AN ORDINANCE PROVIDING FOR A CHANGE IN ZONING FOR APPROXIMATELY 1.615 ACRES LOCATED AT THE NORTHWEST CORNER OF AVERY ROAD AND CORPORATE CENTER DRIVE, FROM PIP, PLANNED INDUSTRIAL PARK (WASHINGTON TOWNSHIP CLASSIFICATION), TO: SO, SUBURBAN OFFICE AND INSTITUTIONAL DISTRICT. (CASE NO. 02-0622 - NORTHWEST CORPORATE CENTER -DUBLIN PREP ACADEMY - 5689 AVERY ROAD). NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring: Section 1. That the following described real estate (see attached map marked Exhibit "A") situated in the City of Dublin, State of Ohio, is hereby rezoned SO, Suburban Office and Institutional District, and shall be subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto. Section 2. That application, Exhibit "B", including the list of contiguous and affected property owners, and the recommendations of the Planning and Zoning Commission, Exhibit "C", are all incorporated into and made an official part of this Ordinance and said real estate shall be developed and used in accordance therewith. Clarke, Director of Planning This is the public hearing fora 1.615-acre parcel located at the northwest corner of Avery Road and Corporate Center Drive. The site was annexed into the City in 1990, but retained its Washington Township zoning classification of PIP, Planned Industrial Park District. On May 2, 2002, the Planning and Zoning Commission approved a conditional use to convert the building to a private school within an industrial district (02-034CU). A condition of approval required the applicant to file an application to rezone the property to SO, Suburban Office and Institutional District, a district that is far more consistent with the school use. On September 19, 2002, the Commission recommended approval of this rezoning request with three conditions. The applicant has followed through on his obligation. This request is largely a housekeeping measure to establish appropriate zoning for a school and to implement this aspect of the Community Plan. Dannenfelser, Planner. BACKGROUND: The property is fully developed with a 7,866 square foot office building and is part of the Northwest Corporate Center development. The site was annexed in 1990 but has retained its Washington Township zoning classification of PIP, Planned Industrial Park District. On May 2, 2002, the Planning and Zoning Commission approved a conditional use to convert the building to a private school within an industrial district (02-034CU). Condition 1 required the applicant to file this application to rezone the property to SO, Suburban Office and Institutional District. This is largely a housekeeping measure to establish appropriate zoning for a school and to implement the Community Plan. CONSIDERATIONS: Site Characteristics: The rectangular site contains 1.615 acres and is Lot 1 of the Northwest Corporate Center. It has 235 feet of frontage along Avery Road, 295 feet along Corporate Center Drive, and is located at the northwest corner. The site is developed with a 7,866 square foot building with parking for 20 cars. The school opened this summer and currently operates with 112 students. The school building is located in the northeast corner of the site fronting Avery Road, and the parking lot is located to the south and southwest of the building. The site has access from Corporate Center Drive and none from Avery Road. An abandoned leach field is located in the southwest corner of the site. A legally non-conforming six-foot tall privacy fence parallels the north property line. The south and west sections were removed within the past few months. A playground is located on the west side of the building. A paved turnaround is located west of the playground. Dublin Planning and Zoning Commission Staff Report -September , 2002 Page 2 Only three of the eight Northwest Corporate Center lots have been developed. The lot to the west is developed with amulti-tenant industrial building, and the lot to the southwest houses a Taekwondo studio. The Mid-States office building is directly to the north and is zoned SO. To the east, across Avery Road, is the Crossings at Avery, zoned PUD, Planned Unit Development District. Community Plan/Zoning Issues: Eight of the nine lots in this small commercial park still carry the original Washington Township zoning classification of PIP. The PIP District allows manufacturing, processing, warehousing, industrial service, and commercial activities normally associated with and intended to serve the industrial establishment or their employees. The records from the township are minimal. The Avery Road Area Plan in the Community Plan recommends that lots located along Corporate Center Drive be used for office purposes. This application will bring the site into conformance with this aspect of the Community Plan. Site Layout: A site plan was not included as part of this rezoning application. The development standards are spelled out in Code Section 153.026, Suburban Office and Institutional District. The conditional use approval required site modifications to conform to the SO development standards. No exterior building modifications are proposed. The existing building will become legally non-conforming regarding minimum side yard requirements. The building is located nine feet from the property line, and the required minimum side yard is 19.7 feet (1/4 the sum of the height and width of the building). All proposed site improvements meet the required standards. Parking Structure/Access Considerations/Traffic Management: The site