AN ORDINANCE TO ACCEPT AN ANNEXATION OF
106.486+/- ACRES IN WASHINGTON TOWNSHIP, FRANKLIN
COUNTY TO THE CITY OF DUBLIN
WHEREAS, on March 4, 1998 the Franklin County Commissioners approved the
annexation application filed by Christopher T. Cline, Agent, on behalf of Petitioners
Dorothy Thomas, 5494 Cara Court, Amlin, Ohio; and Gary K. Moreland, 155 E.
Broad Street, Columbus Ohio; and National City Bank, Columbus, Trustee of the
William Marvin Thomas Trust; and
WHEREAS, Council is of the opinion that this temtory should be annexed to the City
of Dublin.
NOW, TH FORE BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, _~~ of the elected members concurring:
ion 1. That the petition for the annexation of 106.486+/- acres (see attached legal
description, Exhibit "A") to the City of Dublin, Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in force from and after the
earliest date allowed by law.

Property Description
The property contains 106.486 acres located between Shier-Rings Road and Wcerner-Temple
-Y ~ Road, approximately 2,000 feet west of Avery Road. It has been farmed for many years, and
the new owners of this tract have stated their intention is to continue farming, not to develop the
.W site. Water and sanitary sewer services are located immediately to the east of the site at the
Dublin Service Complex.
Municipal services provide a strong incentive for land owners to pursue annexation. Availability
of services also has a strong impact on land prices.
Recommendation
In brief, the Community Plan recommends annexation of all land within its utility service
boundaries. This is based on service, fiscal, traffic, social, environmental and land management
goals presented in the Community Plan and represents a substantial cTiafrtge from the "interim
annexation policy." In Dublin's southwest exclusive expansion area, of which this site is a part,
annexation, and development (and therefore municipal expenditures) were not expected to occur
until later, generally beginning around 2010. Timing of the extension of municipal services and
future development in the area becomes the central issue for Dublin in consideration of this
annexation.

Background
The Community Plan recommends that Dublin strive to control the quality and intensity of
growth along its periphery. Dublin should provide for orderly growth, protect the welfare and
health of its residents, maintain and protect Dublin's quality of life, and expand the area that
enjoys the benefits of Dublin's services by annexing lands to the nortl-west and southwest in the
exclusive annexation areas. The small unincorporated Washington Township "islands"
surmun~d by the City should be annexed whenever possible to prrovide consistent services and
identity for residents living in the area.
The Annexation Phasing Plan (Map 3.b) of the Community Plan recommends annexing the
northwest exclusive annexation area, and the "islands" by 2000. The northwest azea is given trop
priority because of mounting pressures within Union County for development. The Plan
indicates that the large southwest exclusive annexation area, including this site, should be
annexed latter, generally by 2010. Development pressures have been somewhat lower here than
in the northwest area.
Land Use
The Plan indicates virtually no future commercial development is anticipated within this
southwest area. The recommended land use is residential, with a projected density of 1-2
dwellings per acre. The area is currently Iacated within the Hilliard City School District. The
Plan also recommends that wherever posrible the land within Dublin's municipal boundaries
should also be served by the Dublin City School District.
Fiscal
The fiscal analysis conduced as a basis for the Community Plan is summarized in Chapter 5 of
the document. The analysis centered on Dublin's fiscal changes over time that are attributable
to growth. That fiscal Y assumed that Dublin would malae no expenditures in the southwest
area until 2010--because annexation and development in that area would lag behind other areas.
Prior to the year 2010, growth would be experienced in existing Dublin and the areas to the

north and northwest. There is also a note on Map 3.6 (Annexation Phasing Plan, page 3-20) that
relates to the former soccer stadium site: "Annexation of the southwest area in the neaz-term
~- is under review as part of the impact assessment."
Residential development produces net negative annual revenues, and the southwest annexation
area viewed by itself, produces negative revenues. Development in this area needs to be
balan+eed with the revenues being produced in other parts of Dublin. The net revenue situation
becomes quite positive over time, including all of the potential annexations. Dublin's capital
improvement list is pac)red within the fast ten years of the fiscal analysis (1998-2008) with very
expensive road and other capital improvements. The communitx`s fiscal. outlook gets
increasingly brighter as time passes. The analysis assumes that the c:or'~Sinercial tax base will
continue to grow and Dublin will have the opportunity to catch up in the arCa of its capital
improvements.
If residential development is undertalGen in the southwest area well in advance of 2010, the
municipality's fiscal analysis will need to be revisited.

WHEREAS, the Ohio Revised Code in Section 709.031 stipulates that the County
Commissioners can ask the County Engineer for a report on the accuracy of the map or plat;
now, therefore, upon the motion of Commissioner Tester seconded by
Commissioner Stokes ;
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN
COUNTY, OHIO:
Section 1. That a hearing upon said petition shall be held in the County Commissioners'
Hearing Room, 26th Floor of the Franklin County, Courthouse at 10:00 A.M. on March 4,
1998; and
Section 2. That the Zoning Director to the Board of County Commissioners be and hereby is
directed to notify the agent of the petitioners of the time and place of said hearing; and
Section 3. That the map or plat of Dorothy Thomas, et al. is hereby referred to the County
Engineer of Franklin County, Ohio, for the checking of its accuracy of description.

