AN ORDINANCE TO ACCEPT
AN ANNEXATION OF 62.5+/- ACRES IN WASHINGTON TOWNSHIP,
FRANKLIN COUNTY, TO THE CITY OF DUBLIN
WHEREAS, on January 2, 2002, the Franklin County Commissioners approved the
annexation petition filed by Robert E. Albright, 600 South High Street, Columbus,
OH 43215, Agent for Petitioner S.R. Associates, by Jerome Solove, Managing
Partner of SL/SR Associates, 141 E. Town Street, Suite 101, Columbus, OH 43215;
and
WHEREAS, Council is of the opinion that this territory should be annexed to the
City of Dublin.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Dublin,
State of Ohio, of the elected members concurring:
Section 1. That the petition for the annexation of 62.5+/- acres (see attached legal
description, Exhibit "A") to the City of Dublin, Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in force from and after the
earliest date allowed by law.

FRANKLIN COUNTY, OHIO
Now comes the undersigned, petitioner in these premises and being the owner of
a certain area as hereinafter described, consisting of 62.5 acres, more or less, in
Washington Township, Franklin County, Ohio, which is contiguous and adjacent to the
City of Dublin, Ohio, according to the statutes of the State of Ohio. Said area is situated
in the Township of Washington, County of Franklin and State of Ohio, and an accurate
description of said territory is attached hereto and made a part hereof as Exhibit "A".
A plat of the above-described territory in Washington Township, Franklin County,
Ohio, is attached hereto and made a part hereof as Exhibit "B".
The number of owners in the territory sought to be annexed is one (1).

Robert E. Albright, of 600 South High Street, Columbus, OH 43215, is hereby
appointed agent for the undersigned petitioner, as required by Section 709.02, Ohio
Revised Code; and said agent is hereby authorized to make any amendments by way of
additions or deletions which in his absolute and complete discretion are proper under
the circumstances then existing, and in particular to make such deletion(s) or
amendment(s) in order to correct any discrepancy or mistake noted by the Franklin
County Engineer in his examination of the petition and plat. Said amendment shall be
made by the presentation of an amended plat and description to the Board of County
Commissioners of Franklin County, Ohio, on, before, or after the date set for hearing
on this petition.

WHEREAS, the Board of County Commissioners of Franklin County, Ohio, are ~I

WHEREAS, the Ohio Revised Code in Section 709.031 stipulates that the County
Commissioners can ask the County Engineer for a report on the accuracy of the map or plat;
now, therefore, upon the motion of Commissioner Shoemaker seconded by
Commissioner Kilroy
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN
COUNTY, OHIO:
Section 1. That a hearing upon said petition shall be held in the County Commissioners'
Hearing Room, 26th Floor of the Franklin County, Courthouse at 10:00 A.M. on January 2, ~
2002; and
Section 2. That the Zoning Director to the Board of County Commissioners be and hereby is
directed to notify the agent of the petitioners of the time and place of said hearing; and
Section 3. That the map or plat of S.R. Associates is hereby referred to the County Engineer
of Franklin County, Ohio, for the checking of its accuracy of description.

JEROME SOLOVE, being first duly sworn, deposes and says that he is
the Managing Partner of SL/SR ASSOCIATES, an Ohio general partnership,
the Partner of S. R. ASSOCIATES, an Ohio general partnership, the sole
owner of the 62.5 acres, more or less, in Washington Township, Franklin
County, Ohio, sought to be annexed to the City of Dublin, Ohio, and that he
is duly authorized in the premises.
Affiant further says that because of the availability of continuous fire
protection, better police response time, street lighting without assessment,
street sweeping, sewer and water, zoning, better refuse collection, recreation
facilities, lower taxes, the fire insurance rating, snow plowing, roadside
mowing, animal control, traffic signal maintenance, bus service, and litter
control from the City of Dublin, said owner believes that it would be for the
general good of the territory sought to be annexed to be annexed to the City
of Dublin.

