upon the municipal and township clerks of a copy of the notice within seven (7) days
after the Franklin County Commissioners set the date for the public hearing on the
annexation petition, is on or before February 20, 2001. (The enclosed resolution may satisfy
the statutory requirements).

(4) Preparation of an affidavit stating the name of the agent, the number of owners of real estate
at the time of the filing of the petition and the number of owners signing the petition.
(5) Ensuring that the legislative body of the municipality to which the annexation is proposed, by
ordinance or resolution, adopts a statement indicating what services, if any, the municipal
corporation will provide to the territory proposed for annexation, upon annexation. (The
resolution or ordinance should include response times for fire, EMT and police units as well
as information concerning water and sewer hook-ups and other pertinent data).
(6) The Agent or Representative of the petitioners needs to be present at the hearing to present
the petition to the Board of County Commissioners.
Proof of compliance with the above is required to be submitted to this office no later than March
21, 2001.

Re: Services Resolution Regarding the Proposed Annexation of 5.9 Acres, more or
less from Washington Township, Ohio to the City of Dublin, Ohio
Dear Ms. Clarke:
Pursuant to R.C. 709.031(B), the City of Dublin, upon receipt of notice of the Franklin
County Board of Commissioners' setting of a hearing on the Petition for the Annexation of 5.9 acres,
more or less, from Washington Township, Ohio to the City of Dublin, Ohio, is required to pass an
ordinance stating what services, if any, it will provide to the area to be annexed upon its annexation.
The services ordinance must be passed before the Board's hearing on the Petition for Annexation
which is currently set for April 4, 2001. The City's failure to pass such a resolution is grounds for
the Board of County Commissioners to disapprove the annexation. Accordingly, I respectfully
request that you place. the services ordinance on the agenda for the City Council's March S, 2001
meeting.
The Franklin County Board of Commissioners requires that the City of Dublin's services
,ordinance set forth, at a minimum, the following five (5) items:
1. Response time for fire services;
2. Response time for emergency medical technician services;
3. Response time for police units;
4. Information concerning water hook-ups; and
5. Information concerning sewer hook-ups.

OF DUBLIN, OHIO AS REQUIRED BY SECTION 709.031 OF THE OHIO
III REVISED CODE
~ WHEREAS, a petition for the annexation of 5.9+/- acres from Washington Township was
it duly filed on February 1, 2001 by Michael S. Yashko, Roetzel & Andress, 155 E. Broad
~~j Street, Columbus, OH 43215 Columbus, Ohio 43215, Agent for Petitioner Stanley W.
~j Woodruff; and
WHEREAS, a public hearing has been scheduled before the Franklin County
Commissioners on Wednesday, April 4, 2001 at 10:00 a.m.; and
' WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing
~ of the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory proposed for
annexation; and
WHEREAS, the area proposed for annexation lies within Dublin's exclusive water and
sewer service extension area, as provided under the agreements with the City of Columbus;
and
WHEREAS, the proposed annexation is in conformance with the annexation strategy
contained in the Dublin Community Plan, adopted by Council on November 17, 1997.
NOW, TI~EREFORE, BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio, of the members concurring that:
Section 1. The City of Dublin will provide the following municipal services for the 5.9+/-
acres in Washington Township, Franklin County upon the annexation of the area to the
City of Dublin, Ohio:
i Police. The City provides Police and Communications service on a full twenty-
four hour basis and also has mutual aid agreements with other municipalities. The
~ annexation area lies approximately 1-1/2 miles northeast of Dublin Police Division
headquarters. Dublin operates with a minimum of four cruisers on duty. A
response time of approximately three minutes for an emergency situation should be
expected for this area.
Fire. Fire and emergency medical services protection is currently provided by a
well-staffed department in Washington Township. They, too, have mutual aid
agreements with other municipalities. This annexation would not change fire
department jurisdictional boundaries, and therefore response times for fire and
emergency medical services will not be affected. Washington Township Station 93
is located approximately 1/2 mile from the annexation area, and normal response
time would be approximately two minutes.
Sanitation. Residential refuse collection services are contracted by the City and are
currently provided at no additional charge_

Street Maintenance. The City has a Streets and Utilities Division which provides
excellent service in the area of street and road maintenance.