Christopher T. Cline, being duly cautioned and sworn deposes and states as

1. The agent for this annexation is Christopher T. Cline, 37 West Bridge Street,
Dublin, Ohio.

2. At the time of the filing of the petition there wes two owners of the subject
premises proposed to be annexed and that number has not changed Both owners signed
the petition and each remains a signatory. As a result 100% of the owners of the subject
tract proposed for annexation have signed the petition.
3. A map, copy of the petition, legal description and Resolution Number 25-98 of
the Franklin County Commissioners were duly served upon the Clerk of the City of Dublin
and the Clerk of Washington Township, Franklin County, Ohio. Signed receipts from the
clerk of the City of Columbus and the Washington Township clerk are attached hereto as
Exhibits "A" and "B", respectively.
4. The substance of the petition was published once per week for four weeks in a
newspaper of general circulation in Franklin County, Ohio, the Daily Reporter. Proof of
service of said publication is being filed separately m this cause.
5. The City of Dublin has duly enacted an ordinance, # 02-98, stating what
~~ ~ services this municipal corporation will provide to the territory upon annexation. A copy of
this ordinance has been filed separately by the City of Dublin.

A RESOLUTION TO SET FORTH A STATEMENT OF SERVICES
TO BE PROVIDED TO THE AREA IN A PROPOSED ANNEXATION OF
106.486+/- ACRES FROM WASHINGTON TOWNSHIP, FRAIVKI,IN
COUNTY TO THE CITY OF DUBLIN, OHIO AS REQUIRED BY SECTION
709.031 OFTHE OHIO REVISED CODE
WHEREAS, a petition for the annexation of 106.486+/- acres from Washington Township
was duly filed on January 2, 1998 by Christopher T. Cline, agent for petitioners Dorothy
Thomas, 5494 Cara Court, Amlin, Ohio; and Gary K. Moreland, 155 E. Broad Street,
Columbus, Ohio, National City Bank, Columbus, Trustee of the William Marvin Thomas
Trust; and
WIIDREAS, a public hearing has been scheduled before the Franklin County Commissioners
on Wednesday, March 4, 1998 at 10 a.m.; and
V'VIiEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing of
the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory proposed for
annexation.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Dublin, State of
Ohio, ~ of the members concurring that:
Section 1 • The City of Dublin will provide the following municipal services for the 106.486+/-
acres in Washington Township, Franklin County upon the annexation of the area to the City
of Dublin, Ohio:
police. The City provides Police and Communications service on a full twenty-four
hour basis and also has mutual aid agreements with other municipalities. The
annexation area lies approximately two miles southwest of Dublin Police Division
headquarters. Dublin operates with a minimum of four cruisers on duty. A response
time of approximately five minutes for an emergency situation should be expected for
this area.
~. Fire and emergency medical services protection is currently provided by a well-
staffed department in Washington township. Washington township also has mutual aid
agreements with other municipalities. This annexation would not change fire
department jurisdictional boundaries, and therefore response times for fire and
emergency medical services will not be affected. The Washington township fire station
is located approximately one mile from the annexation area and normal response times
should be approximately three minutes.
Street Maintenance. The City has a Streets and Utilities Division which provides
excellent service in the area of street and road maintenance.
Section 2. The City has SEWER and WATER service area contracts with the City of
Columbus, and the subject property is within the service areas. Conditioned on the ability of
the City of Columbus to provide WATER, and to provide sufficient SEWERAGE disposal
capacity, the City of Dublin will have the ability to service the area.

RESOLUTION TO APPROVE THE PETITION OF
DOROTHY THOMAS, ET AL. OF 106.486+_ ACRES
IN WASHINGTON TOWNSHIP TO THE CITY OF
DUBLIN, OHIO -CASE #ANX-0l -98
WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded on the
4~' day March, 1998 to hear the petition of Dorothy Thomas, et al., filed January 2, 1998, and
having in open hearing heard all persons desiring to be heard for or against the granting of the
petition, and having considered all the facts with reference thereto, being fully advised, and
WHEREAS, the Commissioners make the following findings based upon the exhibits
and testimony presented at the hearing of this matter:
1. The Petition contains all of the matters required by Ohio Revised Code Section 709.02
including, without limitation: A. A full description and accurate map or plat of the
territory to be annexed; B. A statement of the total number of owners of real estate in
the territory to be annexed; C. The name of the person to act as agent for the petitioner.
2. The territory sought to be annexed is adjacent and contiguous to the City of Dublin,
Ohio.
3. Notice of the petition and the hearing has been published as required by law, and all
notices of filing the petition and the hearings thereon have been given and delivered as
required by law.
4. The persons whose names are subscribed on the petition are owners of real estate in the
territory sought to be annexed, and as of the time the petition was filed, the number of
valid signatures on the petition constituted a majority of the owners of real estate in the
territory proposed to be annexed.
5. The map or plat and the description of the territory contained in the petition are accurate.
6. The City of Dublin has complied with Division (B) of Ohio Revised Code Section
709.031.
7. The territory sought to be annexed is not unreasonably large.
8. The general good of the territory sought to be annexed will be served if the annexation
petition is granted and the annexation is allowed.
Therefore, upon the motion of Commissioner stokes seconded by
Commissioner Teater '
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN
COUNTY, OHIO:
That the prayer of the Petition be APPROVED, and the territory sought to be annexed
by the petition filed herein shall be annexed to the City of Dublin, Ohio, in accordance
with the law; that the orders and proceedings of this board relating to the Petition, and
map and description attached thereto, and all papers on file relating to this matter be
delivered forthwith to the Clerk of Council, City of Dublin, Ohio.