Dear Mr. Albright:
Enclosed is a copy of the resolution adopted on November 6, 2001, by the Board of County
Commissioners, setting the time and place of public hearing for the annexation petition which
you, as agent, filed with this office on October 23, 2001.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised Code, you, as agent,
are responsible for the following:
Netificwtion of±hP da*.e of filing of your peti±ion ~~nth the Board of County Commissioners to
be delivered to the Clerk of the municipality to which annexation is proposed and the Clerk
of each township which is included in the annexation. (A map, description and a copy of the
petition should be presented to each clerk).
(2) Publication of the substance of the petition once a week for four consecutive weeks in a
newspaper of general circulation in the County. (The enclosed resolution may satisfy the
statutory requirements).
(3) Service upon the municipal and township clerks of a copy of the notice within seven (7) days
after the Franklin County Commissioners set the date for the public hearing on the
annexation petition, is on or before November 13, 2001. (The enclosed resolution may satisfy
the statutory requirements).

(4) Preparation of an affidavit stating the name of the agent, the number of owners of real estate
at the time of the filing of the petition and the number of owners signing the petition.
(5) Ensuring that the legislative body of the municipality to which the annexation is proposed, by
ordinance or resolution, adopts a statement indicating what services, if any, the municipal
corporation will provide to the territory proposed for annexation, upon annexation. (The
resolution or ordinance should include response times for fire, EMT and police units as well
as information concerning water and sewer hook-ups and other pertinent data).
(6) The Agent or Represents±ive of the petitioners needs to be present at the hearing to present
the petition to the Board of County Commissioners.
Proof of compliance with the above is required to be submitted to this office no later than
December 19, 2001.

TO THE CITY OF DUBLIN, OHIO OF 62.5 ACRES
MORE OR LESS, IN WASHINGTON TOWNSHIP,
FRANKLIN COUNTY, OHIO
Now comes the undersigned, petitioner in these premises and being the owner of
a certain area as hereinafter described, consisting of 62.5 acres, more or less, in
Washington Township, Franklin County, Ohio, which is contiguous and adjacent to the
City of Dublin, Ohio, according to the statutes of the State of Ohio. Said area is situated
in the Township of Washington, County of Franklin and State of Ohio, and an accurate
description of said territory is attached hereto and made a part hereof as Exhibit "A".
A plat of the above-described territory in Washington Township, Franklin County,
Ohio, is attached hereto and made a part hereof as Exhibit "B".
The number of owners in the territory sought to be annexed is one (1).
Robert E. Albright, of 600 South High Street, Columbus, OH 43215, is hereby
appointed agent for the undersigned petitioner, as required by Section 709.02, Ohio
Revised Code; and said agent is hereby authorized to make any amendments by way of
additions or deletions which in his absolute and complete discretion are proper under
the circumstances then existing, and in particular to make such deletion(s) or
amendment(s) in order to correct any discrepancy or mistake noted by the Franklin
County Engineer in his examination of the petition and plat. Said amendment shall be

j! WHEREAS, a petition for the annexation of 62.5+/- acres from Washington Township
was duly filed on October 23, 2001 by Robert E. Albright, 600 South High Street,
Columbus, OH 43215, Agent for Petitioners S.R. Associates; and
~I~ WHEREAS, a public hearing has been scheduled before the Franklin County
Commissioners on Wednesday, January 2, 2002 at 10:00 a.m.; and

WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing
I~ of the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory proposed for
annexation; and

WHEREAS, the area proposed for amiexation lies within Dublin's exclusive water and
I sewer service extension area, as provided under the agreements with the City of Columbus;
and
WHEREAS, the proposed annexation is in conformance with the annexation strategy
contained in the Dublin Community Plan, adopted by Council on November 17, 1997.
NOW, THEREFORE, I3E IT RESOLVED by the Council of the City of Dublin, State
~ of Ohio, ~ of the members concurring that:

Section 1. The City of Dublin will provide the following municipal services for the
62.5+/- acres in Washington Township, Franklin County upon the annexation of the area
to the City of Dublin, Ohio:
I
Police. The City provides Police and Communications service on a full twenty-
four hour basis and also has mutual aid agreements with other jurisdictions. The
I annexation area lies approximately 2.5 miles southwest of Dublin Police Division
headquarters. Dublin operates with a minimum of four cruisers on duty. A
response time of approximately 3 minutes for an emergency situation should be
expected for this area.
Fire. Fire and emergency medical services protection is currently provided by a
well-staffed department in Washington township. They, too, have mutual aid
~ agreements with other jurisdictions. This annexation would not change fire
department jurisdictional boundaries, and therefore response times for fire and
emergency medical services will not be affected. Station 91 is located
approximately 1.5 miles from the annexation area, and normal response time would
be approximately 2 minutes
Sanitation. Residential refuse collection services are contracted by the City and are
currentlyprovided at no additional char