Section 2. The City has SEWER and WATER service area contracts with the City of
Columbus, and the subject property is within the service areas. Conditioned on the ability
of the City of Columbus to provide WATER, and to provide sufficient SEWERAGE
disposal capacity, the City of Dublin will have the ability to service the area.

Section 3. This resolution shall be in force and effect immediately upon passage in

WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded on the
5`~ day December, 2001 to hear the petition of Stanley W. Woodruff, filed February 1, 2001, ~
~ and having in open hearing heard all persons desiring to be heard for or against the granting of
the petition, and having considered all the facts with reference thereto, being fully advised, and

WHEREAS, the Commissioners make the following findings based upon the exhibits and
testimony presented at the hearing of this matter:
1. The Petition contains all of the matters required by Ohio Revised Code Section 709.02
including, without limitation: A. A full description and accurate map or plat of the
territory to be annexed; B. A statement of the total number of owners of real estate in the ~
territory to be annexed; C. The name of the person to act as agent for the petitioner.

2. The territory sought to be annexed is adjacent and contiguous to the City of Dublin, Ohio.

3. Notice of the petition and the hearing has been published as required by law, and all
notices of filing the petition and the hearings thereon have been given and delivered as
required by law.
4. The persons whose names are subscribed on the petition are owners of real estate in the
territory sought to be annexed, and as of the time the petition was filed, the number of
valid signatures on the petition constituted a majority of the owners of real estate in the
territory proposed to be annexed.
5. The map or plat and the description of the territory contained in the petition are accurate.
6. The City of Dublin has complied with Division (B) of Ohio Revised Code Section i
709.031.
7. The temtory sought to be annexed is not unreasonably large.
8. The general good of the territory sought to be annexed will be served if the annexation
petition is granted and the annexation is allowed.
Therefore, upon the motion of Commissioner Shoemaker seconded by
Commissioner Kilroy
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN
COUNTY, OHIO:
That the prayer of the Petition be APPROVED, and the territory sought to be annexed ~

ANNEXATION HEARING

The Franklin County Board of Commissioners convened in the Commissioners' Conference Room
at 10:00 A.M. on Wednesday, December 5, 2001, present were:

Commissioner Stokes opened the meeting, which was followed by the swearing in of all witnesses
by Director Nichter.
The first order of business being approval of the Minutes of the November 7, 2001 Board of
County Commissioner's Rezoning and Annexation Hearing. Commissioner Shoemaker moved to
approve, seconded by Commissioner Kilroy. The Minutes were unanimously approved.
The second order of business being Resolution No. 357-01. Commissioner Stokes read the case
for the record: Annexation Case #ANX-08-O1: Commissioner Shoemaker made the motion to
remove the case from the table, seconded by Commissioner Kilroy. Petition to annex 5.9+ Acres
in Washington Township to the City of Dublin, Ohio. By Stanley W. Woodruff. Agent: Michael
S. Yashko, Attorney. Director Nichter presented the case to the Board stating all technical
requirements have been met. Attorney Yashko stated all statutory requirements have been met,
unless you have any questions, I move for approval. Commissioner Shoemaker made the motion
to approve, seconded by Commissioner Kilroy. The case was unanimously approved by a 3-0
vote.

