Albright, 600 South High Street, Columbus, OH 43215, Agent for Petitioners Cosgray Road, LLC, c/o Martin J. Luffy, 5774 Finnegan Court, Dublin, OH 43017; Sheila G. and Samuel J. Lemaster, 5251 Avery Road, Amlin, OH 43002; and Sharon L. Ferrell, 7007 Rings Road, P.O. Box 142, Amlin, OH 43002; and WHEREAS, Council is of the opinion that this territory should be annexed to the City of Dublin. NOW, THEREFQRE, BE IT ORDAINED, by the Council of the City of Dublin, State of Ohio, ~j _ of the elected members concurring: Section 1. Said area is situated in the Township of Washington, County of Franklin and State of Ohio, and an accurate description of said territory is attached hereto and made a part hereof as Exhibit "A". A plat of the above-described territory in Washington Township, Franklin County, Ohio, is attached hereto and made a part hereof as Exhibit "B". It is approximately 4 163.4 acres located in Plain Township to be annexed 5 to the Village of New Albany. Specifically, it's 6 7797, 7891 Peter Hoover Road; 7640, 7650 Walnut 7 Street. This is vacant land on Bevelheimer Road and 8 Walnut Street and also fronting on Peter Hoover 9 Road. 10 The petition is brought to you today by 11 Sugar Run Development Company, Limited; and the 12 agent is Donald T. Plank. 13 Currently, the property is located in the 14 Plain Local School District; and after the 15 annexation, it would stay in the Plain Local School 16 District. 17 The contiguity to the municipality is to 18 the south. 19 And we have 16 of 17 signatures. 20 The Franklin County Engineer's Office has 21 reviewed the plat and has approved it on October 22 24th, 2001. 23 And there are right-of-way issues 24 concerning this proposed annexation on walnut ANDERSON REPORTING SERVICES, INC. It is vacant land. 8 Another shot of the subject property. 9 And that is looking at that tree line 10 where the subject property the annexation stops. 11 Just on the other side of it is actually On the 12 other side of it is actually the subject property. 13 That is also the subject property down 14 Peter Hoover Road. 15 And these are some shots of other 16 properties on Peter Hoover Road that are included in 17 the proposed annexed property. 18 That is also the subject property, Plain 19 Local Schools Or excuse me. This is a park known 20 as Bevelheimer Park, and that is a shot from 21 Bevelheimer Road. 22 And just another few shots of the subject 23 property. 24 To the east of the proposed annexed ANDERSON REPORTING SERVICES, INC. (614) 487-1778 5 1 property is Sugar Run and Black Creek. You can see 2 they're just to the east of the proposed-to-be 3 annexed property. So there are no floodplain issues 4 concerning this property. 5 And it runs from the east down to the 6 to the south of the to the annexed property. 7 That's an ortho of the site. 8 All the technical requirements have been 9 met, and it is ready for your deliberation. 10 MS. I'm the agent for 15 the petitioner Donald Plank. 16 As the Director indicated, this is the 17 annexation of approximately 163.4 acres from Plain 18 Township to the Village of New Albany. 19 Right off the bat, I'd just like to 20 discuss the number of owners. The petition was 17 21 owners. When the map was drawn up by the engineers, 22 they pulled deeds for the property. 23 There was a Mr. and Mrs. Fitzgerald who 24 were undergoing a divorce at the time. Prior to the ANDERSON REPORTING SERVICES, INC. (614) 487-1778 6 1 fi7_ing of the petition, Mrs. Fitzgerald transferred 2 her interest to Mr. Fitzgerald, so this is actually 3 a 100 percent owner annexation. Sixteen of sixteen 4 owners did sign. 5 Mrs. Fitzgerald was not an owner when the 6 petition was signed. There just was that time line 7 when they pulled the deeds and they transferred her 8 interest. I have given the clerk certified copies 9 of the deeds that would confirm that fact. 10 The property as you indicated as 11 indicated is roughly square in shape. It's on the 12 north side of Walnut Street between Bevelheimer to 13 the west and Peter Hoover on the east side. It is 14 contiguous with the Village of New Albany for 15 approximately 1400 feet along Walnut Street. 16 All the right-of-way along Walnut Street 17 where it is contiguous with new Albany is included 18 in this annexation, so it is not creating a split 19 along Walnut Street at its center line. The two 20 sides of walnut Street will still, however, be in 21 the township. 22 All the technical requirements were met. 23 The notices of the petition were served on the 24 Village and Township clerks. They are included in this 2 proposed-to-be-annexed property. 3 And these pictures you're looking at 4 right now, this one and the previous one is the 5 subject property to be annexed. 6 The line basically Basically, the line 7 on 161 ends right down this tree line here 8 approximately. 9 To the west of the subject property we do 10 have Blacklick Creek just touching a portion of the 11 proposed-to-be-annexed property. It has it's in 12 the floodway there; and also the 100-year floodway 13 is this light or white color, and the blue is the 14 floodway. So it just touches to the on the west 15 portion of the property. 16 That's an ortho of the property. Once, 17 again, 161; and this is Babbitt Road. And those are 18 the pictures of the single-family homes I've shown 19 you, along with some of the other single-family 20 homes on 161. 21 All the technical requirements have been 22 met, and it is ready for your deliberation. 