has a parking lot for 20 cars, which is less than the Code requirement of 36 spaces. On July 25, 2002, the Board of Zoning Appeals approved a variance to reduce the required on-site parking spaces from 36 to 20 (02-066V). A joint parking agreement was obtained with the adjacent property to the west for special events at the school, such as classroom presentations, parent conferences, etc. Staff has inspected the site and found parking to be an initial problem. At 3:00 p.m., parked cars were observed in the grass along the driveway and on Corporate Center Drive. After conversations with staff, the applicant is now implementing staggered start and end times of classes. Staff will monitor the parking situation, but given these new circumstances, recommends the installation of a sidewalk along Corporate Center Drive. Condition 1 placed on application 02-034CU for the conditional use required recbnfiguring the proposed pavement and traffic flow to allow for adequate circulation. Staff has worked with the applicant to properly modify the access drive and turnaround. The City has future plans to widen Avery Road into a boulevard from Shier-Rings Road to Tuttle Crossing Boulevard, which will be a $12.7M project. The design phase is scheduled to begin in 2003, land acquisition to begin in 2004, and road completion is scheduled for 2006, as reflected in the latest five-year CIP, Capital Improvements Plan, adopted last month. The City currently has 40 feet of dedicated right-of--way in front of this site. When the road is widened, it will require approximately 20.5 feet of additional Dublin Planning and Zoning Commission Staff Report -September 1 ?002 Page 3 Corporate Center Drive. For future purposes, staff recommends that no curb cuts directly onto Avery Road be allowed from this site. A bikepath is also planned along the future Avery Road frontage, and it will be placed one foot inside the new right-of--way. The parking lot has no parking blocks, curbing, or designated handicapped parking spaces with raised signage. Parking blocks and ADA signage should be added to protect landscaping and to meet the ADA requirements. Landscaping/Signage/I.,ighting: The Code requires vehicular use areas to be completely screened from Avery Road and Corporate Center Drive. The screen must contain one shade tree per 40 feet, plus a 3.5- foot high continuous screen. The applicant will plant the trees and shrubs in October, at the end of the planting season. A landscape inspection was performed on the site, and one white pine is in poor condition. Staff recommends replacement of the dying tree. The existing ground sign, to post only the address, has an unscreened up-light on each side, and the plans show the planting of shrubs to screen those lights from the public right-of--way. The plans also show screening around an up-light under the Dublin Prep Academy wall sign. These,will also be installed in October. Utilities and Storm Water: Since the conditional use hearing, the site has been connected to the City sanitary sewer .system. The site operates using a well. A 20-inch water line is located along the east side of Avery Road, but the Code does not require mandatory connection. No open cutting of existing roadways is allowed for extension of services. STAFF RECOMMENDATION: Rezoning the site to SO from the Washington Township industrial classification will bring the site into conformance with the future land use element in the Community Plan. It is also an appropriate zone for the new school, and staff appreciates the cooperation of the applicant in this regard. Staff recommends approval of the application with three conditions: Conditions: 1) That no structure, including signage, be placed within the area to be acquired for the expansion of Avery Road; 2) That a sidewalk be installed along Corporate Center Drive by October 15, subject to staff approval; and 3) That the site have no curb cuts on Avery Road. She said the Commission approved a conditional use in May to convert an office building to a private school located in an industrial district. One of the conditions required the applicant to file an application to rezone the property from PIP, Planned Industrial Park, to SO, Suburban Office and Institutional District. She said this is largely a housekeeping measure, and she gave a PowerPoint presentation. The Avery Road Area Plan in the Community Plan recommends office use for this area. She said this rezoning will establish office usage and implement the Community Plan. Ms. Dannenfelser said several improvements are still not complete. These include parking lot landscaping, installing bumper blocks, removing some pavement, installing raised handicap signage, and lighting. If the dumpster remains on the site, it should be fully screened. She said rezoning this site to SO will bring it into conformance with the future land uses in the Community Plan and it is an appropriate zone for a school. She said staff appreciates the cooperation of the applicant and recommends approval, with three conditions: 1) That no structure, including signage, be placed within the area to be acquired for the expansion of Avery Road; 2) That a sidewalk be installed along Corporate Center Drive by October 15, subject to staff approval; and 3) That the site have no curb cuts on Avery Road. Vincent Rakestraw, the applicant, said he is now the sole owner of Troon Management. He said they will do the landscaping and install the pedestal light in the center of the turnaround