Smith, Jr., Attorney. Attorney Jackson B. Reynolds, III, Agent is requesting this case remain on
the table for 90 days. Commissioner Shoemaker made the motion to table for 90 days, seconded
by Commissioner Kilroy. The case was unanimously tabled by a 3-0 vote.
The fifth order of business being Resolution No. 1393-01. Commissioner Stokes read the case
for the record: Annexation Case #ANX-61-O1: Petition to annex 16.45± Acres in Norwich
Township to the City of Columbus, Ohio. By Richard Candela, et al. Agent: J. Anthony Logan.
Director Nichter presented the case to the Board stating all technical requirements have been met.
Stated they have no plans for development, but they do wish to obtain utilities through Columbus.
Commissioner Stokes: What about the road? Mr. Logan: The road will remain property will
remain ruraUresidential through the City and we will deal with those issues when we start the
development process. Commissioner Shoemaker made the motion to approve, seconded by
Commissioner Kilroy. The case was unanimously approved by a 3-0 vote.
The sixth order of business being Resolution No. 1394-01. Commissioner Stokes read the case
for the record: Annexation Case #ANX-62-O1: Petition to annex 112.980± Acres in Jackson
Township to the City of Grove City, Ohio. By South-Western City School District, et al. Agent:
Stephen J. Smith, Attorney. Director Nichter presented the case to the Board stating the
floodway is to the northeast of the property. There is residential property across the street. Ms.
Jennifer Wragler, Agent, representing applicant stated: All technical requirements have been met.
We have included the right-of--way and have secured a signature from the County for the inclusion
of the road. Commissioner Shoemaker: Will Grove City provide the utilities? Agent: Yes.
Commissioner Shoemaker made the motion to approve, seconded by Commissioner Kilroy. The
case was unanimously approved by a 3-0 vote.
The seventh order of business being Resolution No. 1395-01. Commissioner Stokes read the
case for the record: Annexation Case #ANX-63-O1: Petition to annex 3.334± Acres in Plain
Township to the City of Columbus, Ohio. By Francis R. Schleppi, et al. Agent: Daniel M. Slane.
Director Nichter presented the case to the Board stating all technical requirements have been met.
There are no floodplain or right-of--way issues. Mr. Slane: In February 1999 we annexed
property and inadvertently missed an island of property. We are now before the Commissioners to
annex that remaining acreage. Commissioner Shoemaker made the motion to approve, seconded
by Commissioner Kilroy. The case was unanimously approved by a 3-0 vote.
The eighth order of business b~:ing Resolution No. 1396-01. Commissioner Stokes read the case
for the record: Annexation Case #ANX-64-O1: Petition to annex l+ Acre in Jackson Township

to the City of Grove City, Ohio. By Linda K. Waller, Trustee. Agent: Joseph W. Hull,
Attorney. Director Nichter presented the case to the Board stating all technical requirement have
been met. Attorney Hull: We are seeking annexation for city services. Commissioner Shoemaker
made the motion to approve, seconded by Commissioner Kilroy. The case was unanimously
approved by a 3-0 vote.
The ninth order of business being Resolution No. 1397-01. Commissioner Stokes read the case
for the record: Annexation Case #ANX-65-O1: Petition to annex 3.047+ Acres in Jackson
Township to the City of Grove City, Ohio. By Mary J. Dupler, et al. Agent: Joseph W. Hull,
Attorney. Director Nichter presented the case to the Board stating there are no right-of--way or
floodplain issues. The property across the street is vacant. Attorney Hull: This property is just
east from the property in Case #ANX-64-O1. Commissioner Shoemaker made the motion to
approve, seconded by Commissioner Kilroy. The case was unanimously approved by a 3-0 vote.