Street Maintenance. The City has a Streets and Utilities Division which
~ provides excellent service in the area of street and road maintenance.
j Section 2. The City has SEWER and WATER service area contracts with the City
~I of Columbus, and the subject property is within the service areas. Conditioned on
jl the ability of the City of Columbus to provide WATER, and to provide sufficient
j~ SEWERAGE disposal capacity, the City of Dublin will have the ability to service

following described territory to the City of Dublin, Ohio:
Situated in the State of Ohio, County of Franklin, Township of Washington, in

Now comes the undersigned, petitioner in these premises and being the owner of
a certain area as hereinafter described, consisting of 62.5 acres, more or less, in
Washington Township, Franklin County, Ohio, which is contiguous and adjacent to the
City of Dublin, Ohio, according to the statutes of the State of Ohio. Said area is situated
in the Township of Washington, County of Franklin and State of Ohio, and an accurate
description of said territory is attached hereto and made a part hereof as Exhibit "A".
A plat of the above-described territory in Washington Township, Franklin County,
Ohio, is attached hereto and made a part hereof as Exhibit "B".
The number of owners in the territory sought to be annexed is one (1).
Robert E. Albright, of 600 South High Street, Columbus, OH 43215, is hereby
appointed agent for the undersigned petitioner, as required by Section 709.02, Ohio
Revised Code; and said agent is hereby authorized to make any amendments by way of
additions or deletions which in his absolute and complete discretion are proper under
the circumstances then existing, and in particular to make such deletion(s) or
amendment(s) in order to correct any discrepancy or mistake noted by the Franklin

You are hereby notified that in accordance with the provisions of
§709.031(B) of the Ohio Revised Code as amended September 26, 1984, upon
receipt of the notice of publication of an annexation, the municipal
authority is required to pass, either by ordinance or resolution, a statement
indicating what services, if any, the municipal authority will provide to the
area to be annexed upon annexation. That resolution or ordinance must be
passed prior to January 2, 2002, the date of the hearing before the Board of
County Commissioners of Franklin County, Ohio, on the above-captioned
annexation. Said notice of publication was served upon you on immediately
prior to our serving the within Notice upon you. Section 709.031(B) of the
Ohio Revised Code provides as follows:
"(B) Upon receiving this notice, the municipal legislative
authority shall, by ordinance or resolution, adopt a statement
indicating what services, if any, the municipal corporation
will provide to the territory proposed for annexation upon
annexation."
The failure of the municipal authority to timely pass such an ordinance or
resolution is grounds for the County Commissioners to disapprove the

OF 62.5+/ ACRES FROM WASHINGTON TOWNSHIP, FRANKLIN
COUNTY TO THE CITY OF DUBLIN, OHIO AS REQUIRED BY
SECTION 709.031 OF THE OHIO REVISED CODE.
WHEREAS, a petition for the annexation of 62.5+/- acres from Washington Township
i was duly filed on October 23, 2001 by Robert E. Albright, 600 South High Street,
Columbus, OH 43215, Agent for Petitioners S.R. Associates; and
WHEREAS, a public hearing has been scheduled before the Franklin County
~ Commissioners on Wednesday, January 2, 2002 at 10:00 a.m.; and
I WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing
of the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory proposed for
annexation; and

WHEREAS, the area proposed for annexation lies within Dublin's exclusive water and
sewer service extension area, as provided under the agreements with the City of Columbus;

WHEREAS, the proposed annexation is in conformance with the annexation strategy
contained in the Dublin Community Plan, adopted by Council on November 17, 1997.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State

Section 1. The City of Dublin will provide the following municipal services for the
62.5+/- acres in Washington Township, Franklin County upon the annexation of the area
I to the City of Dublin, Ohio:
Police. The City provides Police and Communications service on a full twenty-