in October. The school is educating the parents that the turnaround is for drop off only. Class times have been staggered. Mr. Rakestraw said a performance bond will be provided for those items not completed. He said they are happy to comply with this rezoning. Ms. Dannenfelser said the wooden sign indicating they were open is a permitted temporary sign. She said all of the staff report concerns will be satisfied after the landscaping in October. The conditional use conditions have been met. Mr. Zimmerman said he had observed the traffic flow around the school site and it works well. He asked if the sidewalk would connect to another one. Ms. Dannenfelser said not at this time. Mr. Rakestraw said they did not want parking along the street. He suggested establishing a no parking zone until the rest of Corporate Center is developed. He said the unconnected sidewalk encourages on-street parking. With the ditch, there is not a lot of room for a sidewalk/bikepath. Mr. Zimmerman asked if the two wall signs mentioned in the staff report are on the east wall and the door. Ms. Dannenfelser agreed. Ms. Dannefelser said the $800 performance bond covers the landscaping, trees, shrubs, parking blocks, and handicap signage, issues from the conditional use approval. They will need to be installed prior to final occupancy. The site is located at the northwest corner of Avery Road and Corporate Center Drive and has retained its Washington Township zoning of PIP, Planned Industrial Park District since being annexed in 1990. The PIP District allows manufacturing, warehousing, industrial services, and some commercial facilities. She showed several slides. Ms. Canter said the site should be rezoned to a Dublin zoning classification. She noted the Community Plan recommends office use for all the land on Corporate Center Drive, and staff recommends that the site be rezoned to SO, Suburban Office and Institutional District. The surrounding uses include office and multi-tenant industrial buildings: The site contains 1.6 acres and is developed with a 7,800 square foot building with a 23-space parking lot. There is a six-foot tall privacy fence around the northwest portion of the lot. It is currently serviced by a leach field and not connected to City water or sewer. The Code requires a connection if the sewer line is within 100 feet, but there is not a mandatory water connection. She said the estimated 2002-2003 enrollments is 140 students. The school will be in session from 9 a.m. until 3 p.m. It will have a daily childcare program from 7 a.m. to 9 a.m. and 3 p.m. to 6 p.m. Most of the children will be dropped off from cars, during those two time periods. Ms. Canter said changes to the pavement, adding a playground and using a wall sign on the east elevation are proposed. A circular turnaround area is shown behind the building, aid staff is concerned with potential traffic circulation problems. Across access easement with the adjacent driveway is not available. She said staff recommends increasing the driveway to 22 feet, using directional arrows and adding a landscaped island. The proposed playground area is 3,500 square feet, and it will accommodate a maximum of 30 students at a time. Outdoor play areas generally include 200 squaze feet per child, and the playground should be increased to 6,000 square feet. The Code requires 36 parking spaces for this use. The site has two existing ground signs, a center identification sign at the intersection, and a blank ground sign in front of the building. The blank ground sign will have the building address, and its sights will need to be shielded. An 89 square foot wall sign along the east elevation is proposed. Schools are permitted a maximum area of 20 square feet. The height shown appeazs to exceed the Code. A revised sign elevation was distributed that had 19.6 square feet. Ms. Canter said the driveway and parking lot are completely unscreened from the right-of way and staff recommends that they be landscaped to Code. She said conditional uses may have greater impacts on the area than permitted uses. Staff sees the proposed school as an appropriate, provided it is rezoned to the SO District to conform with the Community Plan. Eileen Zelazny, a Dublin resident whose daughter attended the Prep Academy in Powell, said she looked forward to having this school located within Dublin. She felt this is a good location. Mr. Rakestraw said the school will begin a 30-student summer program June 10th. The first building permit is to convert the office building, and a second permit would be for the gym and the additional space shown. He asked for a favorable consideration of this conditional use. Ms. Boring suggested that i Mr. Gerber said this was an excellent staff report, and it answered all his questions. Mr. Ritchie wanted to know if the site would meet all of the SO District standards. Ms. Canter responded that an elementary school is a permitted use, and the preschool would still be a conditional use. The pavement may need to be moved back to meet standards. . Mr. Ritchie was concerned about future Avery Road widening and the Community Plan shows a bikeway on Avery Road. Ms. Canter responded that the Avery Road widening will be a conversion to a boulevard, adding 20 feet of right-of--way. It will still be about six feet in front of the center identification sign. The design for the road widening is scheduled for next year, but she was uncertain about the construction schedule. It will not disturb the landscaping