representing. Commissioner Shoemaker made the motion to approve, seconded by

The eleventh order of business being Resolution No. 1399-O1. Commissioner Stokes read the
case for the record: Annexation Case #ANX-67-O1: Petition to annex 3.2+_ Acres in Jackson
Township to the City of Grove City, Ohio. By Sheila G. Zinn, Trustee, et al. Agent: Joseph W.
Hull, Attorney. Director Nichter presented the case to the Board stating there are no floodplain
issues. All technical requirements have been met. Attorney Hull: We included Orders Road as
part of this annexation, at the suggestion of the County Engineer's Department. Commissioner
Shoemaker made the motion to approve, seconded by Commissioner Kilroy. The case was
unanimously approved by a 3-0 vote.
The twelfth order of business being Resolution No. 1400-01. Commissioner Stokes read the case
for the record: Annexation Case #ANX-68-O1: Petition to annex 2.006+_ Acres in Madison
Township to the Village of Groveport, Ohio. By John S. Johnson, et al. Agent: James
Schockling. Director Nichter presented the case to the Board stating there are no right-of--way
issues. All technical requirements have been met. Mr. Schockling: We are annexing for services
provided by the Village, such as water & sewer. Commissioner Shoemaker made the motion to
approve, seconded by Commissioner Kilroy. The case was unanimously approved by a 3-0 vote.
The thirteenth order of business being Resolution No. 1401-01. Commissioner Stokes read the
case for the record: Annexation Case #ANX-69-01: Petition to annex 50.08+ Acres in Madisan
Township to the City of Columbus, Ohio. By Dayspring Nazarene Ministries. Agent: James B.
Wootton. Director Nichter presented the case to the Board stating the applicant wishes tt~
reduce the annexation by .89 acre by removing right-of--way from the annexation. They will sfi~e~,k
to this in just a moment. There is floodplain through the southeast portion of the site. Mr. Doug
McClure, Agent, representing applicant: We are asking for utilities to serve the existing building
and any future development on the site. Director Nichter: They are also amending the annexation
to remove the right-of--way, which is currently in the City of Columbus. Commissioner
Shoemaker made the motion to amend and approve, seconded by Commissioner Kilroy. The
case was unanimously approved by a 3-0 vote.
The fourteenth order of business being Resolution No. 1402-01. Commissioner Stokes read the
case for the record: Annexation Case #ANX-70-O1: Petition to annex 97.4+ Acres in Madison
Township to the City of Columbus, Ohio. By Leo D. Lamb. Agent: Harrison W. Smith, Jr.,
Attorney. Director Nichter presented the case to the Board stating all technical requirements
have been met. Attorney Jackson B. Reynolds, III, Agent: Leo Lamb is the only property owner.
This is a natural process of annexation. Mr. Lamb is aware of what services aze available to the
property (shows a map of where services are available). Commissioner Shoemaker made the
motion to approve, seconded by Commissioner Kilroy. The case was unanimously approved by a
3-0 vote.
The fifteenth order of business being Resolution No. 1403-01. Commissioner Stokes read the
case for the record: Annexation Case #ANX-71-O1: Petition to annex 1.5+ Acres in Plain
Township to the City of Columbus, Ohio. By The New Albany Company, LLC. Agent:
Harrison W. Smith, Jr., Attorney. Director Nichter presented the case to the Boazd stating there
are no floodplain issues. All technical requirements have been met. Attorney Jackson B.
Reynolds, III, Agent: We are filling in an island. The New Albany Company is developing lazger
parcels and have acquired this parcel and possibly in the future will acquire more parcels that will
be part of this project. Commissioner Shoemaker made the motion to approve, seconded by
Commissioner Kilroy. The case was unanimously approved by a 3-0 vote.
The sixteenth order of business being Resolution No. 1404-01. Commissioner Stokes read the
case for the record: Annexation Case #ANX-72-O1: Petition to annex 12.25+ Acres in Madison
Township to the City of Columbus, Ohio. By Daniel K. Balaloski, et al. Agent: Daniel K.
Balaloski, Attorney. Director Nichter presented the case to the Board stating there are no right-
. of-way issues. We have received notification from the township and city since your packets have
been received. All technical requirements have been rnet. Attorney Balaloski: We have owned
this property forever (20 years). We had hoped to annex to Canal Winchester, but that was not in
the lay of the land. So we are annexing for higher density development, although there are no
immediate plans to develop. Commissioner Shoemaker: For homeowners along the road, when
you say higher-density, are you speaking about apartments? Attorney Balaloski: No apartments,
but again we have no current plans for development. Commissioner Shoemaker made the motion
to approve, seconded by Commissioner Kilroy. The case was unanimously approved by a 3-0
vote.
The seventeenth order of business being Resolution No. 1405-01. Commissioner Stokes read the
case for the record: A~mexation Case #ANX-73-01: Petition to annex 2.87+ Acres in Truro
Township to the City of Columbus, Ohio. By Aleksandar S. Balalovski, et al. Agent: Daniel K.
Balaloski, Attorney. Director Nichter presented the case to the Board stating all technical
requirements have been met. Attorney Balaloski: We are annexing this property for sewer &
water. Commissioner Shoemaker made the motion to approve, seconded by Commissioner
Kilroy. The case was unanimously approved by a 3-0 vote.
There being no further business to come before the meeting, Commissioner Stokes adjourned the
meeting at 11:30 A.M..