_ four hour basis and also has mutual aid agreements with other jurisdictions. The
~ annexation area lies approximately 2.5 miles southwest of Dublin Police Division
" ' headquarters. Dublin operates with a minimum of four cruisers on duty. A

y' ' ~ response time of approximately 3 minutes for an emergency situation should be

Section 2. The City has SEWER and WATER service area contracts with the City

of Columbus, and the subject property is within the service areas. Conditioned on
the ability of the City of Columbus to provide WATER, and to provide sufficient
SEWERAGE disposal capacity, the City of Dublin will have the ability to service
the area.
Section 3. This resolution shall be in force and effect immediately upon its passage
as provided under Section 4.04(a) of the Revised Charter.

a certain area as hereinafter described, consisting of 62.5 acres, more or less, in
Washington Township, Franklin County, Ohio, which is contiguous and adjacent to the
City of Dublin, Ohio, according to the statutes of the State of Ohio. Said area is situated
in the Township of Washington, County of Franklin and State of Ohio, and an accurate

You are hereby notified that in accordance with the provisions of
§709.031(B) of the Ohio Revised Code as amended September 26, 1984, upon
receipt of the notice of publication of an annexation, the municipal
authority is required to pass, either by ordinance or resolution, a statement
indicating what services, if any, the municipal authority will provide to the
area to be annexed upon annexation. That resolution or ordinance must be
passed prior to January 2, 2002, the date of the hearing before the Board of
County Commissioners of Franklin County, Ohio, on the above-captioned
annexation. Said notice of publication was served upon you on immediately
prior to our serving the within Notice upon you. Section 709.031(B) of the
Ohio Revised Code provides as follows:
"(B) Upon receiving this notice, the municipal legislative
authority shall, by ordinance or resolution, adopt a statement

RESOLUTION TO APPROVE THE PETITION
OF S.R. ASSOCIATES OF 62.5+ ACRES IN
WASHINGTON TOWNSHIP TO THE CITY OF
DUBLIN, OHIO -CASE #ANX-83-O1
WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded on the
2nd day January, 2002 to hear the petition of S.R. Associates, filed October 23, 2001, and
having in open hearing heard all persons desiring to be heard for or against the granting of the
petition, and having considered all the facts with reference thereto, being fully advised, and
WHEREAS, the Commissioners make the following findings based upon the exhibits and
testimony presented at the hearing of this matter:
1. The Petition contains all of the matters required by Ohio Revised Code Section 709.02
including, without limitation: A. A full description and accurate map or plat of the
territory to be annexed; B. A statement of the total number of owners of real estate in the
territory to be annexed; C. The name of the person to act as agent for the petitioner.
2. The territory sought to be annexed is adjacent and contiguous to the City of Dublin, Ohio.
3. Notice of the petition and the hearing has been published as required by law, and all
notices of filing the petition and the hearings thereon have been given and delivered as
required by law.
4. The persons whose names are subscribed on the petition are owners of real estate in the
territory sought to be annexed, and as of the time the petition was filed, the number of
valid signatures on the petition constituted a majority of the owners of real estate in the
territory proposed to be annexed.
5. The map or plat and the description of the territory contained in the petition are accurate.
6. The City of Dublin has complied with Division (B) of Ohio Revised Code Section
709.031.
7. The territory sought to be annexed is not unreasonably large.
8. The general good of the territory sought to be annexed will be served if the annexation
petition is granted and the annexation is allowed.
Therefore, upon the motion of Commissioner Kilroy seconded by
Commissioner Shoemaker '
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANI{I,IN

That the prayer of the Petition be APPROVED, and the territory sought to be annexed

2 All the technical requirements have been
3 met, and it is ready for your deliberations.

5 MR. ALBRIGHT: My name is Robert
6 Albright. I'm the attorney and the agent.
7 A comment that has nothing to do with
8 this. The WPA prepared every cemetery in every
9 county, and I know it exists. It's on file in
10 Delaware, and I've used it many times. And it will
11 behoove you to find it from your County engineers,
12 because it shows every private cemetery. And it's
13 very good. I've used it several times in Delaware.
14 I've never used it in Franklin County, but I bet
15 it's there.
16 MS. SHOEMAKER: Can we trust that our
17 person from engineering will look at it?
18 MR. MITTEN: I'll look for it. In 15
19 years, I haven't found that.
20 MR. ALBRIGHT: Now, for the
21 Commissioners, I have an affidavit, if I might, from
22 Jerome Solove, who is the managing partner of the
23 owner, if I may submit that, as to the general good
24 of the territory.