23 MR. And I'm here with Mr. Mike Karr this 2 morning, who is the representative of the property 3 owners. 4 As you can see by the records, we have 19 5 of 21 property owners who have signed the annexation 6 petition, one of those property owners being the 7 State of Ohio. 8 And, again, this is simply a group of 9 property owners who have their homes currently in 10 Plain Township who would like to annex to the 11 Village in order to secure both water and sewer, as 12 well as police and fire protection, although the 13 fire protection will remain with the Plain Township 14 Fire Department under a contract with the Village. 15 If you all remember, we were I was in 16 front of you all in October of this past year, 2001; 17 anc? you all approved an annexation of 126 acres. 18 161 is here. Here was Kitzmiller. So we 19 have, again, attached, as well as to the north we 20 have attached or are attaching to the to the 21 west. 22 So our contiguity And I should have 23 brought a board, but they're too bulky. The 24 contiguity filed was here; but now we're picking up ANDERSON REPORTING SERVICES, INC. (614) 487-1778 p .4k 35 1 contiguity along the west, along the creek pursuant 2 to that annexation that you all approved back in 3 October of 2001. 4 So this was, again, something that was 5 very recently done, a couple of months ago, in terms 6 of adding contiguity to the area. 7 As I indicated, you've got 19 of 21 8 property owners, water and sewer. 9 And I would, just for your edification, 10 show you that the Village prepared a little map that 11 kind of gives you all an indication, for the 12 record that shows you that both water and sewer 13 are currently available there at Kitzmiller and Old 14 161. So all they have to do, in order to get water 15 and sewer, is to run it about 1500 feet down Old 161 16 to gain water and sewer. I think they've got a 17 24-inch sewer line there and a 16-inch waterline. lg And in terms of the other services, trash 19 is available trash pickup, road maintenance. 20 And, again, what we have done is simply 21 included the property owners in that area who want 22 to be annexed to the Village. 23 And I can answer any questions. 24 MS. SHOEMAKER: I only have one question, ANDERSON REPORTING SERVICES, INC. (614) 487-1778 36 1 and that is: 161, that's a State road? 2 MR. REYNOLDS: Yes. 3 MS. SHOEMAKER: And they didn't sign. If 4 this passes, what happens to the rest of that State 5 road? 6 MR. REYNOLDS: Well, the Village does not 7 take care of a State route. It still maintains 8 Ownership and maintenance requirements are done by 9 the State of Ohio, so the State does not literally 10 care in what jurisdiction it is, whether it's Plain 11 Township or the Village. That's why they don't sign 12 annexation petitions, and I think Brig would 13 probably agree with that. 14 It's their responsibility. They don't 15 care what jurisdiction it's in. 16 MR. NICHTER: Commissioners, for your 17 information on the contiguity, we didn't include to 18 the west there, because we typically wait 90 days 19 after an annexation is approved at this level until 20 we hear from the City that it has gone through 21 completely, and then we change our maps. 22 MR. As you can see, 15 this is the right-of-way here on Groveport; and this 16 is Saltzgaber. 17 All the technical requirements have been 18 met, and it is ready for your deliberation. 19 MS. We had to withdraw that one 4 for technical reasons, but this one fit in with the 5 policy. It's 100 percent owner signatures but for 6 you all signing for the road itself. 7 And as indicated, the services will 8 either remain in Madison Township by the agreement 9 that Groveport has with the Township or be provided 10 by Groveport. And under the contract that was 2 originally signed with the Franklin County 3 Commissioners and the City of Columbus back in the 4 1940's and it's been subsequently signed and 5 renewed over the years, since the 40's when the 6 DELPHI plant was originally built, there was a 7 limitation as to who can secure taps in order to 8 develop new property on their site. 9 And so in order to develop the property 10 under the current contract, the property needs to be 11 annexed to the City of Columbus to secure those 12 water and sewer taps. 13 The City has provided you all with the 14 service resolution that indicates that water and 15 sewer is currently available on both Georgesville 16 Road as well as West Broad Street. Fire protection 17 is available from their West Sullivant Avenue site. 18 And just for you all's, again, historical 19 perspective, the same thing took place We were in 20 here about a year and a half, two year ago for 21 Haydocy. We had to go through the same process of 22 splitting and annexation to Columbus. 23 Many, many years ago when I was the 24 Development Director, we did the same thing for the ANDERSON REPORTING SERVICES, INC. (614) 487-1778 45 1 Salvation Army site, which is on the east side of 2 Georgesville Road, that purchased property from the 3 DELPHI ownership. 4 So, again, the only way to serve this 5 property with water and sewer, as well as to secure 6 the fire and the police protection is the annexation 7 to the City of Columbus. 8 And I can answer any questions. 9 MR. STOKES: Do you have any idea what's 10 going in there? 11 MR. REYNOLDS: It's a commercial 12 Obviously, given the location along West Broad 13 Street, it would be commercial. 14 MR.