or signs. Mr. Ritchie said connections to City water service for quality purposes might be advisable. Tom Runfola, board president of the Prep Academy, said the water will only be used for flushing toilets. He said they use bottled water in the schools. Mr. Rakestraw said the water is a 16-inch main on the east side of Avery Road. He was concerned about the parking capacity of the 22-foot driveway, especially with no on-street parking along Corporate Center Drive. Ms. Seitz said there are four classrooms: preschool, kindergarten, first grade, and second grade, with no more than 18 children apiece. Their classes have staggered starting times. All children are dropped off at the back door. No busses will be used at this facility. Mr. Saneholtz said there can only be 24 vehicles between Avery Road and the drop off area. He understood that no traffic signal was planned for that corner. Mr. Hammersmith confirmed this. Mr. Runfola said this turnazound design is different from their Powell facility because the lot is different. They are considering the possibility of dropping the children without the five-minute delay in parking by having someone at the door to walk the children inside. Parking could be added to the turnaround by making it lazger. He did not expect a traffic jam. OccasioFaally, they have special programs in the evening. If it is a lazge program, they usually move it to a larger facility. They have open houses at least once a year, in the evening. Ms. Fife said generally special programs are limited to one or two classes at a time. Ms. Boring noted that it was good for Dublin to have this vacant tenant space occupied. Regarding removal of the six-foot tall privacy fence, Ms. Canter said two of the three sides will be removed. The north section only will remain. It is legally non-conforming. Mr. Rakestraw said they would take down the southern and western portions of the fence. Their neighbor to the north, Mid States Development, had its landscaping approved with the fence. That portion screened Mid States' parking lot from the school, and they would like to keep it. Mr. Zimrr~;ernlan asked if the 13 additional required parking spaces would be on the west side in the vacant field. Mr. Rakestraw said that could be done when they hook up to the sanitary sewer, but their plan is to add parking on the west end of the circle. Ms. Canter said the wall sign conforms with Code as long as the height is below eight feet and the sign face area is less than 20 square feet. Mr. Rakestraw said the pedestal sign will have their address. He said they would like to extend that electricity underground to light the wall sign. Ms. Canter said the sideyard setback pavement in the SO District is one-fourth the sum of the height and width of the side of the building. Mr. Rakestraw said they plan to hook up to the sanitary sewer when Avery Road is widened. Their well will be used only to flush the toilets. The children will drink bottled water. Ms. Canter said the playground will be increased to 200 square feet per child. Mr. Zimmerman said by doubling it, it would expand into the parking and circle area. Mr. Rakestraw said it would be moved to accommodate the playground. He said when the circle is adjusted, they hope to will retain the three parking spaces. If the turning circle infringes, they will be moved. They will meet the parking requirements. Mr. Messineo was concerned that the geometry would not work for the turning circle. Mr. Rakestraw said he had not given up on Mid States granting them an easement. Ms. Boring agreed that this is an excellent location. Having alternatives to public education is valuable to the community. She said she was not concerned about the parking and driving azeas. The parents will choose to attend or not. She appreciated Mr. Rakestraw's cooperation. Mr. Saneholtz was concerned about access for other tenants if traffic backs up on Corporate Center Drive, or onto Avery Road. He noted the drop off process is quite cumbersome with small children. He said he would like to see this traffic concern better addressed. .. Ms. Clarke said when traffic problems result, all parties aze interested in finding a resolution to a defined problem. The safety concerns of the fire and police departments need to be considered. She thought some level of congestion is expected, but the public purpose is to assure that the thoroughfares are free-running, particularly during peak hours. Because this has access from the side street, staff does not see this as a large issue. If parking on Corporate Center Drive becomes a problem during special events, the police department can issue tickets. Mr. Messineo said this is an appropriate conditional use for this site and he supported it. Mr. Gerber said this application was a. wonderful use for this property and that Mr. Rakestraw should be complimented for working hard with staff on a very sound plan. He said waiving the rezoning application fee might be appropriate and asked if Dublin might rezone this area soon. Ms. Clarke said staff was instructed to establish Dublin zoning expeditiously on every parcel within the~City for which no clear Dublin zoning history exists. It is very time consuming and requires a lot of resident/property owner input. She said the next azea rezoning is for the area between Avery Road and I-270, and the following one is for all land annexed during 2000 and 2001. All future annexations will placed into the R, Rural classification per a new ordinance.