1 municipality notices were three days late; but in
2 talking this issue over with Nick Soulas, it is not
3 a material defect that should hold up this proposed
4 annexation.
5 As you can see, that is the subject
6 property there in yellow on Shier-Rings Road and
7 Cosgray Road.
8 That is looking down Shier-Rings Road at
9 the corner of Shier-Rings and Cosgray. This is the
10 subject property right here proposed to be annexed.
11 That is looking directly at the subject
12 property. As you can see, it is vacant.
13 That is looking up Cosgray Road, looking
14 north; and the sports site is a recreational
15 facility up to the right up there.
16 That is looking south down Cosgray Road
17 at Shier-Rings, just at the corner there; and once,
18 again, another shot of the proposed-to-be annexed
19 property to the right there.
20 On this property, you have the Cosgray
21 ditch that is to the north northwest of the
22 property. You do have a little bit of a 500-year
23 floodplain coming across a portion of the property.

14 2001; and we're hearing it today, January 2, 2002.
15 It is approximately 62.5 acres, located
16 in Washington Township, to be annexed to the City of
17 Dublin. It is a vacant piece of ground on Cosgray
18 Road, located on the northeast corner of Shier-Rings
19 Road and Cosgray.
20 The petition is brought by S.R.
21 Associates, and the agent is Robert E. Albright.
22 Franklin County Engineer's Office
23 reviewed and approved the plot on October 23, 2001.
24 I will note that the Township and the

5 MR. STOKES: Annexation 85-01, Boomer
6 Landco, LLC, et al., 14.9 acres in Plain Township to
7 the City of Columbus.
8 MR. NICHTER: Commissioners, this
9 Proposed Annexation Case 85-01 was filed
10 October 24th, 2001; and we're hearing it today,
11 January 2, 2002.
12 It is approximately 14.97 acres, located
13 in Plain Township, to be annexed to the City of
14 Columbus.
15 It has four addresses: 5200, 5210, 5240,
16 and 5330 Warner Road. It is located on the north
17 side of Warner Road, north of State Route 161.
18 The petition is brought to you today by
19 Boomer Landco, Limited Liability Corporation,
20 et al.; and the agent is Anne Eckhart.
21 The contiguity to the municipality is to
22 the north and to the south.
23 The Franklin County Engineer's Office
24 reviewed and approved the plot on October 18th,

2 And there is right-of-way issues
3 concerning this proposed annexation on Warner Road.
4 As you can see, this is the four parcels,
5 four subject parcels, right there on Warner Road,
6 which is right here, including the right-of-way.
7 That is these are pictures of Warner
8 Road. As you can see, there's residential homes on
9 both sides of the road.
10 And that is a picture of one of the
11 parcels, and I'll show you four separate parcels on
12 all four of the subject properties to the annex.
13 And I'm standing on Warner Road, looking at each of
14 the parcels.
15 That's directly across the street from
16 the subject property. Rocky Fork Creek, as you can
17 see here, is coming through the fourth property
18 there.
19 There doesn't appear to be any floodplain
20 issues on the three to the west; but this one
21 property does have floodway coming through Rocky
22 Ford Creek, and there's a little bit of the 500-year
23 floodway also included in that.
24 And that is an ortho of the property

1 proceeding to bring the .302 parcel on the other
2 side of the road on the other side of the center
3 line into the City of Columbus through a separate
4 procedure.
5 So I would ask that we amend the petition
6 from 14.978 acres to 14.676 acres.

9 deleting .302 owned by the City of Columbus on the
10 south side of Warner Road.

18 Hamilton Road extension Do you know whether it
19 will go through part of that or to the right of it?

22 believe that it is going through it.
23 MS. SHOEMAKER: From this map, it's not
24 real clear; and it was just a point of curiosity.
